And they make the joke about salad that poor people invented salad. Now even we can't afford it. The salad was like the go to. When you couldn't afford steak and bacon, you know we can't even afford some. That's because of this zero in The White House. You can't even buy solid. I mean, that is a very foolish political move if you want to run for a higher office, I would think. At least from rakowski, it's not she's not just liberal. I mean, the NEA is a group I have been fighting since I was 18, 19 years old and elected to a local school board. I supported school choice before anybody even knew what school choice was. "And that means we're not teaching human sexuality. We're not teaching race. We're not doing any of this sort of stuff. Does Texas have a curriculum review underway to get the woke out of the school? We're focusing on this on the legislature before I was sworn in. Banned CRT, but we are hearing reports all across the state of it creeping up through other means, less overt means. And so we're going to continue to tackle that problem. But I will tell you, and maybe you have to hear thoughts you may have on this. But I do not understand the liberal teachers unions and some of the professional educational establishments fixation almost obsession with talking about highly sexualized material with second and third graders that don't belong to them. It's a 90 ten issue. I mean, just like boys participating in girls sports because they're having a gender dysphoria. 90% of the people think that's not a good idea. We care for in a compassionate towards children who are troubled and making some kind of emotional journey. But that small group of people can not turn upside down the rest. And so what I understand is on 90 ten issues when I heard former president Trump and former vice president Pence on the same day make the same appeal to save girls sports. I know it's a winner. And we ban that. It was right after I was sworn in. I think it was the first bill that I co authored in the Texas legislature. And we actually outlawed boys competing with girls sports, at least through the 12th grade, and I think we're going to look to actually expand that into college next year in the state of Texas. And what kind of pushback the teachers union because I don't like teachers want this either. It's your dad's additional conflict that there are classrooms. They don't want to do it. But that 10% is very loud and very angry. They're very loud. And I think there's a big distinction between when we talk about teachers talking about teachers themselves and the teachers unions. Because most teachers in Texas are great people who are actually conservatives themselves. But the teachers unions, including in the state of Texas, have had far too much power for far too long, and I look forward to continuing to degrade their influence in the state of America. So Brian with four young children. Yes. You've got to have schools that work, right? I've got 5 grandchildren now. My kids all went to public school in California at a great public school. Terrific. I don't know what they're like now, but I do have to worry about Virginia's goals. It's where all my grandchildren live, you got four, the three boys and the girl, do you hope that they can go to public school? I hope that every public school in the state of Texas performs at a level that every parent who wants to send their kids there can send their kids there and have the full confidence that the age of 18, they will have marketable skills to provide for them and for their families. I send my kids to public school. I am pro public schools school choice is not a threat to public schools. And in fact, letting competition work in the marketplace it would finally do an education where it doesn't every other sector the government hasn't corrupted. And that over time, quality should be going up and costs should be going down. But because government has a monopoly in education, K12 in this country, especially in the state of Texas, we're having the exact opposite or quality is continually going down. Price, it's more costly per pupil. And then I would add on another layer because they're able to behave as a monopolist. They're inserting liberal extreme woke and doctor nation into these children. The left targeted education strategically over generation ago because they know if they can capture those folks that women inside of a generation, they can turn some of the most fundamental principles that we hold dear as Americans and Texans on their heads and unfortunately they've been.

