My grandmother was born in rural georgia during the late nineteen thirties and so she was growing up the jim crow era and lived in a racially segregated community as part of the great migration in nineteen sixty. She traveled west and at that time for the first time in her life she lived and worked around white women and she was amazed by the number of white women diets. Seems like what is this. You know sort of like a typical black grandmother fashioned. By the time. I came of age in the one thousand nine hundred ninety s. When i was in high school she was still troubling over. This question like what is going on here. She would even ask me like why women dying to be thin. And i was like sixteen years old but it wasn't until about ten years later when i was working in a predominantly black community in san francisco baby hunters points. I met women of color who were hiv positive. And we're attaining an hiv medication adherence clinic where i was a researcher who refuse to take their medications for fear of gaining weight. There were three hundred and twenty men and the peer when the explosion occurred all of them died instantly. Two thirds of the dead. Were african american enlisted men who were working on the dock. In fact this explosion by itself was responsible for fifteen percent of all of the african american deaths in the second world war. But it wasn't too far away the biggest difference and the reason why the fatalities were lower. Portugal is that there were no civilians on the base. The thousand cap is not well will will Well known at the moment You know there could be a lot of problems. Also there's a big concern. Some of us have about having roommates and having relatives. What does the say about whether or not you can rent short term to a relative while. You're there or to france in a lot of roommates situations. A lot of my clients will wonder about that. And all i can tell them is that it's a little bit unknown. Because the ordinance prohibits quote non ten uses. Which is quote win. A landlord is allowing the unit to be occupied by a person or entity who is not a tenant unquote and there were ten is defined in our rent ordinance to given the broad definition of rental units in our rent ordinance this would appear to disallow us of a dwelling by property owners family member or roommates in less the unit was registered as an aloe now. Did the board of supervisors in ten that. I rather doubt it. But the way they've written the law. When can never be sure. And i think i would be getting calls on that subject matter. I think the the example you just gave there is a very good real world example of where high-level city housing policy about making housing available for long term residents Intersex and comes right up against the traditional argument of as a private property owner. This is my private property. I have a bundle of rights that go with a a new cannot take those rights away unnecessarily or unreasonably which means anytime we have a housing law in san francisco. We have the result of a lawsuit about policy versus property owner rights. Do you see this headed for litigation will matt. I think it's a lie. ends up. been litigation really depends on whether the largest housing trade associations in the city find this to be a great problem for their members. There's a small property owners of san francisco. There's the coalition for better housing representing large apartment building owners and The san francisco apartment association there are about two thousand two twenty seven hundred Aloes the city. They're not called Been around forever. Question is are. Are those hours active in those trade associations. How active are they do. They represent a lot of the members of those associations. I don't know. But if any of those associations find their a large portion of their membership affected they have every incentive to try to court to overturn this. I don't know whether the court will overturn it. I can tell you. There's a lot of uncertainty and lack of definitions in the ordinance that perhaps only a court ornamental. The law can correct such as whether your roommates who ran for thirty two to thirty days to twelve months or your family members Cause you to be in violation of law As for whether or not the log. I think it'll take further analysis by litigation attorneys to determine that But this is another example of how the board of supervisors goes far in trying to regulate the market and sometimes a misses the mark over oversteps Increase laws it. Former tenants or competitor's Their fines for having an iro utah after june. Twenty twenty two and that's effectively works. In the meantime unit can apply be eiloz By filing a building permit or alteration permit to the building department which should be routed to the planning department in the permit will simply say that we seek approval for short term intermediate occupancy unit and the amount of construction can be listed as a dollar the permits issue in simply changes the us from a market rate dwelling unit to aloe. That's essentially the application so intrusive francisco fashion. You go to the building department to apply for the planning commission permit right So if you've applied for this permit and it's granted. Does that mean that you could no longer rent that unit. As just a market rate. Long term rental does allow a unit to do that or does it restricted unit to only that good question. The