A highlight from SBF TRIAL: Inside Sam Bankman-Fried's Trial Defense Episode 2

"The most important thing is, you know, just because a lawyer tells you something is okay, that's not a defense. Geez, he said it. He seemed to think everything was okay. Yeah. That's not an advice of counsel defense that negates criminal intent, that's an excuse. In part two of our series digging into SPF's defense, we dissect Sam Bankman -freed's claims that his lawyers played a larger role in FTX's collapse than he did. It might sound like a stretch, but there is legal precedent behind it. SPF also says he was pressured by counsel into turning FTX over to their hand -picked successor. In this episode, we sit down with Mark Litt, the prosecutor who took down Bernie Madoff, Travis Kling, a fund manager who still has millions of dollars tied up in FTX, and Mr. Purple, a pseudonymous crypto investor and fellow FTX victim, to see if there's any legitimacy to SPF's claims that lawyers who were there for FTX's rise are now primed to rake in hundreds of millions of dollars in legal fees. Money that SPF says should be used to pay back depositors. I'm Zach Ousman, you're listening to the SPF Defense Podcast, a coinage investigation. SPF's position is that FTX would have made it through the crisis if not for his lawyers, which conspired to steal the company out from under him, cover up their role in its operation, and siphon hundreds of millions of dollars in legal fees from the bankrupt estate. SPF even names one lawyer in particular, Ryan Miller, who joined FTX US from the law firm's Sullivan and Cromwell, and planned on returning there after his time at the exchange, according to an affidavit from FTX's top lawyer. SPF says Miller conspired to hand the company over to Solcrom and their chosen agent, John J. Ray III, who also handled Enron's bankruptcy. And whether you come to believe Sam's claims or not, Solcrom and Ray clearly won. If FTX's bankruptcy process takes the two years like Enron's did, it's on track to cost over $800 million. And Solcrom's relationship has already been called out by more than just Sam. It's even been raised as an issue by senators and 18 state regulators. But could SPF be right about Ryan Miller and Solcrom's nefarious motives? And even if they did do some evil lawyer shit, will it be enough to get SPF off the hook? To fully understand this defense strategy, it helps to start with SPF's story behind his attempt to plug the now notorious multi -billion dollar hole at FTX back in November's collapse. As the story goes, he was preparing to handle the liquidity crisis by courting Nomura, Japan's largest investment group, and the crypto company Tron, who had pledged billions of dollars in liquidity to FTX, while other investors were still deliberating. SPF had said he planned on giving away most of his equity in the company, and therefore most of his wealth, in an attempt to make customers of FTX International whole. SPF has always maintained that FTX US remained completely solvent right up to the end. But SPF says his rescue plan failed because Ryan Miller and Solcrom agents at his company, including Tim Wilson, another FTX lawyer with a past at Solcrom, pressed him repeatedly to sign the company's over to John Ray in bankruptcy, and even implied that if he refused, they could have him arrested and quote, change control in order to authorize a proper insolvency process. SPF said he changed his mind within 10 minutes of signing, but it was already too late. And he says his lawyers reneged on their promises to let him select a board share, blocking him out of his accounts and refusing to communicate further. As soon as John Ray was installed, he chose Sullivan and Cromwell as FTX's primary counsel. To be fair, SPF actually has a point when it comes to the sketchiness of that process. Even outside legal observers have taken issue with Solcrom being tapped as the firm to manage FTX's bankruptcy. In fact, a bipartisan group of two Republican and two Democratic senators, including Elizabeth Warren, sent a letter to the judge overseeing the case, urging him to appoint an independent examiner rather than Solcrom, which worked with FTX and Alameda before the collapse, bringing in $8 .5 million in legal fees. The senators argued, quote, given their longstanding legal work for FTX, they may well bear a measure of responsibility for the damage wrecked on the company's victims. Regulators from 18 states echoed that issue, saying appointing an independent examiner wasn't just right, it was also legally required. But back in February, the judge in the case threw out those requests, saying it would cost too much money, though we should note FTX's lawyers also charged the bankruptcy estate $21 ,000 over 20 days just for meals, which apparently isn't too much to spend. And if you ask the victims in FTX's collapse, this is all pretty important, considering it's their deposits and claims at stake. And if their money is being drained in broad daylight by a law firm who also helped FTX pre -collapse, that might not sit any better than Sam spending it. We talked to Travis Kling, who lost his crypto investment fund in FTX's collapse, and asked him to weigh in. If you ask me at the very beginning, do you think this is going to be one of the most expensive bankruptcies in U .S. history, I would say yes. Yes. You