"This is very clear. Even when we go back to that two thousand two party where Donald Trump and Epstein were having a party by themselves with those calendar girls the guy that was bringing the calendar girls down and I put that in quotation marks Said said to trump warming warned him of his reputation with underage girls said he wanted no part of it trump himself in two thousand and two told New Yorker magazine that Epstein Light Young Girls everybody he knew this accosted by two thousand seven had thirty young minors coming forward saying that they had been raped or sexually abused or sexually harassed by Jeffrey Epstein and he still put forward a deal that would chill Epstein forever from prosecution. I don't think you can defend that the press conference and he tried yesterday right that was secretary Costa's best defense that was the best performance he could possibly give and it wasn't very convincing for all the reasons we've just laid out president trump up as we know has no particular affection for Alexander costs as not a loyalist not a guy who's been by his side for a long time. I think president trump find him disposable. He will dispose of them pretty quickly and frankly as we all know anybody WHO's not inside. The family family at this point is disposable so I wouldn't expect a cost to last if this continues to heat up I wanted to ask Elliott just a pullback the aperture a little bit here and look at the big picture of what's going on giving your experience as a prosecutor getting everything you know about the legal L. System and some of the pressures that might be put on from the outside by powerful people. What do you think happened here? Why would Alexander Kosta Guy who had a good record previous to this was a he's a well pedigree attorney and everything else? Why would he enter into this non-prosecution agreement? Why would he ignore a fifty three page indictment and more than thirty victims in this case? What do you see going on here? Elliott look we all read the Miami Herald piece that laid this out beautifully that said that you had had an incredibly influential defendant with incredibly high powered attorneys who was able to beat a case. That's what it came down to look there were Joseph dozens and dozens of victims here and if they wanted to bring a case they could've figured out a way to make it and now as we know everything that's charged in new that was charged in New York earlier. This week could have been charged back then because it was all largely the same conduct and there would have been a nexus between Florida and New York if they just had taken the time look for it or been able to been able to find it and so no it's a wealthy defendant with a lot of money that might have caused a lot of heartburn to a state prosecutor took department. You'll federal prosecutor's office down there and I think they might have just gotten what does that mean to cause heartburn other words if your job is to protect the victims and to prosecute a case what is money due to a prosecutor sure so for instance they could have embarrassed the victims they could have embarrassed the prosecute. This happens all the time that's people lodge their defenses and they're entitled to do so but when you've got a lot of high-powered attorneys and a lot of money you can cause a higher profile problem for a federal prosecutors and I think they might have just gotten stared and again. Julie Brown's Miami Herald piece really lays this out talking talking about and frankly the interplay between how the prosecutors and the defense attorneys were talking to each other. There's a quote from one of the articles that one of the prosecute one of the line prosecutors was storing the federal code for misdemeanors. She could charge because she wanted to go away okay and didn't want to charge him with a felony. They were just trying to avoid it appears that they were just trying to avoid publicity. They were trying to avoid drama for lack of a better term for the prosecutor's office but you're exactly right Willie. Your job is to protect the the public and again.

"Let's just make this go away. I WANNA play this clip. Senate Minority Leader Chuck Schumer is one of several lawmakers pressuring Labor Secretary Alexander Acosta to step down to leave his post because of his handling of the Epstein case. I am calling on Secretary Acosta to resign. It is now impossible for anyone to have confidence in secretary Costa's ability to lead the Department of Labor L. E. Hoenig Epstein will not get off so easy this time what could be his sentence if convicted he's he's looking at a at least a decade behind bars. I think conservatively if you if you sort of run through the federal sentencing calculation which I won't do but he's got an interesting position to make Epstein. He's really got three choices one. He can go to trial but the vast majority of federal defendants get convicted at trial looking looking at the indictment that came out it looks to me like a fairly strong indictment I and if he goes to trial and gets convicted he won't get out from jail. Probably in his remaining lifetime number two is he can try to plead guilty without cooperating but if I'm back in in my old seat in the southern urban district I'm not willing to give this guy any kind of break. I'm not even thinking about anything below. The double digits at least on a plea deal and thirty can try to cooperate now. That's where things get interesting if he tried to cooperate because if you cooperate as the federal defendant in the Southern District of New York you have to give up everything you know about yourself and everybody else name names now as he willing to do that if he does. That's his best chance by far of getting a lower sentence but be is the seventh district interested in cooperating. I've cooperated some really bad guys cooperated murderers I've done trials based on cooperators were murders but but boy a serial child Molester and child sex trafficker is a different story. I I'd have second and third and fourth thoughts about cooperating him. If I was there let me get a compelled college. Oh yes Julie please. I just want to interject on that on an important point. The unit that is handling this case is the public corruption unit on this which is really raised a lot of eyebrows on here and what what could could be happening and I certainly am not on the inside but but knowing the case and how it worked out in the way that Epstein was pressuring these prosecutors in fact he hired one of them to work for him and my understanding is that he hired ah he dangled a lot of things before these prosecutors so and that combined with the fact that you know that that other woman came out this morning on the today show more victims are going to be coming forward. There's going to be an awful whole lot of pressure to figure out that whether any of these prosecutors had any kind of quid pro quo involved in going along with disagreement. I'm not saying that there was but there was some very there was a number of complaints filed against these prosecutors during the course of this case. I WANNA get a listener in here. Noreen from Newton Massachusetts Hi Noreen if you could be brief welcome to the program. Oh thank you hi. I just wanted to say that I see a parallel here between these child victims and professor Blah's before it and how her case was dismissed and how the senators did really not know the brain science and what happens when children are abused especially and why they don't report because this is the kind of treatment treatment they get. They're not really protected or can't be assured of protection and the Criminal Justice System Noreen. Thank you very much <hes> Julie Brown..

