It's our pleasure. It's our pleasure <hes> before we get started. Why don't you tell our listeners just a little bit about <hes> you and what you do sure so again? My name is Tim San Antonio Ended OPPORTU investigation background screening company here in Orange County passionate about helping clients mitigate risk in their business and also <hes> helping them come up with creative solutions to effectively mitigate things when litigation claims embezzlement fraud and other workplace related issues do arise all right. I like it. I like that minimizing their risk. That's my goal to so when it comes to background checks. I think that you know they can be used sort of in employment contacts. Write preliminary cautionary you know measures <hes> but sometimes as to unite both know right but they can reveal sometimes too much leading to claims of <hes> discriminatory hiring practices <hes> especially where <hes> in employer uses information that they shouldn't to make a hiring decision Asian so one of my first questions to you is and a voice. I've always wondered about this from the other side of things meeting not the litigation side of things but how do you handle the clients who wanted all even this stuff. They're not supposed to see see that's a great question. So there's a fine line between <hes> you know what's possible and what's compliant and necessary in the background screening <hes> arena <hes> so as employers in California <hes> there's <unk> state regulatory issues and federal federal regulatory issues the F. C._R._A.. Specifically <hes> so coins typically say well. I want to know anything and everything about potential applicant or new hire <hes>. What can you show me? How can you go <hes> in the question? In the situation. There is you can go a very deep and very broad. The problem is that from a compliance perspective one of those things like workers comp claims and social media and other sensitive areas <hes> potentially civil litigation in state and federal Rena those things can be the issues when it comes to pre employment background checks and so again <hes> the issue is not what you search. It's how you use it and and and what happens when those things come up so if nothing comes up you're fine but then I always tell clients well if something does come up in these arenas. What are you gonNA do about it? How are you gonNA use it? <hes> in the pre adverse adverse action process and how you're going to remove that conditional offer <hes> and they start to understand that you know that there are some compliance issues and it doesn't make a lot of sense to create more risk and exposure. You're in the hiring process when you're actually trying to mitigate risk so when you kind of frame it in the context of the risk tolerance is the company insurance and compliance requirements. Maybe requirements of their clients or customers have makes more sense to align the background screening process and the package each with those specific things as opposed to just going broad and even wide just because it's possible so it sounds to me like you sort of you sort of work with your clients who come in and say. I want everything sort of temper that by saying well an analytic how you said that it's it's not what you see. It's what you use your you said something to the words to that effect that I thought that was great. <hes> it is how you use it because that's what the you're right. That's what's going to get him into trouble. <hes> and I like this idea <hes> you sounds to me like you're sort of taking the role of the voice of reason <hes> in trying to get them the information that not only they need but they can use if they need to in the proper way. Does that kind of sound right exactly. Exactly I mean again. They don't the employers especially visit aren't thinking about what happens when something does arise so they wanna look but then they don't realize what what those <hes> ramifications are when something does come up that they shouldn't see and then how they're gonNA use it <hes> and so that becomes really what it's all about and also doing that effectively across all employees are all new hires <hes> and having kind of a plan which then you can replicate and use throughout throughout the organization as you scale and grow <hes> and that way you kind of have a refine practice and then from the employee perspective. Hey <hes> you know we we take we do compliant background checks to mitigate risk in the business which makes your employees feel a bit safer more are secure and on the on boarding process. It's a very professional way from the Gecko of seeing what how transparent the the potential the applicant or new hire is in the process and it's really that back and forth and it's more about the process than it is necessarily early <hes> found or not found. Let me ask you this. I WANNA walk through two aspects of this so one. I I know a little bit about to be dangerous when it comes to some of the stuff on background checks but I do know there's notice <music> <hes> there's notice requirements. If you decide that you're gonNA pull that conditional offer based on something you find in the background check now. That's a that's a ban the box law straight across but that's not just estate thing. That's a that's a federal thing as well correct well <hes> so ban the box was was has been has been adopted by many states and some counties and cities so in California as a whole bend the boxes in effect there are various other cities and states across the country that are adopting it so not all of them are in the same boat. Some <hes> states still just have Esi our requirements and no ban the box <hes> and I think that people get a little bit confused about ban the box and the box is not banned background checks it really was an initiative created to ban the the box on a background check on employment application where employers would ask applicants. Have they been arrested for convicted of a misdemeanor and felony in the application process process. That's been removed and what they're saying now is that you can't use that as a discriminatory practice you can do the background check once a conditional offers there and then additionally ban the box includes information suggests that you're going to evaluate things like the nature and scope of the position <hes> based on aligned with the convictions that may be found how long ago those convictions did occur even if there was going to seven year window which is the California rule for reportable convictions <hes> what rehabilitation has been done into those <hes> you know criminal criminal activity directly impact the workers customers or clients that that that that applicant or employee would be working with so. It's really <hes> increased necessary complaints from an H._R.. Perspective on it's changed the way that applications are being deployed Floyd to applicants so you'll you can't ask anything about criminal history until after there's a conditional offer <hes> and I wrote an article about that ban the box and adapting and some different strategies that can be implemented but <hes> you know it's a difficult thing for employers to deal with and that's it's always say background. Checks are getting more and more complicated. That's why you probably want to utilize a service that can help you insure that complaints yeah i. I did a <hes> so in band I knew ban the box was coming and so I kept telling my clients you know all of these things they could do to kind of mitigate risk and to get prepared for it and one of the things I suggested had to do with job descriptions going through job descriptions and thinking about what types of criminal convictions could reasonably prevent someone someone legitimately from performing that particular job and I got this great responsible it yeah theresa a great idea so what conviction like on my ear let let me get an answer for that so I actually did program <hes> with a colleague of Mine Ellen Cafaro who <hes> who provided that part of you know that part of the analysis and we just <hes> Re ran an interview on last show that I did with Alanon ban the box so it's it is very complicated and it makes it very difficult <hes> but speaking of the on the front end of doing the background checks I I've run into a lot of employers who were not particularly clear. They just think they can do it so that they can. Do you know tell the applicant. Oh Yeah we're going to run a background check and a lot of applicants. Go Okay but there's a lot that goes into that right yes so it's a typical kind of stumbling block or or whether may just misinformation employers have which is we put it in our our handbook an policies and we tell them we're going to do it and so that means we can do it and really not the laws surrounding it really in the in really the litigation around noncompliance with background checks really has to do with getting proper authorization. Authorisation and compliance and that means that the authorization must come from that book indirectly they must understand what's being done. They must get a notice of consumer rights and they must understand exactly who the background screening company will be doing the background check so if you have a generic form or you have one from prior provider about surely not compliant they really have to have the ability to interact with the background screening company which is commonly referred to as the Sierra Consumer Reporting Agency <hes> and that way allows them to ask questions contest records obtain a copy of the report and know who's doing it and so those areas right there are really the key things where employers can be vulnerable from a litigation perspective and really has nothing to do with what's in the report or anything else really do is just his the background ground. Check authorization disclosure a standalone document. That's not part of any other <hes> documents at the employee or applicant would fill out the issue there. They don't want them confused. As to what they're doing us we stand alone and that's the specifics fonts and sizes and it's changing constantly and so that right there is the first thing <hes> and whether you're doing that in paper form electric form <hes> it's very easy to stay compliant just by using the correct forms <hes> from the GECKO and <hes> I if you know if you want to let our listeners know from the employer side right if they if they want to look at any of the forms that you're talking about where would they. Where would they go to look? <hes> you know you can obviously go to the government say to the the Fair Credit Reporting Act C._R._A.. Noticed some consumer rights <hes> we have apps you can check with us.