know, it's enormous. There's a ton of fraud, and it's magic internet money. Trying to kind of Monday morning quarterback this and say, oh, Sam would have been better off not filing for bankruptcy. That's not something that I feel very strongly about. And Solkrom's outrageous fees aren't the only reason for concern. SPF also claims Solkrom gave a clean bill of health to Alameda's trading accounts on FTX in a report with the CFTC just months before the collapse. Furthermore, in his affidavit, Dan Friedberg, who was both FTX's chief compliance officer and Alameda's general counsel until he stepped down following the crisis, says Miller only included FTX U .S. in the bankruptcy proceedings precisely because Miller knew it had the funds to pay Solkrom for its work, which backs up what SPF said about how FTX U .S. was never insolvent. So this may be a case of the fox guarding the henhouse. Solkrom denies any of this, of course. The firm's top bankruptcy lawyer, Andrew Dietrich, who told other lawyers FTX was rock solid in an email just days before the bankruptcy, said he only spoke with SPF twice. The FTX debtors also countersued Friedberg to seek damages, alleging he breached his fiduciary duties. We can't say much more beyond that because Solkrom never got back to us when we asked for a comment. But one thing is clear, what guidance Sam's lawyers gave him, and particularly what they knew about the business, will become integral to SPF's defense at trial. Even if you asked Ryan Miller before the collapse, the laws are pretty simple for any business, crypto or otherwise. Here he is explaining that concept at an MIT Bitcoin meetup in July 2022. Don't do fraud, don't lie, don't release materially incomplete statements. That then creates a basis for liability, liability from a criminal authority, be it a Department of Justice or liability in a civil context. Yet according to Caroline Allison's guilty plea, they had trouble following even those rules. In her sworn testimony, she said, quote, I agreed with Mr. Bankman, Fried and others to provide materially misleading financial statements to Alameda's lenders. Could Miller or any of SPF's lawyers, for that matter, be one of those others? Sam's other allegation that Miller contacted the DOJ to turn over documents that led to his indictment days before SPF linked, which controlled the company, makes Miller start to look even sketchier. But even if Solkrom really does have a true conflict of interest, could SPF really use their role in everything that happened to get an acquittal? Given that I'm not a lawyer, we pose that defense to Mark Litt, the prosecutor who took down Bernie Madoff. Can a lawyer be a criminal? Sure. Yeah. Can a lawyer be part of a criminal enterprise? Yes. Do they often go down? I don't know a lot of reputable lawyers who are going to bless lying to investors, lying to banks, intermingling funds, lying to auditors. If he happened to find one who knew all that was going on and blessed it, then maybe as a defense. But I tend to doubt it. You can't think of it as, well, oh, well, you know, Sullivan and Cromwell was involved or a former Sullivan and Cromwell lawyer was involved and, geez, he said he seemed to think everything was okay. That's not an advice of counsel defense that negates criminal intent. That's an excuse masquerading as an advice of counsel defense. Advice of counsel defense is very specific and narrow. You need competent counsel and they'll stipulate that any lawyer at Sullivan and Cromwell is competent in the subject area that they're being asked about. Second, every material fact has to be disclosed to them. Third, you have to seek their legal opinion on a subject. And fourth, you have to follow the advice. So if the defense can make out those elements, I would think they'd be able to present the defense and it might have a shot of winning. So Sol Cromwell might not be saints, but as we covered last time in episode one, SPF isn't exactly facing a trial over FTX's collapse. He's charged with a lot of things that led up to FTX's collapse. Arguably, what's alleged to have happened post -collapse matters more for FTX's victims. And if you ask them, the reviews are mixed on exactly what's played out thus far. If I'm going to judge Sullivan and Cromwell and John J. Wray from my purview of being someone who's seen these things in bankruptcy, I would give them a very low grade because you can say, oh, this is crypto, it's difficult, but it's not that difficult. And sometimes the devil you know is better than the one you don't. I will say that these debtors are extremely bad in my professional experience. That was Mr. Purple, a pseudonymous crypto investor who has experience following bankruptcy proceedings. For former FTX customers like him, Sam's spat with Sol Cromwell matters very little, as long as the firm can help achieve a meaningful recovery of their funds. And despite the fact that legal fees are stacking up, the bidding market for FTX customer claims is showing a growing hope they might not be stuck with pennies on the dollar. Another way to frame it is, you know, there's a claims market for FTX claims, trade claims, trade actively. There's a little niche of traditional finance that all they do is go around to different bankruptcies in all industries and they buy claims. This is this is a, you know, a