But I wanted to talk about the problem with the Pfizer vaccine. Okay. Two different medical doctors have called in to talk about it. And it's on some patients, the vaccine wipes out the platelets. The platelets are responsible for clotting blood if you don't have platelets. You get no clotting and you soon lead to death. It's by a brain hemorrhage or something else. And the word really needs to get out about this. Don't ever take it. My husband and I had it before we knew there was a problem with it and we haven't had any side effects. Some people do, and this is a terrible side effect to wipe out your platelets all together. And both doctors that had never seen cases of no platelets facing low platelets but never no cases. No. And so I wanted to share that if you didn't already know it. To get the word out and to get people, this is stuff that's still developed. And nobody knows what can happen to people to take them. Listen, I appreciate the call. I appreciate your passion for it for it. And what I would say is to anyone that's considering the vaccine, just go out and do your research. I've decided not to take the vaccine. I've natural immunity. Listen, I don't know how long natural immunity will last. I suspect, just like all of us, you know, I'll get COVID, I suspect all of us will get will get COVID again. You know, it's my personal opinion. That based on stuff that I've read that over time, it will weaken as it goes through the population and I feel like we're prolonging this thing. The by not allowing it to do so. The Amish community, although they don't allow people to come in and do testing and all that kind of stuff. In Lancaster, Pennsylvania, convinced that they've received herd immunity simply because they allowed it to hit the entire community. They felt like it was more important to keep working to be able to spend time with family and friends and so on, et cetera instead of allowing it to take you down. Okay, so just real quick again, let me just touch up on this issue with the two parent families and how that's racist. Of course the left wants everything to be racist because the left needs voting blocks. So it's LGBTQ and whatever other letter they can add it's black. It's people of color now. Everything they can to divide. And it's like, okay, illegal immigrants. By the way, I just read this on breitbart so now illegal immigrants that have come into the country and fraudulently fraudulently. So here it is. Report DHS chief Alejandro mayorkas is considering excusing immigration fraud. So people that have come in and lied a lied about their naturalized American citizenship, may be allowed to keep their American citizenship. And all this is, is creating new voter blocks and victim voter blocks for the lab. That's what they want. And now maybe single moms, maybe maybe single dads, people that are disgruntled, maybe they're merit failed, whatever it may be, this is just another attempt to create another victim block. So this guy is the only way this guy will get his agenda pass is if republicans acquiesce cinema standing strong. For god's sakes joe mansion is standing. Strong will mitch. Mcconnell stay strong. That is the question that is what will have to find out. But when it comes to kamala harris they had to pipe in. They had to pipe in the applause she went to. Where was the college that she that she went to College she graduated from morehouse anyway. Anyway piped in the applause. Apparently they were afraid to to to. It's it's ridiculous that you can get a shot or you can get hospitalized or even die. It makes no sense. Therapeutics are the answer. And i do believe a lot of these public officials and these health officials are killing people by not talking about imagining of You know There -peutic all right this from just the news. The numbers are skewed. Colorado officials warn of inflated cova desk statistics multiple public officials in colorado. Are warning that the state's official. Kobe thousand nine death. Count is skewed due to the practice of conflating or confusing patients who have died directly from kobe. Nineteen the disease with those who have merely tested positive for it prior to the death. So you guys got me here. There's a differentiation here. Those are there are people that are actually dying from covert itself. Okay got it. And then there's people that may be dying of some other condition But they may have tested positive for kobe. Perhaps they were even as symptomatic nonetheless. As a caveat there are some people that have some conditions and kobe can worsen those conditions you know and maybe make their demise come on more quickly so we do have to be a fair in that instance but experts in the. Us is health. Officials have failed to make those key. Distinction Points in when it comes to government. The governments tally of cova desk. So leading to accusations at the death rate for the disease is being inflated. And i know that it is a know that it is. I'll tell you guys a story here quickly. Something that happened here in florida early on multiple public officials colorado are being told This is from the the host of full measures show atkinson that they had personally observed deaths halley's that aired on the side of cove it leading to death counts that were effectively misleading to the public. So this is from brinda brock. Renna brock is the coroner for grant county of colorado and she told