"Vowel was attached to the criminal justice system and that disturbed herb some feminists at the same time. The justice system was disturbed by Varroa. The bills biggest enemy was a group that you wouldn't expect to come out so strongly for or against anything judges. The federal judges launched an incredible campaign and technically under the judges ethical code. They are not supposed to lobby and in fact when the women judges were asked what their position on the bill was one of them. Said you know. I don't know if we should take a position because if we do do and then we have to rule on it. That would be a conflict. I never heard that. From any of the male judges federal judges who felt that the violence against women civil rights provisions was going to enable women to use this new statute as a way to manipulate the legal system and get a higher. Your settlement in a divorce case judges wrote letters saying that women would bring these cases in divorces and they would lie I to extort damages from their husbands and of course that was extremely disturbing. That judges would assume that women are going to fabricate charges a domestic violence wins in order to get an advantage in litigation. The chief justice of the Supreme Court was William Rehnquist. He led this resistance and warned that if the bill passed past the courts would be flooded with family squabbles. There are two things that are happening in their arguments one there demeaning the problems in significant and not significant for a federal judge. So it doesn't matter you can go to state law whatever. Mississippi said is fine even if Mississippi says is entirely different from Alaska. There's nothing federal about this where federal means something important. Wouldn't right the second thing they're saying is they're feeding into the very stereotypes. The law was supposed to push against from the very first witnesses. Mrs They were telling US stories about how they weren't believable that they weren't credible. The biggest issue for the judges was the most revolutionary Lucien every piece of Iowa. The civil rights remedy which Victoria had based off of previous laws. Yes previous legislation In the nineteenth century which was targeted at violence in the south. I mean it's called the Ku Klux Klan Act that allowed the federal government to criminalize violence. That was focused on race and that was pretty well established. There's no one thought that that would be unconscionable kept saying well. That is an unconstitutional wiser different for gender. This was my constant refrain. Eventually unfortunately one of the judges on the committee said to me. Well we don't like those cases either. I couldn't get out of there fast enough man The judges were wearing Victoria down. She was losing hope. I really was quite demoralized. I really didn't know how I was going to move forward. The women judges. I just had by then come out in favor of remedy so we had some support. The judges are friends of senators and they had convinced people that this was the worst. I think that it ever happened to them and I could never quite get them out of that mindset but finally and yet another drawn out meeting Sally got through. Sally was very very persuasive. I've never seen a better world argument in my my life. They had all legitimate questions about the scope. What gender motivated me? There were questions and Sally won the day. The judges ultimately backed down and decided not to take a stance on the civil rights remedy. Now it was down to the final negotiations and deals cut behind closed doors. It had been nearly four years since Victoria started working on the bill and in that time a lot had happened well things politically had changed by. Nineteen Ninety Four for we had Bill Clinton as president and then there was the nationally cataclysmic events of Anita Hill professor. Do Swear to tell the whole truth the nothing but the truth so help you. God I thank you. I was sitting at dinner with little Sony. TV watching and like the rest of the nation. I was transfixed and horrified Mr Chairman Senator Thurmond members of the committee. My name is Anita F Hill. Oh and I'm a professor of law at the University of Oklahoma during Justice Clarence Thomas Confirmation hearings the US Supreme Court in Nineteen ninety-one one law. Professor Anita Hill came forward that she had been sexually harassed by her former. Boss Clarence Thomas. She testified before the Senate Judiciary Committee over the course of three days where she was interrogated by senators like Alabama Democrat. Howell Heflin gut to determine what you'll motivation might that'd be? Are you a scorned woman. Do you have a milita Daddy. Tutu relative to is an area civil rights. No I don't have a militant attitude. Do you have a modern complex. No Hey home. And by the committee chairman Joe Biden. It is appropriate to ask Professor Hill. Anything any member wishes to ask her to the depths of her credibility.

"We've got a lot in common. So far, so good. Lot of noise, and it can be ugly at times, but the thirty thousand foot view thing is pretty good. If you're Republican, and I want to talk a bit about Kevin. 'cause I don't people think this is just about Trump causes not now Brett Kevin inviting no breath. Okay. I'm known him for twenty years. Right. What did you say? What you get it worked in the Bush administration who is Bush's private secretary. When he was president nothing came across Presidents Bush disc that he didn't see was very closely involved in nine eleven into what else on that day. And so brand is about as good as it gets on our side. You know, he is one of the great conservative minds of his generation. Do you agree? He would be on any Republicans list that they were president no outlier, and I was so bad told the Democrats. This is a good day could have been judge Judy as brick oven. Let's let's celebrate this. And so I've known him for a long time. I can tell you is about as mainstream as you ever get on our side, and he was the Bush guy. So President Trump heads list of people he identified that. He would choose from which was unusual anyone. So he's not doing anything exotic here and on that list or a lot of good names. Sure. Many of you know, those folks but bread and Neil Gorsuch were to the greatest picks any Republican to now. So I vote for soda Marin Kagan get the crap beat out of me at home. But that's okay. I thought that's the way it should be. I'm trying to do it the way it used to be Senator. Thurmond voted for Justice Ginsburg, not cost you agreed with her because he thought she was a qualified person. And how could you say she's not Senator Hollings the longest serving junior center. The history of the country in case, you're watching happy recent birthday for its he voted for Justice Scalia. You'll never convince me that he agreed with Justice Khalib, but he was highly qualified. So I think one got ninety six votes one got ninety seven whatever happened. Just a complete deterioration of the confirmation process. And was it always are people bor- Thomas bit of Alito now. Kevin. Oh, well, I don't know why always are people. But things have changed not for the better. So there's one person not mentioned in Cavanaugh yet. And that is Susan Collins. Of all the people who really mattered. I would put her at the top of the list Senator Collins gave an explanation of her vote. That is the Pitta me of what the founders had in mind when it came to advise and consent. It was logical well researched. She took the allegations. Seriously. She thoroughly bid at him personally looked at every Casey authored. Acquired a law professor to it buys her spent enormous amount of time looking through Brett's record and came to the conclusion that the accusations against him. Were unfounded and unjust. And at the body of his work demonstrated a king and elect a solid traditional conservative judge. So I want to thank Susan Collins for saving the rule of law now. Of. What Susan did is sustainable if every Senator did what she did. You may not vote. Yes. But you'll at least have a process that's fair the nominee consistent with the cost of understanding of our role in the Senate when make the country proud. It was logical. It was thorough. It was reasoned. The process that Britt went through is unsustainable. Hope let me tell you. Why? Who in this room would want to be next if he had failed? Anybody wanted the job after that? I would probably not vote because you're great. So so the bottom line is visit worked. They had destroyed this good man and he had to withdraw. I think that would be very difficult for conservative judges in the future the step and say, hey, let me do this. And what I told my democratic colleagues is if you can do it. We can do it. And it probably would unleash forces on the right? And Senate Judiciary committee, chairman Lindsey Graham, glad Britain made it I am very proud of the fact that President Trump did not pull the plug on Brett Kevin. A lot of people would have been tempted to do that the accusations were emotionally and the president stood behind his nominee. So it really did matter to me that Brit made it through because if he hit failed it would have destroyed the Republican party because most Republican activists would have believed that we let them down. And I want you to know that what happened to Brett should never happen again to any judicial nominee..

