The only action that could possibly justify that is if Donald Trump had an act of dirty bomb in the living room of Mar-a-Lago with an impending intent to try to blow up Miami. Or if Donald Trump was sex trafficking children via the Lolita express to some unknown island in the Caribbean. The idea of going in with armed federal agents, they knew exactly what they were doing though. This for weeks they were methodically planning this. "Your reaction to what we've learned thus far about the raid on Mar-a-Lago. Well, I don't think we know enough for me to have a real competent reaction. I mean, there are the political implications, but even the political implications so far are in reaction to something that we don't know enough about. And so on the one hand, we could in theory find out this was completely justified and makes a lot of sense despite how unusual it is. Or we could find out it doesn't. But I would predict that no matter what we find out, everybody's going to revert to their corner and conclude that they either like what they hear or don't believe what they hear. And I would say, as a matter of the midterm election, again with the going to win the House majority, because it's very least the Democrats are defending a 5 seat majority that's so thin, it's impossible to defend and even though the Senate races have looked tougher for Republicans in the summer insane recently, we've seen this movie before, at least in the 21st century with wave elections where it starts out okay for the party in The White House. Then it looks really, really bad for a long time. Then it looks like weight, maybe it's not so bad. And then it all goes the way it looked like it was going to go, especially when you look at the states where Republicans are on offense or even where they're playing defense. So we need to know more before I can tell you, okay, this is the potential different impact, but I don't think we know enough.

I think a lot of people anticipated quite incorrectly that he would govern somehow from the middle as a moderate and they voted for someone who they regarded as a nice neighborly gentleman. Who they could imagine having launched with and enjoying it. I don't think they had any idea of the extent to which he had bought off on the radical left's policies that he would be content. And in fact, bent on increasing prices, especially for fuel. I don't think they realized the extent to which he would cause problems in the extent to which he would aggressively pursue angles that are destructive. In fact, just listen to how he handled that debate. The first presidential debate in the fall of 2020 when he was asked, would you pack the Supreme Court and he said, well, I can't say yes, because if I do people will attack me. That shows a degree of malice aforethought. That shows that he was thinking about it. He wanted to do it. He just didn't want to admit it. But he kind of admitted it, not all of us realize that's what he was doing. So yeah, I think there's a ton of buyers remorse out there with very good reason. Well, I don't know if you've seen 2000 mules yet, but I mean, I think these are the most basic things that everyone in America ought to be concerned, whether it's even possible that corrupt individuals would try to steal an American election, not from Donald Trump from the American people. It starts there. In other words, if you're dealing with people who want to win at all costs, who don't have any virtue, any principles, all they want to do is win. You have to recognize that in dealing with them. And when you're talking about packing the Supreme Court, it's just one version of the same thing. There are people who simply don't want to let the American people govern themselves. They don't like the decisions the American people have done. And whatever they need to do, some of it is really horrifying and what you talk about in the book saving 9 is a classic example. They are undoing America and folks like you are sounding the alarm. I know we've just got a few minutes left. What else do you say in the book saving 9 that we should touch on today? Well, I talk a little bit about the fact that over time you've seen the Supreme Court demonstrate that it's not infallible. It's made plenty of mistakes. We've seen liberal judicial activism. Roe versus wade is a great example of that. And roe versus wade was very wrong. He also had conservative judicial activism. In chapter three of saving 9, I talk about a case called lochner versus New York, in which 5 conservative justices on the Supreme Court in 1905 invalidated a New York State law imposing minimum wage maximum hour provisions into laws governing employment contracts with bakery employees. They struck that down. That was a good example of conservative activism. They sort of made up a constitutional principle that wasn't really there. And that caused other problems in the court. And by the way, when roe versus wade came along, they were using the same legal doctrine, even though lochner itself had been undone. They used a similar doctrine called substantive due process, which I explained in the book. But the point is this saving 9 is full of lessons that every American should know about, but no Americans, as sexually, are taught in school, not an elementary school or junior high or high school, not in college, not even in most law schools. But they're in there. They're objective facts. And the American people can learn more about our constitution and how we can protect that system. How we can oppose and win in this battle to pack the Supreme Court. So I encourage all of your all of your readers who want to learn more about this country, how it's government works, and how we can save our constitution. They should read saving nights. "The court was old and out of touch. It started getting legislative momentum. Remember that FDR had very substantial majorities in both houses of Congress. And as it was gaining momentum, the Supreme Court started considering another case. Another challenge to another new deal program, legislation creating the national labor relations board. And on April 12th, 1937, the Supreme Court decided a case called NLRB versus Jones and laughlin steel company. In that case, one justice, justice Owen Roberts, switched his vote at the last minute, switched his vote and joined the liberals on the court to create a new majority for a new constitutional doctrine. They effectively amended the constitution without following the constitutional amendment process and had this been a constitutional amendment. It would have been one of the 5 most significant amendments ever. Because it radically transformed the power of the federal government. Overnight, in one fell swoop, it went from being a government with narrow power to broad power. Because they just reinterpreted the commerce clause to mean that Congress and the federal government generally could regulate any activity that affects interstate commerce. From that moment forward, Congress could pass legislation on basically any topic they wanted, as long as they dotted the I's and crossed the T's. And so at that point, the court packing plan was unnecessary. It failed legislatively in part because it succeeded politically within the court. It scared the justices enough that they switched their votes. Owen Roberts flipped the majority and FDR got what he wanted. So the last thing lesson here, Eric, is that, as I explained in saving 9, court packing is dangerous, precisely because it's designed to threaten intimidate harass and denigrate the Supreme Court. And it can have the potential to spark the Supreme Court to decide