I really like getting updates never know what's going to happen. It matters to us. Telling you, well, S AM eight ninety. On fixing the media at a certain point. It becomes the boy cried wolf, I think there are a lot of folks who go, well, that's just the media spouting after Rush Limbaugh. It's been Shapiro from two to five it's really incumbent on the media to do as much reporting of the facts as possible and leave a lot of the hyperbole out of it. Afternoons two five Ben Shapiro on L S, eight ninety. Coming up. We have a legal cage match between the Virgin Mary. And normally you would think that the Virgin Mary would win, but she's going against a very very very very tough trailer park. And of course, the story comes from Florida. So we'll get into that here in just a few minutes. Let's give the president credit where credit is due after a couple of duds. Like Scott Pruitt, Ryan, Zinke, he made a terrific pick. As far as our next attorney general make no mistake. He will be confirmed. Avila bar William far is Trump's best appointment so says the man we're going to talk to next John McGuinness professor at Northwestern University Pritzker school of law. I have read them in the Wall Street Journal, national review and other places. I think today I found this piece of real clear politics, but it comes to us from law. Liberty dot org. And I thought that was terrific. So we wanna Papa John McGuinness through the speakers here. And I'll read from your piece, I Mr. McGuinness, and then we'll get you elaborate. No cabinet official can get a president more trouble faster than. Attorney general van legal advice can lock the administration bad politics, ethical lapses at the department of Justice can taint the entire government. It is us very fortunate that the president's made us most effective appointment in William bar fire agrees with Trump on most important issues. The borders must be secured that violent crimes should remain a priority for law enforcement and the courts should not be the mechanism for fundamental social change. Professor. Welcome to double the LS on taking it that you're really enjoying this next attorney general Bill bar would you elaborate on that? Please. Yes. Well, one reason I'm very confident in my prediction is that. I worked for him for two years when he was the attorney general in charge of the officer. We will which essentially as the chief law opinion writer for the executive branch, and he's a very good lawyer. And that's very important at the department of Justice while I I don't have any doubts about Jeff Sessions integrity. He made I think a number of mistakes, the kind of a stakes that a seasoned Washington lawyer would not make a not can really hurt the president's policies both in terms of there being upheld and their terms of their perception for the public. Yeah. Mr. McGuinness, let's go through Jeff Sessions in his lacking or lasting legacy. I guess starting with the decision to separate children from their parents at the border that was I think it's safe to say a public relations disaster, even if he was on firm legal ground to do. So. Right. We had discretion. He didn't. That was a discretionary decision of the attorney general's. He made a mistake. Anyone was recognized was mistake. He had in some sense. Good intentions. So it's one wanted to distance given Santa's against bring children across the board, which is real real problem for children as they trek through Central America. But it was a really was a disaster. You also made a mistake and and trying to end the DACA program, which I think should be ended. He said that it was unconstitutional. There was no need to say that that would allow courts, and of course, many of the courts want to reject Trump administration policy and say, well, we didn't really show that it was unconstitutional. The basic fact is the Obamas decision. About administration's decision was also discretionary all think sessions had to say was what we may. Made a different decision which most executive branches made for twenty years before. And so he just did not do some basic good lawyering. And I think the attorney the attorney general bar who's been there before and been the general counsel from very important corporations won't make those kind of mistake. So he won't make any detours in the lawsuits that have absolutely zero point zero hope victory, correct? That's right. And I think the the lawsuit frankly, that's trying to hand the Affordable Care Act, which is brought by the states where the department intervened, I think is one of those and has gotten gotten criticism even among the most conservative legal academics. And so I think Trump is going going to be very well served by William bar because both of these competent, but he basically does agree with the president on basic Justice department policies, that's absolutely crucial. Because there was some very good cabinet members in some sense. Right. Good man who didn't agree with Trump on basic principles and that just as a disqualification at a at a high level of a cabinet officer. Professor mcginnis is a Northwestern University Pritzker school law. He worked with Bill bar Becca Bush forty one how did you like his performance, and it wasn't performance at the confirmation hearing? Oh, I