subsector of of investing. And this is a huge bankruptcy. So this has been a very big liquid market. Right. And the first, you know, we're a very big creditor in this. So, you know, I'm in active conversations in this claims market. First, first bid we saw was in Thanksgiving and it was like six cents. That was the first bid. Six cents on the dollar, six cents on the dollar. And now now it's like 40 cents. And so it's gone from six to 40 cents. So then I'm like, OK, well, that feels quite good. Yeah. And OK, these guys are charging a load of money for that, but they have taken us from six cents to 40 cents. With both FTX's bankruptcy case and SPF's criminal case unfolding in real time, one may very well impact the other. We filed a Freedom of Information Act request for the CFTC to share the report. Sam says Solkrom filed to support that FTX's structure was above board. The agency denied our request, saying it's unable to share documents that, quote, could interfere with the conduct of federal agency law enforcement activities. And of course, as long as Solkrom selected John Ray is running the show at FTX, it's unexpected anything comes out to support SPF's case. FTX, too, didn't get back for comment. So unless SPF has direct evidence of lawyers being aware of FTX's shaky financials and helping for years to cover it up, it's hard to judge SPF's advice of counsel defense or the idea that he thought he was in the clear leading up to the collapse just because his lawyers said it was fine. As Litt said, that sounds more like an excuse than a defense. A highlight from A Flurry of Amicus Briefs in Coinbase vs. SEC

"Welcome back to The Breakdown with me and LW. It's a daily podcast on macro, Bitcoin and the big picture power shifts remaking our world. What's going on, guys? It is Monday, August 14th, and today we are talking about a wild set of amicus briefs filed in the Coinbase against SEC case. Well, today, as I said, the main focus of the show is a slew of amicus briefs filed in the Coinbase case at the very end of last week. But first, a quick update in the SPF saga. Now, I'm sure all of you guys are at least a little bit familiar with what happened at this point, but let's present it for completeness. TLDR, after months of playing fast and loose with bail conditions, Sam has been sent to jail to await his trial. Now, the big catalyst for this was, of course, last month's leaking parts of former Alameda CEO Carolyn Ellison's journal to The New York Times. Carolyn was the CEO of Alameda during the final months of operations, was at times Sam's girlfriend, and will also be a key witness in Sam's trial. Now, SPF had said through lawyers that he was merely trying to, quote, give his side of the story. This is something that he has done a lot of, apparently. Indeed, he has notched up over 100 phone calls with one New York Times journalist in particular, and that's just one of the many reporters that he has been in touch with. The prosecutor argued effectively that this was indirect witness tampering. They said that even though there hadn't been an overt communication with Ellison, the intention was clear, stating, I think the fact the defendant was more subtle in his methods than a mobster doesn't mean it was benign. Now, the judge ultimately sided with the DOJ, finding that Sam's conduct was closer to witness intimidation than constitutionally protected public defense. During the hearing on Friday, the judge said Sam had been willing to, quote, risk crossing the line in an effort to get right up to the line wherever it is. Of Ellison's writings, which Sam shared, the judge said, The documents are in part personal and intimate. They are personally oriented, not business oriented. They are something that someone who had been in a relationship would be unlikely to share with anyone except to hurt and frighten the subject. Ultimately, the judge said, My conclusion is there is probable cause to believe the defendant has attempted to tamper with witnesses at least twice. There is a reputable presumption that there is no set of conditions that will ensure Bankman -Fried will not be a danger. So the other witness tampering attempt that the judge was referring to came shortly after Sam's arrest and release on bail when he had reached out to former FTX U .S. General Counsel Ryan Miller, suggesting that they stay in touch, coordinate communications, etc. Sam had also previously broken bail conditions when he had used the VPN to access the Internet, something that he claimed was just to watch the NFL playoffs, which very few people bought as totally true. Part of Sam's argument for remaining out of jail had been that incarceration would make it more difficult for him to prepare his defense. Prior to locking Sam up, the judge ensured that he would have access to a laptop to continue his trial preparation, which it seems like is just about the only good thing about the facility that he is on his way to. The judge said, I am focused on the possibility that he will be detained at the MDC, not on anyone's list of five -star facilities. That said, I understand he could have a dedicated laptop at the MDC 9, 10, 11 hours a day. Sam's trial is set to begin on October 2nd. His legal team has, of course, appealed the decision to revoke his bail and requested that he remain on house arrest pending appeal, but