"Age or older. And if you're homeless, you can get one because you just have to prove that you're homeless within the city, Philadelphia, and you don't have to be a citizen, and yeah, there you go. There you go. So this is now what cities across the country are doing they're giving out these identification cards because they want people to be able to access all the perks of being a member of the community. And this is what I've been telling you about with regards to the pattern that's happening in blue places of trying to get a legal immigrants to be able to vote which is something that is happening. A lot of places. Although I don't think they require the municipal ID for that. That will be the one thing they wouldn't require ID for and on and on it goes. Joe Biden has a major political problem. But Joe Biden deserves everything he gets. Out of play this clip from nineteen Ninety-one nineteen Ninety-one Senate floor speech, Joe Biden was a Senator from Delaware. At the time clip is one minute long in in this clip. He manages to brag about civil asset. Forfeiture mandatory minimum sentencing expanded federal death penalty. Take a listen. The fact of the matter is we've gone from there all the way up to say under the leadership of Senator Thurmond, and I'd like to suggest I take some small credit for it myself as well and others the presiding officer that there's now a death penalty. We passed it a couple years ago, if you are major drug dealer involved in the trafficking of drugs and murder results in your activities, you go to debt and a lumber of other severe penalties. We changed the law. So that if you are rested, and you are drug dealer under our forfeiture statutes, you can the government can take everything you own everything from your car to your house, your Bank account, not merely what they confiscate in terms of the dollars from the transaction that you've just got caught engaging. You can take everything we have laws in the last several years where we don't allow judge's discretion the sentence. People flat time sentencing, you get caught you go to jail. You get caught you go to jail, and I'll flip the switch and kill you myself. I don't know how that meshes with today's democrat party or anything sounding reasonable or sane. But there is Joe Biden bragging about taking everything you've ever owned your entire life before he kills you. And then kills you again. In fact, our legislation now we dig up the body. We execute him again. And then we we bury him again. Pour. Some bleach on the grave just in case. They might wake up in the middle of the night. Joe Biden, that's the kind of stuff that is going to come after him. So my question is when will Joe Biden apologize for creating the federal death penalty? How does that play with the woke generation the pumpkin pancake brunch crowd? How do they like that? You think how does the woke generation feel about the federal death penalty that Joe Biden created? He just bragged about it. He literally because I'd like to I'd like to think I played a part in that. Killing people thing. I'd like some credit here for this. We don't just think that those guys just voted to kill people. I'm me I'm in. I did this. So now, he's going to apologize for all that and say times have changed again times have changed again. So, you know, he was part of a group of Democrats in the nineteen Ninety-two called people superpredators as you remember and created these ridiculous ticketless crime bills that left people incarcerated in prison for the rest of their life took away all their stuff and left them with. No hope when they left. Now, who's the president who just signed the first step act to try to undo some of that? Was it Barack Obama? No. Oh, it wasn't. Was it Donald Trump? Yes. Yes. It was. And when the president said today, he's not getting enough credit enough coverage for the first step back. He's exactly right because they don't want you to know that the president of the United States did what they couldn't do before him, which is pass sentencing and criminal Justice reform. Led by of course, Jared Kushner president's son-in-law, and I guess arch enemy of Chris Christie. We'll find out when Christie comes for the book event on April eighteenth, I'll ask him about Jarrett, and you should be there for that twelve ten WPN dot com slash speaker series. Get your tickets now April eighteenth of be Scottish right auditorium. I don't think Christie's a fan of the first step back maybe because Jared is behind it. Or maybe just because he doesn't like it. But we'll find out. But isn't that something though about Joe Biden mean here's the guy who was was bragging about the federal death penalty in democrat party? Now that is trying to undo the death penalty everywhere it goes. And he's the guy who created it created it. Meanwhile, APPA hall of Justice Senator Cory Gardner said President Trump would sign the pot Bill into law allowing states the right to legalize marijuana. Now again, I whether or not you agree with with marijuana or not, we should all agree. It's a states' rights issue because it's not in the constitution. If you wanna be consistent on the constitution. Then we have to agree that if it's not in there. It's not the federal government's purview period because it says in the tenth amendment. It's not in here. It's left to the states and the people respectively and just because they pass a federal law. Doesn't mean anything because if it's not in the constitution. They don't have the right to pass the federal law. That's what it constitutionalists should believe. And then you fight it out at the state level. You fight it out on the state level. And you try to battle it out. Whether you want it legalized or not. State issue. So they opposed. They assume they introduce legislation. Cory Gardner from Colorado was safe that legalized pot, and the president has said he's going to sign it. And all it says is that states will be able to legalize it. Then the feds are going to stay out of their way and not not go in there and bust them, which is great to Barack Obama do that. No, no, no, no, no, Brock Obama, rated states actually rated states who were selling marijuana. The truth is Democrats are totalitarians. They really are. I mean, if you're somebody listening right now, who's a democrat. I want you to think about this fact, which party has subpoenaed a major news outlet to ask them why they didn't run a story Democrats or Republicans Democrats which party is trying to use the IRS to go after the president's tax returns. Like, Richard Nixon did Democrats which party is trying to now allow states the right to legalize marijuana. Because it's not in the constitution. Republicans. Which president democrat or Republican signed the most sweeping criminal Justice reform in generations. Donald Trump Republican. So just you see the narrative of the stuff that they spill every night on the news is so wrong. It's just wrong. And that's why I really love to expose these people and all their hypocrisy because it's just so rich. It really is. It's just so rich eight five five three nine twelve ten eight five five eight three nine twelve ten. Joe Biden created the culture, he created the very culture that says now touching and hugging and giving a woman a compliment all of these things are bad, they're bad. And now it's all blowing up right in his face right in his face. So then they turn their attention then to the mother probe and taxes. They want to subpoena the attorney general bar they want to bring them in before congress and testify and now they want the president's tax returns Rudy Giuliani. Greg. We have that. Right. I we okay Rudy Giuliani. Made a great point. He's one, of course, President Trump's lawyers. Take a listen, it makes the point that we've been making for two years despite all of the media reports about how holy and sanctimony is Muller team. Is there a bunch of sneaky unethical leakers, and they are rabid Democrats who hate the president of the United States, and I can't tell you how much false information they've leaked or in. The course of the investigation. How many people are going to be indicted that didn't get indicted? How many blockbusters were there starting with popadopoulos and ending with Cohen who turns out to be a serial liar. How could you have any confidence in this? And with a weaponising of the IRS, which is so Nick Sonian that they did to the president. But you know, again, it's it's it's do what we say. Not as we do do as we say not do what we do. And that's the problem right there that is that is the major problem. So now we have to discuss the president's tax returns because of a nineteen twenty four law a nineteen twenty four low, and there was nothing in the constitution. That says the president has to turn over his tax returns. I want to make that point very clear if we are to be consistent. As a constitutionalist. You follow the constitution. And in the constitution. It lays out the requirements to be president. You will not find the words tax returns in there. Yet. Here's the vampiric. One Nancy Pelosi. You took a break from describing her creepy child games with Joe Biden to say this the US tax code section sixty one zero three what the tax code says. I'm sorry. I don't give a damn what Batak code says. I care what the constitution says. Now with the tax code says. My my Alamo rental agreement says the hell cares with the IRS code says who the hell care it says strippers can deduct their bras. What what what is it have to do with anything base? I think they can. I'm not sure I I that's not fair if they get to none of the rest of us to I you know, what on right Justice that that is injustice. That's gotta stop. Tax code. No what I don't care. What is the federal constitution say? How long have we get lost? I made a bet with Joe before the show that you would last thirteen seconds. And they said you lasted too. So. I lose. You see that that's working together. All these years. I know exactly. The tax code. I don't give a damn what the tax code says. All right. Let's try this again, see we can get the twelve the US tax code section sixty one zero three they never those number sixty one. Oh, no. I'm not gonna remember those numbers. Nobody needs to remember those numbers because were relevant numbers. They're stupid number. Remember this to ready? That's article to the constitution. Remember that number the legal? How many seconds was that creek? That was six six. Okay, I'm working through legal authority. To get the tax returns. The IRS manual requires the IRS manual requires what what stops requires over and over again, and congress has the duty to ensure that has been done and done properly. We also need to determine whether congress should required by statute the RS IRS to do such an audit and the scope of any audit. What the hell are you talking about fifty one of three to do an audit in the scope of audit?.