thought he was very good as really occur particularly with some of the shrill democratic senators like kind of Harrison et cetera. Hirono I wouldn't come on Harris. For instance, said well Gerda, you should disqualify yourself. If the if the ethics people say, so he pointed out that it's his judgment. And you said, it's it's my judgment. I'm not gonna give up the judgment that the statute requires a very strong answer in a very fervent. So you do not allow themselves to be browbeat by democratic senators on the other hand, I think very I think a lot of them critically those who knew him from before and certain people like Federal Way he did a great deal of respect for him. So I think he's got respect across the aisle from people who are willing to give respect to somewhat of a different party. And that'll be firm. With senators who are simply trying to score political points. He has no patience for that. And I've seen him before. And hearing he can really shut that down very quickly. I know you've seen him a number of times used to work in the we're talking to her professor mcginnis who knows Mr. bar. What about your pass with Robert Muller? I know that Barak course, has known them for thirty years have you? And if so do you have any comments on Muller? I don't know him nearly as well. Of course, I worked at a department when he was head of the criminal division. And I think I would say with with what what what what what will you bars? Have it? I think bar is that William Muller's a straight shooter there, I think are bad incentives with respect to independent counsel that it's hard to avoid in other words that they sometimes think they really got to bring a case. And I think. That's that's a problem. But that's not a problem for Bob Muller. That's the problem with the incentives of the independent counsel. I think he's a he's a he's a he's a very good, man. And he's not a partisan, man. And I think the he's likely to do a fair fair job. We'll just have to wait for the report. Do you think the report is going to be more of a yawn or more of a bombshell? I don't know. At the moment. I think it's gonna be more of a yawn with respect to the president. Although it will raise some questions about the president's choice of some of his advisers that have not been wise in the past exactly actually be the the biggest implication of the report does the president in the campaign, and in his personal life that show some people were not very good and maybe a warrant game in the future. But he may be getting it used to someone like Bill Bihar who certainly a very wise choice. You wonder how Rudy Giuliani is doing nowadays? Because he certainly seems to be twisted himself into pretzel. Logic trying to defend everything. Well, I think that's right. I I mean, I think he frankly is shown a great decline in his performance. I was in New York City. I was actually that's their touring his matter mayor Oriole administration. And it seems to me that he's lost a few steps. Leave it there. Professor, we all do eventually it happens to everybody. I appreciate your time, sir. And we'll have you back for more analysis down the line. Thank you so much. Thank you much. Professor. "Welcome back. Bruce in port Jefferson, New York. Hey, Bruce, what's on your mind? One Allegri with real bone earlier you on a special person than you do have special show just formation. Yeah. That isn't it available anywhere else. Thank you, Bruce. Thanks for listening to us on serious. What's your point is? I thank you for your time. I have a proposal of which I would hope would help resolve the shutdown or at least put the ball in the Republican Court. The concept is a special panel like the nine eleven commission Steph with gray hair each appoints. It's all but has veto over extremists on the other side. They have resources and they looked at the border situation. They take input. In the end, they make your recommendation on where a wall would be valuable where everybody would rather be spent, but the recommendation is in the form of legislation and the legislation must be voted on by both houses of congress says that a Mitch McConnell side there where he just won't bring it to the president. If that were to happen. I think you'd close the shutdown this, well, that's a very reasonable solution. Bruce, and it makes a lot of sense. The only problem I see with it is that it could take months for commission like that to to get appointed to to start meeting to convene testimony by experts to draw conclusions. And during those months, you've got an entire federal workforce. That's out of work. This is unless you're saying that appointing the commission would be the thing the point where Donald Trump would declare victory and say, okay, I got what I wanted. Well, and and what I was suggesting also that I did was the w continuing resolution another other which we reopen the government tending, you know, this strain voting on the budget. So this could be both a fig leaf and an actual solution. Yeah. That makes sense Bruce. I think I think he got a good one. I want to get some more callers in here. Thank you for the call. That's a great suggestion RJ in Greenville, Michigan a RJ. Thanks for listening to sixteen eighty AM. What's up? Hey, tom. Hey, thanks for what