And it gets for some people. It gets a little weird for other people. It gets a lot weird, and you've got all these things that we really won't know. The full impact of maybe never, but some of the stuff like the increase in deaths, sins of despair and the increase in drug and alcohol abuse and all those sorts of things, but everybody's been on edge and then Six weeks ago. Roughly. We have this sort of explosion in civil unrest. We have protests, some peaceful, some not. We've got riots. You know, I'm in Arizona. We saw one of our sort major shopping malls was was attacked a couple weeks ago. Or maybe it's close to a month ago now. And it's been tough, right? I mean, every single day, the president's getting pounded and pounded impounded and we're thinking Boy, This is really a tough environment to run a re election campaign. But I was at two weeks ago I was at his rally here in Phoenix. He was in really good form here. People were loving it. There were very few protesters out there. And then there was the Mount Rushmore speaking but I've been contending is and this is where I want you to see what you think. I thought the Mount Rushmore speech was a home run. It was excellent. Where does the president's stand? I see. This is like a turning point like I think he's in the process of turning the battleship around here. No, You're absolutely correct. Any massive pivot and I'll tell you more wise ing this pencil ji massive pain in the right direction. The last call it for five days, but really quick. I mean, think about it. He's taken three major body blows impeachments. Then he had Corona virus. Then he had the riots and looting. And I told some of the folks in the West Wing like Listen he down. He's not dead. And I think what he has done the last five days have been a couple of things that are vital to his re election. First of all. He had to do a reset on messaging. And Mount Rushmore was a massive reset. I think he'd been thrown off. I told my wife that I'm like, you know, I think where there was some paralysis in the White House. That he was listening to some voices, which I think thankfully, he had decided or not some of the best voices to listen to, But when you listen to many voices, it caused this paralysis when you're not following your instincts, and, you know, honestly, I encouraged him to do this. Like Sir, you have the best into instinct I've seen in politics. In years. Go backto following your instincts. That's what won the election in 2016. That's what when you were when you re election. And so what he did on mount at Mount Rushmore is, I think really crystallized. What were what is taking place? First of all, I told my wife again. I'm like the amazing part about this is he has to stand in front. Of these four major heroes of the of American history and actually explain who they are, because we haven't talked really history in our country and not only that, but he did find it in such a way that he had hit this theme nonstop between now and the election. This is about Americanism, The American Republic vs the Marxism and socialism, but I don't think has taken hold inside of Democratic Party. I think it is the Democratic Party. And I think that's the beautiful thing that he has done is a full throated embrace of the American Republican. Of course, Chris. M. you should be you know in this the so he'll of North Africa demonstrating but Charlie my point is this you could have a reasonable discussion about this with these people that's no good faith on the other side hi Mike am I being cynical and and you know of course if you're into bounds yeah when you get these people talking about wanting to rip down all these statues and I I do get it I am I am here as a lifelong so the the southerner who's I'm one of these people who my entire family was southern and has been southern from the beginning and every ounce of my DNA that that sell in in the services of war fell on the side of the south and I can tell you this the issue is complicated it's difficult we have been debating in in small towns across the south we've been debating about these monuments and plaques and remembrances literally my entire life and long before that it is complicated and actually it's remarkably civilized all of these conversations in the south are generally very civilized and you know what some of the statues come down some of them don't many of them don't and and I don't have a problem I I'm said that due to you know what I read about what's going on in Richmond they're they're defacing and destroying the the statues along monument Avenue in Richmond it breaks my heart but I I also get it that that is in it if you have a legal conversation and and you can you arrive at a decision lawfully to do something with one of the statute I'm still going to be sad if the decision is taken down and but I can live can you explain why why am I going to be sad about this because it is a wildly misunderstood part of history the statue to Jeb Stuart on monument Avenue the largest funeral in the history of Richmond probably larger than any funeral most cities ever had up to that point was the funeral for Jeb Stuart the funeral job Stewart judge Stuart died protecting Richmond from an invasion and you said we can debate about what side was right or wrong or or you know whether it was an invasion or a rebel you agree we can debate all that but there were men women and children in Richmond who were living there and the decision was made that that the the state of Virginia killed away from the union and their lives were at stake and Jeb Stuart went and protected the city of Richmond James Stewart the vast vast majority of people who died and fought in the for the south is the work didn't have slaves it's it's it's it's a convenient thing to say that the whole thing was about slavery and yes it was about the economic differences between the north and the south but it but it wasn't it would be it it's such an over simplification to simply sales about a bunch of white people in the south wanting sway their bunch of people in the north warning abolition bull crap bull crap it did both the north and the south had survived off of slavery for a long time it is an indispensable discussing