And then coach kits and we're in conversations about it just before that and before we could close it hit and shut it down and so that really pushed things along with how vulnerable the bits of the businesses and the gym is for shut down and it's her only lively aleve but it is a large portion of for good so she did such a great job there. I mean people and She usually kinda owner. You need to be to own a small fitness place like he got to be a all the time or you have to have people that you trust in the morning to open for you so that can come in a couple of hours later. She was all of that and she had some great plans. Like flexibility within the gym for to meet the unique needs of of a beach gem. Now do you guys plan on continuing some of those things. What what is your plan. Yes so when we. When my husband. And i i came here. We love to work on vacation. It's nice right. Go work out and not being charged. So we i went in there and we're like this is those places awesome and our biggest thing. We travel we go on vacation as finding a jam. That's super accessible. We can kind of go do what we want. This would be the perfect place for a twenty four hour facility. It wasn't twenty four hours at the time. It was not no so we've made that transition. There's some really cool technology That works with our membership software. That allows people that access but also like you said as jim i understand the need for like having not contact and the proof see so. That's one thing. We've built online programs at our home gym and not something that i wanna make available here like. I do nutrition at home. We have an online nutrition programs online fitness programs. Like like. he said we'll be here all the time. Even we don't necessarily live here and we won't be there everyday lake. Did you see a bump in membership when you went to twenty four hours because it makes it so convenient for anybody and people do go work out at three or four o'clock in the morning. Yes it's it's crazy. It's because i've come down here obviously twenty five years so i've seen all the months you know and just within the last two years of how slow june july august september can be so for us. Now it's super exciting. Obviously to own a business. That people are at. I mean there. There had days where there would only be a couple of people that would ever come in the accessibility to the gym. Now with twenty four hours. Everything is positive about people wait staff. We went in there. The other day came across the street from the junkin who had some drinks over there kind of celebrated with the four of us and walked across the street. Obviously we live all our lights on. Everything's ready to go in. There was three or four Waiters and We went in said. Thank you for coming to the gym. And they said thank you for being open because otherwise we have to get up we get off work and we go to the gym or not to jump we either go to bars ryan thank. Yeah so it was just. It was really cool to hear that story from them. That that a healthy option the ability to make a choice to say all right. I'm not going to go out tonight. I'm going to the gym. And one of the challenges in the fitness industry is try to stay up with the equipment because it's constantly changing and getting better and newer and people need to have all the newfangled ipads and whatever screens and the i'm guessing you brought in some new equipment and there was some investment there as well there was..

"No well they actually got called for jury duty a couple years ago but they didn't go to child so but i would have enjoyed it. Do you believe jury. The jury system is fair. When i i don't like is that you have all these jury What do you call them. consultants that tried them late. Who you can pick and the whole thing and it really seems to get away from what the whole thing was set up to be. I think by and large the jury system is fair. We can always be cited two examples. Where maybe there was some bias on behalf of individual jurors. But usually i think a jury somehow comes to a good result in most cases do you think. Oj did it. You.