Second, they need young voters and third they need women, and they figured that as the population became in their words, you know, less white. I'm going to play their words in a minute. That this was going to lead to a quote demographic destiny. They've used that term often. You've written books about it. And that this demographic destiny was going to lead to a long-term dominance of the party like they had in the FDR era. What happened, folks? Donald Trump changed it. This is why I laugh when media people talk about replacement theory. One, it's a leftist fascination replacement theory. It's their thing. And secondly, the theory is blown up in their face. As Donald Trump is convinced, a lot of Hispanic voters and minority voters to flip their votes for Democrat, the Republicans. So you're wrong on both fronts. Oh, that's not a Democrat thing. "Steve, what a pleasure, your first time on the podcast, thank you so much for joining me. As I look around the country, there's so much chaos on so many fronts going on with Biden. Did you expect this administration to be so far off the rails? Going into the midterms? Well, the Nash first grade to be with you. And I know we've met in person other settings, but it's great to be with you on this podcast. And yeah, if you think about it right now, I mean, we are a nation in crisis and it's on so many fronts. It's not like we've got an issue just in one area of the country. You know, we've got an inflation crisis. Gasoline, price crisis. We've got a border crisis. You know, you've got the government going after parents who get involved in their kids education, but then they're encouraging people to break federal law and go protest in front of Supreme Court Justices, houses to try to change the results of a court decision. I mean, this is how upside down things are. And you wonder why people are so livid and angry with President Biden's failures on all of these fronts. I mean, it's hurting families, low income families, especially paying more for everything, not just gasoline prices. But everything and it was so much better two years ago in terms of an economy ready to come back. People ready to come out of COVID with low gas prices, strong energy supply, a secure border, how much has changed in two years, I think, is shocked. A lot of Americans and not in a good way. Now, in some ways, this makes it really easy for the GOP because if Biden is bungling on all fronts and if his poll ratings are plummeting and he doesn't seem to know or care, the Republicans could sort of do nothing and probably do pretty well in the midterms. My question to you is, do you think the GOP needs a positive strategy of saying, listen, this is our agenda going forward. I mean, my mind is flashing back a little bit to 1994, gingrich and the contract with America. If you elect us, we will do these things. So far I don't think the Republicans have put forward that kind of agenda. Do they need to or is it is this the case because it's a midterm? Let's just make it a referendum on Biden. Yeah, and in fact, we are working on that and just starting with kind of where we are. You can see 32 Democrats have already said they're not running for reelection in the house. President Biden and Nancy Pelosi's popularity is in the tank, especially in swing districts around the country. We've got phenomenal candidates. I think we're going to have a great year, but there hasn't been an election yet. And there is no complacency. And by the way, I'm a big sports fan. I hate the prevent defense. So the idea that, you know, oh, we're going to win if we just sit back and do nothing. It's not who we are. It's not in our DNA. I'm a policy guy. I think now more than ever is the time to go run on a bold conservative agenda to show the country. They're already convinced that President Biden and Nancy Pelosi have wrecked the economy have destroyed so many of the fundamentals that make America great, but I think this is the best time to go show them what we're about. Why conservative policy so much better to fix these problems to get parents more involved in their kids education where they're shut out of schools. School choice, for example, dinesh, never a better time to talk about school choice and bold energy policy. But we've been meeting with Newt Gingrich and a lot of others, but our members have come together. And we're working on that kind of contract with American document. And it'll probably be called commitment to America. And we're looking at rolling out this summer. And if you think about the contract with American 94, it was rolled out closer to the election when people, you know, junkies like us are working on all of these issues all the time, but the public really starts focusing on elections by Labor Day. Once you get through primaries, we're still no states finished the primaries even. You know, it's very few states have. So let's go to this summer and you're going to see, and I think most Americans are going to be excited by this commitment to America when they see what conservative policy can do to secure the border to lower gas prices to address the supply chain crisis to secure our country and oh, by the way, you look at the crime in the streets where the left has gone for defunding the police and letting people out on no bail, confronting some of those challenges as well. And I think there's never been a better time to contrast failed liberalism with bold conservatism. One of the things I notice on social media is there's a lot of kind of score machine going on between people who see themselves as sort of the maga types versus the Republican establishment. Now, when I look at the actual issues, it doesn't seem like there's a radical difference of position. In other words, even people who call themselves American nationalists, it's kind of like if I were to say, you know, my family comes first, it doesn't mean I don't care about my neighbors, so I don't care about my community. There's no reason why one can combine America first with a kind of prudent internationalism, but here's my point..