institution and Robert E. Lee for example was one of the very few people who during his time talked about how awful how horrible slavery what nobody talks about that nobody knows personally nobody even knows who Robert E. Smith fellow at the Manhattan institute contributing editor at city journal and she's got a book out called the diversity delusion she's not here she's gonna join us okay sorry this is what happens when you just kind of you know Friday scores slide in all right heather McDonald will be joining us we will be talking about policing in the country it's becoming more important than ever because there's a lot of information that is swirling around that has people nervous we've had we've had him activists we've had an anarchist we've had it protesters whatever the name that you want to call these groups you've had these calls for de funding the police force and I think that makes people very nervous we respect law and order we know it serves its function certainly the president it was in Dallas this week he was there on Thursday and he spoke before some police officers and said that if police are allowed to do the job that's exactly what they do see if you agree with president trump this week in Dallas instead we have to go the opposite way we must invest more energy and resources in police training and recruiting and community engagement we have to respect our police we have to take care of a police that protecting us and if they're allowed to do their job they'll do a great job and you always have a bad apple no matter where you go you have bad apples and they're not too many of them I can tell you that not too many of them in the police department we all know a lot of members of the police I was listening today friend of mine was on very important persons as some of the best people he's ever met her policeman law enforcement people then the taking care of people that in many cases they never even met before and at great danger great risk they get shot for no reason whatsoever other than they're wearing blue they give you life you saw that the other night was a horrible thing the idea is this if you break a window in your home do you burn down the house or do you fix the window and I think most of us would say we fix the window is policing perfect in this country no it is absolutely not perfect but it is a lot better here than it is anywhere else on the planet this country by and large is less racist than anywhere else on the planet and if there are issues of that bad actors within police departments around the country we should take care of those but cutting the funding to police forces are just getting rid of them in general no plan to replace them is not responsible it's being promoted not just by the people you see on the streets with a loud microphones it's even be being promoted by a lot of politicians on the left as we move into this election year heather McDonald is now with us I give you a beautiful intro before have there she is we'll do it again though the Thomas W. Florida senator Marco Rubio chairs the Senate small business committee he was aghast on my program I think that refilling the PPP tank is definitely gonna be on the table to talk to me senator rebel your chairs small business a lot of the small businesses will not reopen if the plaintiffs bar is there like vultures to pick on their balance I don't know how we re open the country without some kind of liability protection are you part of the working group on that issue well not on the working group on the issue but it's very relevant to what we're working on in terms of getting small businesses support they are by far the most vulnerable to that sort of activity look when I talk about excusing gross negligence here paying our you know what some guy knows he has a virus and decides he's going to in fact about to people even though he's the business owner I'm not talking about that we're talking about I own a restaurant and some customer or two weeks later get the virus and now I get hit with a lawsuit by some opportunistic employee claiming that they got it on that night in my restaurant and but the cost of litigating it alone is probably gonna put me out of business defending myself that's a real problem their door to hidden impediment to re opening part of our economy one is litigation and the other schools I mean you can't get people back to work in their nine year old kid has to stay home all day by themselves so we've got two big impediments out there that we need to address for purposes of of getting back to them to somewhere or getting to some normal until we have a vaccine I talked with the vice president yesterday about a do over here for schools and any chewing on that but let's focus on this liability protection there are precedents for taking a federal District Court district whether to Eastern District of Texas for the Southern District of New York they do that the royalties cases the Eastern District US patent litigation I believe you pick one district of the federal court and you say all tort claims based on Kobe it are going here and then you set a standard which is I think like with indifference to best practices when it comes to sanitation how hard is that to do senator Rubio don't want it but it's not hard to do mechanically I think it's hard to do politically we understand it's no secret the trial bar is a major contributor to the Democratic Party in fact I don't know this has been really grossly under reported but there was an effort to months before a listing broke open you know the amount of the three I make you know the the maps are now widely being used to protect people the the the the eggs and not ninety three master over the numbers that those masks those are the same apple use for industrial purposes and so there was an effort and and and legislation to allow that to be mass produced and used for that purpose and it was blocked by Democrats on behalf of the trial bar who wanted to be able to sue and in that there was a liability issue there now alternately they relented my point is we could they could have started rolling out along earlier so it's just an example of the hold the trial bar has over the Democratic Party said the key impediment