"I just bought a two thousand three hummer with one hundred and forty thousand miles on qualifying for that. I think you could come to lunch with us. Ice very nice so that he could. How long did it take you to actually sit down and three hundred twenty pager. I think in. How long did it take you to really focus on it and it. Well that's when i first wrote it. I say you know having done this before. And you've got a lot of research probably about four months. But then i put it on the show for a while and not come back. And i'd bring it a little more up-to-date and edit but the second one that i just finished i i got it done in three months which is record time and i still have do some final editing but i was say generally speaking it's gonna take four or five months. You got the second one done in three months. did you sleep at all. No okay i. you couldn't have. That's remarkable it's just. I was so absorbed into us that i would work eight or ten hours a day on it and then i come to a good stopping point. I'd think maybe for a day or so. How do i wanna per scene but the question that you haven't asked if we have a minute. My favorite aspect of ryan book is su create the character. Yeah because i think an author who can pick characters in a way that the reader can relate to it transports them into their lives. So i tried to create characters where you understood why they were the way they were and even a few of of the in dishonorable individuals in prior restraint. When it's all said and done you at least understood why they were disarmed and in some ways you're transported from your everyday life into their life for that brief moment and to me. That's the purpose of reading books and one other aspect of the book that we didn't mention for anyone that likes to special ops angle. There is a special ops angle in the book. It's not hugely prominent. But there is a special ops anglers book which is cool so What we have you here and under oath as we do just a couple of quick questions would you consider this in your vast experience and knowledge of of being a lawyer and a judge and all that. Would you consider this a public space. Where we're we're sitting right now. I don't know the zoning laws around this town is it a public squares public. Sometimes i would say it appears to be a public square to me. As does it appear to you that we're exercising free speech you most certainly are thank you. That's all i rest my case your honor. "A corrupt you as senator who heads up the senate homeland security committee and it has control over. The investigation uses his power to advance his own corrupt agenda so sort of the second and underlying theme of the book is how power and greed operate in washington. So i take the reader behind closed doors in the cloakroom off the senate and the senators chambers with his chief of staff where he lays out in the dialogue is such where. It's clear how things really work in order to get things done and i guess finally. The protagonists of the book is a young female reporter in washington who's assigned the task of investigating the first murder. And she gets involved with an fbi agent in manhattan. Who's investigating the crime. Some f the fbi and they compare notes and she's very intelligent and very perceptive and she begins to see things that no one else sees and pretty soon she gets too close to the truth and now her life is in jeopardy. And you don't know until the last page or to the book how all comes together but we are just several very intriguing characters and interesting twist at the end which i really liked. that was. That was very cool. Now they're bef- you know. Forget questions he said a lot. That i want to make sure i don't forget now as you're a judge in washington dc. Are you taking notes about what's going on saying to yourself when i retire. I'm writing a book. No okay so this is completely after. Fdr this is all my mind. It's my experience just like you had your experience in this business you you've come to have certain perspectives things work. It's the same. He couldn't do it his memory assault. How we need to have a legal. Yeah how much truth is in you written. Well truth is in the eye of the beholder. not in lawyer speak. Please people in our audience and myself got understanding. There's quite a bit of truth. Nice in the overall content. It's not to say congress. An individual politicians don't do good things for their home constituents but politics is a power game..

No one said it was easy but The old saying is freedom isn't free nor is it easy so I think the challenge for all of us is to again investigate. You know as many perspectives as you possibly can. and some of them may even challenge your own operating assumptions. And that's the point That's what we all want. We all want to be informed of on a diverse group of and so the judge is here folks The name of the book is prior restraint. And you can get it at amazon. I downloaded it. I think it was wednesday or thursday and is from local. If you wanna get hardcover it's everywhere and it's a great book. I loved it and you know. Obviously i love those books. I read james patterson. And and vince flynn and Authors authors like that and it's based out of washington and it's based around Let me just set. Let him lane. That'll bicy- question. And then i'm trying to do this. Like they do on a professional show. Nearest you know you set up this offer on one side and it has to do with the media and the government and corruption yes basically this The theme of this book is a new terrorism in the media and the books starts off early with the nation's number one tv evening news broadcaster brutally murdered on pennsylvania avenue in the streets of washington. And it's just such a shock to the media establishment and the public at large but before that wears off within days the nation's leading newspaper. Column this in manhattan is also brutally murdered seemingly than fundamentalists so now the media's in absolute hysteria and they're scared to death to put anything on the air or or publish anything for fear it will make them a target and before we go further. Let me just give a quick definition for your audience of the term prior restrain. It's a legal term that refers to any attempt to you know censor or prevent publication or broadcast of any questionable material. It's also any action which creates a chilling effect on conduct or speech where such is suppressed by the fear of being penalized an individual or a group and finally it's the self censorship that's imposed by such fear so when we talk about a prior restraint where information is suppressed. Fear is oftentimes a major component to making that happen so back to the story line after these two very prominent public media individuals are brutally murdered..

