"This is a week. Where in theory members of Congress are off out of Washington for the Thanksgiving holiday to meet with constituents? Do what you WanNa do in reality though. This is the week where the House Intelligence Committee is going over everything they heard in the course of seven different hearings in the last couple of weeks encountered an irregular informal channels share baseless allegations with the president. My intent was to raised concerns because they had significant national security implications for our country. I've been hurt. President trump. Ask so he's going to do the investigation. Mr Giuliani's requests were a quid. Pro Pro quo for arranging a White House visit for presidents Alinsky assuming that the end of those hearings the next step would be to write a report and adopted the House Judiciary Committee and and see if that committee draws up articles of impeachment the House would vote on that Senate decides whether or not the president but with every day that passes beyond those hearings. We're learning that's not necessarily summarily. All there is to this story because the People Congress have heard from are not the only people they wanted to hear from and last night a judge issued a ruling that could have profound profound implications. Not Just for how these impeachment hearings go but for the trump administration overall. ABC Supreme Court contributor. Kate show with us. And so I mean can you just explain what this ruling was and why. It's a big deal. Sure Brad so this actually stems back. To the Muller reports Don mcgann former White House counsel was actually a really significant player in the Muller report specifically typically involving some of these obstruction of justice episodes began told the special counsels team under oath at the president repeatedly asked him to fire Robert Mueller mcgann said he refused even threatening threatening to resign so congress has been wanting to talk to mcgann directly since way before these impeachment proceedings were underway. This committee will hear Mr mcgann's testimony even that if we have to go to court to secure it this laws that has been in the works since last spring and now we have a ruling that says the administration has made basically frivolous legal arguments. Them again again doesn't even have to show up to answer questions in Congress I and in fact he's required to answer congressional subpoenas. He may be able to avoid answering specific questions but he can't just not show up. Yeah well that's the Mueller investigation like you said but I remember last week Kate. We were talking about John. Bolton the former national security adviser how much Congress wanted to hear from him in that they subpoenaed him but he was like no sorry. I actually have to wait for a court ruling to know if I'm allowed to comply with does this mean more people have to testify now. I think this ruling could definitely have implications locations beyond just Don mcgann so basically the White House has been making the argument with respect to mcgann with respect to Bolton with respect to Mick Mulvaney that these advisers enjoy something called absolute immunity. That Congress can't even require them to show up to answer questions and then maybe fight about whether things are protected by executive privilege. No the White House has said they don't even have to respond to subpoenas Pena's and this decision is a powerful rebuke of that legal argument. A federal judge telling the White House. The constitution never envisioned a president having the power our quote kneecap house investigations by demanding. His staffers ignore congressional. Screeners to judge is saying this is basically fiction this argument that you can ignore waffle subpoena subpoenas not an invitation or suggestion. You have to show up you know this is just one district court. I think they're almost the DOJ says that's not the end right you. You can appeal all this you certainly can. But it's also the case that if these former White House officials are a little bit hesitant about what they're what they think their legal obligations are they you could point to this ruling as basically an authorization for them to show up an answer questions in Congress you know if anyone is looking for cover in order show up to testify. I think this opinion very much gives them that. We actually heard Bolton's been going over this with his lawyer overnight and Kate. This was not the only legal decision the White House had to deal with last night right the. US Supreme Court is now looking at the president's taxes. I mean that sounds very separate. Is this related at all to what we were just talking about. You know I think. These cases are conceptually linked although the topics are different so there are actually two cases involving requests for the president's taxes. One from the Manhattan. Da One actually from a congressional committee but the White House is is making the argument that because the president is involved basically the normal rules don't apply and maybe the law doesn't even apply and that is basically the argument that they were making with respect to these advisers and their testimony and that this district court opinion really strikes down at the Supreme Court actually issued a stay on giving up those tax returns. Meaning they don't have to do it right now. And if the White House was looking for a signal that the Supreme Court might be sympathetic to the president that might have been pretty decent signal for them still a lot of judges right now saying the president's way more constrained in the White House is admitted in recent history. Kate Shaw thanks so much. Thank you Brad. And as we talk about impeachment remember. There's another central character that keeps popping up again and again and he's coming under closer and closer scrutiny. Rudy Giuliani the president's personal lawyer. The president's lawyer went on on Fox News to say he's not worried his client might expect him to take the fall for Ukraine saying things written. Why he's going to throw me under