And now, as Republican lawmakers from Michigan visit the White House and President Trump's attempts to overthrow the legitimate results of the election dragon, the Trump campaign's focus appears trained on Michigan, which is why we wanted to invite Michigan's Democratic secretary of state on to the program. Jocelyn Benson is in charge of the election in Michigan. Welcome. Good evening. Thanks for having me you have had quite a week. Let's let's start with this business in Wayne County, which is home to Detroit, of course to officials saying they would not certify. Then they said they would not. They want to take it back. Where does this stand? Well, First, it's clear that the voters of Wayne County in Michigan have spoken. They've made a choice. There's no legal or factual basis to question that choice. And the Wayne County Board of Canvassers did in an open meeting as an official process, making official vote to can approve the and certify the results of the election in Wayne County justice every county in the state has done on campus is required by law to certify results. And then convincing state lawmakers to appoint electors who would overturn the will of Michigan voters. Is that a correct summary and if so, would that be legal? But know that it is potentially a path that I imagine people may imagine in their heads stick but there, But there's not something there's nothing in the law that or nothing, actually, that's occurred yet that would indicate that anyone is going down that path, and that's what I think it's important to focus on. Indeed, every one of Michigan's 83 counties have certified the election, Republican and Democratic clerks have confirmed That there's no evidence of widespread irregularities, and the board has previously started fight elections when there were more clerical mistakes and narrower margins of victory. Then there is this time around, and so it really being agreed this departure from their legal responsibility and requirements for them to do anything other than certified the election on Monday, and May I ask you Have you personally seen any evidence is the person in charge of the election message? Men? Michigan have you seen any evidence of widespread fraud of wrongdoing of rigging the vote? No, not at all. And not only that This has been one of the more scrutinized elections in modern history for our state. So if there was anything to discover or find, we certainly would have found it at this point, So there is no reason that you can point to that Biden winning Michigan by more than 150,000 votes that that would not stand. So you had Michigan Democratic congresswoman Debbie Dingell making that point earlier today, she said, This goes beyond partisan politics. It's an attempt to subvert our democracy and undermine the will of Michigan voters legality aside even if the president Did manage to somehow change the result of what happens in Michigan. That still wouldn't be enough to change the outcome of the election. It wouldn't get him 2 to 70 electoral votes. Is he planning to do this in other states? Do we know that's the concern here to your right? That's where we saw all the other things and p p and a lot of Spending to help out this economy. Since then the rate for white man has dropped down now to five point eight percent. And so you can. Look at these policymakers all while things are looking good but if you look at it for other groups so for example black men are at eleven point. Five percent so black men had a similar unemployment rate that whiteman had an april. And then you also even look at what's happening with women women last month. Eight hundred sixty five thousand dropped out of the labor force that they're not even counted in unemployment and the only got half that back. But if you look only at white men with five point eight percent on perpetrate then you can say oh we only skinny bill but white men are not the economy everybody's economy and we have to focus on that. Let me ask you one more thing and And i guess it it makes sense given the state of play right now but you wrote the other day As this pandemic has hit home. Lawmakers cannot be counted on to respond to the magnitude of this crisis or any future economic crisis that is fairly bleak that we can't count on on washington to fix this economy when it so desperately needed. Man arrested after 'erratic behavior' on American Airlines flight to Philadelphia

Back to the elections office. People are suggesting that you've got to get your absentee ballot in a week, if not two weeks before an election just to make sure it shows up at the ballot box. But now the Trump campaign is suing Nevada, which just voted to hold their November election entirely by mail over that decision, For some reason, he thinks that the Florida system is better than the Nevada system. Despite the fact that the vast majority of Nevada voters already vote by mail, and it works just fine. The notion of sort of voter fraud in male is Fanciful at best and outright lie at worst of the number of voter fraud cases that have cropped up across the country, and there have only been a few dozen in the last decade or so. that yesterday yeah that's it and then I would see you as someone who doesn't have a backyard keep your windows open get fresh air yeah much