"So once the secretary, Florida state needs to be needs to be reinstated. If this guy is going to get away with this. Yeah. Exactly. I would have the moon. And here's another one the moon bad. Presidential candidates attacked the call for his resignation. I mean, this is the first day of black history month, right? And and he would be replaced by a black guy. Eight four four or five hundred forty two forty two. What do you think what's going to happen to the governor of Virginia? He is. He is a democrat someone said that the last line of of his of his heartfelt apology. That's what they're going to call. It a heartfelt apology is should be. And I'm not going to resign. Thank god. I'm a democrat. You don't want to when a when a democrat does something like this, even if he's twenty six twenty seven years old. It's a youthful indiscretion. A Republican does it. Racist. That's the way it works. Paul. You're next with Howie Carr. Go ahead, Paul. Our? With Whoopie Goldberg after cheers. Black fits with her on stage. Yeah. That was way up to eighty four. So I mean, how come it's a problem? Well, he's a liberal again. It depends on your political perspective. Oh, so it's do no wrong. Democrats. Right. Well, look at it. I was thinking about during the break. Look at Trent Lott. Remember him? He was the he was the Senator from Mississippi and was the was the Senate majority leader and Strom Thurmond was celebrating his one hundred birthday. He was still the Senator from South Carolina. I think it was his hundredth birthday. And he ran for president is a Dixie crap that was the that was they broke off from the democrat party and forty eight. He was the governor of South Carolina at the time because the Democrats had integrated the armed forces. And so so Trent Lott said he was just making a joke and trying to make an old man feel good at his birthday party. And he said, you know, sometimes Senator Thurmond, I think it would have been better if you had been elected president in nineteen forty eight and they they ran Trent Lott out of his majority leadership position. They basically ran them out of the Senate for saying that just trying to be just trying to say, something, gracious and. Nice to an old guy who wasn't going to be around that much longer. And this guy this guy is going to get away with it though. And again, this is going to be if he gets away with it. If he gets away with a nut still say, he's a heavy favourite to survive. He he will he will prove the double standard once and for all, thanks. Thanks for the call Paul. What else is funny too? Is that if you're a democrat, you can't be judged on one indiscretion you made a million years ago. But if you're a Republican, you cannot only be judged on indiscretion, you can meet judge on hypothetical indiscretions that you made thirty years ago. No evidence, if they feel they have if they have an inkling that something happened. You can lose your job. Will remember Sheldon? Whitehouse was the guy who was really a grilling Brett Cavanaugh the Senator from Rhode Island. White House was grilling Cavanaugh about what he meant by pufus or whatever that word was in the in the yearbook, and I'm thinking to myself, wait, a second Sheldon Whitehouse, didn't your son get into some trouble for some underage drinking a few years back, you know, with with one of the Chafee kids, you know, the Yankees riding around Rhode Island. Drinking their brains out underage. But of course, nobody ever mentions that you don't because again, not because Sheldon Whitehouse Yankee, it's because he's a democrat. So he gets a pass his kid gets a pass. Everybody gets. You gotta be. It it's the democrat immunity from prosecution. So now now that he's confirmed that it's him in the picture. We've moved to the stage of the news cycle where all the reporters. Call every democratic presidential candidate every democrat elected official and ask them. Should he resign? Right. That's that's where this is headed, right? I know you're saying that cynically, but I think you have to ask that. Absolutely. You do you know, especially Cory Booker got all that free ink and airtime today because he announced I mean now now you gotta hit them with a real question. Right. You have to and Joe Joe Biden is taken all this crap for being called a racist. Earlier in the day ask Joe Biden is he still down here in Fort Lauderdale. I don't know. But he tracked down Joe Biden, by the way. How is it time for a national conversation about black face not by Megan Kelly? She's not getting into that one again tau if she were still say we could have a town hall with Megan Kelly and the secretary of state of Florida, and maybe be Trent Lott could come back from his lobbying job in DC. I'm sure there are other ones that I've forgotten about have gotten into GM's for stuff like this. If they asked Kamala Harris about it. I know at her answer would be let's move on. I remember what speaking of Kernersville, which figured it. Police blotter facts. I remember one time. I think I don't know if it was great Swisher is father was also in politics in Kernersville. I think it was the old man, whatever his name was the the older Swisher was at a city council meeting one time, and he spoke in black dialect, and even in even in like, the Sabbath these North Carolina that was a big deal. He took a he he didn't have to resign. But he took a lot of crap about this is this is really gonna be enlightening. How this how this plays out eight four four five hundred forty two forty two Tom you're next with Howie Carr. Go ahead. Tom. Say how you know if the Republicans were really serious about couldn't a night between this jokers shoulder blades. They would get Justice cabinet already issue. A public statement, of empathy and support for this guy. But you know, what Kavanagh did was was so inconsequential compared to this. And again, the age difference the difference between being I think I think Cavanaugh was seventeen wasn't. He wasn't. He a junior in high school when? Macho stuff appeared in the yearbook. So it's the difference with it's it's almost ten years difference in age, those are those are ten pretty important years. Aren't they? Especially when you figure again, north of north of didn't go to light Green Mountain college Hampshire college where everybody's smoking weed all day long. He went to he went to Virginia Military institute. VMI he he had he had a he was from a disciplined institution, and then he went to medical school, which again is is not not an easy thing any medical school. And yet he still behaving in this fashion. I'm just trying I'm trying to pretend that I'm that this these a Republican, right? And and I'm on MSNBC or CNN. So there's there's a CBS reporter how he was asked Governor Raimondo whether she thinks the governor north should resign. And apparently, the New Jersey governors is just directing all comments to the democratic governors association. Well, you know, the the governor of New Jersey's got a problem because he just they just broom the case one of the one of the campaign female campaign workers claims she was harassed by the head of his his Hispanic officer, some some PC affirmative action office, and they just broom that case, so I'm sure governor Murphy the last thing he wants to do is get mixed up in in another one of these cases like this and how you were asking about the difference in age. Well, actually, they really don't let you rent cars until you're over the age of twenty five because your brain isn't fully developed. So he was twenty six he can rent a car breath. Cavanaugh could not ever just doing comparisons. Here. John, you're next with Howie Carr. Go ahead. John. And I like to tell you you have a fantastic crew. Thank. The point that I would like to make his that. I put the governor of and. Of New York right up there with pedophile. That's all I have to say. They're exactly pedophile. It's you know, they're they're not they're not having sex with with children. They're just, you know, governor north rim. He I don't care. How you spin. What he said. He basically said they were just you keep the baby comfortable while you have a discussion with what you're gonna do. And one of the texter says are they keeping the Democrats keeping governor north room comfortable while they have discussion about what they're gonna do with him. You want some coffee governor house he air conditioning in here. Sometimes sometimes governor those of us in political life. Find ourselves in. Circumstances that the coin of phrase might be described as tragic and difficult and sometimes governor for the good of the mother's health candidate is comes is born with severe abnormalities. And you know, it's it's better for all concerned. If we just well, you know, governor you understand you were a pediatrician a pediatric neurologist you understand what it's like eight four four or five hundred forty two forty two. I'm gonna I this is going to be an this is going to be an interesting evening on on the on the moon channels. This is this is one of those things where you you really wanna see see how they're going to remember remember when I made the war woop in in Bangor, Maine. Thank you for that. How he region? Not one of those things that you tend to forget, Rachel Maddow made. It seem like I'd been doing the goosestep and the the the Heil Hitler salute on the show now. And I think history has proven the I was on the right side of history that night that day now who's gonna get who's going to get a tougher time on Rachel is is is the governor of Virginia gonna get a now, especially since you came out for infanticide earlier this week on WTO P radio in Washington is he going to get a tougher time or an easier time than Howie Carr Ola. Now that.

"Yes, he did. But unfortunately, somebody lost their job because Trent Lott showed up at the birthday party and made a I think what he would tell and has to- folks was just sort of an off handed joke about I would've voted for strong country would have been better off with him. He lost his leadership position because I will tell you one thing about Strom Thurmond is that there is a sort of a new way of looking at him from the Senate historians over there in terms of not so much his civil rights stances. But some of the other things that Senator Thurmond began to be known for over there. Senator Packwood lost his job because of some improprieties towards women. It's you know, again, only fifty two women have ever served in the US Senate. It's been a men's club for all these years, and it's been slow to change. But it's interesting there, they have a different way of looking at Senator Thurmond now than they used to have pocketful are this stories about Senator Thurman going into a reception. Grabbing a handful of shrimp. Pocket going back to his office. And offering them to some of the staff, I believe, my friend. Bob Reilly who witnessed it firsthand. He witnessed the shrimp in the pocket. I don't know if he was at the at the office when he gave him to the staff, you mentioned Senator Packwood Senator Packwood left, the Senate back in nineteen ninety-five resigned. He's still alive. He's eighty six years old here he is on the floor of the Senate in his resignation speech and nine hundred ninety five..