"This is all things considered from NPR news I'm Mary Louise Kelly And I'm Adi Cornish The national defense authorization act or NDAA passed last night and is headed towards the Senate Joining us now is Conor O'Brien a defense reporter for Politico has been following the story Welcome to the program Thanks for having me Tell us about the legislation's focus on Russia and China Well this has been a particular focus of The Pentagon trying to after 20 years of war and Afghanistan in the Middle East to reorient and match kind of the military modernization that we've seen coming out of Russia and China It was the focus of the national defense strategy that was issued under the Trump administration and continues under the Biden administration So and it's pretty popular on Capitol Hill So what you saw in this defense Bill was a focus on Russia and China Congress a couple of years ago created this what's called the Pacific deterrent initiative To reorient the military to the Pacific and build up posture there and deter China they put $7 billion into that a couple billion more than the Biden administration requested on Russia with the threat to Ukraine They approved $300 million to arm Ukraine about 50 million more than the administration requested So there are a number of things to that effect It's a major theme of this legislation Money for new technologies That's another that's another area of emphasis for The Pentagon and for lawmakers I think a big thing that you saw in this bill was providing funding for research and development for emerging technologies emphasis on things like AI and hypersonic missiles that are being developed by Russia and China And to allow for that investment you saw a willingness from Congress to allow The Pentagon to retire a lot of older weapons there were some of those some of those parochial battles over some of these what they call legacy weapons planes ships where Congress did kind of override The Pentagon but you did see some willingness to let them move forward with that and to reinvest that You called dropping women out of the draft a stunning reversal Why Well that was the provision that was proposed to expand selective service to require women to register for a draft Was in both the House and Senate defense bills And normally when something is in both bills it's typically a pretty good indicator of bipartisan support which it did have And that it would be in a final compromise bill So when we found out that it was that it was going to be out of the final agreement that was quite surprising I was a victory for conservatives like Josh hawley Jimmy and pushed to get that out of there really played hardball And was indicative of some of the wins that Republicans got in this bill That's Conor O'Brien defense reporter for Politico Thank you for your time Thanks Today the U.S. Supreme Court's conservative supermajority seem poised to hand school choice advocates a big victory as in paralegal affairs correspondent Nina totenberg reports that could mean a very big expansion of state programs that are required to fund religious education Maine is a state so rural that a majority of school districts don't have a high school The way the state has dealt with that problem is to contract with existing public high schools to take kids from the districts with no high school and to pay the same amount to non sectarian private schools to take up the slack as well What the state will not do is pay tuition for students attending religious schools School choice advocates have long sought ways to promote equal treatment for religious schools with taxpayer funds and they had a willing audience today from the court 6 conservatives 5 of whom attended religious schools all signaled that they too view mains refusal to find religious schools as unconstitutional The court's liberals noted that in the past the court has said states may have voucher programs that allow parents to send their kids to religious schools but that in this case school choice advocates are asking the court to require that states must treat religious schools the same way they treat non sectarian private schools Justice breyer suggested that in this case beliefs taught in a religious school seemed to.

Well, because he had two parents, a mother and a father there from Haiti that cared. And they were strict. They made him do homework. They wouldn't even let him play sports until the seventh grade because they wanted him to focus on education. Education. That's more important. You're not going to be a basketball player. "Welcome back to secular school choice back at the Supreme Court. Once again. This is our brief from holding my hands right now. This case is out of Maine. Walter Weber, a senior counsel with the A. C L. J is joining us now, Walter my first question for you just before we even get into the the factual details, which might be the reason why Is it? It seems like when it came to school choice and religious schools and parents having the opportunity to just make the decision on their own, that the Supreme Court answer that and then in a case the Espinosa case out of Montana, these states that have these amendments which are really anti Catholic amendments, but were broader than that at the time, so it didn't look that way. On paper, the Blaine amendments, the court gutted In 2020. So why are we back at the Supreme Court again on this question? Jordan has a great question that there seems to be recalcitrant or resistance in the lower courts. It's not entirely the fault of the lower courts. Keep mind at the Supreme Court for a number of years, mainly in the seventies, and sometime after that was very strict about saying You can't have any government funds going to the teaching of religion. And the Supreme Court since that clarified that school choice is fine, and in fact not only to find that in some circumstances, it's a constitutional right. You can't penalize people. Parents in particular because they choose a religious education for their Children. So there's a little bit of lingering tension between this idea that you have to keep all federal or state money away from religious schools. Versus saying in the school choice program. As long as you treat everyone equally, that's fine. You know, Walter, the issue here. It's specific to this is out of Maine. And we learned about this in Maine specific in some of the facts, specifics that there are rural areas where there might not be public schools nearby. I mean, so that become difficult. So main enacts this program. Uh, what was it was at the state or was it that was at the courts that prevented the parents? From utilizing these vouchers to go to religious schools if they chose It was the state. What happened was that As you said Jordan in Maine. There a lot of rural areas where they just don't have