law says that. Tom you can Go back to offering the unit for more than one year without us losing the right to thereafter change it back to a rental of thirty days to one year you can go back and forth the only time when you lose your right to use it for intermediate length rentals if is if three years have gone by and you haven't one trend to the unit as an aloe sh but as long as you You you keep you. You rented on ilo use once every three years. You don't abandon it. And you can go back and forth between being a non aloe allow an ilo. Gotcha so for folks in san francisco that wanted to short-term kind of allah airbnb rentals. The city is created the short term rental registry that has a very specific process reporting requirements. And then you know. There are other laws that affect property using san francisco. That don't have nearly that level of upfront reporting and auditing and it sounds like the enforcement of the i. alot is more like the second and not so much like the creation of another short term in this case intermediate term length rental registry. That's correct matt While the planning department we'll keep a registry Of what size buildings have what number of iowa's the city is not hiring new staff as they did for the airbnb short term rentals to applications review. Them question them and then register them. There was funding for that on the airbnb. Laws it's called had the funding to create a staff to go through the elaborate process of reviewing accepting applications. In the case of the iro law. It will be much simpler when just files in alteration permit indicating a change of use of the unit to an ilo gets reviewed by planning in planning basically just registered in their In in their files so that it can keep track of several things including weather. At the time you apply. There is already been in approval of one thousand of such units in the city. And i'm afraid to ask this question. I'm but once we've counted up to the thousand Ilo units that the city will now allow. What's the process for. Actually taking something off of that list since. We don't have proactive in enforcement. How do you actually is. Is there a process to figure out. If you know a thousand are actually still in use or is that just kind of. We'll see how this goes. I think i would put that in the category. We'll see how this goes because there's nothing in the ordinance telling the planning department Howard should count whether or not a particular kind time. I should say whether particular time when thousand eiloz exists. For example people may choose to take an ilo rented for more than a year while the question is the inform the planning department of that and does the thousand seventy become nine hundred ninety nine when that occurs. These are interesting questions and none of that has been resolved. So i guess if i'm a property you know if we're looking at this and we're thinking you know if you're looking at these unit restrictions one to three units none forty you forty nine units less than two point five of them ten plus twenty percent. Max it's very much about preserving kind of existing housing stock End my question. Like what if i've got a ten plus unit building right now that i've been completely using intermediate length occupancy. Just you know. I didn't do a asandra dramatic thing. It's just how happened over. The years is are these situations grandfather. Dan or none of that allowed. Come twenty twenty two. That's a good question. None of these are grandfathered in for example if if in a building owner wants to continue his eye lows in building of more than ten after the date of june twenty twenty he cannot in less summer all of those islands have received an alteration permit to have their us officially changed to i allow before june. Twenty twenty so on the one hand. I'm kind of hearing that. There's a reasonable amount but not a massive amount has ever been on the radar to upset the housing policy makers of san francisco. Happy near happy new year's well here's looking at twenty twenty one So you have been doing san francisco real estate in real estate law for a very long time and we are so fortunate to have you on the air today to speak with us about a very specific law which is intermediate occupancy law. So maybe before we even get started about how this came to be what isn't intermediate occupancy law thanks man it's actually called intermediate length occupancy law and all grieve as i l o. That's what the industry calls it and what it says. Is that starting a couple years. Only a thousand unison. The city will be allowed to be rented between thirty days in one year and it affects for kinds of buildings First of all buildings that one to three units which can't have these at all if they have them today they have to stop. Then in effect seed billings afford to nine units in the Aloes are loud there as long as the number of the building does not exceed twenty five percent of the units in the building. Then there's a category of buildings ten some more and i a- lows are only allowed there if the planet commission gives approval and the planning commission has a lot of discretion in the planning commission to say yes. Ask you to show the following three or four things first of all that at the time you seek approval from the commission. There's only a thousand or less units better. I at that moment you'll have show that only twenty percent of the units