shirl atkinson that in november. Listen to this and this isn't this isn't a one this isn't a one. Oh she told shirl atkinson that back in november. She processed a murder suicide case the very next day that murder suicide case showed up on the state website as a covert death remember. Hospitals get paid a butt load for covert patient. Was it eleven thirteen grand somewhere in that area over ten grand for kobe cases. Lot of these nurses and stuff that are working. I'm sure plenty of overwhelmed. But they're getting paid a butt load extra of cova pay but they were gunshot wounds. I didn't die of kobe. The murder-suicide it wasn't like i'm gonna coughing your face and then hold my hand in front of my face coffeenated spirit and this is a murder suicide. No it was bullets the murder suicide and they counted the state officials in colorado counted as a kobe. Day this lady brinda brock. The coroner medical examiner again of grand county colorado said she questioned that immediately because i not even signed off on the death certificate yet and the state was already reporting them as cova death. This wasn't a mistake. Make no mistake about it. They weren't confused. This was deliberate. This type of behavior makes you question and wonder how. How often is this going on. How many coroner's as a matter of fact that perhaps weren't his diligent as her. That did this slip pass. Or maybe they just didn't check it because they assume that people that they're working with their moral they notice how they perhaps even expected the coroner to go along with it not talk back so Brock claimed that authorities even counted to people who were still alive as kobe desk. And you believe that. So this is a quote from brennan brock. Two of them were actually still alive and yet they were counting them. Had i not call them on it and ask them who those were Where were they where were they from all the information about it and it's like oh well that was a typo. They just got put in there by accident. But this isn't just happening. They're the same thing is happening or their stories of this happening in denver colorado. This is from jane's caruso he's the medical examiner and the coroner for denver and he said he's heard similar complaints in denver. He said i was told by some of my fellow. Coroners in the more rural counties in colorado that it was happening to them That they knew of issues were they had signed a death certificate with perhaps trauma involved but it was. "Everybody everybody welcome back to behind the numbers. I think the cameras caught that fist-bump but that's okay. That's what we do here. We're having fun today. Talking about brand development protection with Sean McConnell was the senior attorney at Pepper Hamilton and in the first segment showing you shared a lot of great insights not only from legal perspective but from a marketing and branding perspective. And I want you to explain explain to the audience how you're able to deliver that perspective because you've got a pretty unique background Before I went to law school I did marketing consulting and branding Back in Pittsburgh did it for a wide host of companies from large real estate companies to charities to small product talked small product manufacturers and after law score upon entering private practice. I kind of fell into to An opportunity to to do the legal side of it and and it got me to. It was always a love. It's always been a a love love to see the the creative side of marketers the processes that they go through the behind the scene angst and back and forth fourth and the effort that they put in to really creating a story behind a product. And so you know. The the chance that I have to help be cog in supporting that process. It was a great opportunity when when I mentioned it in a private the practice and and that's kind of what I see. My my role is now you know I may be listening and seeing where a marketing team might be going and I understand. They're speak because I was there and I understand the challenges that they have and I understand the pressures that they're under from the top to deliver something that can actually bring value to the underlying bottom one. Yeah and that's so important that you've been there and you can look at it from their Lens and have that perspective so I just want to make sure the audience understood that frame because you're adding it's tremendous insight from that other side and when folks to understand that we take a dip into the wonky world evaluation short for second. I can hear because you know. In my world we're valuing trademarks and trade names on a daily basis and they're super valuable intellectual property assets. Can you talk a little bit about whether it's large company or small small company. Why it's so important to develop the value of that? Ip and how that impacts the value that business so when you're talking about evaluation of your Ip you're talking not it just about you're talking about a couple of things one you're talking about selecting the right mix of assets right you you can. Everybody knows in the back of their mind. They've got patents and copyrights and perhaps they're thinking about trade secrets and perhaps thinking about trademarks and the mix of those is what a company really needs to be thinking about as they're moving coming forward and think about your Ip assets almost as as a moat around your brand around your