you do. You you were just talking about Powers Act right while there's multiple ones. Actually, it turns out, right? Is there a clause do either, you know, there's a clause that allows Trump to eliminate agencies altogether or or gut them like social security or health care. He got them anytime he wants all he has to do is direct them to stop spending money. He can't eliminate them without an act of congress. I mean, this is what this is why it has already been done to the department of interior and the way they've been, you know, the they're they're laying off scientists. They're the dialing back on the work that they're doing the. Brian Pruitt Ryan Zinke, gutted those agencies. Okay. Okay. Hey, thanks. Yeah. Thank you are Jay, thanks for the call Maryland in Belvidere, Illinois, Maryland, what's on your mind. Oh, I just want to talk about the shutdown a minute. I'm not crazy. But I think that the Democrats oughta go ahead and giving this money, and what they get for hear me out is they get to take away his battlecry. They get the people back to work. And and the people are going to be very appreciative of that. And they're again a lot of political from that. Then what they do is. They just say, you know, we we tried to negotiate with the terrorists, but they wouldn't have an intimate and called Trump, and the Republicans are terrorists that they are and say that they want you to look at the border because they're the ones you're only causing terror. But Maryland, I mean, one of the first lessons that I learned as a new parent back in the day was that the first time you give into your kid is you're pushing them down in the cart down the grocery aisles. And he walked by the cookies the first time, you give into them. You're you are setting up that every single time you go to the supermarket. Your kid is going to go off on you. The first time you feed your dog from the. Table with table scraps. You're doomed, you know, your dog is going to constantly have its head and your lap. This is this is not just human behavior. This is right across the whole animal spectrum. And why would Trump be any different? I think that if they give into Trump, then he's gonna start demanding all kinds of wild stuff. Well, I just know that primaries are are twelve months away and to wipe out as many as Republicans as you possibly can. So we don't have to deal with the Stephanie more. I know people cannot buy groceries with principals isn't the predicate of your suggestion Maryland that this is doing more harm to Democrats than Republicans. I'm not sure that that's the case. I think it's coming to a tipping point. Are not gonna care who's who's talking is. Can't pay the rent. They can't buy the groceries. Yeah. Yeah. And the simple reality is if one of two things were to happen. This would be resolved very quickly. Another one involves the Democrats if Mitch McConnell was simply to allow the legislation that already passed the Senate unanimously on December nineteenth if he used to allow that to come up to vote. It would reopen the government and we provide Trump with one point six trillion dollars for his border wall or billion dollars. I guess for his border. But is he going to do it? And then the other while he would do it. If Fox News would start talking about how.

"Taylor van Cise villa? Neil headlines. House speaker Nancy Pelosi says she doesn't like the profane language used by one of her new members who predicted the house will impeach President Donald Trump. She said that impeachment is divisive and wants the new democratic majority to be unified, a new Associated Press poll shows, the top problems Americans hope. Government addresses this year are the economy, healthcare immigration, politics, and the environment. New trouble for former interior secretary. Ryan Zinke the Justice department considering whether he lied to investigators about his real estate dealings in Montana band in a Connecticut casino project matchup Petoskey covers the national security beat for the Washington Post and joins us on the KOMO Newsline high match. Hey, thank you for having me. All right. Zinke left office Wednesday amid a cloud of ethics questions. What's the latest, Matt? Well, the latest we're hearing is that I mean, we knew he was referred based on some of these ethics inquiries to the Justice department. We understand now even though he has left office. The Justice department is exploring whether he lied to inspector general investigators. We don't know exactly what lie they suspect. He told our sources sort of wouldn't tell us that. But this is a significant development. We've seen a lot of people in President Trump's orbit plead guilty to lying to various investigators to federal crime. That could carry a five year penalty. And we understand the Justice department is now investigating whether Ryan Zinke should be charged with that crime. Do we know at this point, Matt why investigators kind of raise their eyebrows, what to the inspector general group feel that they were lied to about? Well, that's the big piece that I think we're still trying to report out we know that it wasn't tied to this land deal. The inspector general at the time that Zinke resigned sort of focused on two things. One was this land deal in Montana, and the