"Okay. I'll say three eight and three in the Egbo against Mississippi State pretty good including the nineteen Ninety-two game. When they stopped state on eleven plays inside the ten yard line in the last four minutes and held on to win. And also that he was twice nailed for pretty serious NCA violations, which was especially awkward it all miss because the president at the time Gerald Turner was running the president's commission. So which was the reform arm of insa. So that was a tad awkward. Billy brewer. No longer with us at age eighty three. And I mentioned he was on the field against Billy cannon. Of course. Billy cannon nineteen Fifty-nine Heisman winner died. Also in may about a week after Billy brewer Billy cannon was eighty years old an incredible life such a hero in the state of Louisiana. You can't imagine the hold that Billy cannon head on LSU fans in the late fifties. He was the star of the nineteen fifty eight national championship team. And then of course, had the what is now considered the epic eighty nine yard punt return to beat ole miss on Halloween night in one thousand nine hundred fifty nine and cannon was. Grew up on the wrong side of the tracks and Baton Rouge. He sold cokes at tiger stadium as a kid. Not what people don't remember about that game rhyme. The ole miss game in nineteen Fifty-nine. Not only did he return that the folk politics you ahead seven to three but on the last play of the game canon and Warren Rabb made a goal line tackle to keep ole miss out of the end zone and preserve the victory. And of course, wins the Heisman goes onto NFL career. A now notorious conviction for counterfeiting that landed him in federal prison, and then a redemption in among LSU fans, they loved him again until he died earlier this year when the only time I had a conversation with Frank Ford. We just happened to be in the same place at the same time. And we're just chatting, and I was young magazine writer at that point. And the only question I had for him was was his novel. Everybody's all American based on Billy cannon because I'd always heard that. But then growing up in North Carolina also heard it was based on Choo Choo Justice and Frank to Ford didn't like being asked that question. I feel like I was maybe the ten million person that had asked him about question. But Billy cannon certainly thought it was based on him. Yes. Gavin grave, Greg ghost. Everybody's all American. It's a you like college football. And you're like good writing and should read that. We are not really going strictly alphabetical. We're sort of going off a battle bouncing back and forth a little bit. But as long as we're at the top of the alphabet Ryan, you you wanted to tell a story about president, George H W Bush and his connection to college football. Of course, he died recently that the age of ninety four. Yeah. The only time I was in the chatter with George Bush once I was in the room with him a couple of different times. The last time was at a Texas A&_M football game. Of course, lived there in Texas in Houston area in all the way up until. I mean this past spring made appearances to Texas A M baseball games. And of course, he was a college baseball player played in the first two editions of the college World Series. That's why chatted with him on the telephone. And I found out how difficult it is to get former presidents on the phone. But once you once they got him on the phone. They said you have five minutes. I think you talked for thirty because he enjoyed talking about just college athletics. But I so I was a Senate page as a high school senior, and I was the morning after the nineteen eighty eight presidential election. I was a Senate page for strong Thurman because I was from South Carolina, and George Bush came to Washington to take a victory lap as the president elect that the morning after the election, and he came by Senator Thurmond's office, and at one point the only people in the office were me. President-elect Bush Strom Thurmond the by far senior member of US Senate, Bob and Elizabeth Dole and Ted Kennedy..

"My years as a prosecutor is a lot of ties with people try to blame the victim. Not up to their own deeds. He angrily asserted baseless player tirades. He was all too eager to promote the false Republican talking point to Senator Feinstein was lying in wait with this allegation. He even claimed the allegations were driven by revenge on behalf of the Clintons. Tied to make this stuff up that amounts to conspiratorial madness. In my time in the Senate. I have never seen such volatility. Partisanship. Lack of judicial temperament from any nominee for any court in the end ministration. It's no secret. I have deep concerns about what a Justice cabinet. I would be in for the rights of women for workers probably healthcare for unchecked, presidential power and other important issues. I also believe he's unfit to serve on our nation's highest court because of his history of misleading the setup while under oath. But as serious as these concerns are. This is different. Voting to advance and ultimately confirm judge cavern while he's under this dark cloud of suspicion. Well, forever changed. The Senate our nation's highest court. Politicize the US supreme court. Branch of our government. He should be above politics. And for victims and survivors of sexual violence struggling with whether to come forward. The consequences baby. Even worse. Every one of us who's been a prosecutor has seen how hard it is sometimes for victims to come forward. And are we sending the signal you stay there? Don't come forth. You know, how this committee handled this domination? Reviewers reflection of how seriously. Her society views credible claims of sexual misconduct. During Dr Forrest tests, more in the national sexual assault hotline saw an unprecedented hundred and forty seven percent increase in calls. When survivors has taking sexual assault. Seriously. They're empowered to come forward. If they see us callously sweeping under the rug, I fear. They'll have disastrous consequences if victims think they'll never be believed or not married. Terribly. Then why come forward at all? Carter four deserves to be hurt. And that must mean more than just checking a box. Remember, Dr Ford did not spend her entire life. Preparing for this moment. She is not backed by the most powerful officials in our nation's government. She did not come here with a political agenda. She did not testify with a job promotion on the line. She did not invade our questions, and she did not demean our motives, I've either Republicans or Democrats. Instead plainly with grace times emotionally recounted the trauma that she experienced as a fifteen year old girl. Trauma has been haunting her for the thirty six years since she had nothing to gain. Everything lose I coming for. Heinsohn closer to both her judge cavern. And I believe her. As I believed, Anita hill. I'll be voting on judge cabinet nomination. He does not have the veracity or the temperament for lifetime appointment highest court and our nation. Those such dominate should be confirmed in the face of such serious credible and unresolved and unresolved. Allegations of sexual assault. Senator Graham, thank you. I know I'm a single white male from South Carolina told us should shut up. But I will not shut up if that's okay. Because I got here the same way. Everybody else did the people in South Carolina voted for me and centers got to be their voice men and women, and I'm going to try to be their voice today. And maybe not just for South Carolina. But a little bit about what I think is going on here. Joe Biden, I can't believe we're saying this on our side. Listen to Joe. But Joe was right. A lot Joe Biden's a unique guy if you had one last conversation before you die. You don't want to have it would you? You'd be around for a while. Is decent guy theorized for president. He'd be hard to be. He came to Senator Thurmond's funeral. And gave a long eulogy. Asking Joe, I said that was incredible. This can't help you in Delaware. I just like the old guy. When I was down and out. He was there for me. And to my colleagues on the other side, this will end, and we'll see what we do next. I hope we can muster the ability to move forward. But some observations about where we find ourselves in. How we got here. I wrote a book, and I think Senator Blumenthal is the only person I know that actually read it. It was on line. I ran for president. And I got one percent. So I've had my time to be president didn't go very far. And I lost. I didn't think Trump would win. I ran out of adjectives to describe about. How about his campaign? Well, he wanted I lost. He's president. And I'll try to help him where I can. Say no one must and they'll actions over for me. I would like to tell him that. You had a choice to make for the supreme court vacancy of Justice Kennedy. I think he did a good job, Mr. Preston. For somebody's supposedly crazy. And there's chaos everywhere. He did a good job here. Now, why difference between gore and Kennedy excuse me Gorsuch cabinet out is the Kennedy seat. You know, get that you're not paying much attention gore sake is a even swap for Scalia. But this is has take stuff. This is the C or the guy in the middle is at risk. Cavenaugh clerked for Justice Kennedy. Would you pick them? No. But you lost the election. And that does have consequences when I said about Obama winning. A minute. Merrick garland. Scalia dies. Indie election year the last year of the term of President Obama. The primaries are already underway. Not in one hundred years has anybody been nominated under that circumstance. So I don't think I did anything unfair. Unfavorable, darling. As to soda buyer and Kagan. I was told on our side you've got to keep them off the court because they're gonna be a pro choice, but they hate gods. On and on and on. And I tried to go back to what this committee used to do Strom. Thurmond voted for against Berg. You'll never convince me it was because he agreed with our philosophy. I think he saw on her a qualified person Brits Hollings voted for Scalia. The same is true. Ninety six and ninety seven votes. What's happened? Most nominees supreme court never had a hearing. It was always just assumed if they're qualified and they're not hacks that they're gonna go Ford. Elections do matter when it comes to President Trump. Elections. Do matter now about the law into my friends who have been prosecutors I've been a prosecutor I've been in defense attorney, and I've been a judge. Every woman who's been victimized. Needs to be heard count me in a thousand times over. Count me in for the proposition for every one woman who comes forward. Only God knows how many women and children go to their grave with the abuse. If you don't realize that you just don't know this area of life. But you're going to be heard in the United States. I had a young man accused of sexual assault. When I was in the air force's of defense attorney. The case eventually fell apart and he almost killed himself. Women who've been gang rate and didn't wanna testify, but they did along with counselors. I set up with them all night. Tough stuff emotional. I've been doing this legal stuff. Most of my life. I'm never heard a more compelling defense of one's honor and integrity. Than I did from Brett cabinet. He looked in the air by and he was mad and he should have been mad. He could tell you where he was at what he was doing during high school in a way that just blew me away. Brad Kavanagh and women. If you're a gang rapist when you're a sophomore and a junior in high school, you don't let it go. Every woman who actually knows Brett cabinet. Is come forward to say he is not that kinda guy. He has been at the highest level of public service under tremendous scrutiny six FBI investigations. And we missed the sophomore junior gang rapist. We didn't miss it much garbage. We're in the twilight zone, and here's what I would say. Miss ford. All I can say about miss Ford. I feel sorry for her. And I do believe something happened to her. And I don't know when and where, but I don't believe it was Brad Kavanagh, and as a prosecutor, you couldn't get out of the batter's box because in America before you can shoot accuse somebody but crime, you have to tell them when it happened, and where it happened, and you have to prove beyond a reasonable doubt. It did happen. The reason this case will never be brought in Maryland or anywhere else. Just can't get there. If you wanted to get a warrant, which is a probable cause standard to search or arrest somebody you gotta prove by probable calls where it happened in point. It happened. How are you supposed to defend yourself? Is the burden really own you to prove that you were not at a party thirty five years ago. And they won't tell you where it wasn't when it was. So all I can say is it under any reasonable standard any concept of the rule of law. This would not go forward. There've been five allegations here. The allegation was brought to me by Senator Whitehouse. Who did absolutely the right thing. Somebody contacted him in Rhode Island and said a friend of his was on a boat with Mark judge and brat cabinet on they treated badly. He went down and beat them up. And she won't come forward. I said, well, I'll make sure I'll join with you. Let the FBI look at it and turned out not to be true. The fourth allegation was an anonymous allegation a letter without a date or return address Santa Cory Gardner, just a few days ago. And he turned it over to the committee. And somebody on that side leaked it to NBC news. And it made it on the news. The fourth allegation that really bothers me. I don't know what's going on over there. But that's not right. It was somebody over there. Now about miss Ford. I feel really bad that she wanted to remain anonymous and could not the one thing I know for sure. Is it Diane Feinstein would not do this and did not do this. But I know for sure somebody did. It wouldn't chatter from a friend three groups had this letter that was requested to be anonymous Dianne Feinstein and her staff, the congresswoman from California and her staff and the lawyers. Somebody betrayed her trust. And if you can't figure out why you should be driving to delay. This hearing to set in motion to destruction of this man to keep this seat open past the election that I know beyond any any doubt. What else do I know? About fell out of my chair when Dr four said yesterday, I didn't know you would be willing to come to me..

