The Pfizer Court specifically Joe in the larger story here is what is accepting the FBI's word on the dossier and allowing them to spy on the trump team when it would have been pretty easy to figure out that That's the big fail but believe it or not. The shortcomings continue. Let's go to these quick stories. You so number one jerry. Dunleavy of Washington. Examiner says they you know they were looking at some of these court filings and they noticed that one of the judge is about bows Berg. Forgive me from Saint. His name wrong that they were looking at some of these paperwork in a Pfizer court headlines Washington Examiner Jerry Dunleavy. Five court mistakenly says fusion. This is all we can see the report. We know what was in the report. We know there was no evidence. We know that Muller himself has on the obstruction issue stated to people on the phone. Bill Barr and others that they hadn't come to a conclusion obstruction. Not because there was no legal case to make for it and it had nothing to do with anything other than the fact that they could not make a legal case for obstruction. Simple as that. Why is Judge Reggie Walton inserting himself in this? So I get more on that. I'll tell you more but having said that the courts keep failing us what is really going on. What is the swampers? And it's now up to congress to decide what to do with special counsel Robert Muller's findings while the special counsel declined to prosecute President Trump on obstruction of Justice. He left the door open for congress to pursue several avenues, in fact, house intelligence committee, Adam Schiff, he says he was not happy with attorney general William bars. Representation of the report Democrats putting the focus on their next investigative steps. Let's bring in our guest this morning. Byron Henry joins us here on America's First News. He's an attorney with sheaf and stone Byron joins us from time to time on af en to discuss legal issues that I do not understand constitutional issues that I do not understand Byron good morning. And you know, for for the audience to we we appreciate it. I'm not the only stupid one here by. Let's talk about the findings here and the legal theories that attorney general William bar talked about yesterday and having to do with obstruction. Can you explain that to us? I think the point that attorney general bar was making his most people know of the legal. We have forced to do investigating present evidence to a grand jury in the grand jury determined that. There's there's enough evidence they presented to a grand jury in the grand jury decides skip a crime was committed died a pedigree decides whether or not someone's guilty of crime. What bar is saying here of lifetime. Prosecutors decided there wasn't even enough evidence gathered to actually presented to a grand jury or to actually charge a crime charges, you know, grand juries do. They just bring it to the grand jury. So here what bar saying you. When these people can't find these law enforcement officials couldn't find enough evidence. Put it up evidence to pace let alone if a grand jury would've indicted or convicted which is what you have to go through the process, then that is the equivalent of insufficient. Evidence of obstruction of Justice. So that's his point from a legal standpoint. But from a political standpoint. Trump is doing things, and it seemed to maybe even though he doesn't get to hear evidence. The reports say that he calls people to live whether the reason he fired James Komi than when you put those things together from the report from that side of the prosecution did his bad politically for President Trump, but from a legal standpoint bars saying insufficient evidence to even of Justice. I see. So that's so now, that's what congress will decide. Congress will now decide what to do with that information. That's correct. It looks like they're back backing off the impeachment talk. But then what people have to realize is we learned from political party twenty years ago that you can't impeach the president. If he doesn't commit a crime. But Democrats told us that so. Publican's came up with new argue whether or not it was legitimate or not, but they came up with the crime of -struction and perjury to tempt into impeach Bill Clinton. Now, we're learning from the same twenty years later. To commit a crime to be impeached. The congress the sole judge if you can just do some stuff that they find. Position to be a crime. But but the congress belief is on towards and impeachable. Correct. Donnas proof is the constitution does not limited to his high crimes misdemeanors in congress pretty much decide with that thing. So if to the defense of the democrat, if I opposite party wants to appear president for for unfold behavior that they think is unbecoming of the president's. They probably have the political will they probably have forty to do. So Rudy Giuliani was lambasted as a gaffe machine throughout this entire process. But it appears they that his team did a pretty good job your assessment of the president's team. It was very risky to waive executive privilege because we would not know any of these conversations that the president had with his high level Kelsen and the White House counsel. So so the things that make the president look the worst of the report things we probably wouldn't know the president of exerted what he is absolutely entitled to week dirt as the executive and the president of executive privilege. That's number one. So he was very open. If it was me, I would say if I was his lawyer and my job was to protect the president. I would say he was to open because now because he was his open as he could get himself in trouble. But on the flip side, I would say that the attorneys for the president did a wonderful job of making sure that all the