the bus right when they say that? I say he isn't but I have insurance but Giuliani now says in a tweet. He's being sarcastic. And while Congressional Democrats ponder their next steps while the White House fights it's battles while the White House Turkey Start Angling for their pardons. Let's get you up to speed here. ABC's Johnson Touchy is sourced up and down Pennsylvania Avenue and Jonathan. There could be new evidence in this whole debacle Well like you Brad. I was hoping is to focus on Turkey pardons but like usual. Washington is other plans for our weeks. You know I do think that as we start to see things if you will quiet down. Publicly as members of Congress are away. That doesn't mean. The work of the Committees has necessarily stopped. We've actually learned within the last couple of days. The House Intelligence Committee came into possession of documents records videos images and photographs. From one of Giuliani's lianis associates love partners Farnesina Gor. Fruman stood before the judge here in pleaded not guilty to campaign finance charges. One of the two that were indicted up in the southern district of New York case that is still ongoing. What's interesting there Brad is that that is the first person as a released Giuliani to actively cooperate with with this congressional inquiry? Now our sources tell us that it's a lot of stuff it's a Lotta video recordings it's images there's documents some are in English Submarine Marin Ukrainian. We don't know the exact substance that is so obviously it could be something huge. It can be something not so huge but the fact of the matter is that it is still jill cooperation ever the less that they are going through right now house intelligence chairman Adam Schiff announced. Today he will release a report. Shortly after Thanksgiving revealing ailing quote a fact pattern that is overwhelming unchallenged and damning. And so that's what. I'm trying to figure out John. I mean we've had these congressional investigations but we've also had the criminal investigations by federal authorities or those guys finding stuff that would influence congress in theory and if so does Congress need to slow its role. Well your your question is interesting. But then the other piece of your question is do Congress and the federal investigators in New York have to play Nice with each other and the answer to that is not really right. The feds are going about their investigation slowly methodically. We saw overnight. The Wall Street Journal reported. ABC is confirmed that the prosecuting nineteen in the southern district. New York has actually been issuing more and more subpoenas To the Guiliani orbit they asked for documents records etc etc and the details details according to the Journal. Is that indie subpoenas. They were looking for information about money. Laundering fraud campaign finance violations. I mean the list goes on and on and on the takeaway is that they are casting a wide wide net but John I just have to ask a really basic question. All the stuff about Giuliani's associates and pleading eating not guilty to campaign finance violations. I mean even if Giuliani himself got indicted. What does that have to do with President trump and whether he exploited another country to look into Joe Biden? Like what does that have to do with anything because they took the same road together. Brad because you have. The president is State's asking Ukraine go after Joe Biden while the road that he took required vehicle to get there and in the driver's seat of that vehicle was Rudy Giuliani. And these two guys partisan firm and were in the backseat. Rudy is a great crimefighter corruption fighter. I take your point that they're not exactly the same stars if you will because the president is obviously the focus of the impeachment. c'mon pro because he's the one that could be impeached and Rudy is the star of the Southern District Investigation which is still growing but the fact of matter is that they had to go on the same path together for what they were doing. And if there is something damning if you will in these documents records videos recordings etc etc that Congress has that could be something that would be focused. More for Giuliani stuff but it could have been actions condoned by the president. We don't know yet. Another nugget reported overnight. The White House is actually reviewing that attempt to withhold aid from Ukraine to go over their own phone records thrown emails and sources. They're telling you you do a real question springing up about whether there was a scramble at the White House to go back after the fact in justify all these calls John Santigi. "ABC's Aaron Katersky live outside the federal courthouse in New York, Aaron we'll come back to you. And a couple of moments. I want to go to the White House now ABC's, Karen Travers and Karen. The president his work to really distance himself from all of this especially in the last couple of weeks. But no doubt there there are a lot of is in the White House watching what's going on today. Absolutely. I mean, this is been an issue that has rattled this administration since April when there was that raid on Michael Collins, office and home and hotel room. This is something that really shook the White House then and his continued to loom very large. I want to go back to something that Royal Oak said which I thought was very impression given what Michael Cohen has said in the past. He said that Cohen dodged a bullet today. And let's not forget this is the same person who once said he would take a bullet for Donald Trump and the president earlier this year was banking on the fact that Cohen would be loyal to him. He said Cohen would not flip Cohen would not turn on him. Corwin, of course, signaled that his loyalties had shifted and that he was loyal to his family and not to President Trump. It's hard to overstate though how critical Michael Cohen was to Trump world. He was the president's personal lawyer. He was his fixer as he was known as he was also a fierce. Defender of Donald Trump and in recent