cases differently in deference to the president. Obviously, it is fundamentally against this idea we call America. We've heard a lot of promises about vaccines the race. To approve proven effective vaccine has taken a toll on public trust especially in the middle of a heated presidential election. Earth shattering and if we had even have a fraction of what comes out of arizona pennsylvania. It's a show changer. So most americans are not tuned into this. They're going about their lives thinking. Well we're under the biden diktat administration and they're not aware that a threat is being pulled. It's kinda like you get a pair tweezers and you see. turning out there paying attention but you have to be talking to them now you can't come a last minute amounts before final action say oh I want your vote I want to talk to you you've got to be engaged in those communities now and I don't care what community you live in it is about economic security for the family good jobs education for their kids access to healthcare Mr Miller no matter what community you're talking do you feel that there has been enough of an effort among Democrats to register and energize and get these voters out because that is one of our ongoing criticisms I'll just have to say if the party apparatus as it were so are you seeing that effort to get people you know registered organized an out well I can see it in the back because that's literally what we have to do so yes I see that organization I see that happen about it now I can't speak for the rest of the country but I definitely know what's happening around we want to talk more about that out risa matter what are you saying there well one of the things we now right every time the election cycle rolls around there's these all these questions about whether nineteen as voter not in what we do now is that once registered Latinos in presidential elections vote at level very close to other groups eighty two eighty three percent of Latinos who are registered to vote the problem is and you were talking about this a little bit there's just not a lot of investment in actually closing registration gaps in our country to make sure that eligible Americans I register to vote and can I can I get you to take a pull up for brief pause here just a brief pause here we're coming right back to you we just need to take a brief pause to say you're listening to live special coverage of the Nevada democratic caucuses from NPR news from KQED news I'm Michelle Wiley well the Nevada caucuses are under way voters here in California have a few more early voting options today for our upcoming primary kick you stick me camp high reports several more early voting centers are now open and Santa Clara at San Matteo and napa counties these places and twelve other counties across the state adopted the voters choice act an optional law passed in twenty sixteen that aims to make it easier for residents to vote one big difference you can vote in person at any vote center in your county residents who live in counties out follow this law can also drop off mail in ballots register to vote or update voter registration at these voting centers even more early voting locations are expected to open up in these fifteen counties next Saturday I'm Tiffany can hi KQED news speaking of elections there's a proposition on the November ballot that's raising the question how can our property tax system be more fair to all Californians that's a question KQDS housing team is asking online in an attempt to create conversation that might lead to some solutions here to explain if Kiki senior editor of housing Erika Aguilar and Erica at this question is being raised because in November at they'll be an initiative to revamp prop thirteen yeah yeah yeah that's right prop thirteen you know is this voter initiative that passed in nineteen seventy eight and it's tight property tax rates to the purchase of the home you know at the time so ultimately what that does is cap revenues for cities local governments and schools but now there's this measure on the November ballot that will ask corporations and businesses to pay property taxes based on the current value of their property but there's you know still a lot of debate over how prop thirteen in general can be changed or more for share and that's the approach that we're taking with this project is to hear what people think about that supposed to go online and tell you what they think would be a fair property tax system but often comment sections just turn into people arguing yeah and you're hoping that this computing system using will help people come to a consensus yeah I hope so what I hope to hear is different ideas about what we can do to make prop thirteen maybe more fair to get past the polarizing debate I think we can all agree that seniors should be put out of their homes if they can't afford to live there because property taxes are just too high right we all can agree that seniors should not be living on the street but how we get there is so different you know the way this computing system works is will look for her likely words were words are matching up for ideas starting to align because what we're looking for is consensus where do we align on such a polarizing debate this is that we can come together and start having a conversation about what we agree on more than what we don't agree on when We can do a bipartisan way on healthcare, and I said by partisan, and I meant it. I think people there's despite our disagreements on on some of the repeal debates. I think there's a lot we can do together to get the cost of healthcare down to deal with these individual problems in the system instead of fighting about healthcare, we should be wanting to expand it and bring costs down. So it's just a short list. That's pretty it's pretty impressive list. I think it's why list that most people would actually agree with. I know you have to jump Senator Casey. Although I don't think the conservative movement is is dead and Wisconsin, not by longshot. You you still had a great year in Wisconsin. The Blue Wave that everyone was predicting didn't exactly sweep over the state that you did have some problems. But the first thing I want to talk about is the Joseph project, and it's for something that you have been involved with for how long sir it's we're going on three years, but it really came about yet. I've been in manufacturing for thirty years, and it's been a challenge hiring people into manufacturing environment. You tell all. You have to get a four year degree kind of implies that you. You know fact, you work or going to the trades is is sort of a second class status thing. Nothing could be further from the truth. But the bottom line in Wisconsin is a big manufacturing state and since I've become centers. I travel over the state there's not one manufacturing plant that I visited that can hire enough people. And so you realize there's all this opportunity all around the state, and yet we have these pockets of of high unemployment in places like Madison and Milwaukee. But my guest today really is my champion on criminal Justice reform in the United States Senate when I was a very new Senator about five years ago, I came to the Senate to work on criminal Justice reform. It was one of the things that drove me to want to try to a run for the Senate in the first place and the guy who when I landed on the Senate floor and the democratic caucus who kind of took the under his arm would already had the seminal piece of legislation. Do sentencing reform is a man named dick Durbin, the Senator from Illinois. And I have him is my guest today.
