According to reports confirmed by CBS News, the former vice president has been argued that as president of the Senate he was part of the legislative branch, which could block the Justice Department for making certain demands of him. This is part of special counsel Jack smith's growing and sweeping investigation into efforts to overturn the 2020 election. Again, that CBS correspondent Scott mcfarlane. Just one more day before a homeless encampment is cleared off federal land and McPherson square, but now D.C. lawmakers are pushing back. They're asking the city to make a plan for 70 plus people who live there. The plans to clear McPherson square of unhoused people is set to move forward. The National Park Service says it agreed with a request from D.C.'s Department of Health and Human Services to move the clearing up from April 15th after learning of three deadly overdoses in the camp. The park service says it gave 14 days notice to those who live there, but with more than 70 encampments, it says it's challenging to remove trash and keep the area sanitary and accessible for emergency responders. In a letter to the superintendent of the park service, D.C. council members Robert white and Brian nadot disagreed with the decision, asking for a plan for everyone to be safely housed before the campus closed. Meghan clover AWT op news. Ocean city is asking for offshore wind farm development to stop immediately. The city's mayor and the council say it's because of a series of whale deaths along the east coast. Noah says at least 14 whales have died on the east coast since December 1st. Some are more common humpback whales, some are sperm whales, which are endangered. Congressman Andy Harris of Maryland and Jeff van drew of New Jersey also called for the projects to stop. Noah says there's no evidence that indicates offshore wind projects are to blame for the whale deaths. One ungainly, yet graceful bird could be coming off the endangered species list. U.S. fish and wildlife says the wood stork population is recovering in Florida and other southern states. The service says restoration of the bird's habitat, especially in the Florida Everglades, is leading to the population bump. In the 80s, there were only 5000 breeding pairs of the birds left. Now there are more than 10,000. The wildlife service will take comment through April 17th before making the delisting final. "This week, the house January 6th committee, which will soon no longer exist, released thousands and thousands of pages of transcripts of interviews that conducted during its long investigation. I asked CBS News congressional correspondent Scott McFarland, what he thought were the biggest takeaways. Jenny Thomas, the wife of Supreme Court Justice clarence Thomas, was deposed by this committee of the first time we're reading some of what she said, looking through this a few different times. I don't see any blockbuster nuggets, but it's a provocative thing to have a Supreme Court Justice's wife speak to a congressional committee in the deposition. She says there was an ironclad rule that she and the justice don't talk about legal cases and that they don't talk about politics because she told the panel Clara's Thomas is uninterested in politics. But I'll note a few things I hit with my highlighter in the deposition. Jenny Thomas acknowledges being at The White House ellipse rally January 6th that she didn't go through the magnetometers. She said she's just sat with the normal folks at the rally that she wanted to see and feel the atmosphere of the crowd that day and said she had no idea about efforts to bust or fund the travel of any of the rally participants. And remind us why the committee felt it was necessary to release all of the evidence in raw form now before the committee no longer is in existence. This committee does expire. Tuesday. It no longer exists. It is dissolved, it's possible its website is scrubbed and no longer exists on the house dot gov website. They want to have a formal record of their work so they're publicly releasing copies of their transcripts, including with the key witnesses to have a record that exists out there even after the committee is gone. Plus the committee has said it's wants to release all these records and the name of transparency. And they also don't want to have Republicans when they control the house next year. Cherry picking parts of these depositions and weaponizing them as a criticism of the January 6th committee. "Residents have now been selected to sit on the jury of a high profile trial. Of the January 6th rioters. The trial will examine members of the oath keepers and anti government right-wing organization that was key to the planning of the capital attack. Scott McFarland, CBS News, congressional correspondent, tells WTO the track record for these trials so far shows a conviction is likely. This is the one we've been waiting for more than others because this January 6th trial, which begins at the federal courthouse, involves 5 accused members of the oath keepers who are very much accused of plotting