"Tony Katz here for Tuesday's with Tony 100 people dead across the country due to the Fourth of July violence, Tony I saw that number initially that I could have been in Indianapolis alone, which just sad. I mean, I know it's unbelievably sad that we even have to think about that. So here Central Indiana, we had violence people. There were homicides over Fourth of July weekend nationally. Obviously it was it's 100 100 150. Nobody, according to Fox News, arrested for those shootings around the country. Oh, there. I don't think there's any surprise there. This is going to come off as being anti cop, and it's not Anti cop but not know Annapolis for for certain, but when they have no backup, they have no follow through. They have no plan. They have no one to give them a plan. And no one in the higher ups cares about arresting somebody who commits a murder. They only care if the cops somehow has a uniform out of line so they can get rid of the cop. That's the way police feel. That's the way it's been portrayed. And if you would, if anybody trust the city County Council, they're out of their damn minds. No one surprised, but I find amazing. I was talking about this this morning. Nobody puts a microphone. Joe hugs, Let's face. I don't even know where the dude is. No one puts a microphone in Bob Bosley president Indianapolis City gonna council There's no might run his face. What are you doing about this? 5000? Residents don't show up to any of their officers and say, What are you doing about this? 10,000 residents won't show up to the City County Council meeting saying, What are you gonna do about this? And the business leaders of Indianapolis who were sure to say, Hey, General Assembly don't interfere with the police and and with the city's, uh, deal with with police. They all stay silent, and I'm I'm begging for one of them to speak out. Don't tell me how woke you are people are dying in the city is falling apart and we knew this would happen on June 2nd. That was the date that we found out that there was going to be some federal money being able to used to help fight crime here in Indianapolis, June 2nd. And since then We have not had a vote by the City County Council. We have not had any sort of direction about what to do with this money, everything that we thought, what happened. Tony has multiple people have died. There's been no leadership of any kind. And when you press the few people that have reached out to press the city County Council members, they right snarky things back to you. Asking these people to come in for a special vote. It's almost like pulling teeth. It's ridiculous. Abdul has confronted Mayor Hogg said several times in his responses to get mad at the question. Tony that's mayor. Hog sets response. I understand that that's the response because he gets it from one guy Now. I don't go to the meetings. I do something different than I'm doing and you guys do as well. I want to know where the reporters are that demands respect. Want to know where they are. What makes people think this is happy? Go lucky Indiana. Those days are over. I didn't say they weren't good Reporters Russ McQuaid, Paris Labelle. I didn't say there are people who aren't doing their job. But the idea of happy Go lucky Indiana is over. Stopped showing me the person who's been on air for 40 years and saying, Oh, those were the good old days. We've got a crisis on our hands, and we have nobody except for this station addressing the crisis, Let's be clear. We're the only people fully completely willing to address the crisis in this city. It is obvious even though the the actual anchors and reporters might care they may not be allowed to do it. We're the only people who act on actually giving a damn If you were Bob Mosley or Ryan mirrors. These are two guys that are being rumored to be interested in running for mayor. Both running for mayor of Indianapolis. Why wouldn't you take the lead on this and say, Hey, we need to do something above and beyond. With Bob. You're the head of the City County Council. You are one of the strongest voices in the black community. That people have a chance to listen to you. Why wouldn't you take the lead on this and say, Hey, this isn't good enough. I'm going to be the leader here because you may have to tell your constituents are doing the wrong thing and he doesn't have that kind of strength. He doesn't have that kind of style. He doesn't have that leadership skill and that leadership ability. The fundamental problem that we have in this violence first, let me be as clear as I can stop calling a gun Violence. It's not gun violence. That's not the issue. The gun is not the problem. Stop insulting, law abiding gun owners stop attacking law abiding gun owners. This is garbage. The gun laws haven't changed. Indianapolis with the violence is up. It's a cultural issue. But those cowards won't address the cultural issue because they may have to look at people who look like them or look different than them and say you're doing this wrong. But they think that addressing it culturally is a black white issue. And of course, it's not a black white issue. It is a liberal and not issue. Their liberalism has set this up. Their progressivism has created this failure. Whether we're talking about mayor Hogs, and we're talking about Bob Bosley or Zach Adamson, who refers to NRA members as Nazis, or we're talking about Ryan Miers and his unwillingness to prosecute it is liberalism. And not liberalism has failed. Indianapolis grow up, get over it and vote accordingly..