as you can even if it makes your apartment a little chilly right now put on extra layers put on those socks but get fresh air and then you know in the moments when you can sneak outside go for a walk through what you need to try to do it every little bit feels like it makes a difference and the same sort of physical activity like I'm planking in the middle of my living room and doing wall sits and like trying to find ways to stay somewhere active because like we were never designed to set sixteen eighteen hours a day yeah yeah no it's it's true you know will willing to a couple of articles with different resources and and tips for working from home what I would say is for me trying to keep some little tiny routine things like even and that's very different from like needing things to be orderly those are two different things and I wanna make that clear because I think the most important message is just taking the pressure off he may start to hear Rosie makes sounds right now because by me hold up but just like take pressure off for to look any certain way other than what is manageable for you at this point but certainly like tiny things like for me if I know that like when I went to the store I was able to get coffee and I got it because I know that for me just making that Cup of coffee makes me feel like okay there's some routine in my day I have a friend who is working from home and she's just trying to close her laptop to eat lunch even if that's five minutes it won't be longer to give that a try great yeah like do things like take a real lunch if you can take regular screen breaks even if you have to set an alarm on your phone to go okay chest and you know fifty five on the hour if I can I'm gonna just take a screen break setting something like a bad time alarm which if you have kids that piece of advice may not be helpful but you know trying to set yourself up for success like I know for me even before I go to bed now some nights I'm just like collapsing into bed whatever right I don't get this right every time but sometimes like if I can clean my work space so that when I wake up in the morning it's in some semblance of order my favorite tip right now if anyone has zoom if they're doing yeah call specifically in zoom platform yes you can go into your settings and there is a check box that applies basically a it's a beauty filter it's like an Instagram filter so you can check and then instead of you having to put on make up I'm not joking I've done a I will do you putting on make up technology applies it for you you're welcome that is a huge the hero whoever whoever designed that you know I think that yeah the point is do what works for you yeah for me I realize that I did want to start putting jeans and a broad line just because it was like helping my emotional state to do but for you you may be like oh I'm going full like comfy it all right here I mean right now right now that's where I am so as much as it's important to figure out how to work from home I also want to talk about what to do when you're not working because this is the one yes I do know this is the hardest thing for people who are from home period is like there are no boundaries in your day or there can I feel like there are no boundaries right and I think in the middle of this right now we're even more prone to that because certainly when I'm working I'm not thinking about this and that so I don't want this to suddenly become the thing that you're working all the time to avoid scrolling Twitter yeah so my favorite thing to do in the last few days is face time at least one person and I've been doing lots of people every single day I need to talk to a human who is not my husband or my daughter everyday yeah and in particular doing it like group happy hour yes with some of the women in my professional network where we all just get on and we're drinking or drink of choice which could be water and I'm just checking in you know each other and keeping those social connections strong even when we're having to keep our physical connections quite distant yes yes such an important point you know connecting with others is just it's so ascential for mental health and knowing that even if you are isolated which so many of us are you're not alone and you know it's not easy to reach out for everybody like it's not on both sides of that it can be difficult to reach out to offer help to know what to say that's even going to be helpful and it can be difficult to ask for help and what sort of help me with that is to just take a pause and go like what would be helpful if someone could offer it to me right now or why it might bring me comfort and how can I kind of pass it on to somebody else and I think I've just been so grateful for even just a little quick emoji taxed or a hello from people that I haven't heard from for quite some time and then other friends have gotten more creative like I have set up facetime drink dates and a friend invited me to escape book club a friend of mine last night just did her own Instagram life of I just have like a coffee throat of reading out of her diary and like just honestly being in my kitchen by myself at ten o'clock at night and listening to any like read about her hopes and dreams in her twenties just gave me a lot of comfort.