"So your honor when you have people in front of you in a courtroom do you ever just. Is that appropriate still or iran. I feel like it's a big deal with iran. It's kind of never not your honor anymore. Non of funny you say that z. Sometimes when i play golf with my buddies though say it's your honor your honor so your honor back to my question. Do you ever look across the courtroom at a lawyer. Who said something completely idiotic. And you just say to yourself. Gosh that guy's a dummy. Well you know keep in mind in the course of of an exceedingly long trial and you know people attorneys are oftentimes flying by the their pants depending on the testimony as being given so you know. I'm not sure any of us wouldn't say things. That may come across in hindsight as a little. You know foolish or unsubstantiated but That's yes and lawyers speed but So onto the ever have to like clear. The court and admonished people forgetting well. Well yeah. I've had to do that a few times. But i think what's important as a judge that you set the tone very early and people you know realize when they came into my court that we weren't putting up within the or anything like that and if they got too far. You know out of line in terms of their questioning i would admonish them to. Let's keep this. Yeah you're judge ito and no no. I'm not that's for sure. So the the now. I forgot my question to you about the court darn it. I'll come back to it. So the is washington a swamp it is a swamp and it's It's been a long time in the making. This is nothing new. What's happening in d. c. I think Goes back to almost the beginning. And i think our founding fathers were fearful when the citizen. Legislators came in from their farms throughout the area to work for the summer to pass legislation and then they would get back to their farms. But i think the founding fathers were concerned at once they were able to have access to the federal treasury that it would become more problematic. And i think that's where we see it very much today and people ask me what. What is it about politics. And i always say well. The you've heard the expression the art of politics and people believe and the politicians below per pound the notion that they're working on behalf of their constituents but in reality oftentimes if not most time. They're working on behalf of their corporate sponsor and many times. Those two interests are not who he said what. So what is your personal opinion on the supreme court and this discussion of stacking the supreme court. It seems like recently with these unanimous decisions. The court is trying to send a message to the politicians that. Hey we don't need you getting involved. The numbers right. Even though there's democrats and republicans we can still come together and make the right decision and you guys need to stay out of it..

"And it sounded kind of interesting to me because that those are the kinds of books that i read and i contacted the folks at the library and in a roundabout way we had We have steve come on. The show is you're to get nice and close with the microphone. Is that your book. Is you first of all your background as your Judge a federal judge in an from washington. Dc and you are. You are now retired living in naples and the book is about media. I don't want to give away too much. I've i've never actually did a whole review of a book with so i wanted to be careful not to get away where people don't purchase the book but it has to do with the The local media the media being killed because a free speech. that's that's trying to be squashed. So the name of the book is pie restraint before we get into the book which i read The day before yesterday and yesterday took days to the early. Not sleep at all. So i got to finish it last night and i certainly won't give away the ending. Let's talk about your your Your life you are a federal judge right so tell us about that. Well first of all let me say thank you for having me on the show. It's always great to be in Fort myers beach. And i'm honored to ask to be a part of such an acclaimed program. Thank you very much. We are number one. Radio show on fort myers beach. Honored guess an opportunity to come speak but No i had a. I was in washington for proximity on thirty two years. I had a A a a a legal career attorney a government attorney for approximately fifteen years. Then i had the great honor of being appointed as a federal judge. And i retired as the chief judge of the federal trade in commission where we have presided over Some rarely large antitrust cases. What's the biggest trust case. You were involved. I had the distinct privilege of presiding over the largest case in ftc. History in two thousand three. it was called Then rambus which was a small company out in california who were in the d. ram facturing business and they created a new technology to break up the Bottleneck and d. ram memory so lot of the global manufacturers wanted that technology but as we came to appreciate during the course of the five-month hearing they didn't wanna pay for the technology so The ftc brought a complaint against this company And i think in hindsight maybe to somehow acquire their technology or the big orbit interest. Say that for bang but you know any big media yes During the court. I will say We had seventy four attorneys on this case about. You're hurting cats That was certainly it. But throughout the course of this Of this hearing we were issuing orders. Every day annual virtually the next day you would see a squib in the Wall street journal. Does it was such an important case. and it was a huge huge case. And then they were talking about it on you'll cnn. And also i mean that was a great honor to be able to preside over that..