castle and parts parts of those assets form parts of that moat and they can form additional barriers outside of it. So as you're building being out your your idea or your product and you're thinking about is this product. patentable and patents are great and for a lot of types of of ideas and developments. That's the right mix and whether or not that's a utility patent or whether or not that's a design patent. There's a lot of utility in value to that but think about whether or not that idea that concept might be more useful to be held as a trade secret you you know. The the colonel has done pretty good at making sure that his magic herbs and spices has some value to it I mean they went to painstaking gene staking processes several years ago. If you cut it in the seven hundred eleven it it's it's the magic seven okay and maybe it is eleven at this point. Who knows but they went to somebody? They went to a lot of process a lot of pomp and circumstance when they did an office change of making sure that they were showing showing that they were keeping that stuff secret and there's value to that and the same thing can be said though for trademarks and brands. Because while there's a life recycle for patents and they expiring going in the public domain and even for copyrights and they expire and ultimately into the public domain albeit. Many many many two years from now brands can last forever. You can have brands that. If they're continually being used they're being used in the right way and they're being marketed and promoted in the right way. They have the ability to stay to stick in the minds of consumers whereas you have companies that like like General Motors and Ford. That have been around for eons. Even you could think of a name like Edison and realized that his name was initially tied to Trinity. And it's evolved through the years but but that name held swain still hold sway in a certain way. Yeah that's really good stuff when I ask you. You mentioned building a moat. So it's about protecting your clients protecting your secret sauce so to speak. Where does the concept of premium pricing come into the equation in leveraging the brand rand if at all because not every brand is going to necessarily command a premium price early luxury brands? You think about that but can you talk about the pricing component. Luxury brands certainly obviously can go ahead and charge a premium for it. It's also you have to balance your pricing. Not just on the product that you're offering. Where does it fit within the marketplace? What is what is the segment of the market? That you're trying to enter into it doesn't have to be a premium price. You could believe that you've got the better product that you can sell L. at a smaller price that can gobble up a greater size in the marketplace. And you're still making a good margin on on what the product is in your goal is. I'm going to gobble up more geography and more market space. Then I'm going to have small sliver of it at a premium price so it really is. Where do you see your product fitting into the market segment that you want to enter into? And that's probably a real good segue into whether it's from the marketing perspective with legal perspective. And maybe you'll marry both here. But what kinds of research should companies be doing before they embark on a brand selection process. If you will I think that from a legal side the the process is relatively sibley straightforward. You're performing clearance searches. You're performing trademark searches the the extent and the depth of what you want to to embark in from the legal side depends a lot on how important this particular product. This particular mark is going to be for you if if this is the ultimate brand if you're going to be venturing into many many geographic markets. If if you think that this has legs to go international because we are in a global marketplace and it's really easy to sell internationally now now you have to start to think about. I'm more broader search if this is a seasonal product if this is a sub brand that isn't necessarily surly going to be a regular product for you that you're GONNA be offering or it's we're going to have it for a couple of months we're going to run a special on. It were an ad or a tagline. We're just going to run for a little bit. You May WanNa go ahead and do something a little bit smaller smaller a little bit more finite and not really think about going beyond it and registering it. So it's understanding where you WANNA be. Is there a thing or two or five that you could rattle off. Perhaps that they should be mindful of recognizing that they may not have the same same runway. That a larger company has experimenting with Brandon Belt. And I I think the important factor to think about here is the a lot of these smaller. Companies are the companies that are driving a lot of the ideas that are making this country forward. They're coming up. They're the innovators. They're the entrepreneurs and I truly enjoy working with them the challenge that they have is if they if they choose the wrong path or they select an idea and they run with it and they haven't taken the time to think it through perhaps clear it and and make sure that their path forward is not going to be without any major hurdles. They can run into challenges down the road a larger brand or someone with senior rights comes comes in and says hey. We're