"Keep an open mind and let good conversation cost six point seven five four ten thirty four eight nine two nine ten thirty. Nightside with Dan Ray on WBZ NewsRadio. All right. We have reached our number twenty here. It's been an interesting week on nightside as I think it tends to be just a real quick recap. Then we're going to give everybody an opportunity to chime in on any of three or all three topics. We talked about Monday night, we had people predict what they thought President Trump's ultimate fate would be whether he'd get reelected whether he would be impeached removed from office. Interesting conversations we actually did pretty much nearly four hours on Monday night. Which is a very rare occurrence, we also referenced the riots in Paris over climate change and the taxes that are associated with it. And the government of Macron Tuesday night, we had Sam Barbara the owner of the marijuana. Distributor retail distributed. Cultivate, he's a CEO as well as the chief of LeicesteR, Massachusetts. Jim Hurley talked about two hours about how that transition up. There has gone then we spent a couple of hours from ten to twelve talking about the showdown in the Oval Office. Amongst President Trump soon to be again house speaker Nancy Pelosi and the Senate minority leader Chuck Schumer of New York Wednesday night did an hour on the concept of group think in how people are being forced actually a couple of hours about the concept of assuming based upon people's appearances based upon their their gender based upon their age based upon their religion based upon their race or any other characteristic where people think well that person since they are that way they must vote that way that's not troop on Wednesday night at ten o'clock had a great our with Chad Fallon the principle of Medford vocational. Technical vocational. Technical high school. Also, one of his teachers Lauren Sherata was in school. She teaches in in studio she teaches cosmopolitan mount policy there. Then we criticize times choice for person of the year talked about that. Last night did four hours two of which were on which were political. The concept of whether or not people should be able to run for president under the age of thirty five that's not going to happen. But there was an article in vox, Vokes, vox magazine, a website, you say about how brilliant Alexandrio Casio Cortez is the new democratic socialist out of New York, I begged to this great talked about the new tax on telephone text messages that could be in place in California soon, we the WBZ car guys in last night. Larry, Scott and Tony to great hours. Great calls. I two hours time we talked about no plastic bags in Boston. And last hour about Jim commes. I thought incorrect. Improper comments that he made about sending FBI agents to go interview. General Michael Flynn, and that issue will come up next week again in court in probably on nightside. Let me just preview next week coming up. We will have with us in studio on Monday night. Marshall Sloan Barry Sloane, and Linda Sloan k the the leaders of century Bank gonna talk about. Establishing a relationship with the Bank. You know, I've been a customer essentially Bank for a long time. But also talked about getting home mortgages, particularly for millennials. "Good evening. My fellow citizens tonight. I want to speak to you. Nightside. Get ready. Interesting hours. I hope you enjoyed those both gentlemen, were really very their respectable you'd expect out of the police chief, but also Sam Barbara young guy into the ground floor of a business. I'll tell you. It's it is here to stay whether we like it or not. And of course, there will be battles fought in different communities, and we will keep on top of those. Now, let us move on. There was a very interesting meeting in the Oval Office today in which the house speaker and the Senate minority leader Nancy Pelosi, the nation say the house minority leader and the Senate minority leader soon to be Nancy Pelosi, the house speaker. They met with President Donald Trump, and what came up for conversation. It was but a fifteen minute back and forth between and among. The president. Nancy Pelosi and Chuck Schumer conversations about border security and about the wall. It was almost a debate a debate. It was an extraordinary example. It was basically the the they shoot a photo op showing the president, and and his guests, and then the media would be normally just shown the door. And but they didn't do it. There was a back and forth between and amongst the speaker. And the again soon to be speaker and the president and the still the Senate minority leader Chuck Schumer. So let's let's just get it going here. If you haven't had a chance to listen to what transpired today, we have some very quick soundbites here, and let's try to walk you through it. This is the president. He kind of started the conversation talking about the wall. But the walls very important thing to us. I might put it a different way border.

