But I do find myself agreeing with the people who say if twitter and facebook limit the spread of something that's not censorship they're not taking anything down. They're not preventing something from being published from getting out there. It already has been published. It is out there. It's more that they're. Not to amplify something that is already out there, and that's I. think a fair choice like if I decide not to cover a story on this podcast, that's my choice. If I decide to try to stay away from politics on the show, that's my choice. That's not me censoring something that's me saying that's not something I choose to talk about. Well coincidentally, yesterday SEC commissioner a jeep pie suddenly said that the FCC will start a rulemaking action to clarify the meaning of section two thirty and that social media doesn't have quote special immunity denied to other media outlets and quote quoting Bloomberg the announcement came hours after Senate Republicans demanded the chief executive officers of facebook and twitter explain steps. Their sites took to limit the distribution of a controversial New York Post article concerning Hunter Biden the son of Democratic presidential nominee Joe Biden twitter and facebook said they did it because of questions about the articles accuracy and use of hacked material end quote. Problem is pie and the FCC have no authority over section two thirty like none. Quoting, Mike, MAZANEC IN TECH DIRT PIE is wrong. Almost everything he says in his statement the FCC has no jurisdiction over Internet websites. Previous lawsuits have already held that furthermore, the FCC has jurisdiction over section two thirty, which was explicitly written to deny the FCC authority over websites. The FCC has no power to reinterpret the law. The final paragraph is the most ridiculous of all pie is correct that social media companies have a First Amendment right to free speech and section two. Thirty as was written and properly regularly interpreted by dozens of court decisions. None of which the FCC has ever said a word about helps guarantee that right is not diminished through frivolous bogus and misdirected litigation. Also, the claim that the immunity is quote denied to other media outlets is straight up wrong. Any outlet is protected from liability for third party content on their websites. It's why Fox News and Breitbart can have comments on their websites. It's why things like Parlor and Gab can. Pie knows this he's just being disingenuous in terms of actual impact. All this will serve to do is row people up waste a ton of time and not actually change anything because it can't but it will create a huge mess in the meantime distracting everybody and wasting a ton of resources and quote. Actually went to underline something that Mike said there because a lot of other people have been making this point as well. If your concern is that platforms have a power to quell speech were take things down or limit reach or quote censor things if that's what you believe is happening if that's your concern, the last thing you WanNa do is monkey with section two thirty because if platforms are liable to be sued for everything that billions of people post trillions of times a day if they're suddenly opened up to lawsuits at scale, then believe me they will immediately and very aggressively take a ton of things down if they didn't they end up risking being sued out of existence. You can be unhappy with editorial decisions made by the platforms I. Often am where you can think that section two thirty is a bad thing I often do but I'm wondering if it's possible to do both simultaneously.

"I'm observing this firsthand through people that have contacted me. And Are currently and I can't talk about any specific cases, obviously or specific investigations, but Folks are being investigated by the F. I just say this generically. Should perhaps be concerned, and I'm not a fear monger. I'm not waving my hands. I'm not saying the sky is falling, but I want everybody to have a heads up about an issue that's very riel. And I've seen it without any question personally, through active investigations were going on and again, I can't share anything about actual active investigations. That my clients may be involved in. But this is a real issue, and I think it makes a lot of sense to make sure people understand what's going on. So you know, Indiana in general and to some degree Indianapolis along with him and and Gary have been getting blamed for Chicago's crime problems for some time. Go on. We're backto President Obama. I mean, he had a town hall where he said, Well, the only reason we have a crime problem in Chicago. It was because of all the lacks good laws in Indiana. And the current mayor of Chicago, Lightfoot. She said Just recently. Last year, her less has come out and said, Oh, yeah, well, we don't have a violence problem in Chicago. We have a problem because of all the lax gun laws and Indiana people go to Indiana and buy guns and bring them back to Chicago. And that's the only reason we have all these murders. And we have all this quote unquote gun violence. I think the term gun violence is stupid. By the way, we don't say knife violence. Or fist violence. Um Or bomb violence. We just say violence, but suddenly it has to do a second Amendment rights. And, of course, we have to demonize the weapon. But what you hear over and over from these folks who clearly want to demonize firearms, and they want to demonize us who exercise our second Amendment rights you hear over and over well, Chicago's Crime problem and gun violence problem. Um Isn't really Chicago's fault. It's Indiana's And that To me is goofy for a couple of reasons. One isthe That The implication that Indiana's quote lax gun laws, unquote. Are the cause of Are at fault for Chicago's crime problem. Is a way for people who proposed gun control. To avoid The argument back from us of Hey, wait a minute, Illinois and Chicago in particular. They have they have Every gun control law, Any gun control proponent could ever want anything that Shannon wants and moms demand action, or Michael Bloomberg. Or Former representative Giffords any of these folks who are out there, fighting left and right. Tooth and nail every day. Strip us of our gun rights. They've got everyone. Of those restrictions and those gun control laws in Illinois. So a lot of us point to Chicago in particular and say, Obviously, gun control doesn't work because every law That any gun control proponent could ever want. Their entire wishlist was already on the books. Innit, Illinois and in Chicago. And if people are still killing each other at an incredible rate, and they get what 50 shootings in a weekend in 8 to 10 murders a day Obviously, gun control doesn't work. And those folks who like their gun control laws and want to voice their gun control laws on the rest of us. Hey. Us having the ability to point to Chicago and say, Ah ha done. Control doesn't work. So what do they do? They said, Well, no, It's not our fault. Our gun control works for Illinois residents. Is you people there in Indiana who have such lax gun laws. And people come to Indiana by guns and bringing back Chicago. That also implies by the way that if they're blaming Indiana's so called wax gun laws, the people must be coming. To Indiana and buying guns in a way that's legal right? Because our blacks gun laws allow it to happen. So people must be doing something that's actually legal by buying guns in Indiana because our lax laws allow it. That's how the argument goes. So that if we just toughen up our laws in Indiana By implication. Then they wouldn't have a CZ much crime in Chicago.

Why vote now, this was something that was it was his life on by both the president and the vice president. Mr. Trump and mr. Biden. So I I asked a question. Why vote most of us walk around in a naively Elevate wage state of impunity. No one is going to forcibly tell us what to do or limit where we can go. Nobody is going to kick down our door or drain our bank account.