information was there. So that you had both sides of the story that President Trump was closely frustrated that he could govern be president while he was being investigated and wasn't necessarily worry about going to jail or being impeached as what he was not being able to get things done. And that I think. Intern is a huge. Roll the conclusions. Baid the fact that so much evidence. That information was included. The President Trump was about about being found of colluded because he knew it had happened though crime committed. Crowded been committed. So how was he struck the investigation over trumped up crime though to speak man that help. But I think they did a good job. And I will tell you on the collusion spiracy question 'interference with the election count for gift the corollary things of what was done during the investigation. President Trump was one hundred percent and his followers. Exonerated is too. Light a word to say, they're literally was nothing. No evidence zilch of any type of conspiracy coordination or collusion with respect to the two thousand sixteen election. Talk about the redacted redacted versions that have to do with other investigations. Now, we know we know a couple of them, but the majority of them are ongoing and blacked out. Where does that go from here? I I know and putting unit tough spot here. But. Where does that go from here? So the first thing is the majority of with ongoing investigation of others of you could tell from the report itself unredacted force the office of legal council and the department of Justice is currently pursuing any avenues with respect to crimes committed by the president of the way, the report handles the campaign finances with with Donald Trump junior and the meeting with the Russian Trump Tower or the Russian agent at Trump Tower that the this idea that that don't worry about more because there's other US attorneys out there that are bringing charges against the president. I think that pretty much slams the doors read the report and how the office of legal counsel of Justice. Charging the sitting president with the crime. Anyway, I think that's it. But there are other investigations of other officials going on right now, and and everyone has been finished, and you have shown battery some other pants. Very of Trump campaign individuals that are currently under indictment, and there may be other indictments to come in US attorney opposite of spun off the bowler investigation twice most of that. That's what that deals with. There may be some Coen. Stormy Daniels issues going on that's about the only thing. I think of that would implicate the president though, I doubt it has to do with charging the president. It certainly surfing facts that could damage the president politically than some of these suspect, that's the majority of what you saw redacted. And then of course, you have the new revelations that William bar is going to internally begin an investigation of quote, the investigators. How did this? Desiccation which is President Trump calls it of start. And get forty to make this happen. It doesn't happen in this former fashion again, so we still be interesting. I don't think that's going to be nearly as public. I don't think that's going to be nearly as as, you know, in the news media that's going to happen internally. I think it's gonna happen quietly. One day you'll just find out that nothing happened. The inspector general is going to report. So that's probably the first job and then in bars investigations, probably the second shoulda drop on how this whole investigation over quote, Russia code the evidence. And how he was the campaign was was not spied on the use. Whatever word you want. How did that all happen? I think we're going to get an answer to that question time in the near future at it might be close to election day. Yeah. I yeah. You're absolutely right. I think it'll be close to election day as you mentioned Democrats stomach are backing off in impeachment. They will put these investigations they will keep these investigations up until until we go to the ballot box. And I think they're going to let the public decide. Huge huge in town big this just in Michael Cohen gives documents to house panel on Trump attorney. Alleged changes to the two thousand seventeen testimony. So that's the big story. That was Michael Cohen hot off hot off the press. He was testifying today. This is his fourth time in front of lawmakers. I mean, I think it was the second sense decided to tell the truth. So this is the fourth day of testimony. Yes, starting my thought he came back today after the first one two days last week. And then he's back here today. Interesting. So now, they're saying that he's he's so so the house they were requesting documents from eighty one different individuals entities groups, whomever. Anybody connected with the Trump administration. So is that what we're talking about here? He decided that he was going to pass these documents that he said were edited. They were let's see here. I'm just I'm just forgive me. Because I'm just reading it hot off the press or he's claiming that Trump's attorneys took his written statement and changed it and said, okay. Well, you can't talk about this. And you can't talk, and they basically the the inference is that they changed it. So it didn't it altered the date of the Trump Tower negotiation for the Russian Trump Tower to move it back before he became the president. Is basically what it's all about. So at this point. He just throw anything at the wall and see if it sticks. You're right. Lose going to jail, right? So. Okay. All right. Well, that's believable. I guess I could see some attorneys changing his statement. I mean, there's a lot of stuff that's just gone up there that is not on the up and up. But I don't think anybody