"Your computer and right away to your friends and say how do you spell cliven. It's K. L. A. V. A. N. so just like I said the the Democrats immediately moved to make this story about Alex Acosta Alex cost is the Labor Secretary. He was as a U._S.. Attorney <hes> over a decade ago two thousand eight. I believe it was when a deal was made to bury this Epstein case look. It looks like a bad deal. It was a secret deal it meant that he only got to spent thirteen months in prison and jail during that time he was allowed to work <hes> and and so here's Chuck Schumer reliably racing to the scene to make sure that this thing is somehow about donald trump. It was not just that constant failed to get it right in in two thousand eight. The evidence suggests he didn't care to accordingly. I'm asking three things I I am calling on Secretary Acosta Kosta to resign it is now impossible for anyone to have confidence in secretary Costa's ability to leave the Department of Labor if he refuses to resign president trump should fire him instead of prosecuting a Predator and serial sex trafficker of children. Kosta chose to let him off easy. This is not acceptable. We cannot Hannah have as one of the leading appointed officials in America someone who has done this plain and simple the president needs to answer for his statements. He has made about his relationship with Mr Epstein in two thousand two. He said he'd known Epstein for fifteen years and he was quote. A terrific guy who enjoyed women quote on the younger side Unquote Epstein was also reportedly irregular at the Mar a Lago Club for years. The president needs to answer for this and I don't recall is not an acceptable answer in this case particularly since president trump appointed Mr Stir Kosta to such a powerful position now. Let me tell you why Chuck Schumer's Scumbag for doing this okay because this is. This is a widespread practice again. I'm telling you is happening out here in Hollywood is I speak. I'm sure it happens in DC. I'm sure this guy has done at all. Over the place the city big story it is not just an opportunity to for Chuck Schumer to stand on the abused bodies of young people in order to get his political will done and I'm happy to say the Wall Street Journal which has far is not that attached to Donald Trump and has far more reporting power than I have <hes> a confirms my instinct on this Kosta deal. It says they have a piece in the on the op-ed page today on the editorial page. The innuendo here is that Mister Acosta went easy on a sexual Predator as a favor to the masters of the universe were known to socialize with Mr Epstein including Donald Trump and Bill Clinton who you notice was not mentioned there at all as well as his high powered lawyer Alan Dershowitz and Ken Starr so Democrats are now demanding. Mr Costa resigned his cabinet post but they go on to say there is nothing in the Epstein indictment of the Epstein indictment by a cost to indicate that Mr cost abused his power or violated. His Oath is U._S.. Attorney I was talking about this yesterday but this is their reporting confirming what I said by all publicly available evidence. Mr Kosta acted honourably and drove a tougher deal with Mr Epstein Than State Prosecutors Tsukuda all democrats and some lower level U._S.. Prosecutors sought the non-prosecution agreement required Mr Epstein to cop the two state felonies that lead to a thirteen month jail sentence register for life is a sex offender and pay restitution to the victims as well as their attorney fees that that was the big one <hes> that Acosta was trying to get in there he was trying to make sure in spite of the malfeasance of the state <hes> prosecutors and the lower down federal prosecutors he was trying to make sure that Epstein the victims could go after <hes> Epstein <hes> according according to documents unsealed in a related federal case low level federal prosecutors initially sought to have Mr Epstein plead guilty to a misdemeanor but Mr Cost of pushback against Mr Epstein Lawyers U._S. attorneys have been negotiating with defense counsel at for some sometime complained to me regarding the tactics used by the defense team..