"Back to the phones we go Jose is working hard. He's the heart. Rob jose's. The work the hardest working guy in the building. I'm telling you. That's true. Jose you number one, man. Let's go to Roberto. Roberto is in roslindale. Hey, roberta. How are you? Good evening, Dan. How you doing? I'm doing great. You're on the ringcentral nightside caller line with Sam Barbara the the CEO of, cultivate, cheap. Early in me, go right ahead. Roberta you've got the mic. Thank you. Thank you. And chief, thanks for your service. Thank you very much. Yeah. I appreciate you guys being tonight. But I think like. Blumenau proportion with the whole, you know, driving in the fluency of. I mean, I think more people are probably going to be more. Being sleep deprived and distracted from other things more than they would just from the marijuana. So. I don't think as much of a big deal or something like that. Well, I can I can say this Roberto chief to go ahead. I I I would agree with you. I mean, obviously we talking about marijuana tonight. So we're talking about driving under the influence of marijuana. Absolutely. But we we're in the media. Middle of an opioid crisis. And there are people and driving under the influence of opioids. There is too distracted driving and drive down the road. You can drive anywhere in the KOMO often. You see somebody on a phone? I agree with you on all those points. But we're talking tonight about marijuana. And that's the issue. Right. And you know, the marijuana. I know everybody takes anything differently. Just like if you took a shot, somebody might fall on the ground. I mean about somebody my phone the ground or somebody would take ten more in Dr St. so people, you know, we'll take marijuana in may drive the best role in their lifestyle. I I've seen people react to things differently. Like that. Will get rid of you telling me that you know, people who are out there smoking. In the letter driver. I it may not be a bowl. They call. It a. People react differently. Let me ask. Yes. Okay. 'cause 'cause you you raise a good point. And I just challenge you just a little bit. Do you think that marijuana usage in Massachusetts will lead to some car accidents and were some car fatalities? Anything is possible. Dan. You know, you could be looking at the nice. So. It's worth the and again, we're not heated debate it, but it is worth having the access to marijuana is worth whatever problems might results not worth the problem. But I know that there's you know. Pros and cons to everything. I just know some people's gonna react completely downward spiral than somebody else. I can say. People call these like, they might write the best paper based off of taken marijuana. It's a whole way like your mind opening up the focus. It's just some people, of course, is going to, you know, react a whole different way. But one thing I have for the CEO is guys ever considered. I notice a profitable business drug dealing and those sound crazy but same way. Everybody's making money off drugs. Anyway, post will you ever thinking about helping the guys who had drug offenses? For small amounts currently doing or go back and forth to court with fees based off with the same thing that you guys are now being able to become millionaires off of. Well, I think you know, that was been a very core. Part of the rollout. Massachusetts is offering people that have been affected by the marijuana laws to give them the opportunity to get into business. And if they have, you know. Previous convictions in some areas. They're actually getting priority application status. So that they can profit from this and provide themselves and other people with with an opportunity this employees owners for both. Absolutely. So if you have a marijuana conviction, you're gonna get sort of a priority potentially in some parts of the state right now. Yes. Sure. Well, why some parts of the state wasting Br Roberto pal? I know right. Roberta is if of walk the straight and narrow and someone else had know. Before whatever reason for whatever reason had a little bit of problem. They're going to get a priority over the people will walk the straight and narrow. Yes, I would say so because. You going to say so now only because you know, you've got to think of the pain and suffering that came along with it. I mean, you being a good guy walk in a straight arrow just like if I was trying to get a job, I'm walking the straight arrow sign hawks for the job. Now, my dad or my dad was a cop. I we get more priority over somebody who hasn't had that all FOX served. Are we get more priority would be an officer? That's a veterans preference. Or that's. Boy, that's a preference for family members dedicated themselves. Okay. Interesting boy, Roberto hadn't thought of that. Yeah. You gotta think about all levels. Dan. Every level Roberto you are. Like a unilateral. It's a million. I mean, it may be the legal side of drug now, but for somebody who for small amount that probably still sitting because they can't afford to pay for those those court fees in the legal fees and things like that. I was just hoping that they'll either get some sort of assistance for the for the same thing in jail for that. You're not filing a job application here tonight. Right. Roberta anonymous. Radio job. I don't do drugs. What's what's great about? It is that you know, the state is providing access for people that have have suffered from previous laws giving them opportunity to open up businesses giving them priority status. And then also, you know, if you have had those past convictions. You know, you are still allowed to be an agent at one of these these facilities as well. As apply for. You know, a license. So I think the way masses done it is has been a fantastic job. They've they've gone above and beyond. To make sure that those guys do get the opportunity in there working on, you know, helping them clear those records think. The. Break here Roberto. So I think just real quickly. Was really saying that was because it will be the most experienced 'cause they can speak on both sides and fits in give lessons the people who are questionable about it. Thank you. Roberta a good night. It's interesting. You used the phrase people who have suffered from previous laws. It's an interesting character station. Arrest a suffer from the tax laws. Six one seven to five hundred thirty triple eight nine two nine.

