"Reed was just days away from being executed when he got a stay from Texas top court, Reid has been on death row for decades for the murder of Stacey stites. He's maintained his innocence through the years, and his case has gained national attention with support from celebrities and lawmakers as diverse as Kim Kardashian and senator Ted Cruz. Reed says a DNA test on the murder weapon, a belt that was used to strangle sites will prove his innocence, but the state of Texas has refused. Now whether he's executed could hinge on a decision by the Supreme Court on a technical issue, whether he filed his appeal to the federal courts too late. Joining me is Bloomberg law reporter Jordan Rubin. Jordan, tell us a little bit about read. Ronnie Reed has been on death row since 1998. He was convicted and sentenced to death for the 1996 murder of Stacey stites and Rita has maintained his innocence throughout and the latest issue that's brought his case to Supreme Court arguments is his attempt to get DNA testing on crime scene evidence, including the belt that strangled sites. This crucial piece of evidence was not tested, the state has reasons that it says it thinks that testing might not show anything, but in any event the state is resisting testing and that's what has led to Rodney Reeves lawsuit to try to force the state to do that testing. And it's the latest in the line of cases where there's a person who's claiming innocence and there's some evidence trending in that direction that has gotten the attention of people beyond just the legal community. Yeah, it's sort of echoes the case against adnan syed. That's gotten so much attention. So this is a federal civil rights claim? That's right. So what happened is this in trying to get DNA testing, Rodney Reed pursued that claim in the state court, but that claim was denied at the trial court level and then up through the state criminal appeals court. And so after that denial, Rodney Reed then filed a federal civil rights claim challenging the denial on the state level, saying that those state processes violated his due process. And so that's the crux of his federal claim. The problem is that Texas is saying that he waited too long to bring the claim. So the question at the Supreme Court is when the statute of limitations starts to run for a federal claim that state DNA testing procedures violated due process. Does it start to run when the state trial court denies testing or does it start to run when the state appeals process has played out? And so it's this very technical sort of question that one might be tempted to get lost in, but it's a crucial question. The answer could depend on whether Rodney Reed and others who are claiming innocence can get DNA testing in these types of cases. Was there any talk at all during the oral arguments about the fact that he claims he's innocent and the DNA test could possibly clear him? It's hard to see why you wouldn't give someone a DNA test. Right. So in terms of kind of the reality of the case, that wasn't the subject of the arguments. And that's often the case at the Supreme Court. Nonetheless, three lawyers certainly didn't mention the innocence aspect during the arguments, but there wasn't really this straight up question posed to Texas of why don't you just do the test that they're really focused more on the technical issue as is often the case at the court. Could you read where the justices were on this issue at all? I definitely saw justice is on both sides of the issue, for example, justice Thomas seems. The most likely to vote with the state is questions of both sides was the same, which was what liberty interest was read even deprived of in the first instance and who deprived him of it, but he was kind of on his own with that. Most of the justices were more so grappling with the crux of the issue that was presented in the case. But I really didn't get a sense that there was a majority coalescing around any particular answer to this question, at least at the argument. So it's another one of these where we're going to have to wait and see. I do think that read has a shot, although you really never know at the court because we're talking about a death row inmate and the court has been very skeptical of claims coming from death row. So

I'm not a libertarian on a lot of issues, but I agree with them on size and scope of government and overreach of the national security apparatus and gun laws. Can you talk about that as we close out our conversation here, senator about how that coalition is going to need to materialize for victory a week from today? Listen, I agree with you that we need a broad coalition when it comes to libertarians. I'm not a full on libertarian. I'm a conservative, but I'm a conservative for libertarian reasons. And I think if you look at my voting record, I'm one of the three most libertarian senators in the Senate. Myself, Rand Paul and Mike Lee are pretty clearly the three most libertarian. Senators, I believe, number one, an individual liberty. I believe in small government. I believe in small businesses, I believe it's low taxes, I believe in low regulations. I believe in government staying the hell out of our lives. That means vigorously protecting free speech. That means stopping censorship of free speech. That means protecting the Second Amendment vigorously. That means protecting