"Ralph for a 93 w I b c Welcome back. I'm guy Relford on the gang I show on 93. W i, B c Uh, I want to talk about a case that's unfolding right here in Indy. And Is clearly shooting that's contributing to the Record breaking numbers. That Rick Snyder and I just discussed and by the way, lest there be any confusion There's always An important distinction between What we saw What we say is a correlation. And what we call causation. In other words, two things may accompany each other. So there's a correlation, but you can't necessarily say one caused the other. And any time you're discussing Issues like this. It's important to recognize that distinction, however, if there is a correlation, sometimes, in fact, You can establish one thing actually causes the other. What am I talking about? Well. Rick was talking about the changing prosecutors. That we had. We went. To Ryan Mirrors, and by the way, we just lost Terry Curry. Terry Curry was a longstanding Marion County prosecutor. Terry and I disagreed on on Second Amendment issues rather directly, we testified, often on opposite sides of legislative issues over in the Statehouse. I got to tell you, Terry. Was a good guy. He was a gentleman. He was an excellent prosecutor. And and he was a highly respected colleague. And you know what? After I would get through testifying on some gun Bill. And I'd be testifying in support he'd be testifying against or maybe the other way around. He would always walk up to me with a smile on his face and shake my hand. And, you know, offered to buy me a cup of coffee and discuss about what? We disagreed on what we agreed on, and I had unlimited respect for Terry Curry. And you know, he left the office for health reasons. That's when we got Ryan mirrors. Um, but I just want to acknowledge with great great respect Terry Curry, because yes, he was an opponent on some political issues, but he was a friend. And I had unlimited respect for him. But that change occurred in 2019. The homicide numbers and again. I can't attribute causation here, but I'll lay out a correlation for you. Because Rick Snyder was talking about how the change and prosecutorial practices has led to more violent people being kicked out onto the streets. 2000 and 17. At the midway point of the year We were at 72 homicides, 2000 and 18 79. So a similar number 2019. We actually went down just a tad to 74. So in those three years almost identical number 70 to 79 74. 2019 Ryan Miers comes into the office. 2000 and 20 went from 74 all way up to 108 set a record. And already in 2021 in the first six months, So we're comparing apples to apples here, 122. I will not point fingers to the extent of saying there's causation there. But you have to notice. After a significant event like that, and a change in practices to some degree In the prosecutor's office. That We've seen an explosion in those numbers. I think that's worth noting. That's all I'm going to say about it, cause I don't want to be unfair. But it's certainly worth knowing. Right now. We're taking a break. We'll be right back. "Drive you blur dot com hotline and bring on former Marion County Prosecutor Carl Brizzi counsel. I think it was just two weeks ago, The verdict came down in the George Floyd Derrick Show, Vin Trial, Derrick Show and convicted second degree murder. Third degree murder, second degree manslaughter. I quite sure you predicted on our show, there would be an appeal that happened this week. And the lawyers say they want a whole new trial. Does any of this surprise you at all? No, not at all. There are several issues that could potentially need to retrial. Dirt seven. The fact that the jury Wasn't sequestered. The fact that there was a change of venue requested that was not granted due to the pretrial publicity on. Apparently there's some some Argument about your intimidation. I did also see Brandon Mitchell, one of the jurors to answer no On the jury questionnaire. So so one perspective, jurors are being flushed that they have to fill out during questioners that the lawyers on both sides and the judge agreed to in one of the questions on the jury questionnaire was whether or not a juror Had participated in a protest about police or police use of force in Brandon Mitchell replied. No. Now there was some back and forth during your selection between the defense lawyers and Brandon Mitchell, about You know what that meant. But what he didn't say was that he was at a Martin Luther King rally wearing a T shirt that said, Get your knee off our necks. Prior to being footed as a juror or so I think the argument will be made that he was not completely honest on injury questioner, whether or not all of those factors combined. To overturn the verdict that will see you know these. These appeals are long shots, but that's what you know. Criminal appeals are You were marrying county prosecutor for a long time when you see something like that about that juror wearing the T shirts and you know, answering yesterday on a question here, a sopra secure or you like. Oh, come on, man, Are you Are you face palming? Are you shaking your head or is it is it just kind of part of this whole process? And now how do we fix it? So I think it's changing, You know, I mean, I was I was the elected prosecutor in Indianapolis from 2000 and 33. 