"The over under on win, the Democrats demand that Peter Struck and Lisa page lead. The FBI investigation. Exactly, they probably have already asked. Senator Hirono laid out the strategy just a few days ago. In an interview. Hey, we could keep the seat open until twenty twenty one. Do you think he will be on the court? I don't know. That was last week. I think it is more of a question. If he's not is there another this is before the Ford Cavanaugh hearing. So the other day Trump nominee that could get through the Senate. There are plenty of people on the federalist society and Heritage Foundation lists. And the question what if the Democrats take the Senate and the midterms which is something you're hoping would happen anyway. I don't think we'd be looking to the federal society and the Heritage Foundation for people that we can support. Therefore, if the Democrats took over control of the Senate, president could forget about any of the nominations the nominees. He has on the list that he put out the list that helped get him elected all laid out. I don't think we'd be looking for the list put together by the Heritage Foundation. And the federalist society, let's hope that the process will change to one where there's more of a meeting of the money. This is an interview that took place before the testimony of Dr Ford before the testimony of Kevin of Kavanagh's in response. And we could find someone who would garner more than the bare minimum of Republicans are supporting this person. So lifetime appointment to the supreme court. So I hope that that will change that dynamic will change, and we'll all be able to come up with something much worse than somebody much more acceptable. You think there's someone that President Donald Trump would nominate that should there be a democratic. Authority in the Senate could be confirmed. Sixty four thousand dollar question. Here's our answer. Surely there must be can you name somebody? Well, one of the people in the got on the night circus is someone that he probably got a few number of Republicans voting for a man in with somebody from Hawaii. Because he wasn't conservative enough. We'll see if President Trump would nominate that person's experience court, and if you did would you vote for him. I shouldn't say, but I just think that with all the good judges said they're out there that that. I don't mind judge being conservative as long as I feel as a leader has some kind of ideological ax to grind what does that mean? Which Trump appointees? Trump appointees all have political access to grind by definition. Well, this would be a Trump appointee. You're right. Up to now. But there there are a lot of conservatives who I think one could conclude that they can manage to be fair and apply the law. Why don't you put together a list of the conservatives that you think that you'd vote for once you do that save some time this wonder, and we can leave it at one how long that list would be this. It's possible that the Democrats are gonna take majority in the Senate. It's probably about a long as a list of the people that have been treated unfairly by a criminal Justice system that President Trump demanded that the NFL supply that breath Kavanagh's nomination is not going to make it through here. If it doesn't it seems unlikely that another nominee would be able to be confirmed before the midterms at this point, just the timing is, right. You wouldn't support that kind of a Russian something? So no, I wouldn't. So this one's just done until after the midterms and assuming we pay control of the Senate then. Those persons that President Trump has on that list supplied by the federal society and Heritage Foundation. You can forget that do you end up in a space than where if there's a democratic majority which there may or may not be and we could potentially have an opening on the supreme court that because of gridlock because of an inability to agree because of politics on both sides of it is there for two years. I think those kinds of vacancies before and not a problem with me for those kind of vacancies before. And we certainly have over a one year vacancy with Merrick garland. So the world does not come to an end because we don't feel all of the nominees. But as I said, my hope is that if cavenaugh does not get confirmed that there will be much more of a meeting of the minds, and that we'll be able to get back to a advice and consent process. The world won't come to an end. If the seat stays open for two years, the world won't come to an the seat doesn't stay open for two years after Geraldo. That's the strategy. Delay delay. Hopefully, we take control of the Senate and then President Trump can forget about any of the nominees. He has on his list. We have a list of nominees. Wha that we like to get to the president and one of those persons on the list is imminently qualified lawyer named Barack Obama. I'm joking. Of course, it helps says there are women that committee, but you know, what I expect the men in this country and the men in this committee, and many of them believe me because we all signed onto this letter to demand and FBI investigation by really guess, who's perpetuating all of these kinds of actions. It's the men in this country. And I just want to say to the men of this country just shut up and step up. Do the right thing for change. Okay. See I'm a little upset by this the fairness of that. But you have a same question, Senator Graham, thank you. I know I'm a single white male from South Carolina told us should shut up. But I will not shut up if that's okay. Because I got here the same way. Everybody else did the paper in South Carolina voted for me. And Senator Scott be their men and women, and I'm to try to be their voice today, and maybe not just for South Carolina. But a little bit about what I think is going on here. What's going on here? Joe biden. I can't believe we're saying on our side listened to Joe. But Joe was right. A lot Joe Biden's a unique guy if you had one last conversation before you die. You don't wanna have it with Joe? Around for awhile. Is this guy bureaus for president hippie our debate he came to Senator Thurmond's funeral and gave a long eulogy. Asking Joel said that was incredible as kit. Help you in Delaware. Disliked guy. Then agree with him. Like some of the things he did in his life. On ours down out. He was there for me. Toback colleagues on the other side, this will end, and we'll see what we do next. I hope we can muster the ability to move forward. Now after Dr four testified, but before Brett Kavanagh did in ABC panel headed up by George Clinton, novelist who was involved in the nuts or sluts strategy maligning the accusers of Bill Clinton. No credible accuser. Caller, credible city had no agenda. Could it wasn't a disaster for the Democrats for the for the Republicans a disaster El Kebir watching this all across the country is this began. I got a text from fencing. She looks like every woman you now. She's he indeed does she is a guy George Clinton who was maligning the women who made accusations against Bill Clinton. He maligned Paula Jones, he maligned Juanita broaddrick. Someone who is completely recognizable to everybody in the country. We know women just like her, and and she certainly doesn't seem to be somebody with an agenda as she is putting herself in this very difficult position. It's a very odd hearing and the difference between Democrats and Republicans has been very striking. But we will keep saying she has no agenda needed this Cavanaugh her persona. I think has come off so far is highly credible. I've examined hundreds of witnesses on the witness stand. She's. Extremely credible. She's extremely detail oriented they're a little things about what she has said. Detail oriented, she has two front doors. He can't make that stuff up. It is so unusual that sort of detail it makes her testimony extremely credible. And the fact that she has two front doors means Brad Kavanagh, attempted to Raipur also that she said, I am terrified to be here. I don't want to be here. But I feel that this is my civic duty I found her to be one of the most credible witnesses. I think I've seen triple eight nine seven one S eight triple eight nine seven one seven two four three Linda Graham told mansion and Donnelly you won't get away with not going for cavenaugh Donnelley's already said he's not gonna vote for cavenaugh triple eight nine seven one eight triple.