weeks, you're right? The president has distanced himself calling Cohen, not very smart. And and, you know, saying that he wasn't a very good lawyer prompting questions of why did he work for you for so long? But certainly the president can't erase Michael Cohen from his past. And this the one charge in New York or the campaign finance violations that hush money payment that was made to stormy Daniels in the weeks before election day and to Karen McDougal. This first time that prosecutors are trying to connect the president to these crimes. Because of course, we heard them say last week that Coen acted in coordination with an at the direction of President Trump, Alex, president story on his involvement in that payment to stormy Daniels. It's changed over time. He at I said, he didn't know anything about it. He later said he only found out about it after it was made. That's very critical what he knew. And when he knew it it. Let's go more in depth on all of that Johnson. Tucci ABC's, John Santigi. He covers. The Trump send John that that loyalty between Cohen and Trump did definitely has changed over the last hour or so. It is gone, Alex. To remember his Karen, rightly said, you know, Michael Cohen would brag about himself as Donald Trump's pit bull. He was a person that was always sent in to clean up Trump's messes. He was a person that interfaced with the press. We know that is a big priority for this president and his family day care about what they're media perception is and before it was President Trump. It was businessman. Trump Cohen was Donald Trump's PR guy. He was the one that would call and complain and try to correct a story. If it wasn't something that businessman Trump Bill. I'd like I mean that was the role. That's what he did for so long that relationship at definitely frayed over the years. I mean, they know obviously, it's gone completely upside down in this last period here one he flipped in cooperate with federal authorities. But you'll remember as we saw reporting over the last several months here. I mean, the president is slashed Michael Cohen salary when he was working for him. He was pushing Cohen aside. Cohen was in charge of the president's twenty twelve exploratory look at running for president had no official role in the president's two thousand sixteen campaign. Unlike many others around the president Michael Cohen was left very much on the sidelines going today saying that he felt it was his duty to to cover up for the president's dirty deeds. We have to believe that he's referring to the alleged hush money payments to to stormy Daniels into to Karen, McDougal you cover the Trump's you. You're listening to breaking news. Donald Trump's former lawyer Michael Cohen has been sentenced to three years in prison. Live coverage here on NewsRadio KFB K and saying this is getting closer. They say, no, the the public message of this is completely separate. And and there's no connection whatsoever. So here's the thing to remember and all of this. And this is what the Trump said Trump organization folks at the White House. No, this is the beginning of multiple investigations that are going to open. So let's start with what we know about on the law enforcement side, we know that there are three separate probes right now looking into the president his family the organization, we know obviously about Bob Muller. He's the one that everyone is talking about all the time with the special counsel's probe. We also know that besides Michael Cohen the southern district in New York has been looking into actively abroad by the Trump organization, the third prong, and this one in my personal opinion is potentially the most damaging for the president. Because it's not pardon proof is the New York state attorney general's case they are looking into Trump foundation. Remember that was the pound Dacian that the president allegedly was using to buy personal portrait of him. Not necessarily giving always to charity that we know that the incoming attorney general in New York state has said she's going to continue the investigation that been going on by state authorities there and the president doughy can pardon anybody convicted or charged with a crime in a federal case that does not bleed over into a state cases, we know. And then, of course, it come January, congress and subpoenas. I spoke to several people close to the president and close to the Trump organization earlier this week bay. No, they are going to get mountains of subpoenas starting in January. And they know that if they are legit, Alex. They are going to have to comply how much of all of this. Do they believe it's just political that that there's nothing really there that that this is just a political witch hunt? The message that the president is constantly putting out there are many people around the president that are in lockstep with him. This is a witch hunt. This is. Completely being led by Democrats. They believed that Robert Mueller who let's just make one little fact check their either Republican buddy are thinking that he is surrounded by Democrats. They just are serving to take down Donald Trump. There's definitely a coalition there. There are others that have been around the president for a long time. Several former attorneys at his acknowledged that you know, what not everything with the Trump organization may pass the smell test here as we mentioned the foundation is a big concern for many individuals here. We know that the CFO of the Trump organization Alan Weisselberg had enter into a cooperation deal with prosecutors in New York southern district. He knows a lot. He's been with the president before the president built Trump Tower. Alex, he actually works for the president's father. He knows we're how Donald Trump started his business things these done over the years, and we're currently stands today. Johnson tucci. He covers the Trumpster ABC news. John. Thanks. I want to go back to Royal oaks, Royal really specifically talking about Cohen here that moving forward in this case, he pled guilty. Can he appeal this sentenced