against unreasonable searches and seizures. You know, all the liberals cheering the FBI, raiding Donald Trump's home. That was an abuse of power. It's what I talk about in the book justice corrupted is, is the left uses power to target their enemies. I believe in civil liberties. I believe in protecting our rights, government is bad. Why do they want 87,000 new IRS agents to harass and harangue and target and go after you. The left supports government power and my view is we ought to have a coalition of everyone who values liberty standing together. By the way, I agree with you in Arizona. I think Carrie Lake is going to win. I think Blake masters is going to win. I did rallies with both Carrie and Blake and also with Eli crane who's going to get elected to Congress that who's going to be a great new congressman as well. Navy seal, strong lover of liberty. I think we need to be supporting people who know what they believe number one. People who can win number two. But people who will be warriors because I'll tell you Charlie once we win the majority, that's when the fight really starts because you and I both know they're going to be members of Republican leadership who are scared to fight and if we want the majorities to fight, we need to elect warriors to their own shadows. And so talk about the race in Texas though, do you think that there might be a chance that the out of state liberals are going to get a little demoralized because the more they spend in Texas, actually, the margins are increasing. Well, I think Mike Lee's race is critically important. I would encourage folks listening, go to Michael Lee's website and make a contribution because the Democrats are trying to really steal that race by deceiving the voters of Utah. And it is, it is uncomfortably close. I will say more broadly though. I am incredibly optimistic about election day. I think we're going to see a red tsunami. I think we're going to retake both houses. I think we could come out of the house with 30, 40, even 50 seat majority. And I think in the Senate, my number, I think we're going to come come out either with 53 or 54 Republicans in the Senate. And so Charlie, I've spent the last month on a 17 state national bus tour. "Trump. One of the things I talk about in the book justice corrupted is the meeting in the Oval Office on January 5th, 2017. With Barack Obama, Joe Biden, the head of the FBI, the CIA and the DoJ. This is 15 days before Trump would be sworn in as president and in the Oval Office, they agreed together to go after Trump to attack him and for four years of the Trump presidency. These partisans tried to destroy Donald Trump personally and tried to destroy the Trump agenda. And now Charlie under Joe Biden, it is metastasized. It is out in the open. They're not hiding it anymore. They view the machinery of government as the stormtroopers for the DNC and their partisan agenda. That is so well said the book is justice corrupted. I want to encourage our entire audience to pick up a copy of that. Senator, one of the chapters you talk about here is about the IRS coming knocking. You know, there's a lot of vulnerable Democrat senators right now, including Raphael Warnock and Mark Kelly, who run the hills every time you mentioned they voted for 87,000 new IRS agents with now how we see DHS operate with backend access to Facebook. I mean, is it inconceivable that the IRS might one day be able to get back into access to TurboTax or to other information warrantless ability information? That might sound outrageous or outlandish, but I don't trust this government at all. Talk about the expansion of the IRS and how you articulate that in your book justice corrupted. Well, as you noted, the Democrats just rammed through a bill authorizing 87,000 new IRS agents special agents who can carry guns who can come knock down your door and that is designed to target and harass and go after you. And you know, when you talk about the IRS wanting visibility into your financial transactions, remember Bernie Sanders build back better plan that Joe Biden put as his number one priority. Part of that was requiring financial institutions to report every transaction of $600 or more. To the Department of the Treasury. Every single one. That means your rent, unless you've got a really good deal on rent, you're probably paying more than 600 bucks a month for rent. If that's the case, every single financial transaction, maybe your car note, heck, give the Democrats another year or two. It might be filling up a tank of gas. I mean, they wanted that power that came very close to getting it. I believe when we take the majorities and I think we're going to take both the House and the Senate a week from today. When we do that, I think one of the very first priorities needs to be defunding those 87,000 new IRS agents. I think right after that, we need to impeach Alejandro mayorkas, the secretary of Homeland Security. Yes. And right after that, we need to impeach Merrick Garland for politicizing and abusing the Department of Justice and the FBI. Yeah, I think that's so smart. And we've said on the program, I don't think endorsing Joe Biden. I don't think that's a good use of time. Honestly, I think it's fine with political theater. But going after the deep state, that middle band is so important, right? We now know also that the FBI was actively urging