And I will tell you I've had debates with Lindsey Graham over the years. We've had falling outs over the years. And if you can't figure out why you should be driving to delay. This hearing to set in motion destruction of this man to keep this seat. Open fast the election that I know beyond any any doubt. What else do I know about fill out of my chair when dot four said yesterday. I didn't know you would be willing to come to me the Email interactions between this committee and her lawyers. My staff would still welcomed the opportunity to speak with dot forward at anytime any place. Convenient to her come to us are we to you? I'm willing to have my staff traveled to Dr Ford in California or anywhere else to obtain her testimony September the nineteen well that wouldn't fit in the plan when be public, and it would get over with sooner than people want it. I don't know what to believe. But I tend to believe that Dr Ford did not know about this invitation, and I've been a lawyer most of my life and somebody needs to ask the question to her lawyers. How could she not know about this? Are you beginning to understand what's been going on for a very long time in this case, it's not that hard to figure out? So if this is the new standard, the accusation proves itself to those who aren't ask questions. You hate women. God help us all if the new standard for the committee is that there's no. Resumption of anything that you have to prove why somebody would accuse you not just say, I didn't do it. And here's why do it. But you gotta prove the motives of year accuser. God help us all Daven naughty moment tells you what's going to happen. If we keep this farce going, plenty of time, plenty of opportunities to get to the truth. This is never been about the truth. This has been about delay and destruction. And if we reward this it is the end of good people warning to be judges. It is the end of any concept of the rule of law is the beginning of a process that will tear this country apart. And if I am chairman next year, if we keep the majority and Senator Grassley moves over now hope he doesn't 'cause I think he's done a great job. I'm going to remember this. There's the process before cavenaugh in the process after Kevin if you want that nominee, you can delay things for the next election. You will not if you try to destroy somebody. You will not get away with it. And Jeff is leaving. He has wrestled with this. He is trying to be fair. I cannot tell you Jeff what happened thirty five years ago. I can tell you this that do any legal system. This thing would not get out of the batter's box. And that everything I know about judge cavenaugh screams that this didn't happen and all the other things. So to my good friend friends on the other side who are struggling. I think an FBI investigation is going to do nothing. It's not gonna tell you any more than we know. Now, it's gonna just keep it going and going and going to Hebrew and he walked into the next five come forward. I'm going to vote. Yes. "Eight hundred nine four one Sean before all this went down. Down with obviously snowflake today. Lindsey Graham, laid out the case in his statement. And I will tell you I've had debates with Lindsey Graham over the years. We've had falling outs over the years. And but he had his finest moment I thought yesterday, and then today followed it up, and I think this is worth playing on. This is what he said before this mess earlier. I know I'm a single white male from South Carolina. And I told us should shut up. But I will not shut up if that's okay because I got here the same way. Everybody else did the people in South Carolina voted for me. And Senator Scott to be their voice men and women, and I'm going to try to be their voice today. And maybe not just for South Carolina. But a little bit about what I think is going on here. Joe Biden, I can't believe we're saying this on our side. Listen to Joe. But Joe was right. A lot Joe Biden's a unique guy if you had one last conversation before you die. You don't want to have it. Would you be around for a while is decent guy is for president hippie hard to be it came to Senator Thurmond's funeral and gave? A long eulogy. And I asked him Joe said that was incredible this kit help you in Delaware. I just like the old guy. Agree with him. And I didn't like some of the things he did in his life. When I was down and out. He was there for me. It's about colleagues on the other side, this will end, and we'll see what we do next. I hope we can muster the ability to move forward. But some observations about where we find ourselves and how we got here. I wrote a book, and I think Senator Blumenthal is the only person I know that actually read it. It was online I ran for president. And I got one percent. So I've had my time to be president didn't go very far and I lost. I didn't think Trump would win. I ran out of agitates describe about how about his campaign while you are in and I lost. He's pressed and I'll try to help him where I can say no must and they'll actions over for me. I would like to tell him that you had a choice to make for the supreme court vacancy of Justice Kennedy. I think you did a good job Mr. pressed for somebody's supposedly crazy and there's chaos everywhere. He did a good job here. Now, why difference between gore sick and Kennedy misgivings Garcia can Kevin is the Kennedy seat. If you don't get that. You're not paying much. Attention Gorsuch is a even swap for Scalia. This is has stake stuff, right? This is the seat or the guy the middle is at risk. Cavenaugh clerked for Justice Kennedy. Would you pick them? No. But you lost the election, and that does have consequences when I said it about Obama winning a minute, Merrick garland glare dies in the election year. The last year of the term of President Obama. The primaries are already underway nine one hundred years has anybody been nominated that circumstance. So I don't think I did anything unfair garlic as to serve our and keagan hours told on our side you've got to keep them off. The court costs are going to be a pro choice. They hate God's on and on and on. And I tried to go back to what this committee used to do Strom. Thurmond voted for Ginsburg. You'll never convince me that was because he agreed with our philosophy. I think you saw on her qualified person Fritz Hollings voted for Scalia. Same is true ninety six ninety seven votes. What's happened? Most nominees supreme court never had a hearing. It was always just assumed if they're qualified in hacks that they're going to go forward. Elections do matter when it comes to President Trump elections do matter now about the law about France have been prosecutors I've been a prosecutor I've been a defense attorney, and I've been judge. Every woman who's been victimized needs to be heard count me in a thousand times over count me in for the proposition for every one woman who comes forward only God knows how many women and children go their grave with the abuse. If you don't realize that you just don't know this area of life. But you gotta to be heard in the United States. I had a young man accused of sexual assault. When I was in the air force's defense attorney the case eventually fell apart, and he almost killed himself and women who've been gang rate and wanna testify, but they did along with counselors. I set up with them all night, tough stuff emotional who to believe I've been doing this legal stuff most of my life. I've never heard a more compelling defense of one's honor and integrity that I did from Brett cabinet. He looked me in the air everybody in the end. He was mad and he should have been mad. He could tell you where he was that what he was doing during high school in a way that just blew me away Brett cavenaugh and women if you're a gang rapist when you're a sophomore and a junior in high school, you don't let it go. Every woman who actually knows Brett cavenaugh has come forward to say he is not that kind of guy. He has been at the highest level of public service under tremendous scrutiny six FBI investigations. And we missed the sophomore junior gang rapist. We didn't miss it much garbage where in the twilight zone, and here's what I would say miss Ford. All I can say about miss Ford. I feel sorry for her. And I do believe something happened to her. And I don't know when and where but I don't believe it was Brett Cavanaugh, and as a prosecutor you couldn't get out of the batter's box because in America before you can shoot accused somebody. Crime. You have to tell them when it happened, and where it happened, and you have to prove beyond a reasonable doubt. It did happen. The reason this case will never be brought in Maryland or anywhere else. Just can't get there. If you wanted to get a warrant, which is a probable cause standard to search arrest somebody you gotta prove probable calls where it happened. And when it happened. How are you supposed to defend yourself is the burden really own you to prove that you were not at a party thirty five years ago? And they won't tell you where it was when it was. So all I can say is it under any reasonable standard any concept of the rule of law. This would not go forward. There have been five allegations. Here. The fifth allegation was brought to me by Senator Whitehouse. Who did absolutely the right thing. Somebody contacted him in Rhode Island and said a friend of his was on a boat with Mark judge and Brad Kavanagh they treat her badly. He went down and beat them up. And she won't come forward. I said. Well, I'll make sure I'll join with you let the FBI look at it and turned out not to be true. The fourth allegation was an anonymous allegation a letter without a date or return address sent a Cory Gardner just a few days ago. And he turned it over to the committee and somebody on that side linked it to NBC news. And it made it on the news. The fourth allegation that really bothers me. I don't know what's going on over there. But that's not right. It was somebody over there. Now about MS Ford. I feel really bad that she wanted to remain anonymous and could not the one thing I know for sure is it Diane Feinstein would not do this and did not do this. But I know for sure somebody did it wouldn't chatter from a friend three groups had this letter that was requested to be anonymous Dianne Feinstein and her staff, the congresswoman from California and her staff, and the lawyers somebody betrayed her. Trust. And if you can't figure out why you should be driving to delay. This hearing to set in motion the destruction of this man to keep this seat. Open fast the election that I know beyond any any doubt. What else do I know about fell out of my chair when Dr four said yesterday, I didn't know you would be willing to come to me the Email interactions between this committee and her lawyers? My staff would still welcome the opportunity to speak with dot forward at anytime. Anyplace convenient to her come to us are we to you? I'm willing to have my staff traveled to Dr Ford in California or anywhere else to obtain