were denied on that motion. Former journalist Dan Nguyen really captured, I think, the sensibilities of the entire Twitter sphere when he wrote, SPF got one of the sweetest bail deals in history, and all he had to do was chill at his parents' Stanford home, play with the new dog his parents bought for him, and not use a VPN to secretly commit more crimes on the Internet, and yet, clown face emoji. Anyways, guys, just another gross chapter in a bad story. But with that, let's move on to something much more positive. On Friday, Blockchain Association Chief Policy Officer J. Chivinsky wrote, Today is a fun day. The deadline for amicus briefs on Coinbase's motion for judgment on the pleadings of the SEC's enforcement action. I expect to see many excellent briefs on many different issues. They should start hitting the docket soon. And indeed, hit they did. On Friday, a slew of briefs were filed in support of Coinbase's motion to dismiss the SEC's lawsuit. Now, most crypto lawsuits from the SEC have seen numerous amicus or friend -of -the -court briefs filed, but the Coinbase lawsuit attracted more attention from the legal community than usual. The Coinbase motion for judgment on the pleadings was supported by venture firms Paradigm and A16Z, who filed a joint brief, crypto lobbyists including the Blockchain Association, the Chamber for Digital Commerce and the DeFi Education Fund, and perhaps most notable were briefs from Senator Cynthia Lummis, as well as a group of six legal scholars. Coinbase is, of course, being sued for offering the sale of unregistered securities. The SEC's lawsuit hinges on the claim that 13 tokens offered on Coinbase's centralized exchange are securities. In addition to alleging that the main trading venue requires registration as a securities exchange, the SEC also alleges that Coinbase's self -hosted wallet is an unregistered securities brokerage and clearing agency. Finally, the lawsuit also alleged that Coinbase's staking product is a securities offering. As usual, all of these claims rely on the Howey Test, which is a Supreme Court test to determine when a transaction is deemed to be the sale of an investment contract. Coinbase's argument is that none of the tokens they offer fully satisfy the test, and as such, the lawsuit should be thrown out without the court hearing any further facts of the case. In addition, Coinbase is arguing that the SEC has attempted to expand its jurisdiction beyond the authority it was granted by Congress. This argument, as we have discussed, is brought under the Major Questions Doctrine, which is a relatively recent legal doctrine put forward by the Supreme Court. The Major Questions Doctrine holds that administrative agencies must have explicit authority from Congress to oversee an industry which forms a major part of the U .S. economy. So now let's go through the set of different briefs kind of organized in the context that they came in. We'll start with the VC and lobbyist briefs. The joint brief from Paradigm and A16Z focused extensively on the damage that could be done to the industry if the SEC's view of the law was held to be correct. They wrote, The brief noted that the SEC claimed crypto tokens themselves embody the terms of an investment contract, so continued to carry a classification as securities into the secondary markets long after their initial sale. This approach was rejected in the recent Ripple case, but remains contentious among federal court judges. The brief warned that allowing the SEC to take this approach could extend their reach into an endless array of commonly sold assets including fine art, classic cars, and vintage wines. Now, a group of crypto lobbyists led by the Blockchain Association said in their brief that the SEC seeks to cast aside the nearly century -old understanding of an investment contract and usurp Congress's authority to decide how to regulate a burgeoning industry. They claimed that the statutory text, history, precedent, and common sense all foreclosed the SEC's attempt to rewrite the definition of investment contract to reach digital asset sales unaccompanied by any ongoing contractual obligations. In a Twitter thread discussing the joint brief, G. Kim, the General Counsel at the Crypto Council for Innovation, wrote, The SEC is trying to short -circuit the legislative process and seize the power to resolve questions of massive economic and political importance by presenting its flawed interpretation in enforcement actions. The Chamber of Digital Commerce echoed their fellow lobbyists in making the point that the SEC is exceeding their authority and using inappropriate methods to bring the crypto industry to heel. They wrote that the SEC is choosing to use the blunt and unpredictable tool of enforcement proceedings to the exclusion of all other methods. They characterized the lawsuit as Coinbase's turn on the SEC's roulette wheel. Now, the DeFi Education Fund took a different approach, focusing their brief on the technical side of the case and linking the underlying functionality of crypto products to the legal arguments. The DeFi lobbyist explained that both Coinbase's staking service and wallet are software products rather than regulated financial service products. They argued that a decision in favor of the SEC's overly expansive theories related to this software application