Uh up at mcconnell said that the twenty thirteen rules change led to a quote political avalanche that led to the confirmations of justices gorsuch and cavanaugh the highest number of federal judicial appointments of any presidencies first term. "We've been talking with ross baker distinguished professor asser of politics at rutgers university joining us now from henderson nevada is former democratic senator majority leader harry reid welcome to on point senator very much so you recently wrote a new york times op-ed on the subject of the filibuster and in it you say that while the senate is meant to be the slower lower more deliberate body in congress. You add quote what is happening. Today is a far cry from what the framers intended. What do you mean by that. Well first of all let me compliment dr baker. He is an academic who spent much of his life trying to understand the congress kind of any knowledge that have great respect for him. However i mean that'd be an expert in all areas of government but i know a lot about the senate and i want the listeners to understand this. When lyndon johnson was the majority leader he was majority for six years uh-huh. I wasn't majority leader for about twice that and <hes> during the time that he was majority leader. He had one filibuster overcome. Maybe maybe to <hes> excuse me so during my six here says majority leader i had to overcome more than hundred so much as time went on each year was worse and lotion whoops. No one knows for sure. I guess you could figure it out but it's not easy i had overcome hundreds and hundreds of filibusters so i want to talk about the reason i moved for little change of course it wasn't the first time rules have been changed but obama was elected president. He was a very popular popular president. Just been elected your things he wanted to do and i was the majority leader the job quarterbacks stuff through the congress with help of pelosi in the house and here's where i where i found myself here's where the country was they. They the republicans even filibuster the secretary of defense we we couldn't fill cabinet officers we couldn't we couldn't confirm subcabinet officers the d._c. Circuit the second most important court and the tar country. We have four or five vacancies there. They wouldn't let us film. They would come to the floor and say well. They don't have enough to do anyway. It's a very important court. We had over one hundred judges as we couldn't confirm the national labor relations board they couldn't attack organized labor head on the republicans so what they did they made it so we couldn't get had a corner on the national labor relations board because they wouldn't confirm any so i came to the conclusion that if obama's alba's presidency was going to be meaningless i wasn't part of that so i work with my democratic senators. I said i'm going to make a move to change the rules and the rule change was so very important we confirmed over one hundred judges. We filled the d._c. Circuit we get we got all the cabinet and sub cabinet officers field it was something was so say the national labor relations board were able as a result of that to do obamacare dodd frank wall street legislation that is still being and many many other things we believe that as a result of that we were able to pass a stimulus bill that created for the first time and sentenced renewable energy weird weird solar geothermal..

I'm David Chaldean the CNN political director, and this is the daily DC. Thanks so much for listening today on the podcast, the narrowing democratic path to a Senate majority. It has always been a massive uphill battle for Democrats to win a majority of the United States Senate this cycle. This is one of the most advantageous Senate maps. I recall seeing in my career. So much of the battle is taking place on Republican turf where Democrats are holding seats that just would be unimaginable to have them hang onto if the political environment overall wasn't as advantageous Democrats as it appears. But even with that advantage in the overall political environment, a lot of these states are deep red that we've talked about, but even where Democrats. It's are playing offense. We're talking pretty red territory, so not just playing defense in North Dakota and Montana and West Virginia, and Missouri, and Indiana and in Florida. But we're, they're playing offense in places like Tennessee or Texas, which granted they're not really investing overall in Texas. It's more just the Aurore fundraising juggernaut phenomenon that is happening there on the ground and then in much more battleground, e type states, but one that Trump won Zona one that Clinton one, Nevada, the latest round of polling shows us. Let's start with Texas the longest of long shots of flipping a red Senate seat, blue Quinnipiac university out with a poll this morning, showing a nine point deficit for a Rourke versus cruise. The New York Times Santa poll showing something similar that Quinnipiac poll is identical to the gap that existed last month in September when they pulled and cruise was ahead by nine. This is. Looking increasingly like it is out of reach for Aurora. Now that being said, you know, money, crowd size, energy, all that liberal resistance energy that is poured in hopes and dreams into a rook. I don't want to discount that entirely that there could be some big wave that that takes Rourke to the United States Senate, but it just looks like that is not really in the cards by the polling. What we're beginning to see in this post cavenaugh environment since the testimony of cavenaugh Blasi Ford, two weeks ago now and the extra one week FBI investigation and the ultimate confirmation of cavenaugh up until this week on Monday night, the president apologizing to cavenaugh on behalf of the nation and making this a political issue