really cares at the end of the day. I was just reading something where was this? Here. Majority of Americans think Trump committed crimes before becoming president. Quinnipiac poll indicates that many Americans believe that Trump has done illegal stuff. And also just that Trump is facing a sharp gender gap heading into twenty twenty. So sixty four percent of respondents in this survey think that Trump committed a crime prior to taking office a lot of people think that hairstyles. I wouldn't say he's doing a great job with that. But kind of reminiscent of flock of seagulls. It's a good. Look. It's a good luck. It's like a flock of seagulls. These figures, dad. So twenty four percent who do not a think he committed a crime thirteen percent. Who said they didn't know so six listen. That's shocking. It's shocking. I mean did Bill Clinton commit a crime before he became president. I say he did. Sexual abuse is a crime, right? Yeah. Okay. Rape. That's a crime. I think right. So do you think Americans really care though? Even though they believe that he committed a crime before it became president. Like, you said the real estate world values in the business world. I want to get into the that that tension there because there's something that doesn't kind of connect for me on the the don't want to be president. There be additional fallout for the Trump children from what we've learned today. Could you do you see any potential here for criminal activity to be posed onto the kids? I'm not a lawyer. But certainly if I were on that committee, I would very much like to call Donald Trump junior or and Ivanka and ask them what they knew and were they lying or as Michael Cohen the liar here, so long go back to what you were just talking about in terms of his desire Cohen said the President Donald Trump would do anything to win the presidency, right? He's Uber competitive. He wants to do anything to win. But at the same time he said that Trump didn't expect to win. So how do we reconcile someone that would do anything to win with someone that really doesn't wanna win? I've been having the exact same thought. I thought I was missing it. Okay. Yeah. Yeah. One thing that sort of illuminated it for me. Maybe a little bit was where Cohen was talking about the role that Roger stone played he said that Roger stone was in regular contact with Ricky leaks, and that he let Donald Trump no kind of contact that he was in with WikiLeaks about releasing emails and documents and coinc- and and Cohen was pressed on this point will what was stones relationship to Trump at this point was he working for him was he working for the campaign, and he described him as a freelancer, and he said he was working for free. And so I it's there then it's sort of quick for me. I'm like, okay. He likes people who offer them things for free. But this is a big thing. He was offering. And supposedly again, we don't know how I mean. Because to me, how do you you? You can't explain the DNC WikiLeaks part of this without saying, the president current president actually wanted to win that would be you know, the whole point of doing that wouldn't it? I don't know how you then sabotage your own Cam. I don't know. I I don't know. But I do I I do find it. Confusing. It may be that Donald Trump's strong desire to be a winner and be seen as a winner. Overcame his wish to build his business through this branding opportunity switching gears a little bit here. We also heard Representative Mark meadows really press Michael Cohen on whether or not he sold access to the president. Let's take a listen to that exchange. Did you collect one point two million dollars? Or so from Nevada's I did for access to. The Trump administration. No, sir. Why did you collect it because they came to me based upon my knowledge of the 'nigma Donald Trump? I found that rather. Confusing. I mean, this this is sort of this sounds like standard issue pay to play. And I think that is probably what happened here. It's interesting. The the small bits of ground where Michael Cohen is trying to hang onto a shred of his integrity and plant plant that integrity flag on his behavior and say it wasn't selling access. I was selling sort of knowledge or a sense of who this guy is and how how this enigmatic man thinks those meetings often should not involve money from what I understand where you wanna learn something about a candidate did not necessarily giving them what four million dollars was the total that I think has come up so far. Different companies. I mean what I have read in the press accounts. Is that Michael Cohen ultimately was not able to provide that much of value to them. Cohen also said that he explicitly did not want lobby language in his contract language that said I will not lobby. So I'd like to know more about that this hearing is proceeding very very quickly. So what we're kind of finding is recycling through topics and then cycling through them again. And again, and and we the reporters and journalists and people watching have to sort of put a star in each thing and see how all the elements connects I'll tell you and Andrea who we also had on the show are the experts at my mind on this. You've been reporting on this issue for so long did anything else stand out to you has anything else stood out to you? So far, we've got about a minute left in the segment, I think, they're really two columns here. One is the the motivation section, right? We're we're Michael Cohen somebody who understands Don Trump knows the organization is able to really tell us what the motivation here it was then there are the financials. And I think the most fascinating thing is he has started. So Iliad, what are some of the broad patterns that we're seeing in the questions today because I feel like there are two strategies that we're seeing emerge one