a public high school. In fact, I think it's about 50%. Maybe even more than 50% of the quote unquote school units in the state do not have Public high schools. So what the state did through its legislatures have said, Well, all right, If you don't have a public high school, you can just pay the parents the tuition up to a certain cap. To any school. They want to go to private or public. And in fact, parents use that to go to both private, secular and private religious schools until The state in response to an attorney state attorney general opinion decided that it was an establishment problem for them to pay the tuition for parents at a religious schools. And so what they did was they adopted a new law, saying You can send your kids to any school you want and we'll pay for it. Except not a school that quote unquote promotes the faith or belief system with which it is associated and or presents. The material taught through the lens of his faith, so you can send your kids to religious school long as it doesn't teach religion. Which was obviously a problem. You know, Walter, I think about the cases that we've handled over the so many years at the Supreme Court. Dealing with religion clause of the establishment clause is one thing that we've been able to establish with the cases we've handled. And the president's we've handled is that in fact, the establishment clause doesn't license government I'm quoting from one of our opinions here. The the establishment clause doesn't license government to treat religious people are religious practices as if there's subversive. To the Constitution and subject to unique disabilities. Yet that's precisely what is happening. I agree with the the lower courts have been in conflict because the Supreme Court itself has been In conflict, and they had this very strict interpretation of church state separation for a long time. That is changed. Now. What do you feel like? The outcome of this case is going to be Well, I'm very optimistic about it because the Supreme Court has said In Trinity Lutheran Church and Espinosa. Most recent cases on the question that targeting Religious entities or persons for second class status is unconstitutional. It's not just a matter of the state can include them, The state cannot exclude them just because of who they are. Now what Maine is done in this case is trying to thread the needle and say, Well, all right, we're not excluding religious schools because their religious we're excluding them when they teach religion as if there's a difference between Being a religious school and teaching religion. Harry, we We've talked about this this issue of education as a civil rights issue. That's why we support broadly. The school school choice efforts and we fight the hurdles that come in the way like Walters type of this ridiculousness of saying, Well, no, you can use it a religious school but not an actual religious school. If they have any kind of religious training in the school day, and I mean some schools that would be very difficult to separate a history class out from Other classes. It's just because it be part of the culture of the school, which the parents would know. Then they would be making the decision but again, even when they want, it's like even when they want to give these opportunities. Can't quite get over the hurdle of saying it's okay to send your kid where you think is best and take out all the other issues. I mean, that just seems what ultimately what's fair. I think you're precisely correct. And so in the Zelman Simmons case, which was decided almost two decades ago, and it involved a school's system in Cleveland designed to advance the interests of African American and minority kids. The Supreme Court ruled in favor of the parents, it said. That choice follows the that excuse me. The money follows the parent's choice, and that is enough to satisfy the religion causes. Today. We live in a very vexed time. People continuously talk about inclusion. They talk about diversity, except they don't want diversity when it comes to parents who want to place their kids in religious schools. And so I think we need to be very, very aggressive, very, very vigilant. Because at the end of the day we live in a time of real particular Arat ease where religion is under attack. But first and foremost, it's under attack in universities and colleges. And then this per percolates into state legislatures. And they are then misreading in my view. The United States Constitution. You know, Jordan, I was going to say something here, and that is that the and I think this is following up above what Harry and Walter have said the fact of the matter is, and I think we have to be clear on this is that there has been with changes in the Supreme Court. Um, I think a clearer understanding of what the establishment clause is. In the free exercise clause, Mean and actually pretty speech close to a mall to one of the things I wanted to get your insight on. You've got with Justice Gorsuch, Barrett and Kavanaugh added to the court. My sense is that the main case should not really be that you never count counted over until it's done. But it should not be a difficult case for them in light of where their own jurisprudence has been, even while they were on the lower courts. Yeah, I think that's right. And in fact, this should be a lopsided decision. I mean, unless, of course, unless somebody on the court is going to say we're not following our previous precedents that say you can't treat Religious people and religious choices. Somehow second class, uh, the idea that there is a difference between excluding religious schools and excluding schools that teach religion. It's just, uh it's fake. I mean, the it's like saying we're not making a law against evangelists are only people who preach the gospel, right. I mean, it's It's the same thing. So I think I think the Supreme Court should not have any problems. Seeing that That's the problem here. The fact that they lower courts may think that there was some wiggle room left. Probably just reflects the fact that the Supreme Court will decide the case in front of it and not future hypothetical cases. Now that the first circuit essentially dare them to say Well, tell us that their religious schools and schools, the future religion or the same thing, I would hope the Supreme Court would say. Yeah, they are. And Walter. I mean the final question this this would if this case if we're and we're filing today, if there's a victory here, it's clear like you said. They answered this question, which seems absurd. But then they answered, so it's clear for these lower courts. This has been a fundamental shift at the Supreme Court level, which would open the door to more states, uh, being more creative with their with their voucher programs in the school choice programs..