"Night, December eleventh two weeks from tonight. It will be Christmas night. It will all be over. Well, I mean, the people's vacations won't be over. But it's it's creeping perilously close now here in Massachusetts pot shops are no longer perilously close they exist, and we have the owner of the pot shop in LeicesteR Massachusetts in studio with a Sam Barbara the pod that particular institution has been functioning now for twenty days, are you open seven days a week. We are seven days a week. What time open on Sunday morning. Ten to eight every day ten to eight every day. No restrictions on Sunday morning or anything like that. Interesting. I assume that the same for liquor stores. If you know chief liquor stores can now open on Sundays. I know that I know that believe me, they're always have always been a a to eleven PM. Okay. And Sam Barbara is the CEO of cultivate, chief Jim Hurley who just heard is the chief of police in LeicesteR, Massachusetts these two gentlemen, twenty years ago. You never would have imagined that a police chief would be working closely with a a seller of marijuana. I'm marijuana products. But obviously here in Massachusetts, we approved the legalization of marijuana in two thousand sixteen and it seems to be a fairly a very friendly harmonious in cooperative relationship between the chief in you of the owner of the store. Was any problem that existed between you guys did this thing really work, very very smoothly? Is it seems to? I mean that doesn't seem to be any sort of an issue that ever existed between you guys. I don't think there's ever been a problem. We we've got a great working relationship. They've been excellent. And as I said earlier transparent and just if we have an issue that comes up with a repacking or traffic, we we squared away. Now, I know chief did you said the the first three weeks here twenty days, there's been no problems. I would assume that there would be out of how many how many customers have you had walked through the door Sam it's around twenty thousand. Okay. That's about a third of the the capacity more than thirty two thirds of the capacity of Fenway park. Full fill the Boston Garden with twenty thousand people. That's a lot of people. None. No one's been an uncle had. No one has has decided to to light up ten feet outside the door will get into their cars. Whereas, you know, not not that we've seen. We did have last believe it was last night. We had one person leave a younger child in a car down at the parking lot and twelve in the shuttle. So that's under investigation. I was very young. I believe from what I understood when I got a quick briefing onto morning summer in Asia. Ten okay. What's the t ten might in some cases? I think you could could potentially leave a child in a car, I agree with that. So that's part of the investigation. But the child was in the car and a lot the not a good idea. A great idea at all would have the child been allowed to to accompany the parent into the store or no, hey, wouldn't they wouldn't? So the choice would have been to leave the child in the doorway. They wouldn't be allowed inside the facility where we're checking before they can even enter in our facility, you need to show that you're you're over twenty one or you have a medical license. So therefore if you have a ten year old child get a babysitter. Right. And in this particular case, the the parking lot is about a two minute drive away. So they had to take a shuttle trial texted, the adult said, I'm nervous a line went right back and went to the child, but the officer had already located the child. Okay. Let's get back right back to the phones. Going to go to Abraham in Newburgh up by new report, Abraham you first this hour on the ringcentral nightside. Call a line with Sam Barbara the CEO of, cultivate, and chief Jim Hurley the chief of police in LeicesteR, Massachusetts where cultivate, cultivators located go ahead rim. Thank you for taking my call and merry Christmas Christmas. Whatever. Whatever holiday do. You celebrate Christmas. What are you? Celebrate this. Right. Everything have happy Hannukah, happy Kwanzaa happy. Festivus merry Christmas. Exactly. Oh, take much to celebrate. Good for you. I sorta guy Abraham. At any rate. I I love a simple Simon solution to the driving while impaired problem. Understood. Because it really is a point seven how much of this. How much? Well, impaired not being able to drive it can be because someone gel because someone's tired now. Allergy medication. We'd alcohol doesn't really matter. The danger comes from their inability to drive so we really should be testing. I don't get the point seven hundred Terry measure because point you're just if just to be correct or plano eight. We all know people at handle and better than others. So I'm not sure how apple point. Oh, wait is some people could be fine. A point on weight some. Stumbling and capable guy. Would I would do? Why should a simple solution? If you remember the kid's game Simon. We put him on skates. We put him in a hockey net. And we have someone shoot hockey pucks at him. That'll that'll test your reflexes Abraham go ahead. Remember the game Simon. It's a kid is game. Yep. Sure. Mccain. So light comes on the red light comes on. And then you have hit some of the red light. Mole everybody. That's what we should be testing. People's requests ability to drive. I think that's an