from the Democrats won from the Republicans will start with the Democrats. They seem to be trying to paint Donald Trump as the villain. Yeah. Absolutely. There's a lot of different directions, and we keep kind of looping back to those. But you know, at the center of it all is Donald Trump's judgment, Donald Trump's potential legal exposure, what other parties might have on Donald Trump and really trying to understand his motivations. How he ran his company with the Republicans. There's been a lot of talk about Lanny Davis. A lot of talk about a potential book deal. Justin Amash, I think has been the only one so far that's really had substantive questions about Donald Trump himself himself, and that's really telling because. Because none of the Republicans are out there really defending the president around the things that Cohen is saying they're simply trying to ding his credibility. And for the most part. He's saying look, I pleaded to the stuff I'm going to jail for a substantial amount of time. But if you would like, I can talk to you about what I know about Donald Trump way worked for for ten years. It would be different. If I said, that's the nicest looking tie ever seen, isn't it? What are you gonna fight with him? The answer is. No, so yeah, it's the nicest looking I've ever seen. That's how he speaks. He doesn't give you questions. He doesn't give you orders. He speaks in code. And I understand the code because I've been around him for a decade. I wanted to add one of the really interesting points that emerged in the last hour or so of testimony had to do with Cohen's earlier prepared testimony to congress, which he wrote with his lawyer and then shared with the with Donald Trump's lawyers, and according to Cohen, they edited his testimony there were changes made additions Jay Secolo for one where there is about the timing. The question of time has expired you may answer that there were several changes that would made including how we were going to handle that message. Look was. Guess the message, of course, being the length of time that the Trump Tower Moscow project state and remained alive. That opens up a lot of very surprising possibilities, especially if the edits that they suggested were some kind of cover up, or if they were inserting lies Narco in has already said that his testimony was false, and he's going to jail for the false testimony. Nevertheless, if Donald Trump's if the US presidents lawyers were making Coen's testimony more false than it already was. That's really thing. That's like a whole new area of legal exposure that we have hardly begun to contemplate it's we're on air. So people can't see my are is sort of like all James thinking like this is really crazy. Let's talk a little bit about some of the actual back and forth. Earlier today, we saw democratic Representative Debbie Wasserman Schultz of Florida ask Cohen specifically about the connection between Trump and the Trump family and rush. Let's take listen if Mr. Trump and his daughter, Ivanka and sundown Donald junior are involved in the rump in the in the Russian Trump Tower deal is it possible. The whole family is convict conflicted or compromise with foreign adversary in the months before the election. Yes. Ilia? Yeah. I think the person who might have the most headaches coming out of this as Donald Trump junior because he has already given sworn testimony around this stuff. And so if he perjured himself if Michael Cohen is telling the truth that Donald Trump junior was repeatedly briefed on this very involved. And if Donald Trump junior said something contrary to that to to law enforcement, or to the congress that creates a lot of problems for Donald Trump junior. That moment was also very at a lot of built in drama for people who have been watching this for a while because Debbie Wasserman Schultz, of course, was the chair of the DNC her emails were among those that were hacked. She was actually forced to step down believe during the democratic convention in two thousand sixteen and you could hear a little tremor in her voice during that questioning as she was kind of homing in on those issues. So we also heard democratic Representative Raja crush more the of Illinois ask Michael Cohen about the last time he had contact with Donald Trump in one of his associates. Let's take a listen, unfortunately, this topic is actually something that's being investigated right now by the southern district of New York, and I've been asked by them not to discuss it not to talk about these issues. Fair enough. Is there any other wrongdoing or illegal act that you are aware of regarding Donald Trump that we haven't yet discussed today? Yes. And again, those are part of the investigation. That's currently being looked at by the southern district of New York. Any sense, Elliot? What Coen could be referring to there. It's gonna be really hard for the headline writers to pick out of these hearings. But I think this might be the best one. We did not know that the southern district was invest apparently investigating the president. We don't know what the contents of it are, but there is a clue here. Because congressman Chris Christie Murthy had asked about Cohen's last communication with Donald Trump when it took place and what it was about. And Cohen, I think said it was late summer of twenty eighteen years are blending together. But that he's been asked not to discuss it because it's subject of an ongoing investigation and Cohen is cooperating on an ongoing basis with southern district. Prosecutors. Interestingly if his cooperation is fruitful Cohen, maybe eligible for some kind of sentencing reduction, we don't know that much about it. And that a lot about hinges on whether Coen's information is good, and whether it leads somewhere, but he does have an incentive to talk.