would have a chilling effect on the developers and service providers that innovate in DeFi and consequently the users of this technology. With regard to the wallet, they pointed out that Coinbase does not route orders nor take control of customer assets, so it's difficult to see how they could be viewed as a broker in that context. In discussing staking, they noted that while Coinbase administers the validators which deliver staking rewards to customers, their, quote, function is squarely ministerial as an IT service provider. Put another way, Coinbase provides an IT product that leads to a financial reward, but that reward stems from the crypto protocols themselves rather than from Coinbase's efforts. Now, maybe the most striking brief in support of Coinbase was co -signed by not one but six law professors with expertise in securities law. This includes experts from UCLA, Boston University, Fordham Law School, Widener University, the University of Chicago Law School, and Yale Law School. And importantly, this isn't a group of outspokenly crypto -friendly professors. Between them, this group has written multiple textbooks and authored countless academic papers. Some of them quite literally wrote the book on securities law. Their brief focuses on the definition of the term investment contract and argues that it has a much more limited scope than the SEC seems to think. A key part of the SEC's crypto lawsuits has been the idea that a crypto token is one part of an overall investment scheme which does not require a formal contract between the parties. This would mean that a token could be considered a security even when the issuer doesn't make any promises to holders and doesn't take any direct investment from purchasers. The professors rejected this as ignorant of the history of securities law. Their opinion is that the Securities Act of 1933 used the very well -established language of investment contract to refer specifically to situations where, quote, the investor receives, in exchange for an investment, a contractual undertaking or right to an enterprise's income, profits, or assets. They argued that this definition of an investment contract had been present in state legislation and cases leading up to the passing of federal regulation in 1933. They added that this definition has been consistently used by the courts to decide lawsuits following Howey to this day. This historical argument flies in the face of SEC briefs, which have often discarded state legislation and cases prior to 1933 as irrelevant. The legal scholars wrote that nowhere in the Howey decision does the Supreme Court, quote, suggest that it was doing away with the court textual and historical anchor of the statutory term investment contract, i .e. contractual undertakings. Rather, Howey's reference to a scheme or transaction simply reflected the instruction that courts should consider the economic reality of a business venture to determine whether an investment contract exists. The law professors suggested that by agreeing with the SEC's definition of an investment contract, the court would be going against almost a century of case law. They urged that, quote, The court should adhere to the settled meaning of the term, consistently applied by the state courts interpreting state blue sky laws, as well as by the federal appellate courts before and since Howey. Under that settled meaning, an investment contract requires contractual undertakings to deliver future value, reflecting the income, profits, or assets of a business. Paradigm policy director Justin Slaughter writes, It takes real skill to so mismanage the situation that you have serious institutionalists like Professors Macy and Hammermesh filing amici briefs against the SEC in an enforcement case. This case is on track to blow up the SEC's powers and maybe weaken agency powers across the board. That people invested in the current securities regime are still siding against the current SEC position speaks volumes. Finally, Senator Cynthia Lummis has also filed an amicus brief addressing the question of whether the SEC has overreached its authority. Lummis began her brief by drawing the court's attention to the numerous bipartisan efforts currently underway in Congress to craft regulations for the crypto industry. She wrote that she, Has a special interest in upholding the Constitution's separation of powers by ensuring that federal administrative agencies do not exceed the authority conferred upon them or encroach upon Congress's ongoing legislative efforts. Amicus believes that the SEC's approach to enforcement in this case, and in the crypto asset industry more broadly, contravenes that separation of powers. Now given that the cornerstone of any major questions doctrine argument is that an administrative agency is exceeding the powers granted to it by Congress, it seems extremely relevant to be told by a sitting US Senator that they believe this to be the case. Lummis continued, When Congress created the SEC to regulate securities markets, it did not grant the SEC power to reimagine the definition of securities to expand the agency's sphere of influence into other asset classes or to encroach on other agencies and regulatory schemes. The SEC's attempt to shoehorn an entire new class of assets into the existing definition of a security and thereby add to the