in your building will be you have to show that at least two thirds of all at the time our downtown and you have to show that less than one third of the is at the time we seek permission. Aren geographic areas of displacement. And they're they're given The locations of those areas of displacement in recent years are indicated we can go into which areas they are later but that is essentially the law and one more thing if you ever building than has notice of violation against it for any reason your disqualified from being off from having i lows in your building and you were also mentioning. There's the fourth category of building while the fourth is a building that has vs. Okay so i. Re- categories are distinguished by the number of units and the fourth category is building a with overseas notices of violation. Which case you have no chance of having l. alot ellos and does the date of construction of the building matter at all or is it everything that's ever been built in san francisco. It's everything that ever has been built. There's one rule based on a day. Any buildings built after june. Twenty or june. Fifteenth of twenty twenty cannot have eiloz at all so from here on new. Buildings cannot have iowa's gotcha and in terms of unit counting may. Maybe the hasn't been litigated yet. Are unwarranted units units for the purposes of ilocos. It's a good question. The ordinance does not say that but other ordinances in the city for example. The ordinance called copa which gives nonprofits the right to By building three or more units in that rule a non-legal unit doesn't count toward being one of three units for the purpose of deciding whether the building is three or more units and thus subject to copa which gives the nonprofits the right to offer to purchase prior to the in general. Yes so hopefully. It'll be interpreted that way on this law. I would hope so if you're listening to this. You're like wow. This sounds like a really complicated law. how this law come to be. Why do we need it. Or why did i not that you can speak for the board of supervisors but what can you tell us about how it kind of came to be in the problem that it's tempting to solve sure we'll for many years. Progressives in the city have been considering going to the board of supervisors to regulate the number furnish rentals that are short term with the idea that those units are taking away housing from those who have a housing needing can't afford market rate housing but what really was distracted for the camel's back was the project known as twenty one hundred market street in which the developer bryan spears. Put up a. I think about sixty units and without telling the city he was doing so he mastered least all rental units to accompany called saunder and that of course was a good deal for him because it means he never had to worry about vacancies. That saunder would take the risks. There were vacancies. He'd get one steady check from saunder. Every month and people noticed it. Solder was moving in furnishings. And obviously there were all of them. We're going to be furnished. Units with the exception of eight units that are below market. Which saunder did not lease so city planning for was made aware of it in the board supervisors were made aware of it end a felt. This wasn't the intent of the planning commission improving in approving the project however looking back to approval there was no Provision that this could not happen in fact the laws did not prevent this from happening so while many intended to half saunder its use of the building that way The c- could do nothing about it. saunder end. Mr brian spirit had found a loophole. It was perfectly legal and the board of supervisors decided. We should do something about this by creating some legislation and that's how it came about met so that is a conflict complicated story And actually you know to your point. intermediate length occupancy law rentals have been around in the city for a while like sander is not the first company and bryan. Spears is not the first developer but what was very different as you pointed out was this was brand new building and it was one.

You know, we as an industry can do but not only that my Samsung has a burger can do I'm going to kind of take that down to do too because it sounds like you've already given us the first one which is don't be afraid to start a conversation. Yeah. I mean don't be ready to start a conversation. Don't be afraid to follow your foot if you say something ablest it's okay. And if you don't know something ask and like but I would say the big thing that I'm gleaned from talking with you today, but that's about the industry. I came into this call. I don't know the real estate market like I don't know anything about this. I'm literally just sharing my disability experience. You mean I'm really the only one here that seems all weekend Googling houses down and looking at real estate on the internet. Okay, I mean probably not but of the two of us wasn't your weekend. Yes, I look for other big things that I can enter, but that's that's besides the point. But no but you know the higher more disabled people talk to them be aware of your own able ISM in the market and like for you as a as a broker to just run run up the stairs of a listing a stable person. They'll be whole that's a whole deal to think about how the privilege in that and think about like I know obviously there's a lot you can't do