"News talk eleven ten ninety nine three WBZ. Welcome back to the Pat mccrory show on this Tuesday morning. Recent article in the Raleigh, news and observer. From Colin Campbell. The editor of the insiders state government news service. Title. The article governor Cooper should provide information on the pipeline deal goes on to say Republican legislatures have about sixteen questions for governor ROY Cooper's administration, and he's refusing to answer Cooper and his department of environmental quality. Skipped a recent legislative committee meeting on the state's fifty eight million dollar agreement with the developers of the Atlantic coast. Pipeline lawmakers want to know more details about how the agreement came together. And while the questions are obviously politically motivated, the governor's administration needs to be transparent and provide answers again this from the Raleigh, news and observer Colin Campbell writing that and on the Patrick Henry show. We have a member a member of your cabinet when you were governor of this state, Don Vandenberg is with us. He served as secretary of North Carolina's department of environmental quality now. Good morning, sir. Good morning. Appreciate you being here. The governor is beside me as always. And this is a story that the pipeline story one that we discussed a lot the first half of the year on this show and the chatter statewide seems to have died down a bit. Do you agree with that? Had died down. Although throughout that, period. I think there are still questions that were being asked. By the general assembly, and they have been stonewalled repeatedly. And I think ultimately Palmas Senator Paul Newton had had enough. And that's when they ask for subcommittee to be to be in Scots. And and now the recent meeting they decided to hire a private well a special investigator. Now, this has surely go with Paul Newton. Paul Newton Senator for Mecklenburg county state Senator from Mecklenburg county, former Duke power executive I knew Paul Newton both as governor. And in my Duke power days, and he would know Duke Energy extremely well. But the the question is was fifty seven million dollar pipeline, extortion, a payoff or was it just nothing as the Democratic Party? And the ROY Cooper administration says and from all indications there are indications that maybe the Cooper administration demanded some. Sort of payment in order to get approval of the permits for this pipeline. What are you hearing in your own pipeline of information being inside Raleigh? Well, you know, the first thing is that the memorandum of understanding of the agreement is unconscionable on its face. However, it got developed, you know, it basically says that if permits that the money will go to the governor. And remember the governor is in charge. You know, the governor's in charge of the agency issuing the permit. So the MO says fifty eight million dollars as governor if my division my department issues the permits or somehow rescinded or future permits are not granted that I have to give the money back. And so that's uncomfortable the pressure that puts on the department of environmental quality is just untenable. It sounds like pay to play. It sounds like pay to play. So then the next on the face of it. It's unconscionable. The next question is, well, wait a minute. Why would do enter into something like this? You know, that that is not the kind of thing they're going to do presumably, and I. Think that you're right. I think the what's the what Senator Newton, and the others are afraid of is that somehow they were coerced into into signing the agreement, and that's where you get into the legality question. Finally, the Raleigh news observer and McClatchy newspapers except here in Charlotte and Durham and Winston wherever else they own all the newspapers now, North Carolina. They have been silent on this issue for a long time until Colin Campbell whose well-known reporter inside reporter. In raleigh's, finally, saying, well, I'm not questioning whether this extortion or not I am questioning how silent the administration is in providing the legislature. And I assume some members of media this information about one of the meetings held at what was said in the meetings. How is this fifty seven million dollars? That's a doll money. Can you imagine? If you would even ask for ten dollars from Duke Energy for something you'd be in jail. Sale right now. Don. Well, absolutely. And and and the the reporting has been has been nonexistent as you said and even Colin Campbell. You know, he does I think what they're doing is. They're realizing that this is really a ridiculous. And and there were differences there down. There was another agreement up in Virginia. Paul moody made it clear distinctions their statutory structure is different than North Carolina. The money didn't go to the governor. The money was going directly to mitigation groups, not, you know, a charity groups so there were there were huge differences between those agreements. I think that you know, Senator Newton knows this industry as you said, he's a he's a he's got a lot of experience. I don't think he would be asking for a special investigator unless there's something that that that needs to be answered and governor this this could be serious. This is a you know what they're talking about. Here is a violation of federal hob back. So I I would not like to be on the business end of this investigation. So the business people if they're concerned about the Hobbs act and federal laws being broken here in North Carolina. I guess they're only defense then would be to say we're forced to do it by the by the administration. Correct. Correct. And and the, and that's what the object is to act prohibits a an official from using their position for some kind of some kind of action some kind of game and the the fifty eight million dollars seven million dollars was met for a lot of. Plus type activities like economic development. They had talked about hookups to the pipeline. But there's money available under North Carolina's programs and gagged department and elsewhere for that. Are they talked about mitigation already due could already pay eleven million dollars in mitigation. So it it seems a little bit Don if you had done this under my you would have been fired and then investigated, so you and I had to fire me while I was in jail. Don van devora? Have you back? Don.