really is getting it past not so much implementing once it is your colleague senator Scott is said on the show he does not want to give any money to blue states that have been badly managed in red states that have been badly manages not indifferent he just cares about management to me it seems that the Democrats have got to have bail out for places like Illinois they've already borrowed twelve billion dollars from the treasury isn't that going to be the trade offs some additional relief for state and local governments and their employees and their unions in exchange for protecting America's small businesses from the plaintiffs bar isn't that is the essential elements of a deal yeah I mean I think you could see something like that coming together for a political bargaining perspective I would say that when it comes to the local and state government I want to be clear about this there are two separate things here number one is money you owe liabilities you have because of mismanagement and bad decisions we should not be bailing that out and then there is some sort of basic baseline of revenue that you need to pay firefighters and garbage you know pick up people and the sanitation department in your building and code code division and and your the firefighters and police officers there's a baseline revenue there that we can't allow to decline now does just a federalism relies on local governments providing these basic services and and so there's a difference between funding those basic services which they may need some help on and extra money to help them to service the debt they took on because they've mismanaged their pension fund and and again I think it would be terrible precedent to use this Arab crisis as an opportunity to allow them to come here and get bailed out for bad decisions on the pension side but there is a baseline of operational revenue that local and state governments need to provide essential services and that we cannot allow to collapse I agree last quick question senator you almost retired the Orlando shooting persuaded you not to are you glad you came back for a time such as this I can tell you that my second term has been much more rewarding and a lot of key if she's got a lot more.

C. super the best long interview audio video was with you and we never met and I sat down in your studio in in California then you have the facility to be on obtrusive to kind of sit back you barely looked at anything you had to know because we barely look to them and then we just chatted where did you learn that Dave and and how much of it is a function of your personal journey from the left to the right I'm just curious is all organic thing you always had or was it something that happened off is it Hey people have been lying to me I need to learn stuff yeah all right so this is gonna be the even think those differences matter actually in many ways the political differences that you and I have which I know we have a few of them if anything it makes us stronger actually because that that's really the the energy of life is like wohl Gorka and I can keep talking about what our differences are and without trying to take each other out I think that's the beauty of America so I would say to my style I really you know it's unfortunate we have to do these beer via video now all the time but you know one of these days when I get you back in here you know it's like just to sit down with someone look them in the eye and say tell me about you and about your life and then to try to map that against what I believe so if you say something that is counter to what I believe I'll try to you know find the right question to go there and if you say things that that jive with what I believe then we can move in a different direction but you know I don't like the the constant having to look such a perfect example of everything I saw wrong with the left you know to decent people try to have a mature conversation and then the responses you know slamming my hands on the table right in the B. being every subset of religious communities what exactly right and what's interesting about that is is is churches that have several specific constitutional right for them are being treated worse than other types of commercial establishments that don't have any specific constitutional right and so it's been turned us on on its head and that's what we're looking at what are you allowing a customer because if you're saying look you can't get in groups of more than ten okay fine but you're saying that you have to have groups of less intense except for what you'll see is essential businesses and then there's thirty forty fifty list but not the church and I think that's the mistake that these officials are making I would be surprised if one of these cases through this covert response does not end up at the Supreme Court because there are weighty issues here not only for now and for the practice of constitutional rights but what about the future when they look back and said well we did this before so we're going to do it again well David I also see a lot of the culture of establishment clause idiocy holding back some banks from funding PPP applications from church communities faith community they're the invisible safety net and they can't get these loans is there any reason why they should not be in a line on an equal basis with any other small business that qualifies no it's a matter of fact it should be in court for years and especially as of late has specifically said just to discriminate against religious organizations in general government programs not only violates the constitution but the court has said it already is to the constitution and I think that's what people need to understand because they try to say well you know look they're specifically funding religion now with their funding is the economy the funding of private organizations and not for profits and businesses across the board and that's what makes the constitutional because if it didn't even benefit you can't say what we're going to give this to everyone to make sure they're not for profit survived but we're gonna excluded from religious organization that actually.

J. Cleveland that selects professor Prof M. J.