"That he can and then you guys are up there trying to make it all work work together and come from the military where probably you don't have to deal with as much of the politics as you. You have to hear how. How do you guys. We've through that so you can try to figure out not everybody's going to be happy not everybody's going to agree with the final plan. So i d work through that so at least we don't get poisoned jerk so at the end of the day. I think it's it's about remaining largely apolitical in the military has done that For decades You know trying to steer clear of political influences in trying to be above the fray of politics a- as best As we can certainly This is an issue that generates a lot of interest And it's not unlike you know corps of engineers projects across the nation generate interest from communities. Even when i was back in missouri there were corps of engineer projects. They're man made reservoirs that When water was being held in those reservoirs to reduce downstream flooding than you've got the the people upstream complaining that the is holding too much water and then we let some of that water ago of course downstream folks have complained in the cores letting it go and causing flooding so there is. There's kind of an interesting relationship with these projects are so massive They impact so many people and now you know they've been around for decades so people have built businesses around them and economies around them. So obviously when your ability to earn money is under threat for whatever reason That causes people to get very passionate about things. And certainly they reach out to their local elected officials to share those concerns with them and the local the elected officials. That we hear from congressman mass. The congressman down there in fort myers They they're they're there representing your constituents. They're sharing that feedback that they're getting with us. And in many instances asking us Seeking clarification on what we're doing So that they can help educate educate their constituents on our activities as well. I become political. But i think that's part of it is just the nature of the corps of engineers in the work that we do. Well you mentioned The reservoirs and we actually have a question. Regarding that from fort myers beach councilman. Jim aderholt. he wanted to ask how new reservoirs that.

"Now in those you said there's five mm models as is there still some room to juggle them and adjust them. Because i know there's been at least down here. There's been talk of that. The feeling is that c c. I think would some with some adjustments would be one of the top top runners that people feel as pretty well balanced and sends as much water south as possible. So is that true there still some adjusting. There's still some will go on. So this the these these that are coming out or again another opportunity to have another conversation so I'm trying to remember the timeframe it was a few months ago that we shared some initial modeling where the focus was on. How do we get the best schedule. If we were just concerned about one particular project purpose if we were just concerned about water supply what is what would ask schedule. Look like if we were just concerned about The estuary communities fort myers stewart What would the what would that look like. And so we did that now. This integration to and so we told the team to go back and look at okay we found if the best if if nothing else was a concern of those single object these now. Let's let's see what we get when we put multiple objectives in there and what that looks like but this this i think drives a conversation on philosophy. So what weight do we want to give to. The coastal communities versus the white we give the water supply versus the weight on lake ecology and a number of other factors about talked about the team. Going back. who who makes up the team. That's kind of looking at this so the team. There is a two hundred member project delivery team if you ever hear the acronym pd t that stands for project delivery team. And so that makes. And that's an interagency and intergovernmental team so that is made up of representatives obviously from the corps of engineers but also state agencies and local government as well and so and these are folks a lot of them that are on this..

"A special music station. There are a lot of great News stations out there like wto p in washington and a lot of new york city but the small markets like Fort myers and things like that. You're not gonna find a really local news station which is good for us. We get these things like this and talk to the folks on the beach in small communities and it means a lot to the people that are in those communities to have their local news brought to them. But i wouldn't want to be in the radio industry right now. We're going through what they're going through like a lot of industries where the last year have right now but it certainly changed And it's just not what it was back when we had lots of fun. I'm sure you had lots of funding your days in walk as well so john tell us a little bit about the army corps corps of engineers. I think a lot of people locally have probably heard more about the army corps of engineers in the past six months then they they have a long time. Can you kind of explain what. The role of the army corps is in jacksonville and in florida. Bet sure so. That's almost an hour long. Show in and of itself. So the corps of engineers Across the nation thirty five thousand employees in the corps of engineers It is part of the us army. We are commanded by three star general that Has served in wars lieutenant. General scott spelman. The core is divided up across the nation to forty three districts I worked for the jacksonville district which has responsibility for florida The florida peninsula and also puerto rico in the us virgin islands. So we've got a lot of work. Going on down in puerto rico post hurricane maria Probably for your the the folks that are listening and viewing your show a. They're our biggest touch.