because the city like you said, it's pretty a lot of the structures or pre 88,000 pre-1990 and all that stuff. But like we can at least start having the conversation like California for power wheelchair users when it isn't a fire tornado of death Is you know somewhere that that a lot of us like to go because it's warm like imagine not having accessibility in your apartment when it's like minus 12 or inside like how crappy would be to try to try to gain access when you couldn't like getting cuz of the snow. So I think California is in a prime position to move more accessibility for these individuals. I mean and also think about like think about how annoying it would be if you wanted to right now Matt go get a glass of water and you couldn't reach it you're in your accessible thought and you couldn't do it but it's accessible to you. Right cuz you can get in the house. Like we need to expand our view of what accessible means past. Oh you can get in the room. That's not what it is. So close yet so far right and some ways off worse, right? Cuz we got you closer to the water but not loose enough. Yeah, exactly. Like I would say this I would say accessibility is a feeling it's not only ramps and elevators wage. Buttons, it's how do you feel as a disabled person when you're in the room, if you don't feel like your needs are being met the room is not accessible for you. The event space is not accessible for you. The hotel is not accessible for you. If you'd like your needs is a disabled person are being met. And so we have to look at accessibility as a feeling versus like a thing we have to tack on at the end and I feel like everywhere not just a real estate not just in your industry, but every week if you like disability is requirement and not something we give value to and we think about from a holistic standpoint accessibility is a feeling I actually I think that's a great quote thought it's here to me. Do you say it all the time that's like an Andrew Garza ISM that I'm trying to make it strong enough to be a hashtag. Yeah. I mean, I've tried to make it a hashtag it hasn't caught on. So maybe I'll make it a shirt and then perhaps we can do here Jackson full of real estate from our global social media headquarters. Maybe you can wear it with your nipple out and it'll go Wildfire. It's San Francisco crazier things have happened off. Turns out of control true. Let me see if I can sum this up number one don't be afraid to have that conversation number to recognize that this isn't an hour and you think the eventually all of us become less able and disabled in some way over time. I did a walk-through for a theater here in Toronto last week. They asked me to do I'll just clearly tell the story. They asked me to do a walk-through for their front of house for they wanted their front doors and their bathrooms and they're like ticket counter for their theater to be more accessible and everything. I said to them they said to me. Oh God, I never realized that I never understood that now and now I do and so it was such a cool experience because when we left and I really over there they went thank you so much for telling us we would have never realized and now we do and now he can make our business more accessible. I just thought that's really really cool better than awesome story. "Who I am. Is in the market to buy a home here in San Francisco, but I was amazed how little our multiple listing service actually supports wrong information. It's pretty not disability or so. There's not in most businesses. Generally whether we're talking about real estate or you know, because we're both gay men because talking about later like Club owning any business you go into will probably not have accessibility standards listed or what's available that's accessible which is a shame really because like even thought I'm looking to visit places cuz I do a lot of traveling with my work when I'm looking to visit somewhere to stay for a day or two for work. I often look for airbnb's instead of getting a hotel because their babies tend to be a bit home or in a little bit cheaper sometimes maybe so I always look for accessible and you would be surprised how very little that's often included in what I look for so I can't imagine trying to buy a home. Looking for very specific accessibility needs and having no options available to you. Well, let's just kind of, you know, start making this a theoretical conversation off and let's say you're my buyer and you came to me and said, you know Matt my speaking and Consulting career is off the charts phenomenal cuz my podcast is such a used bike. So I got a couple of million to put down on a place here in the city. Could you help me find it if you were to say that to me I'd be like sure and real help you out and then you know what happens next month and then you go there's no listings. Oh, you've got a good budget two million bucks. We're definitely going to find you something here. If I was to turn to our multiple listing service wage, which is kind of primary way that agents communicate listing availability to other agents in San Francisco. It's also what feeds all of the public sites like Redfin and Zillow and so on and so forth. Currently the San Francisco MLS has arguably for perhaps five fields that are related to accessibility and disability. Are you ready? I am ready elevator yes or no handicap bath. Yes, or no lowered switches. Yes or no wheelchair access yes