big tech to censor the story about Hunter Biden's laptop. And they were doing it that the FBI told big tech that that was Russian disinformation. That was totally false. We now know the story about Hunter Biden's laptop was true. It was accurate and big tech censored it forced the corporate media to censor it. And it was actively at the behest of the FBI. And that's really what the book is all about. It is about how Barack Obama and now Joe Biden have politicized and weaponized the Department of Justice and the Department of Homeland Security and the FBI and the IRS and they've turned them into weapons to target their political enemies and it is a profound threat, not just to the rule of law, but to individual liberty of all of us. And what is so interesting senator about this DHS story is in the leaked documents, they kind of self appointed themselves a role, and I mean, you are one of the more articulate the most articulate person I should say on the idea of separation of powers, but also congressional oversight. And these bureaucracies, the fourth branch of government, they kind of do whatever they want. So senator, I mean, you're on a lot of these committees. You vote on a lot of these bills. Since when did these agencies get permission or inform you that they were going to be involved directly in election meddling of information? I mean, do they just get to chart their own path now? This is outrageous. Well, they haven't. And they largely defy Congress. And if you look at the history of it, if you go back, the book justice corrupted starts with Richard Nixon. And Nixon tried to do this. He tried to use DoJ and the IRS, the FBI to go after his political enemies, by and large the system worked by and large the system resisted being politicized and Nixon resigned in disgrace. So look, here's the big takeaway. We created a vast national security bureaucracy. And they're always going to try to justify their existence. So people like Lindsey Graham and senator blumenthal and senator Murphy that kind of uni party defender defense of the national security state, they're always saying, well, you know, terrorists could be around the corner. The problem is, what happens when you have a supply and demand problem with terrorists? Well, then you have to go find new terrorists. If all of a sudden, America doesn't have as many terrorists as you think we do, and ISIS and Al-Qaeda are not as strong as they used to be, but then you've got to go find new terrorists. And those terrorists just happen to be right wingers. So terrorism has faded in the traditional sense. And thanks to left wing politics, we aren't allowed to care about our border, so they've turned on the easiest target. Imaginable. DHS, by the way, should we focus on the invasion of our country 2 million people coming into America? Not worried about whether or not someone is challenging that we send aid to Ukraine or wondering, hey, are we really systemically racist? Policing free speech, monitoring speech, spying on the public and targeting etern internal American dissidents is the new focus of this regime. So the only fix to this is admitting an acknowledging we made a mistake when we passed the Patriot Act, we made a mistake when we put the DHS into power. "There was a massive story. That quite honestly, we should have covered yesterday. And we're going to lead with it. It is a story that should be dominating the entire news cycle. It's a story that thanks to the intercept, we have learned some incredibly consequential information about the Department of Homeland Security. So let's just kind of first set our terms. What is the Department of Homeland Security? DHS is a branch of government that was founded after 9 11. I believe completely unnecessarily. DHS was duplicative in some ways. TSA is under DHS border patrols under DHS. It was just another branch of government that at first was sold to us as being able to go after the terrorists. But in reality, DHS is actually here to go after us. So all of this new information that we have about Department of Homeland Security again, this should be the number one news story in the country. Not the Pelosi story, not even the polling story. This right here should make the midterms even more important than ever before. So the intercept, which is a rather effective website I have to say. They used a mixture of leaked documents and materials obtained through recent lawsuits found that the Department of Homeland Security is actively engaged in colluding with social media companies to police your speech. So now that the war on terror is over and is basically gone away, DHS doesn't close shop and fire their employees or go focus on something else. No, this is the permanent domestic surveillance industrial complex. You see, DHS has now pivoted to a new self appointed mission. Congress never gave them this mission. We never voted on it. This is the fourth branch of government just gone awry. Their self appointed mission of fighting toxic narratives online, assisted by the FBI. Now, the two have been holding by weekly meetings without any knowledge from Congress or other people, which makes really makes you wonder what is Congress doing all day long with media outlets. Since the 2020 election, that's right. The FBI and the Department of Homeland Security have been actively holding meetings with media companies.