interesting point a little off topic. Abraham let me get the chief to comment on your lack of faith in the point zero eight sobriety level. Because obviously someone can have great reflexes. And if they are if they over imbibe, those reflexes are are not going to be as good as Abraham said. There are people that can tolerate alcohol at different levels having a set standard. Is a bright line. Once you cross that everyone is treated the same. And I think that is the most important factor in every second of all the Breathalyzer that gives us that reading is scientifically sound and is legally accepted, and we have nothing else about a whack a mole test to go to your blood, alcohol content. Right. But then you, you know, if you're not doing a Breathalyzer, and we have to go to blood. There's a whole nother set of short, but very accurate, correct? My Terry takes care of the issue. With the inability to test right now. So so would you say is we have a whack a mole and every police station. Breathalyzer instead of doing that. The. Contest all afternoon. Abraham. Dr. No, I I get you chief glad you wanna comment. What we need is. We need a scientifically sound chest that gives us a standard for what is in peered while someone is driving under the influence of drugs. Allergy medicine driving. Well, then you get into a you're going to enjoy whether that operated needs to be brought before the registry and retested on their abilities to drive the car. And we do that quite frequently. So every once in a while, you see the story of some elderly, very elderly person who thought the car was in reverse and they drive into a fast food restaurant. Take care of all of it. Somebody who's driving. So noted so noted Abraham appreciate your holiday saying you have a great one Abraham six hundred seven two five four thirty triple eight nine to nine thirty. My name is Dan Rae. And we are we're not arguing over the legalization of marijuana. If you have a question you can chat with Sam, Barbara the CEO of, cultivate, or the chief of police in LeicesteR, we're, cultivate, is located Jim Hurley it's been an interesting nearly three weeks in LeicesteR. We have two perspectives both of which are working cooperatively. And it seems to be going down going pretty very well. Whatever question of comment, you have feel free to join the conversation. "The the first nearly three weeks of marijuana dispensaries recreational marijuana dispensaries cheap in LeicesteR. Now. I know the town voted for it. How is the house? The town accepted the reality of you sort of the epicenter of one of two epicenters so far of legal marijuana sales here in Massachusetts has the town and fairly welcoming or how would you characterize it? I think the town has been fairly welcoming. Obviously, we were really thrust into the national spotlight by the opening, and we did have some bumps in the road as I said, some of the neighbors were upset and held a meeting. But there was also strong support at the meeting and for not only for, cultivate, but for the police department way, we're handling things. So things really seem to have started to smooth out. And I think the community itself is accepting of the the facility it's going to be here long term and they're ready to move forward. And just keep going how how concerned are you as a police chief? We've seen stories. The herald ran a story today about a crash that took the life of a five year old. There was an article by Jessica Hesam. There will be accidents. I mean, there are accidents with alcohol, we know that people drink and drive and people. I'm sure we'll we'll smoke and drive. How much of a concern is that again, not putting your personal viewpoint in? But the point of view of of a police chief, I I have a serious concern about it. And my concern is based upon the fact that the marijuana law and the criminal law have not mesh together seamlessly as they should if you a driving under we can give you a Breathalyzer. Just how much alcohol's in your system. If you get started driving under the influence of narcotics. We don't have a test. There is not a scientifically accepted test. The court recognizes to be used even field sobriety tests that we give for people under the influence on not given the same evidentiary weight in court now called road site assessments for people under the influence of narcotics. So we need the law and technology to catch up with the Canopus. Lock reminder standing is that if you nail somebody for drunk driving and they fail the field sobriety tests. And even if they refuse a Breathalyzer a police officer on the witness stand can be asked in his professional opinion was the person under the influence of alcohol right mind is standing as quote decision in Massachusetts, which which denies the opportunity for a prosecutor to ask that question. He can he can say if someone's pulled over and they suspect having used marijuana glassy eyed. Unsteady in the feet and all of that. But they can't ask that ultimate question officer in your professional opinion from your experience is it your opinion that this defendant was under the influence of marijuana. That is correct. We asking a lot more of call now, drug recognition offices were specially trained to identify someone who is under the influence. They can testify. The state supreme court here in Massachusetts. So it's almost better. I shouldn't say this. But it's but