definition enumerated by Congress exceeds the SEC's authority, encroaches on Congress's lawmaking, and contravenes the separation of powers. Put simply, she said, Basically, the brief is an attempt to provide evidence to the court that Congress is not content with the status quo when it comes to crypto regulation. Much of the brief describes the various ongoing legislative efforts. And after outlining these bills, Lummis writes, The multitude of interests at stake require a holistic approach beyond the scope of a single agency. Ultimately, she says, Lummis urged the court to, Now, I think where most of the analysis lands, holding aside deep legal minutiae, which obviously will become very important in terms of how the case actually resolves, is from a sentiment shift it feels to people, of course, outside observers, that this is going to be a hard one for the SEC. Algorithmic trading firm CEO Xi Zhen writes, Now, I would never go that far given that Let's hope that these friends of the court are correct. Appreciate you guys listening as always. As costs bloom that is changing the way singles are dating. Instead of wining and dining someone other fancy restaurant, people are going to museums. They're taking scenic walks. And even making home cooked meals. On the dating app hinge, almost 41% said they were more concerned with the cost of dates now versus a year ago. So both love and money are top of mind for singles in the U.S. and it's changing the dating game entirely. A growing list of school districts are suing social media giants and their parent companies. Bucks county, Pennsylvania is among school districts that want social media companies to change their practices, The Washington Post reports the schools also want any damages used to fund prevention and education efforts along with treatment for social media use that's grown problematic. Their complaint cited incidents among county students, including a 15 year old boy who threatened to shoot up a high school via SnapChat and shared school shooting videos on TikTok. A thing to note in Maryland, we have a crash investigation closing the westbound side route 32 in jessup. 32 between Dorsey run road X to the 11 root one, all lanes are blocked, follow police direction, crash investigation. If you're heading west and get diverted, you can rejoin from route one, so a lot of workarounds on an early Sunday morning. In Virginia, saying railways running pretty well three 95 from the 14th street bridge all the way to Fredericksburg, you have the express lanes pointing north, but Sal three 95 near the seminary road exit four. You've got a single lane going across the bay in both directions to each bounce band closed to a travel on the westbound, watch for stops, they should discontinue this shortly if they hold you at either end, it would only be momentarily. Is the biggest issue in the region continues to be the inner loop of the capitol beltway right under two O two. This is over by FedEx field. It's one lane out of 5, the center lane getting you through major crash involving one overturned on the left and one of the Woods on the right, so lots of attention there and folks are doing a good job taking it slow, heading through that single center lane on the interloop of the beltway southbound pass two O two northbound, you're on effect, and although you get quite a show as you're driving by, don't see any delays or rubbernecking there in the camera. Elsewhere, BW Parkway, southbound, I think the issue of the disabled vehicle at one 75 is gone. However, what's not gone is the closure of route 32 westbound at Dorsey run road, you can get back on it route one, use guildford road as your alternate, you will be routed off of 32 at Dorsey run eastbound is unaffected. That crash happened back in the 2 o'clock hour, so it appears to be fairly serious. Elsewhere in Maryland, the capitol belt, the rest of the bellway Montgomery county looking good, no problems on two 70, the ICC and Montgomery county, 50 out to the bay bridge. We still haven't wrapped up the overnight road work, so it's going to be a single link getting you across each side of the westbound span, eastbound span is still closed. Over in Virginia, no problems really to report 95 southbound you're in good shape all the way down towards Fredericksburg and Richmond, 66, no problems out to front royal. The Virginia beltway three 95 are looking good. We're still working the crashes in the district at 12th and constitution and Georgia and park. In Springfield backlit road north of the beltway near hechinger drive, there is a crash working there, watch for police direction. Into Maryland, we have a crash that was clearing on the inner loop. You'll hit the brakes near the greenbelt metro heading south toward kenilworth avenue exit 23 crash was at the beginning of that ramp along the right side. But you also want this team to start feeling good about its game. And now you've got a situation where you're handing the keys over to swimming and Mark, you'd like to be for them to play better and at the very least if they're rolling through some of the ups and downs, at least getting wins along the way. It's one thing of like swimming is playing well and turns a corner, but it was still losing like two one game because your top lines, two thirds of it's out of commission. So I'm hoping that