to block the peaceful transfer of power in America and attack the capitol of raising a plan raising money, raising arms and preparing to attack Stewart roads, the founder of the oath keepers is the top name defendant, but there are four others, this trial could take three to four weeks, jury selection itself took a couple of days. So far, about a couple dozen defendants in January 6th have gone on trial in front of D.C. juries every one of them has been convicted on every charge. The trial begins Monday, October 3rd will be tracking the trial for you as it gets underway next week. Russia has officially annexed four regions of Ukraine and has doubled down on its war against Ukraine and more people are leaving Russia because of it. WTO's national security correspondent JJ green joins us live with more on this exodus. "A judge this afternoon unsealed the search warrant for president Trump's Mar-a-Lago estate. The unsealed property receipt indicates the Justice Department recovered a long list of classified documents removed from mister Trump's estate. Court papers indicate the former president is being investigated for three federal crimes, including possible violations of the espionage act. CBS News correspondent Scott McFarland joined us earlier with more details on what the FBI found. Well, there are about 28 to 30 items listed on the inventory of things seized during this search warrant, according to the records that were just unsealed. About 11 of them, maybe 12 have some version of secret or classified as a description to the items taken of boxes, envelopes, bags, whatever, full of materials that were deemed classified or secret. That said, this search warrant signed by a federal judge a week ago today, executed Monday all the way through 6 p.m. before the deadline the judge said of August 19th is laying down a marker. The feds went the president's property, executed a search warrant and unprecedented moment in American history, but we don't have that big piece of the puzzle. We don't have the affidavit that was filed with the judge to secure his approval. And that affidavit, if past is prologue, is pretty blunt and will have forthright language, as many federal affidavits do, explaining the rationale for this. For now, we're just guessing. So what do you think investigators are looking for? What is in those boxes? Because some of the violations could include violating the espionage axon. Affidavit would answer that question. The court sees fit to release that. We'll have a much better sense, but here's what we know, Anne. We know that in January, the national archives here in Maryland said that some records that were supposed to be in its possession were suspected of being at Mar-a-Lago. That in February, 6 months ago this week, they asked the Justice Department to launch an investigation, which culminates it seems on Monday with this search of the former president's property. This is, according to multiple sources speaking with CBS News, a search and an investigation about presidential records in the maintenance of those records. It's important to distinguish because there are multiple investigations across the country right now that have some nexus to Donald Trump. Such a big news day, we're going to have to pivot quickly. The house took a big vote today on the president's spending plan, any surprises there. Write down party lines, all Democrats in favor all Republicans against a nearly three quarters of a $1 trillion plan also considered the largest climate change bill in American history. They call it the inflation reduction act. I asked the House speaker if that happens soon. She says, well, we got to start somewhere, but most of the impacts of this bill don't kick in until after the new year. That was CBS News. Let's take you live to CBS News congressional correspondent Scott McFarland, Scott, what are the decision cipollone must make and what are you hearing about them ahead of a big deadline? Well, the decisions will have to be made soon because the deadline, the committee has imposed is tomorrow. In their subpoena to pat cipollone, they requested an interview with him tomorrow. Now, interviews with this committee take on all different types of complexion. Some of them are virtual. Some of them are in person. Some of them have carve outs for certain topics or questions. So it's possible they can work around any executive privilege issues that the former White House counsel tries to invoke. But the committee has been pretty clear here Dimitri, they very much want to speak to pat cipollone. They carved out some of the valuable real estate from their public network hearings to say in so many words that they want to talk to pat cipollone. It appears this committee believes he has the keys to the kingdom and we'll find out if they get access to those keys as soon as tomorrow. Is some of the committee members have been teasing that they've got a lot of witnesses lined up who've been inspired by Cassidy Hutchinson. And they also talked about the next public hearing. So when might that be? And