20,000 and 10. It was It was a different time. Then I think there are a lot of factors at play. Now. You know, social justice, canceling You know, some of these things are, um they're making things weird. Yeah. Why would you just be totally honest about the fact that you're participating? In a in a priest. Use of force protest if you're being selected on the hype, high profile case where an officer is accused of using excessive force, like That means that you have an agenda. All right. I mean, you weren't honest about it means you have an agenda. So jurors with agendas you don't you don't want them either. That the prosecutor or the defense lawyer because they screw things up, and they make all of that work that was put into that case, and that makes it such those convictions in jeopardy. And so no one You know, it doesn't do any good for anybody to have their Children retried because of a knucklehead who wasn't honest. An attorney who if you're if you're the defense or the prosecution, are you as a prosecutor requesting a sequestered jury? Do you want that or the defense Want that or Maybe the defense doesn't want that so they can appeal and ask for a new trial. What would it be the prosecutors that asked for a sequestered jury and relocation of the trial who I have, as a prosecutor agreed to Both I don't remember ever asking for either achieving the venue or a sequestered jury, But I have had a higher profile cases. One. I remember specifically where we You know the defense. There was a lot of trouble so I was trying to case myself and we moved it from Indianapolis. Tonto, Valparaiso, Indiana. And so that the judge and the prosecutor and defense lawyers, we all moved toe Valparaiso for a couple of weeks and try to attempted murder trial. Now I do want to get into some local things here in India. But one more thing on this situation with Derrick Show Vin and the defense team. If they do get a retrial here, let's say that they are granted a retrial. Is there any possible way you can find a jury that hasn't heard or seen coverage of this trial? Now you have to be now he'd have to literally have some kind People living in Iraq. So So you know, with that, with that knowledge, then just have to do and an extensive jury selection process where the judge and the attorneys have enough time. To make sure that the jurors Our fair. Look, everyone is going to come into it with an opinion, right? I mean, we're human beings, And so we're all gonna have an opinion about things. But the point is Can you check those opinions and those biases at the courthouse door and evaluate the fax based on the evidence presented within the four walls of the courtroom? And and everyone deserves that. No matter what crime anyone is accused of, no matter what the pretrial publicity is, like, no matter, you know, no matter anything, And so the point here is that there's a tremendous amount of There wasn't is a tremendous amount of pressure to hold Derek shoving accountable for what he did not saying that that's long, but I am saying that that has that potentially could have an undue influence. Under 12 people and the judge who are deciding his fate. Indeed, a Marion County judge has basically decided to take the red flag cases. Away from prosecutor Ryan Miers. Basically kind of getting him out of the equation on this. I've spoken to some law enforcement people, this kind of just You know, they're kind of don't say doing a victory lap, but they're saying this is, you know, kind of what we've been saying. The prosecutor has been neglecting these things. So now what Judge is going to come in and take these away from him? "Firearms under both state and federal law. But you haven't demonstrated to us the government a sufficient reason. Ah, good enough cause To convince us that you need Is a word that's really repugnant to me, and, frankly, makes me angry whenever it comes up in discussions. That you meet. Exercise a constitutional right. Protected by the second Amendment. What right the right to bear aren't Is there any argument that the word bear means Carrie? Of course not. In fact. That issue's been resolved by the U. S. Supreme Court in the Heller decision that came down 2008. I didn't get much deeper than that into the issue. But the resolve the issue of whether the word bear means something other than Kerry. And obviously, it does. I suppose the question could also be Does the word bear, meaning Cary? Have an application. Was intended by the framers of the founders of the People who drafted the Constitution. Does have an application that somehow limited to only being within the home. In other words, Not talking about a right to bear arms outside the home. No, no, The argument goes. Nothing in there. This is bear arms. Outside or in public. Where you might actually need to defend yourself other than in your home. No, no, The right doesn't mention in any way carrying a firearm in public. Well when a case called Peru to versus county of San Diego was denied social robbery a few years ago. That was the case. By the way, the ninth Circuit in the case coming out of California, where the ninth