much, right? Like you still want to start feeling better about your game and now not just the fact that you're without your top two forwards on that top line, but now the whole rest of the domino effect is you've got guys a lot of order. But it's still a bet on ecm larson being better than he's been in recent years i don't think they're trading for norris trophy defenseman but they're they're they're trading for player they believe can be better. It's a big bet right but it's splashy it's a name has been talked about for awhile. overhauling i mean overhauling. If you will the defense if you wanna call it that but at the same time you know tucker pullman travis hammock are going to be asked to do a lot more than i think is really what they're capable of that to me in. The end is going to be where the bulk of the story. The season lies. I mean along with ken thatcher. Damn co keep it keep going. I mean you had you had a pretty good rookie season. Not an amazing rookie. Season had a really good stretch but some really bad stretches this past season came. He put it all together. Be that consistent guy. You know fifty five sixty nights this year Does your whole still have what they need from your to be that solid backup goaltender. I mean that's been a story here for for so long with the exception really. I suppose the cory schneider years and and you know briefly. I guess you know various points. When eddie lack had a good run vine ryan miller when jacob from i showed up i suppose but really the you know the the struggles of the backup. Goalie was such a story for so long here You know you wonder if that'll be back and they should be able to to score in bunches but at the same time. There's a lot of pressure on that defense and you know. I think the outside view is that you know to go back to your point. This defense isn't good. Nothing even with Hughes returning to some of the form he had they're going to have some challenges Which we saw plenty of last year. This was not a good defense team last year. Obviously the mix is a bit different But let's not forget that even in nineteen twenty when they were sort of lauded for improving playing up tempo hockey. They weren't great in their own end. Either i'm really not looking forward to the analysis of all ackman larson all season long because the minute us criticize him once this year be like guys never gave him a chance. I am not looking for the case. guarantee you. it'll be. And I think that's a really good way to look at it, because when that Ryan Miller played his last game here in both Florida keeping center He waved to the fans and did as little spin around and it was almost and we know it was a good bye and I always wondered if there wasn't a pandemic last year. If, at the end of the season, Ryan Miller would have said the same thing, he said right now, like maybe a week or two weeks before the end of the season at the end of this season, I am retiring but depend Emmick hit They They kind of delayed everything. And then all of a sudden he goes into the off season and he has plenty of time to recover. And he has time to be home. And then he has time to work out. And he has time to beep already. And it was like, you know what? I'm gonna come back for one more year, and I'm gonna really I use this as a bonus and enjoy it. And enjoy going to the rink. And as you pointed out, PD enjoyed bringing my family to the arena and lived through it all. And I think that was Very much a fairytale in that sense to be able to enjoy that. For Ryan Miller and his family. It was crazy for him when he was here. I mean everywhere. Every who everywhere he went. I mean, he was he was hounded. Pounded by people. Oh, if you're just tuning in. We're talking about Ryan Miller announcing his retirement at the end of the season and made the announcement yesterday There was a press conference. There are pieces of the press conference out there. I'm sure you can find it on social media, but very emotional. Um And understandably so do you. Do you think Do you think he's satisfied? With what? With his career. Well, I think he's I think he's satisfied. I think when he has time to sit down and think about what he's accomplished, he's gonna be very pleased. We all know If you don't win the ultimate prize, there's always going to be a numpty feeling someplace in your in your in your soul in your gut. To this day. Can't be happier with what I did. There's always going to be something there that I feel like I did not fulfill. Think Ryan Miller had an absolutely incredible, incredible career. There's always going to be something. That he feels that he did not accomplish and not every player that plays in the National Hockey League have a chance to You have that feeling? And, you know, I think you know when he looks through everything he's going to be very fulfilled with what he accomplished in his time playing. It's funny how his first two years his first two full seasons with the Buffalo sabers, will 506 Oh six or seven. He gets to the conference finals. He gets within. You know it one period of the Stanley Cup final and five or six and Within beating our wine or six or seven, the president's trophy year. But then after Dad, unfortunately and that's how fast and how you have to appreciate the moment early in the career or late. You never got past the first round after that.