or no and flashing warnings. Yes or no. That's it further more of those five. None of them are actually required. So unless the listing agent goes out of their way to enter that information that doesn't propagate through the system and then on top of that because those fields are soberly used most of the large portals and brokerages. Don't bother to map them onto their public website. So even if the information was listed in the original Source, it never makes it to the website almost dead. Ever we can't rely on the MLS. We got that one, but I actually do have a little bit of good news about the MLS going to share it with Andrew. I'm ready this coming twenty Twenty-One. San Francisco is actually moving to Georgia original MLS with our Bay Area partners and the number of disabled and accessibility Fields goes to over a dozen. Well that's better. It's a lot more descriptive package because based on the four, you've given me like, what were they again? Does the building have an elevator does it have a handicapped bath lowered switches or wheelchair access off or flashing warnings? Okay, because I have questions. What does wheelchair access mean? Who are they talking about because guess what wheelchairs come in different shapes and sizes and wage, you know, some summer power somewhere manual so like to say as the end user of both the apartment and a wheelchair to say. Oh, yeah, it has wheelchair access dead. I use a power chair for instance. So my chair is often too big to fit on to fit in accessible buses in to fit into like, you know to just hop on a bus and go on my chairs often too busy. So when they say wheelchair access my first thought is a buyer is which will surely talking about what you know, have they done the specs to make sure and I would guess probably not and thank you Andrew for walking our listeners into the frustrating catch-twenty-two that exists because guess what exactly to your point no listing agent knows what wheelchair access means and no listing agent off to get sued about misrepresentation. So since it's not a required box and you don't have to figure it out. They just never check it. Oh, that's even that's so that's so bad. I mean that seems to be the level of ableism in this market because it suggests then that a disabled person in a wheelchair who does have two million dollars in the bank and wants to buy a fancy sfbay home which by the way it can make the happy. Yes, I want to do that. It's all on your man has the consultant career, and I know you were rocking. I just bought my disability after dark t-shirt. So I know your merch is like off the hook as well. See what people are hot. Sure. Yeah. Yeah, that's yeah. Yeah, that's what I mean. So many hashtags Andrew so many hashtags. I saw the Twitter yesterday so many hashtags, but you know, they need to address their able ISM because disabled people deserve house and they deserve proper housing that they can access like they shouldn't be put in places where yes, it's accessible and that I can get my wheelchair in the room, but I can't feel at home in here and that sort of where I live right now. It's my home and I'm I liked it and I liked it. It's accessible ish, but I still can't if you were to come over and hang out of my house or and I couldn't be a good host to you. I could offer you a drink. I couldn't you know what? I mean. It just feels very inaccessible. So and based on on some of those some of those boxes. You've told me that are in the MLS they're dead. How big is the elevator can more than one chair because what have you what if you have a friend that you want to go out with and you want them to come the other with you? And also you also said handicap bath. Like what does that mean? That makes sense to me. First of all, it should say I would hope it would say bath and shower because a lot of disabled people need more space a lot of these units that they put people in don't account for the fact that someone with a disability might not not everybody but somebody was complex disabilities like me would need somebody to help them shower help them dress a problem with all the activities of daily living that many able-bodied homebuyers probably take for granted in I have to think of the space for myself my wheelchair and another person. So when it's often things like handicap bath my very first set is well, what does that mean? You didn't lay it out for me and my feeling is and it feels having you know having heard that from you and having you read those things out. Me it felt like they put those check boxes in there because they were required to by the Ada or they were required to bylaws. They didn't get sued but they didn't get their due diligence in like what does it mean? Did you hire a disabled consultant to test what that means? Did you ask the community what they need? Probably not and if you just one person you didn't ask enough because guess what every disabilities different they're going to tell you different things. So you need every single thing available to you. Well, I wasn't around for the addition of these fields to the office last. I've been involved enough and Industry MLS politics that I am not stepping out on a a risky limb here when I say there was actually no requirement that we add these fields but you know, there was a lawsuit and it was like, you know, we need to do something so that you know, we can show we've done something. So here we've done some things and.