what do you think we're going to learn from it? It's committee's pretty good at raising expectations for itself. They have a thousand witnesses already, but they've also been saying, as you mentioned, that there have been new witnesses who've come forward since Cassidy Hutchinson's testimony last week. We know there are more public hearings coming, which means there are going to be more public witnesses. The next hearing will be led by local congressman Jamie Raskin. It will focus on the role of far right groups, the accused conspirators, plotters, and planners. What they were doing on the ground January 6th, and what they were doing in the run up to January 6th between planning, raising money allegedly, raising arms in some cases allegedly. There's a lot to get into with the far right groups. They've been mentioned several times already in previous hearings. The next hearing will be focused on them. "Again, in D.C., Scott McFarland, joining Tanya rivero and Meg Oliver with the reporting over this Matthew Martin defendant from New Mexico found not guilty yesterday on all January 6th charges. We have breaking news, Matthew Martin of New Mexico has been acquitted of all charges connected to the January 6th riot. That's right, Martin traveled to Washington, D.C. after reading then president Trump's tweets about the 2020 election being stolen. He came to the protest on January 6th and entered the capitol with a crowd of other people. Martin has stated that he only realized later that the protests were worse than he thought during his trial, he claimed officers waved him into the capitol building, a prosecutor called this quote nonsense. Joining us now is CBS News, congressional correspondent Scott mcfarlane, Scott, welcome. So tell us about the verdict for Matthew Martin and its significance for other cases. Hey Tonya and Meg, this is not the most significant case. It's a lower level case, a misdemeanor case, but this ruling, this verdict could be quite significant. It lays down a marker that not everybody here unlawfully in the capitol was deemed unlawful that day by all judges. The judge has found this defendant Matthew Martin not guilty of four charges, entering a restricted area, two charges of civil disorder and unlawful picketing and parading. The judge says the government didn't make its case sufficiently on any of those charges. What the judge cited is what Matthew Martin didn't do on January 6th. The judge says, according to the evidence shown at trial, Matthew Martin wasn't screaming or shouting, wasn't crowding people. He was here. He was amid the mob, but the judge says he was not an impactful member of the mob.

"Now, there are reporters who do a pretty good job of covering all angles of a story like the January 6th Capitol Hill riots. Scott McFarland, out of D.C., is a great investigative journalist. He's been all over. That's kind of his beat. He's been given the beat of January 6th in the D.C. area. And he reported on something that I didn't see on ABC world news tonight anywhere else. "He actually lost This morning we turned to CBS News congressional correspondent Scott McFarland with the latest the house committee's investigation into the January 6th attack We spent the afternoon speaking with Jamie Raskin congressman from Montgomery county about where the committee has had at least one of the 9 members of mister Raskin said they are engaged in conversations with former vice president Mike Pence and so far those conversations have been productive We know they've had at least 300 interviews that they've secured tens of thousands of documents And where this is headed isn't clear but the timeline is clear They've got to get this done by summer the committee says there's a bit of a deadline they're facing and they are expecting prime time hearings to shine a brighter light on what they're finding likely in late or mid February We heard from the attorney general can you recap what's happening with the justice probe There are 700 plus federal defendants so far There's an expectation there could be hundreds more Of those 700 defendants only a few dozen have been sentenced their cases nearly closed And largely those are the lower level defendants Those accused of or who pleaded guilty to just misdemeanors for the larger level defended those conspiracy or assault their trial dates are a ways on Merrick Garland said their 17 defendants have their trials on the calendar but the calendar is a little slippery as you know all of our chords locally Maryland Virginia and D.C. have had COVID issues restrictions and shutdowns in fact the D.C. federal courthouse is closed through this month So trial dates might start getting delayed Give us an idea of the atmosphere there I saw a number of families of U.S. capital police officers who were here just to be close to their sons or daughters or brothers and sisters On a difficult day there was a symmetry temperature was almost exactly the same The same January 6 chill in the air And there was just this malaise the sadness one year after such a traumatic.