"Here's senator Ted Cruz over the weekend. Madam president, there are a lot of bad things in this bill, but fewer worse than the proposal by Democrats in this bill to double the size of the IRS and create 87,000 new IRS agents. I guarantee you citizens and every one of our states, if you ask them, what do they want? They don't want 87,000 new IRS agents. And they're not being created to audit billionaires or giant corporations. They're being created to audit you. The House ways and means committee, the minorities put out an estimate that under this bill, there will be 1.2 million new audits per year with over 700,000 of those new audits falling on taxpayers making $75,000 or less. I believe personally we should abolish the IRS, but at a minimum we shouldn't make the IRS larger than The Pentagon, the State Department, the FBI, and the border patrol all combined. That's what the Democrats are proposing here. It is a terrible idea. If you don't want 87,000 new IRS agents, vote yes. Good for you. Senator Cruz. Unfortunately, elections have consequences. You've also been endorsed, I think in one of the, one of the cooler endorsement trace Atkins who doesn't get involved politically a lot, but he stepped up. How did you get trace involved? Well, you know, and we also can't leave out senator Ted Cruz. I mean, here at the end, when we felt that the race might be tightening a little bit, he without hesitation jumped in. "To be 97° Right now though just 58 at O'Hare 62 at midway 61 in Juliet the celebrating our 100th year serving Chicago I'm James Sears on Chicago's very own 7 20 WGN Rather than open up the show with a lot of music and everybody cheering Jimmy Kimmel last night to no audience last night started his show this way Hi it's Jimmy and I wanted to speak to you directly without an audience for just a bit before we start the show because here we are again And so then he just reacted very emotionally He always gets emotional especially when it's issues involving children He can be very political but what I thought was just instructive were some of the numbers that he included in his monologue and some of them were these 89% of Americans want background checks before a gun can be purchased which is the just the very least we can do A bipartisan bill passed in the house that's been stalled in the Senate for over a year now They won't pass it because our cowardly leaders just aren't listening to us They're listening to the NRA They're listening to those people who write them checks who keep them in power Because that's the way politics work That's the idea we settle on We tell ourselves but it doesn't have to be that way Not for this You know you can tell things are out of whack when the coach of the Golden State Warriors shows more leadership and passion than almost every Republican in Congress And I say that this tonight with the whole not with an expectation but with the hope that people like Ted Cruz and Greg Abbott and John cornyn people who are elected by Texans Well actually listen to it Instead of going right to gun control laws don't work and we need harm teachers and guards at schools If your solution to children being massacred is armed guards you haven't been paying attention to what's going on There was an armed guard in Buffalo There was an armed guard in Parkland There was an armed guard in ivaldi They had armed guards There were police officers armed on the scene And these murders still happen And gun control laws do work by the way We know this 26 years ago Scotland had a school shooting that killed 16 kids and a teacher And the government responded by enacting gun control legislation and there hasn't been a school shooting in Scotland since then In 1996 in Australia a mass shooting killed 35 people they passed gun legislation They haven't had one since This is the only country where this keeps happening Firearms are now the number one cause of death for American children and teens Number one senator Ted Cruz I will see you stepping up the comfort of people he serves is the NRA Ted is scheduled to speak at an NRA event this weekend And here's the thing I don't believe Ted Cruz doesn't care about children I don't I refuse to believe he's unaffected by this He's a father I bet he went to bed sick to his stomach last night It's easy to call someone a monster but he's not a monster He's a human being And some people might not like hearing me say that but it's true So here's the thing I would like to say to Ted Cruz the human being and governor Abbott and everyone it's okay to admit you made a mistake In fact it's not just okay It's necessary to admit you made a mistake when your mistake is killing the children in your state It takes a big person to do something like that It takes a brave person to do something like that And do I think these men are brave people No I don't I don't But man I would love it if they surprised me He went on for about 5 more minutes citing other numbers giving his opinion There was a Montage of the coverage of the event and some of the things that happened before the event late in his monologue He simply said this This is not a time for moments of silence This is a time to be loud and to stay loud and not stop until we fix this What the fix is is not so easily known but I think we could all agree with what Jimmy is saying there The Dallas TV station that runs his show cut away from the monologue a couple of times last night and the explanation is that their newscast of course went long The system that automates the insertion of the commercials didn't account for that and so while he was speaking there were technical difficulties during the monologue and now they cut away then they come back I think it happened a couple of times He says he doesn't know if that was intentional or not The station has apologized and they said it was an error due to automation and they were not trying to cut away from Jimmy's gun control.

We've seen in the last two months, unprecedented allegations of voter fraud and and and that's produced a deep, deep distrust of our democratic process across the country. I think we in Congress have an obligation to do something about that to take us through this process. Welcome now former Democratic senator from Montana and former U S Ambassador to China Max Baucus. So, Mr Ambassador, Thank you so much for joining us. This is not the first time there's been a challenge like this. But also there's the business of the country that has to get done here. What might this portend for the Senate in its ability to operate? I mean, we just heard a report that now Mike Lee, a conservative publican actually led the defense and the impeachment for President. Trump says he doesn't think this is the way to go. There's divisions even within the more right part of the Republican Party. There is, uh, unfortunately, I think is a deeper Drift in the country. People are falling into their own little silos. They don't really care much about facts, and then it's also reflected in the Senate. It's been it's reflected. I think pretty much nationwide is a big problem. And frankly, I think that it's major. Challenge that the press select Joe Biden must face when he is inaugurated on January 20th how to get bring the country together, really, and the way he's gonna have to do that is to show That he the president and both parties we're gonna have to show for it is they do in fact, listen to they are listening to a lot of people in the hinterland.