Circuit ruled there's no right, no constitutionally protected freedom to carry a handgun. Outside the home. What they said. And the petitioners in that case, tried to get the Supreme Court to take it. Filed a petition for social right Supreme Court did not take it. They turned it down and then a descent. That decision did not take the case, Justice Clarence Thomas said. Apparently The Book of the justices here on the Supreme Court believe that the word bear as in bare arms. Set forth in the Second Amendment means carry a gun from the kitchen to the bedroom inside the home. That's the only logical interpretation you could come out with. From a reading of a case that says, notwithstanding the right to bear arms being protected in Second Amendment, the ninth Circuit says no right to carry a gun outside the home. How do you square those things? Maybe a better question is how do you How do you slam that? Square peg into that round hole doesn't quite work that way. But we'll get into more of the specifics of the New York case and how this can impact. Many other states, several other states. Across the country and by the way, Indiana An Indiana gun owners have already gone through this fight. Get that We went through it in 1980. A little bit proud of that. For all my disappointment. And to some degree discussed. And how gun owners have been treated in the in the Indiana General Assembly at least this year. I'm pretty damn proud of the fact that Indiana through the Indiana Court of Appeals resolve that question. Many, many years ago. All the way back in 1980 get this. It's precisely the same question. That the U. S. Supreme Court is being asked to resolve in the New York state rifle of Rifle and Pistol Association case. That was just accepted. Wording is a little different. We had the Indiana Constitution also would play. But the analysis is exactly the same. We'll get into that. And we come back, as is my habit Producer. Johnny's wagging his finger at me. Where the where the issue is right, and it was beat into our heads that the old folks have to get it or you will die. That's what we've been taught over the last year. I'm like our college is allowed to say, Hey, you can't come back to campus unless you get the cove in 19 vaccine for students that part and the law is unclear, but I am sure that there is a health and safety provisions. The statue that lets colleges do that there. I mean, you have to have certain vaccines to get into like Notre Dame. There's certain vaccines that they say Hey, yeah, You have to get these vaccines only difference is this is not Fully approved by the FDA, right, so I think that's the rub right there. Well, the all the vaccines have been approved by the FDA. Bazil got emergency use. Yeah, we got him. They haven't been fully but they got emergency approval. So I mean, like I said, I got the Jang Jae shot. Fight leads to a shooting. Now. This. I think we could make the argument is rare Shootings happened far too often. Shootings on the street happened far too often. Mass shootings happened far too often. But we don't have an everyday story of a father and son getting into a fight at leading to a shooting. That's what we don't have. No one is too many. So the conversation has to be. How do we as a society deal with the fact that we might not always get our way? What's our plan? That's the question. That's what we have to be looking at. How do we teach kids? How do we teach adults? How to better handle these things, specifically concepts of disappointment, which we have so well eradicated from from do we want to say younger generation by that old that I can say that? Right. Everything is always everybody else's fault, as opposed to looking inward and saying, Okay, I messed up or you know what That's just the way it is, and sometimes doesn't work out your way. It isn't actually somebody's fault. It's just the way it goes. Maybe I'm presupposing into this case, not knowing enough about what happened between them. I know that six people are dead. And that none of us should want it. And it is a story that has made national news. I've seen people and saying, Why don't we talk more about this? Yet? There seems to be A lot less coverage than you would think. Maybe it's because it doesn't fit into any level of narrative may because it's a little more intimate than we understand. It's one that we should keep discussing. And saying, How do we ensure that we build a society? That could have a father and son disagree and doesn't lead to a shooting. How could we have people on the street disagree. It doesn't lead to a shooting. How can you have a kid in school who is unhappy and it doesn't lead to a shooting. But basically they're trying to explain away the fact that there are still thousands of troops essentially National Guardsmen at the White House and at the Capitol and making you know D C look like a total war zone. So what the statement from, DHS said, And this this bulletin came out yesterday, it said, We're issuing a national terrorism advisory System bulletin today after consultation with the intelligence, community and law enforcement partners. There is currently a heightened Threat environment across the U. S. That is likely to persist over the coming weeks. DHS does not have any information to indicate a specific, credible plot.