The left means well that they're not diabolical. They're not actually trying to deconstruct. That is have a different way to go about it. How important is it. I think that is actually very liberating for a citizen to realize because then you no longer have to kid yourself. Try to convince yourself that you have to try to achieve some sort of false promise of bipartisanship if somebody tells you today that they mean well. They're out of their minds. Teaching racism they're teaching transgenderism to eight year olds elementary school. They have destroyed academic freedom and our colleges and universities. Does that does that mean. Well look at the border now. The suffering that's going on the border because the democrat party wants to fundamentally change just the nature of the nation but that they're embracing this radical ideology that i just mentioned earlier. Do they mean well. Near attacking our economic system. You're tacking the ability for people to put bread on their table economic growth Opportunity when you're going after our energy system which is the heart and soul of everything you do economically in a country. Among Democratic voters. There is very high support for school choice, especially in African American and Latino communities. Within Democratic leadership that has to be stopped because they are owned by the teachers. Unions on the Aurora Education Association is taking a move is making a move. That is effectively designed to lock out anyone from being able to buy their school board members like the teachers unions to you, and you know, people think I'm over the top with this, but after any school board election Go back and look and see how much the teachers unions, their packs or money was given two packs to support their school board members. It's in the hundreds of thousands of dollars. You cannot expect to raise that from individual donors that the donor limits that we have in Colorado. So if you guys were all mad about, you know people being bought that we need to fix our campaign finance laws. So that unions can't outspend. Their opponents tend to one or 15 to 1 or 22 1, which is what happens on a regular basis in school board elections. There is an organization called Democrats for Education reform. They are very supportive of school reform, innovative schooling school choice. They want kids to have the best education available to them at any time, and they're looking for the means to make that happen wherever it comes from. And now the Aurora Education Association, which is the teacher's union that represents the teachers in Aurora, have said that they will not endorse or support any candidate. That accepts donation money from Democrats for education reform or similar groups. So that means that every member of the school board in Aurora is going to be bought and paid for by the teachers unions because nobody is going to be able to work with discuss or even cooperate with any of the organizations that actively advocate for school choice. Because they cannot afford to not be funded by the teachers unions. You know, And here's the thing. Years and years ago in Douglas County, Florida, they just Douglas County, Colorado, They decided that they were not gonna work with the teachers unions anymore, And there was a big push a reform movement. People got elected to the school board and the teachers unions did nothing but wreak havoc for the entire tenure of that board, showing up at meetings, screaming, yelling, carrying on interrupting things, creating chaos. And then they during the next election cycle. They went out and said, Hey, if you left us We'll bring calm back to the district. Because they were the ones creating mayhem. And it's sickening, and it happens over and over and over and over again and until there is a consistent and concerted, an organized effort to give enough money to packs that run candidates that are not beholden to teachers unions. The teachers unions will keep your Children out of school in a pandemic. That's the only reason kids are back in school. Full time. Teachers unions don't want it. Period full stop. And now this little end around This little end around is going to remove the voice from anyone who supports school reform, whether they're Republican or Democrat from the from the city of Aurora. I don't think there's a more important data point that we could be looking at. For those of us who care about education. For there's there's no more important data point that we could be looking at them in third grade reading scores. And while Florida has made remarkable progress in public education outcomes over the last 20 years, We still have 43% of our third graders who cannot read at grade level. And why I think that data point is so important is when you look at the number of students who are coming into our K 12 system who are deemed quote not ready to be there. That number is at 42%. And then when you move out to 10th grade reading proficiency for most counties in Florida, you're still sitting Somewhere close to 40% of 10th graders who aren't reading at grade level. So there really is this very straight line that you can draw from whether another child is ready for kindergarten, whether he or she is going to be reading a proficiency by third grade. And ultimately, whether or not they're gonna be reading a great level by 10th grade. So for for our Legislature to look at third grade reading and to acknowledge that this is a challenge that we have to overcome in Florida on, we need to take a multi pronged appropriate approach to it. I think is is really In my time in this space, probably one of the most encouraging policy steps that I have seen. Well in my research mirrors what you're articulating about proficiency with literacy by the third grade, And so I bought you for also looking at, you know the information through an empirical lenses Well, along with what you're proposing here. One other item I'm watching in the state session is expanded school choice. I don't think it's a coincidence that as we have seen expanded school choice in Florida over the past real 15 or so years we've seen Significant improvement and education outcomes statewide, specifically in south border but also with previously underserved communities. Our chamber has not yet ruled out a comprehensive package so I can't really speak to the substance of the impact of the of the state of the Senate bill, but Well, I think your point is is it is extremely important because I think there's a lot of misinformation in Florida about what the role of school choice has played. I mean, if you look at Florida of the last 20 years We have We have gone from the bottom quintile and student outcomes to the took to the top on Do you know to me as somebody who again was dedicated his professional life to educational equity. There's no more important data point that we should be looking at in public education policy than student outcomes. Amen. And right. I'll look we're gonna have to. We have to hold it there.