going to need you to go ahead and change. We're going to need you to stop using that and that for a larger company that might be a little easier easier because they've got the resources to do it but a smaller company might not have the marketing dollars to do a full pit or to do a pivot in enough time to salvage the product before the market doesn't want it anymore and so not only worrying about dollars but you're also worrying about the time. Invested vested in those are precious resources and I would argue more precious resources to the entrepreneur into the early stage company to a more established company. Yeah no question so get it right out of the gate and get it right out of the gate good and that's a great spot to end. Unfortunately we're out of time. So thank my guest Sean. "Today we're going to be talking a combination of brand and legal and we're talking brand development and the protection of that brand with my guest today Sean. McConnell who's a senior attorney at pepper. Hamilton Sean. Welcome behind the numbers. Dave thanks for joining for inviting me. I appreciate it and I'm excited about a brand aspect aspect of things has always been a big part of what brought me into the legal field. So yeah we're gonNA talk about that. Tell the audience a little bit about who you are in your firm and then we'll jump in. My name is Joe McConnell. Obviously I am. I'm an attorney with the intellectual property department at Pepper. Hamilton we pepper. Hamilton is a full-service legal firm And we were based in Philly. But we've got offices all over the place great. So let's let's start by the types of companies that you work with New York with both large large companies and small companies right. Yes okay so when we talk about brand and brand development and protecting the IP around the brand what are some of the similarities with with what regard to whether you're large well a brand for whether or not the company's small is an investment. They they are. They're they're making investments into the marketing dollars that they spend into the products that they're trying to support the ideas is that they're trying to develop so from similarity standpoint both large companies and small have the challenge of ensuring that what they're looking to bring into market is going to have a clear path forward That's the first thing And they also have the challenge of getting the the the value of that brand developed the have the challenge of getting the idea out into the market in the first place. So one of the things that I think that they do that. Large companies and small companies Have a similarity doing is taking time to invest in and looking at what's the best idea to back and we're going to jump into that and a little bit but before we do. I kind of want to chalk the field a little bit if you will. We'll just talk a little bit with regard to the protection process. Yes and any high level what's involved in protecting a brand so the first thing that the marketing marketing team is probably going to do is come up with a variety of ideas You know the product teams may become to them with. This is the newest product that we're gonNA come out with. This is the latest service. This is the latest software platform that we want to offer to the public tour customers. How are we going to name it? How are we going to brand it and you know they drop it to the marketing team whether or not that's in house in large companies that often is and in small companies? It's either the founder. WHO's come up with the idea himself? Or they're reaching out to to a branding agency of some idea and the key here is if you're bringing being your legal team in early on this having having your legal team work with the marketing side to make sure that the ideas are free and clear that you're clearing trademarks that you're clearing potential brands that you're making sure that the avenues that you wanNA walk down are clear clear and so the first process is kind of going that trademark search route. If if you're coming to an idea or you're coming to a product with multiple options and you're thinking you're not wed to one you're usually in a better usually in a better place because you have the ability to say I like idea a I like idea. B B. Looks like it's going to be a harder path. Let's just go with that and that at the back and forth that you can have with your legal team and your marketing team is really what helps identify which is the better path to take okay so you talked a little bit about backing the right idea so I want you to unpack that a little bit more and talk a little bit about also how brands work to stand out in in a good way. The first thing that you want your brand to be authentic. I think think that you want it to be something. That's true to the the company that's backing it. You want your customers tumor to look at it and say Yeah I get it. That's that's coming from. You know a brand is is a source. Identifier trademark as a source identifier and customers are going to look at that brand in the marketplace almost in a vacuum and you want them to associate that product or that trademark with your company with WHO's providing that authenticity is a is a word that we hear a lot in terms in business ratings authenticity. What really resonates with people? Whether it's your colleagues colleagues consumers wherever you are there any examples of authentic