it's. You you have a you have a better chance of avoiding being convicted when that without that question being asked and entered into evidence. If you're dealing with marijuana's supposed alcohol there needs to be consistency. I assume you agree with me. I agree with you a hundred percent. And that's where I'm saying that the law technology on the criminal side has to catch up with the cannabis law. So see you you guys are selling this stuff. And again, just like anybody who owns a liquor store. Obviously, there will be accidents. I know that you recognize that what are you? What are you trying to do to minimize that? I mean people walk in and they want to buy marijuana. What what can you do? Or is there anything you can do to make sure that people don't don't overuse. And then go out and get behind the wheel of a car. Right. Well, in in that's been the biggest focus for us as an organization is going into this. We never wanted to do this. If we thought it was going to be something bad for the community, and for the whole, you know for everybody, and I think it really all comes down to education, and that is what we have focused on an pride yourself on is with every person coming through our door. You know, we're offering education material or making sure that during every transaction, you know, we've spent a lotta time training our staff to take time for each transaction. Walk everybody through what are the risks with this? You know, what is the correct way to use it? And then on top of that, you know, we're we're limiting sales. So yes, there is that is something we are very concerned with. And something we are going to continue to keep working on. And I think you know, what the state has done is taken a long time to develop these regulations push this education material and limit how much people can dose, you know, for their infused products as well as how much they can buy much more than other states that have legalized so while it is a big concern. I think the way that the state has set everything up is is one of the is the best I've seen out of any other state in the country. Now, I know that restaurants and bars have to be very concerned about over serving alcohol, and I assume that most restaurants in bars must have some insurance which would cover the the the horrific event that none of us probably want to contemplate in that some leaving a bar leaving a restaurant and going out, and and injuring someone or worse. Have your lawyers talk to you about having some sort of additional liability insurance in case someone goes in and they they walk out of the store they puff away. They drive down the street and hit someone. I mean, obviously, that's not gonna happen necessarily that quickly. But if it somehow, do you think there's any of your lawyers suggested any exposure on you're selling this product, would I it's it's, you know, a very clear part of of these transactions in the way that, you know, we're we're inspected heavenly heavily to make sure that nobody is ever using that product onsite. It's it's not allowed in on every single container. It's very clearly written. You know, you can't use this while you're driving for providing education material for everybody walking out the door. And it's it's just like, you know, we we can't follow people home. That's at some point. We need to understand. What can we control? There's any protection or. Are you going to you'll lawyers in cases just have to rely and say, hey, we told him to be careful or no insurance. No additional insurance. You bought for this? Because I can anticipate there we have waivers that everybody is is signing off on saying that they won't be using this on their way home. You know, this is it's a part of the state requirements your lawyers telling you that sufficient. Yes. It's it's our liability. Is you know, we're not we're not. We can't follow everybody home. Liability insurance? You're not doing anything like that. Just in the in the horrific case that someone does. You had no insurance in that regard. You're are you saying ensure people driving home? No have no not you can't ensure physically you can't you can't go with everyone home. But I'm saying rate that you would not have some sort of an insurance policy just in case something horrific happened. So that you would not have exposure. Well, I think it would be the I think the alternative version of that you would be thinking of like a bar over serving someone. Well, that's right. Right. Right. You're still selling the product. There's if the person hadn't bought again, I don't want to be a lawyer here, which I am. But it would seem to me that one of the things you might be thinking about is having some sort of even relatively you. You know? I don't want to give you legal advice. Yeah. No. We we do have we do have waivers. And and again, you know, we're not serving anything you're not permitted to use that on say it is against the law. You're satisfied that protects you legally. It it is it's very clear you can't use this product in a public setting. And that's that's in the state regular, okay? Fro enough enough. We'll we'll say we're gonna take a quick break. Six hundred seven two five four thirty triple eight nine to nineteen thirty Sam Barbara he's the CEO of, cultivate, and the chief the cheap the police chief from LeicesteR Massachusetts Jim Hurley in studio we're gonna go to phone calls.