testimony September the nineteen well that wouldn't fit in the plan when be public, and it would get over with sooner than people want it. So if this is the new standard, the accusation proves itself to those who want ask questions, you hate women. God help us all the new standard for the committee is that there's no presumption of anything that you have to prove why somebody would accuse you not just say, I didn't do it. And here's why do it. But you gotta prove the MO. Odors of your chooser. God help us all that moment tells you what's going to happen. If we keep this farce going, plenty of time, plenty of opportunities to get to the truth. This is never been about the truth. This has been about delay and destruction. And if we reward this it is the end of good people warning to be judges is the end of any concept of the rule of law is the beginning of a process that will tear this country apart. And if I am chairman next year, if we keep the majority and Senator Grassley moves over, and I hope he doesn't 'cause I think he's done a great job. I'm going to remember this. There's the process before Kevin O in the process after Kevin. Oh, if you wanna bet that nominee, you can if you want to delay things for the next election. You will not if you try to destroy somebody. You will not get away with it. And Jeff is leaving. He has wrestled with this. He is trying to be fair. I cannot tell you Jeff what happened thirty five years ago. I can tell you this that the any legal system. This thing would not get out of the batter's box. And that everything I know about Judge Kevin screams that this didn't happen and all the other things. So to my good friend friends on the other side who are struggling I think an FBI investigation. This is going to do nothing snack not anymore than we know. Now, it's gonna just keep it going and going and going to Hebrew six and he walked into the next five come forward. I'm going to vote. Yes. And I'm gonna tell is two daughters that I'm proud of your dad, and I really really believe he's a good man hotel daughter for. I am sorry. You had to go through this to our. We'll take a break. We'll come back more with us in a minute. Now, it's gonna just keep it going and going and going into Hebrew. And he walked into the next five come forward. I'm going to vote. Yes. "Eight hundred nine four one Sean before all this went down. Down with obviously snowflake today. Lindsey Graham, laid out the case in his statement. And I will tell you I've had debates would Lindsey Graham over the years. We've had falling outs over the years. And. He had his finest moment I thought yesterday. And then today followed it up, and I think this is worth playing on. This is what he said before this mess earlier. I know I'm a single white male from South Carolina. And I've told us should shut up. You don't wanna have it with Joe you'd be around for a while. Is this guy is for president? It'd be hard to big it came to Senator Thurmond's funeral and gave a long eulogy. I asked him Joe said that was incredible this kit help you in Delaware. Disliked though guy. Agree with him. And I didn't like some of the things he did in this life. When I was down and out. He was there for me tobacco colleagues on the other side, this will end, and we'll see what we do next. Hope we can muster the ability to move forward. But some observations about where we find ourselves and how we got here. I wrote a book, and I think Senator Blumenthal is the only person I know that actually read it. It was online I ran for president. And I got one percent. So I had my time to be president didn't go very far and I lost. I didn't think Trump would win. I ran out of adjectives to describe about. How about his campaign while you are in and I lost. He's pressed and I'll try to help him where I can say no when I must and the election's over for me. I would like to tell him that you had a choice to make for the supreme court vacancy of Justice Kennedy. I think you did a good job Mr. press for somebody's supposedly crazy. And there's chaos everywhere. He did a good job here. Now, why difference between gore sick and Kennedy misgivings? Cavenaugh is the Kennedy seat get that you're not paying much attention. Gorsuch is a even swap for Scalia. This is has stake stuff. Right. This is the C or the guy in the middle is at risk. Cavenaugh clerked for Justice Kennedy. Would you pick them? No. But she lost the election, and that does have consequences. What I said it about Obama winning a minute, Merrick garland glare dies in the election year the last year of the term, President Obama, the primaries are already underway nine in one hundred years has anybody been nominated on that circumstance. I don't think I did anything unfair garland as to sorta buyer Kagan. I was told on our side you've got to keep them off. The court costs are going to be a pro choice both they hate guides on and on and on. And I tried to go back to what this committee used to do Strom. Thurmond voted for against Berg. You'll never convince me that was because he agreed with our philosophy. I think you saw her a qualified person Fritz Hollings voted for Scalia. The same is true ninety six and ninety seven votes. What's happened most nominee spring court? Never had a hearing. It was always just assumed if they're qualified and they're not hacks that they're going to go forward. Elections do matter when it comes to President Trump elections do matter now about the law about France who've been prosecutors I've been a prosecutor I've been a defense attorney and judge. Every woman who's been victimized needs to be heard count me in a thousand times over count me in for the proposition for every one woman who comes forward only God knows how many women and children go their grave with the abuse. If you don't realize that you just don't know this area of life. But you gotta be heard in the United States. I had a young man accused of sexual assault. When I was in the air force as defense attorney the case eventually fell apart, and he almost killed himself women who've been gang raped and more testify, but they did along with counselors. I set up with them all night, tough stuff emotional who to believe I've been doing this legal stuff most of my life. I've never heard a more compelling defense of one's honor and integrity that idea from Brett Kevin. He looked me in the eye. Everybody in the end he was mad and he should have been mad. You could tell you where he was that what he was doing during high school in a way that just blew me away. Brad Kavanagh and women if you're a gang rapist when you're a sophomore and a junior in high school, you don't let it go. Every woman who actually knows Brett cavenaugh has come forward to say he is not that kind of guy. He has been at the highest level of public service under tremendous scrutiny. Six FBI investigations. And we missed the sophomore junior gang rapist. We didn't miss it much garbage where in the twilight zone, and here's what I would say miss Ford. All I can say about miss Ford. I feel sorry for her. And I do believe something happened to her. And I don't know when and where, but I don't believe it was Brett Cavanaugh, and as a prosecutor, you could get out of the batter's box because in America before you can shoot accused somebody but crime, you have to tell them when it happened, and where it happened, and you have to prove beyond a reasonable doubt. It did happen. The reason this case will never be brought in Maryland or anywhere else. You just can't get there. If you wanted to get a warrant, which is a probable, call standard to search or arrest somebody you gotta prove by probable calls where it happened when it happened. How are you supposed to defend yourself is the burden really own? You. You to prove that you were not at a party thirty five years ago. And they won't tell you where it was when it was. So all I can say is that under any reasonable standard any concept of the rule of law. This would not go forward. There have been five allegations. Here. The fifth allegation was brought to me by Senator. What else who did? Absolutely the right thing. Somebody contacted him in Rhode Island and said a friend of his was on a boat with Mark judge and brat cabinet on they treat her badly. He went down and beat them up. And she won't come forward. I said, well, I'll make sure I'll join with you let the FBI look at it and turned out not to be true. The fourth allegation was an anonymous allegation a letter without a date or return address Santa Cory Gardner, just a few days ago. And he turned it over to the committee and somebody on that side linked it to NBC news. And it made it on the news. The fourth allegation that really bothers me. I don't know what's going on over there. But that's not right. It was somebody over there. Now about miss Ford. I feel really bad that she wanted to remain anonymous and could not the one thing I know for sure is it Diane Feinstein would not do this and did not do this. But I know for sure somebody did it wouldn't chatter from a friend three groups had this letter that was requested to be anonymous Dianne Feinstein and her staff, the congresswoman from California and her staff and the lawyers somebody betrayed her trust. And if you can't figure out why you should be driving to delay. This hearing to set in motion the destruction of this man to keep this seat. Open fast the election that I know beyond any any doubt. What else do I know about fill out of my chair? When dot force said yesterday. I didn't know you would be willing to come to me the Email interactions between this committee and her lawyers. My staff would still welcomed opportunity to speak with dot Ford at anytime. Anyplace convenient to her come to us are we to you? I'm willing to have my staff traveled to dot afford in California or anywhere else to obtain her testimony September the nineteen well that wouldn't fit in the plan when be public, and it would get on with sooner than people wanted. God help us all the new standard for the committee is that there's no. Of anything that you have to prove why somebody would accuse you not just say, I didn't do it. Here's why didn't do it. But you gotta prove the motives of year accuser. God help us all Daven naughty moment tells you what's going to happen. If we keep this going, plenty of time, plenty of opportunities to get to the truth. This has never been about the truth. This has been about delay and destruction. And if we reward this is the end of good people warning to be judges. It is the end of any concept of the rule of law is the beginning of a process that will tear this country apart. And if I am chairman next year, if we keep the majority and Senator Grassley moves over, and I hope he doesn't 'cause I think he's done a great job. I'm going to remember this. There's the process before Kevin in the process after Kevin if you wanna bet that nominee, you can if you're want to delay things for the next election. You will not if you try to destroy somebody. You will not get away