"He's kept a pretty low profile <hes> as <hes> as secretary of Labor under <hes> under under president trump <hes> and it's not like this wasn't known he's been asked about this over the years even in his confirmation hearings about the deal with Epstein but <hes> as the entirety of the alleged crimes committed by Epstein of come to light as the women <hes> now women they were girls at the time as you mentioned Maryalice I've come forward through the terrific work of the Miami Herald and other news organizations to to to surface these stories. It's put a lot of pressure on a cost a lot of calls for him to resign <hes> again as as the architect act of a plea deal that seemed to very much favor a a man who according to these allegations was terrible terrible sex criminal and look I was struck by Secretary Costa's statements over twitter in the last few days pretty unflinchingly stood by his actions and decisions ten years ago in that controversial plea deal saying that the evidence available they got a deal that was decent. He had to go to jail yet to register as a sex offender. <hes> ah they put the world on notice he was a sexual predator. That's from a Costa's tweet and then he went on to say that he thought the crimes are horrific and he's glad that New York prosecutors are moving forward and he's glad that they seem to have new evidence what he didn't do in those tweets tweets was in any way acknowledge the surprise that people are dealing with surprise and shop when people are learning about the INS and outs that plea deal or acknowledge how alleged victims might have been hurt by that original plea deal. There was not even a nod to that so I'm not sure he he helped his case really with his pretty barebones statement and it is an interesting test case for president trump as you point out in the note this morning maryalice. There's been a lot of churn from that original cabinet and for all of the ways that this this president has allowed scandals to to brush off of him that hasn't always applied the people around him. You have seen this White House this administration move against people <hes> in the cabinet that are embroiled in scandal and I wonder her how much longer a cost can hold on this. There are numerous Democrats calling for his resignation. We haven't seen a break in the dam among Republicans but they are making noise about having hearings on Capitol Hill about how a deal like this could have been cut and <hes> I and I wonder I wonder whether the pressure bills to a sufficient degree that he becomes the latest casualty in the cabinet wars yet your point when the president said that he feels bad for him and he's a guy and he works hard but that the White House was going to have to look into it. Look into it very carefully carefully that just felt like the line we've heard before we felt like when he was talking about looking into Scott Pruitt and Ryan Zinke and these other former members of his cabinet that got swept up and in controversies kind of past and present we've been here before like you said just a real revolving door in this president's cabinet yeah it'd be interesting to see how much they hang on and if the president decides to try to go on offense on this on this issue as well <hes> it is it is a striking one. I think you're right a lot of people asking about whether he's he's the only powerful man to escape justice do <hes> political connections. We're GONNA take a quick break right here. When we come back? We're going to be joined by a man who says he is going to be at the next debate and has got some pulse approve it. Trump defends cabinet member Acosta embroiled in Epstein sex-abuse case

"Today the president expressed sympathy not for the girls who jeffrey epstein is accused of sexually abusing but for alex acosta who wasn't any federal prosecutor in florida who made it very forgiving deal with jeffrey epstein over ten years ago on similar charges a deal meant jeffrey epstein served no federal prison time alex acosta is now donald trump's labor secretary i feel very badly actually for secretary costa because i've known him as being somebody that works so hard and has done such a good job i feel very badly about that whole situation and back with us mimi roca andrew lena maxwell and certainly no he feels very badly for oh yeah he thinks the side with the person i they're accused of rape or somebody who's covering up a crime and that's backwards we should have are empathy place squarely with with the victims in this case were very young and all of whom are recovering from the trauma the experiences teenagers but that is that is a lifelong recovery process that's not something you get over overnight on but in addition i think there's a compound effect when it comes to donald trump i am a firm believer that there is eventually going to be a reckoning reckoning for donald trump around all of these instances of sexual assault sexual misconduct and all these examples where he is siding with people who are accused of those those similar crimes and the reason i say that is because while the people that support him don't care the people do not support him we care a lot we're angered every single time this happened one in four women survived sexual assault in their lifetimes and so now each time he does something like this more and more activated to push back and resist against the administration to make sure we we don't have private insurance credibly accused of multiple rape who is on television defending people who covered up child rape midi of alex across his handling of this case it's gonna be drifting lower so so it's gonna be central to his defense is gonna use it to try to the first things could happen apparently in in on the defense side is any motion to dismiss on the basis of what he calls his global agreement with alex acosta yeah and i think that motion is going to fail a i i i understand why they're making the argument but if you i mean the southern district preempted this in their detention letter they were well aware of this what's coming in their detention letter they said as a little aside by the way that florida agreement it doesn't bind us it says specifically in the language this is specific to the united states attorney's office in the southern district of florida and by the way there's case law in the second circuit that says unless an agreement a plea agreement says it binds all you us attorney's office says it only binds one so they have language of the agreement an la on their side they they knew this was coming this is not like some you know rookie thing here i mean they they expected this becoming and they're going to lose that argument of course they're going to make it i mean this is their job their defense attorneys but it's going to simply highlight frankly how abominable how horrible how pathetic that original plan was an end i do not see how alex the costa stays in this job he's not just any cabinet member he is the department of labor that oversees human trafficking sex trafficking human trafficking he should not be in this position he let a sex chopper go and if you reach judge mara's opinion in florida where he found that the prosecutors violated the the victim's rights act and not notifying the victims these emails between the prosecutors and the defense attorneys it was calculated decision decision to keep it from the victims i cannot tell you as a former prosecutor how shocking that is to me and why that press conference yesterday a with with