sounding or resonating brands that come to mind or how would you describe creating authenticity. And your brand I think creating authenticity starts with appreciating what the mission is behind the company are what's the product that you're offering are you. Are you an old style manufacturing company that you've been offering products for years and years and years and years where your building off of the history behind the company or are you a new tech company or a you a new software platform that you're trying to create something new in the marketplace create very frequently. See A lot of these new start ups and there. I'll call it taking the Google approach. They're taking a word that's new or they're taking a spin off of a word and trying and to play it in a new in a different way because they want their idea to be viewed as we're company bringing a new concept and new market to to to bear so it really depends on what the goal is from the company itself an older company by by contrast that already has an established call it apparent brand wants wants to make sure that whatever they're they're offering is going to connect back to what they've already established because it it's an easier ability for them to to create additional call it satellites or sub brands off of what the big parent company might be. Yeah so as a fan of shark tank. I'm always intrigued. You buy what the companies do and and how they branded themselves and to your point. There's a number of them. Have these interesting names that were. They've created a new word and sometimes we're sitting on the SOFA and we look at each other and we I think what are these guys do. He can't tell from their name What their product or service line really is so? Where's the balance between sounding clever hip with a new name new word and being really clear to the marketplace? In what you're offering so in the trademark world which is what I basically live in. There are two concepts of a whole continuum of how words might be described and completely made up word. Google Xerox are highly unique very distinctive and yet before the companies existed. You had no idea what they were right and often often times you see these startups kind of going along those routes. It's easy for Google. The do it. It's easy for Xerox to do it. Because they've been around forever and so people understand who they are. Is your building out the real bulk of of the brands and the trademarks though fall within this realm of suggestive marks versus descriptive marks six. And you can build value around those because concept will be suggestive of what you're doing but it won't really really it'll give you a hint of what you might be offering but not do it precisely like saying you know you can you can use. I'll give a term like let's start with Apple. A term like apple really has no bearing on what it meant for purposes of computers. But if you start to use that term for a different brilliant brand that's closer to baking or jellies or food products or restaurants or some- somewhere more along those lines you see it where it falls closer to describing what that product is and you don't WanNa fall too far down that continuum because then you can't protect it but the closer that you can get to being clever you call. It is probably the sweet spot of where you want to be and and ultimately as you're going through that clearance process this is that back and forth between your marketing team and probably our legal team to make sure that you're not gonNA fall too far to one side side or the other Sean for the folks watching and listening to learn more about you or how they can work with you. We only have a couple of minutes left in this segment. And we want to ask you something when you talked about Xerox. It occurred to me that Xerox became rather generic term for making a photocopy in a similar way that Google has almost become a generic term for search Q Tip Kleenex other ubiquitous brand banned. Yeah exactly so. These are really well known brands. But what happens when you reach that tipping point where they cross over to now becoming becoming more of that generic commoditised perception. It's it's a real challenge but it's a challenge. You're probably want right right so I if if your brand is so valuable that people are using it almost as a noun. which is what you don't want to do? You WanNa be band aid brand band aid bandages. You WanNa be Coca Cola soft drinks. You'd WanNa be a xerox photocopying. The the challenge is making sure that you're associating. Not just that word and using it at times just as a single word is fine but always associating it back to the product or service that you're offering and that is a lesson that holds true not just for big companies but for smaller the companies and startups who are trying to build off of what their new product or what their brand is going to be. You don't WanNa you don't WanNa take take steps down the road and essentially crew 'cause generic side to your mark out of the gate and frequently. We see a a lot of companies. Maybe not very experienced companies who've already done that they'll do that in in describing it on their website or they'll they'll use the term very descriptively on marketing materials. That go out or in presentations to their own customers. At some point in time you lose. What the brand is behind it? I think that's a great spot to take our break here.