with it. And Jeff is leaving. He has wrestled with this. He is trying to be fair. I cannot tell you Jeff what happened thirty five years ago. I can tell you this that through any legal system. This thing would not get out of the batter's box. And that everything know about Judge Kevin how screams that this didn't happen and all the other things. So to my good friend friends on the other side who are struggling I think an FBI investigation. This is going to do nothing. Not any more than we know. Now, it's gonna just keep it going and going and going to break in he walked into the next five come forward. I'm going to vote. Yes. And I'm gonna tell her two daughters that I'm proud of your dad, and I really really believe he's a good, man. Now, no daughter for. I am sorry. You had to go through this to our. We'll take a break. We'll come back more with us in a minute. I want to remind you I have insomnia, and I've got the antidote, and it's a pillow now this pillow works, so well, you're going to sleep better than you ever have fall asleep faster. "I've found Dr testimony to be wholly credible. Not one member of this committee is suggested that she was not and the same cannot be said of judge Cavanaugh. Judge Kavanagh's veracity has been issued every single time is ever testified before the Senate. Whether it's repeatedly telling senators he had no role inventing a working on various controversial. Bush era judicial nominees. Suddenly turned out to be a blatant untruth. Or whether it's testifying in response to more than one hundred different question. From both Republican half a dozen Republican and democratic senators they never see or do you receive obviously stolen materials from democratic senators computers that was another blatant untruth. We found we could not depend on judge cavern to tell the truth under oath. We only learned the truth years later. The only learned the truth of what he. Head said. What he had said untruthfully? Henry reviewed the small White House. Record chairman Grassley was willing to request for this combination time and time again. When confronted with questions about his involvement in Bush era scandals or controversial matters. Judge cabinet misled the Senate. Now, the fact that he's misled the Senate over and over and over again. That does not make him guilty of sexual assault is a seventeen year old Dora's. The fact they minimize the heavy drinking, and as you. Misrepresented the misogyny in his yearbook. But it does go to the heart of judge Kavanagh's truthfulness anytime he's faced with potentially incriminating questions. Yesterday. Judge cavenaugh falsely claimed over and over again. Every other person, Dr Ford place in the house said the assault didn't happen. That's just not true. And we know it's not the only person has claimed this incident didn't happen. Is Brett cabinet? Your memory of it, just as Dr Ford assume they're say given was for them an ordinary night. More than even. Stay. She believed Dr fort, which of course, judge cavenaugh conveniently failed to dodge. Judge Kavanagh's defiant a base it is is vehement attacks against members of this committee in the face of powerful incriminating testimony. Surpassed even that of Clarence Thomas at the time of Anita hill. He tried to portray Dr Ford's allegation as part of a calculated an orchestrated political yet. My years as a prosecutor is how a lot of ties with people try to blame the victim. Not up to their own deeds. He angrily asserted baseless Pyrates. He was all too eager to promote the false Republican talking point to Senator Feinstein was lying in wait with this allegation. He even claimed the allegations were driven by revenge on behalf of the Clintons. Tired to make this stuff up? That amounts to conspiratorial madness. In my time in the Senate. I have never seen such volatility partisanship and lack of judicial temperament from any nominee for any court in any administration is no secret that I have deep concerns about what is Justice cabinet. I would be in for the rights of women for workers per healthcare for unchecked, presidential power and other important issues. I also believe he's unfit to serve on our nation's highest court because of his history of misleading the setup while under oath. But as serious as these concerns are. This is different. Voting to advance and ultimately confirm judge cavern while he's under this dark cloud of suspicion. Well, forever changed the Senate nation's highest Corey. Politicize the US supreme court. Branch of our government should be above politics. And for victims and survivors of sexual violence struggling with whether to come forward. The consequences baby. Even worse. Every one of us who's been a prosecutor as harder sometimes for victims come forward. And are we sending the signal you stay there? Don't come forth. You know, how this committee handles this domination? Reviewers reflection of how seriously. Our society views credible claims of sexual misconduct. During Dr fours tests, more in the national sexual assault hotline. Saw an unprecedented hundred and forty seven percent increase in calls when survivor has taking sexual assault. Seriously. They're empowered to come forward. If they see us callousness sweeping under the rug, I fear. They'll have disastrous consequences if victims think they'll never be believe or not matter even if they are. Then why come forward at all? Carter four deserves to be heard. And that must mean more than just checking a box. Remember, Dr Ford did not spend her entire life preparing for this moment. She is not backed by the most powerful officials in our nation's government. She did not come here with a political agenda. She did not testify with a job promotion on the line. She did not evade our questions, and she did not demean our motives, either Republicans or Democrats. Shit instead plainly with grace times emotionally recounted the trauma that she experienced as a fifteen year old girl. Trauma has been haunting her for the thirty six years since she had nothing to gain. Everything lose I come in for. Listen closely to both her judge cavern. And I believe her. Because I believed Anita hill. I'll be voting on judge cabinet nomination. Is not have the veracity or the temperament for a lifetime appointment highest court and our nation. Such dominate should be confirmed in the face of such serious credible and unresolved and unresolved. Allegations of sexual assault. Senator Graham, thank you. I know I'm a single white male from South Carolina. And I told us should shut up. But I will not shut up if that's okay. Because I got here the same way. Everybody else did the people in South Carolina voted for me. And Senator Scott to be their voice men and women, and I'm going to try to be their voice today. And maybe not just for South Carolina. "When she arrived and Kassebaum Republican, my Jew was just the second woman who got in without filling the seat of someone who had died, and I was ask a lot of times for it. Like being only woman or are you strong enough? I said if I worried about all those kinds of things I'd never get anything done. She was known as an ideological bridge between the parties as someone who sought common ground to solve. Problems. And then in nineteen Eighty-six a Baltimore democrat joined her in the Senate and nobody ever asked if she was strong enough. I came to the Senate everybody wondered what would Barbara mcculskey be like, which she be Matthey Bogatici. Had a reputation for ten years in the house of being a strong advocate for what I believed in. It was just the two of them and ninety eight men Makovsky knew right away that if she was going to succeed she'd have to crack the boys code how to get on that right committee. How to when my way in a seniority system when there was no other democratic woman. Also, what were the formal channels of power in the Senate, but what were the informal channels, Mike, the after hours session, she used to have with Ted Kennedy and Chris Dodd show Kennedy in whenever I'd have a hard day whenever there would be an old guy who thought he was being funny. But it was a joke from Wyche eighteen forty we would go after a restaurant called mcelwain. They would encourage me. They take all he secure, David. Pour me another glass of wine. Felt like I'm willing to like spit in the bucket and go back the next day. And that was the world of the Senate as of the summer of nineteen Ninety-one when Thurgood Marshall retired from the supreme court who too many is just a significant to civil rights history. As Martin Luther King junior any action on the part of any official in Arkansas or any providence. Vitriol for oppose. Certification of the schools in Little Rock. Calculated violation of the law. So this was a big moment. Just like it is now frankly, and what does President Bush do Hugh points? Clarence Thomas, a black conservative who was primarily known for his opposition. To affirmative action that alone was explosive. Mr Chairman, Senator Thurmond members of the committee. My name is Anita f hill, and I'm a professor of law at the university of Oklahoma. Just two days before the Senate was to vote on the nomination, Anita hill story broke she told a horrific account of what it was like to work for Thomas when she served under him in the Reagan administration. Can you tell the committee? What was the most embarrassing of all the incidences that you have alleged? I think that one that was the most embarrassing was his discussion of of pornography involving these women with large brass and engaged in variety of sex with different people are animals that was the thing that embarrass me the most and made me feel the most humiliated. She thought she was coming to a hearing the Republicans on the judiciary committee head organized as if it were trial. He said that. You took it to mean. Judge Thomas wanted to have sex with you. But. In fact, he never did ask you to have sex, correct. Now, he did not ask me to have sex. He did continually pressured me to go out with him continually. And he would not accept my explanation. As one is being being valid. It became a national event. Everybody tuned in to watch fourteen white men some of them still powerful figures in Washington today. Interrogate this black woman on live television. It was very clear that there had to be more women in we needed to be every committee. More women ran for federal office that year than ever before. Four more women came into the Senate, including the first ever black woman guys at the door. Didn't wanna let me in like where are you going? Carol Moseley Braun was actually motivated to run. Even before Anita hill emerged the idea of Clarence Thomas taking over Thurgood Marshall's seat that was enough to move her by itself, and the fact that her democratic Senator Alan Dixon plan to support Thomas's nomination. I was horrified. So she ran against him. And she made the court. They sitter piece of her campaign, but Anita hill actually kind of complicated things because in the states black community..