today or does he have to take it because of the the guilty plea? He's got to take it when he enters a guilty plea what he's doing is throwing himself on the mercy of the court. And so this is the deal. The only question Mark as we've discussed it could get even shorter his sentence, if he cooperates further, and of course, alternately the president's potential culpability whether in an impeachment setting possible criminal charges after he leaves the White House may rely on Donald Trump's state of mind about the hush money to stormy Daniels. And Karen McDougal, did you consider the money just another cost of doing business or engaging in personal conduct? Or did they in any setting admit, he knew it was a campaign contribution paying money to help when the election? We know Trump is is not a big Email person. Provocatively? We know Michael Cohen made tapes of his calls with Donald Trump. And prosecutors have those tapes someday the world may learn what was said between them in two thousand sixteen he may not like E mail definitely loves Twitter. And then that comes into play with a lot of this as well. You heard behind Royal there a moment ago the sound outside of the courthouse. This is what it sounds like. We are expecting Michael Cohen two walkout here. Any moment. There are microphones that are set up. We don't know if he is going to choose to.

So they've put out the word that they want to catch whoever did this. It's not funny. Thankfully, though, there were no actual threats. Everybody is. Okay. So eyewitness weather the weekend. The nice part is it's going to be partly sunny, but it'll be chilly. Thirty eight degrees, less windy than today. That was pretty brisk and breezy out there. "Okay. Want to hear about some of the weird rules of the Royal family. Oh, yes. We remember we were talking about this, but we didn't, like I said, a quick Google search. Like didn't give you the results I wanted or something. Yeah, I want to know what the other ones are. I heard something about Megan Markle not being allowed to our wedges. Yes, that's what I told you. Oh, you did tell me did because the Queen hates wedges. I give them today. They're so cute. They're so cute, but a lot of the things the Queen hates. She is so seats with like lower class. What if she were like? I hear what shoes 'cause ganglion cysts. So they're out. That's just good sense. Yeah, a lot of the rules are based on the queen's arbitrary preferences that have to do with class and home, weirdness. Okay. So what else is, what else are peasants using, but making this, it's not allowed to have anything with garlic. What you're saying Megan, but I mean, they're not allowed to have garlic like official events. They're all bam, Pires in clearly it at home, but they cannot because garlic breath is offensive. That's the reason. Okay. She's trying to avoid any public humiliation. It's what the sounds like. Yeah, and the women have to wear pantyhose. Okay. I'm out that's just asking for these days. Is it extracted. Area for all the time. No, I do not want to know what's going on in queens undercarriage. Okay. They have to get blowouts the women three times a week. I really heard something else. And I was like good for them keeping alive. Those looking men blowouts. Got it. That doesn't sound like a rule as much as a luxury. Right? I was like, okay, although they were pointing out how because Megan has quote unquote, ethnic hair. Yeah, needs time, you know, maybe go under different. I don't know how it works like if that would hurt her hair to do too much or maybe different rules. Yeah. One weird rule is the game of monopoly is forbidden. There's a story behind that. Yes, there is. Okay. Played one one day and you know the brother Andrew Prince, Andrew married to Fergus. Oh yeah. Yeah, yeah. Yeah. He was so competitive in the family was so competitive that he then said no more monopoly, and so that's right. Does. 'cause oh, given the family, the English tradition of colonialism by, yeah, they're not. Maybe it's like too close to home are like, oh, this reminds us of our. Yeah. You think like they would be really bad at taboo. Although maybe they'd be really good because they have to be real careful about their words, veto they. Oh, so they wouldn't accidentally? Yeah, the wrong word, but they would make no associations. We're like that. The other like common folk with, they'd be like, oh, you know, that thing that we when we were in the south of friends. Yeah. They'd have to only play with each other. Yeah, it'd be like, okay, they have to wear natural makeup and they are not allowed to wear false eyelashes. Good. A lot of people were surprised that Meghan Markle look very natural at her wedding, but that's probably why she had to rules are rules. They are always required to travel with a black outfit in case somebody dies while they're away and they have to go to a few holes minute that is the most depressing rule. You're basically always ready to mourn. Yeah, that's sad. And then when they're away also like traveling to other places, they're not allowed to eat shellfish because there's a higher risk of being poisoned. I think they mean food poisoning, but yet saying poisoning way more fun. What do you think about those? You know, some of them I can get behind. I don't like anybody telling me what to do. I definitely don't like that. But I mean, garl- no garlic at a party is just not the Borst thing. I disagree. Of course I could twisty garlic bread. Yeah, and like everyone's eating garlic minister at the olive garden. They are the. That's why. Can you picture that was the old guard it? Have you seen the video up? Did a Red Lobster too since they can't have the mercury? Yeah, and just cheddar bay biscuits only did you see the video where people say that Meghan Markle has developed in English accent? Oh, that happens and I believe they do, and there's a name for it. It's what happens when you're a person who's empathetic and you're around people. I hang out with Kenny Santigi too much. And all of a sudden I'm born and raised in jersey..