other was this issue involving some native American tribes bid to open a casino up in Connecticut. It's a really complicated issue. But essentially they needed interior department approval, they seemed poised to get it. And then didn't they allege that this was because of sort of inappropriate political lobbying from people in Nevada connected to MGM wanted to open their own casino. We suspect that is what? Thinki- lied about. Because that's the only other thing that was outstanding. If it isn't this land deal, but we don't know. Unfortunately, what precise lie. Investigators believe Ryan Zinke told all right in this latest inquiry. Have we heard anything from Zinke about this? I mean after all he resigned with his head held high touting his accomplishments just the other day. Yes. That's correct. His lawyer said to the best of of Zinke is knowledge Zinke did not lie in these interviews with the inspector generals. So he certainly disputes to conclusion that he lied, and I think after our story published he gave an interview to the Associated Press where he also disputed that. He lied. His position is look I've been investigated ad nauseam by the inspector general, and they've never really been able to put any meat on the bones, and I should stress here. He's charged with no crimes as we sit here today, and it's very possible that he won't be charged with any crimes oftentimes in these cases, the Justice department just kind of loses interest when somebody leaves office for any legal reason. But just because they're there's have less high-profile at target. And he insists that he has done. Nothing wrong. Certainly as you mentioned a complicated case, but you can get more clarity online at Washington Post dot com is always math. Thanks for your time today. The departing attorney general departed attorney general who you covered for for a couple of years. This is a guy. I know who was scorned by many Trump supporters for not seeming supportive of Naf of his president which wasn't his job. A bit. Also scorned by people on the left because of the immigration and other policies that he backed what are his friends and supporters saying of his two years as attorney general a lot of support statements supportive statements overnight, Steve from sessions, former colleagues in the Senate where Jeff Sessions surfer twenty years, they say he had a forty year dedicated record of public service. He did a lot at crack down on immigration and asylum, which is one of Donald Trump's top priorities in his heart was in the right place. He wanted to do the right thing. That's why he recused himself from the Russia probe which put him in the president's ill Grace's to begin with Gary. Thanks so much. Really? Appreciate it. My pleasure. That's NPR Justice. Correspondent Carrie Johnson. Okay. The firing of sessions is one of several rapid fire. Moves by the president. That's right. I e held a news conference yesterday afternoon where he expressed bitter satisfaction at the defeat of many House Republicans he said that some of them lost after failing to embrace him. He said that the lesson. He learned from the election was quote, people like me, then after that the White House revoked the credentials of a CNN reporter, and in the midst of all of this. Of course, the White House is up against a changed political landscape because Republicans lost the house and elections at many other levels on Tuesday. NPR's Scott Horsely covers the White House and is with us. Hey there Scott good morning. Steve led me, I ask about the change at the department of Justice Whittaker's attempt, these the acting attorney general how easy is it. Going to be for the president to have a replacement confirmed by the Senate, well, certainly the president's fellow Republicans had encouraged him not to make any changes at the Justice department before the midterm election, but he may feel. Freer now to make changes with that election behind him. As a result of the polling on Tuesday. The president now has a larger friendly GOP majority in the Senate, and that's the team that would be responsible for confirming any replacement Mitch McConnell. The Senate GOP leader was asked yesterday about the confirmation process. This was before we knew that sessions was on his way out, and he said that how controversial that processes would depend on who the president chooses for any for any new post. We have seen some lip service paid by Republicans. And and senators elect Republicans in the Senate and senators elect to say that the Muller probe must be protected on the house where there will be a new democratic majority. They of course, won't play any role in confirming a successor, but they will have the power to investigate the process of sessions dismissal. Okay. So there'll be a lot of news there, and that is just one cabinet depart. -ment are other changes expected in the administration after the midterm election here. It wouldn't be surprising to see more departures. The president said yesterday he is for the most part extremely happy with his cabinet. Of course, that was just hours before we learned that sessions was on his way out. The president did say he would be taking a look at some of the ethical complaints. That had been lodged against his interior secretary.