that he thinks works for him. You know, among his Republican troops, we are seeing some polling coming out of these states where the Democrats are trying to make an offensive charge and flip states that are currently. Held by Republicans that do not have great times for the Democrats, dean Heller in Nevada Republican, incumbent Senator the only one in a state, Hillary Clinton one that's up for reelection this year is obviously in a margin of error race. We pulled there about a month ago. It CNN and we had Rosen up four this week NBC marriage to showing Heller up to the New York Times. CNN upshot poll showing Heller up to so Heller in the latest round of polling comes out on top. It's still clearly a margin of error, race and a real toss up. But the fact that Heller is even in the game and edging ahead in this most recent polling. You know, this is no certain pickup for the Democrats. Many people thought it was going to be the Democrats best opportunity for a pickup and eight is no certain pickup for them in Arizona. Most of the polling post Labor Day has been showing cinema with an edge over MC Sally, we will see if that holds as we await more reportable polling out of Arizona that meets CNN standards. But we'll see if we're seeing any of this post cavenaugh affect taking place there. We're certainly seeing it in Tennessee where again, we have seen some polling come out of Tennessee in the post cavenaugh environment that shows Marsha Blackburn edging ahead of Phil Bredesen's prior to the whole cavenaugh moment. Bredesen's had been edging ahead of Blackburn in most polls. All that is to say is if indeed the Democrats are going to lose North Dakota with Heidi Heitkamp, which those poll numbers of look pretty grim for her. Then they're looking for three pickup opportunities. Assuming that's the only one of the seats that they currently hold that they lose. Then they're looking for three pickup opportunities. If you're writing Texas off the map, which seems like most people can do with some confidence at the moment you're looking at Tennessee Zona in Nevada, and I just said that Tennessee and Nevada. Had polls post Cavanaugh, the show the Republican, whether the incumbent dean Heller or seeking to succeed Bob corker Marsh, Blackburn edging ahead of the democrat, if there's no way for the Democrats to win control of the United States Senate, if all they do is pick up the Arizona Senate seat, picking up one is not enough. They need a net gain of two. And that is to say nothing of the battle that Claire mccaskill finds herself in Missouri defending her seat, a margin of error, true tossup, race or Joe Donnelly in Indiana. These are some pretty red states where the democratic incumbent is significantly embattled and then you've got the politics of hurricane Michael in Florida, where Bill Nelson in the Senate race there, the democratic incumbent had been edging ahead of Rick Scott, the governor in several polls. But you had the post cavenaugh moment that we're seeing play out in some other states that may be energizing. The Republican base. Florida. We await more polling there and you just have Rick Scott, having a huge opportunity here to show management skills on being on top of this hurricane sort of plays into his wheelhouse after eight years as governor where he is had to manage his state through other hurricanes. He sort of seems in control and command. Now, there are many more layers to this hurricane story to play out, and we'll see what the extent of the damage is. And if that harms Rick, Scott's political standing at all. But at the moment he's dominating the airwaves in a very significant way doing his day job as he should as any governor would. I'm not suggesting there's anything untoward about it it it's he's doing his day job in his day. Job is allowing him to be in front of Floridians hour after hour in a commanding presence, managing crisis. So that may not bode well politically for Bill Nelson. Again, we'll have to await around a Florida polls. Once people in the panhandle star. Getting back on their feet and begin the rebuilding process after all the devastation that Michael caused. Now, at the start of this cycle, it looked like the idea that we would even be talking about a control of the United States Senate battle that that the Senate was in playing just seemed absurd on the facts on its face of where things stood. And then as the cycle progressed and the democratic energy enthusiasm started getting very heated. We got into the summer and post Labor Day and it looked like wait, it's still a long shot, but the Senate may be in play here. There is a way for Democrats to kinda shoot the moon, maybe get the majority. And now in the post Cavanaugh world, the polling that we're seeing coming out this week suggests wait, no, perhaps it is such a long shot that it's not even truly in play now. I don't think we can take it off the table entirely in huge wave years. We've seen these things happen where one chamber falls on the other collapses with it kind of thing. Now, again, the terrain and the battleground map of the Senate this year makes that extremely unlikely or at least there's so much more fortification for Republicans to withstand that kind of big national wave simply because of the geography of where the battle is. So I wouldn't rule it out entirely. I wouldn't just ignore the Senate and stop paying attention to it. But these polls this week, I think we have to watch over the next couple of weeks if indeed that supercharge democratic enthusiasm is really taking off everywhere else. Perhaps we'll start to see Tennessee Nevada, Arizona really consistently looked like the Democrats may flip three seats or so. But at this moment in time, this snapshot just, you know, three and a half weeks before election day suggests that the idea of the Democrats can win.
