After much resistance, Donald Trump's former attorney and former New York mayor Rudy Giuliani is finally on his way to Atlanta. Tomorrow, he's scheduled to testify before a special grand jury looking at whether Trump and his allies illegally trying to interfere with Georgia's 2020 election. It comes as Giuliani himself learned he could face criminal charges in that case. But Giuliani's attorneys all but certain to claim their client doesn't have to utter a PEEP, I asked WA V legal analyst page pay is his appearance here, just a big waste of time. Well, it could be a waste of time and not just because Giuliani invokes attorney client privilege. He may also decide to invoke his Fifth Amendment privilege against self incrimination. But I think his team is indicated their first step is to try the attorney client privilege and try to avoid answering questions based on that. Now, assuming it does apply, the district attorney does have an option to try to force Giuliani to answer the questions anyway. She can claim that there's no privilege here because Giuliani and Trump were engaged in either an attempt to defraud someone or criminal activity because there's an exception to the attorney client privilege. It does not protect conversations. If you and your lawyer are conspiring to commit some sort of criminal offense. And then if so, Giuliani may have to answer the question, but could then, of course, fall back on the Fifth Amendment. So it's going to be legally interesting to see how all this plays out in real time in front of a grand jury, but it's not so simple as saying, I don't want to talk about it because it's privileged. Lindsey Graham is in a similar situation, and he definitely does not want to appear before the special grand jury. He cites his privilege as an elected member of Congress. Are we talking about the same thing as we are with Rudy Giuliani? No, totally different challenge. Senator Graham raised, I think, three separate challenges to his subpoena and number one. I don't have to talk to you. I don't have to talk to the grand jury because what I say in connection with my legislative work is protected under the constitution. The speech and debate clause. Federal judge here in Atlanta deny that said no, you're wrong. Graham then said, well, it's okay because I'm protected under immunity, simply because of my position. And the judge rejected that as well. And then finally Graham said, well, if you want to know something, call my office, I'm just too important to come down there and judge may rejected that challenge. So he's got to appear, but we don't know yet if he's going to have to answer every question. Because like some of the other elected officials who have been subpoenaed, I expect senator Graham will challenge some of the questions that may be asked of him and claim specific privileges relating to those questions. And so it's going to be a question by question analysis perhaps by the judge to see if he's going to have to answer. Final question yesterday, the judge presiding over this whole special purpose grand jury signed off on a security order. The four provisions were redacted. We don't know what they say, but what does this indicate to you in terms of where the case is going? To me, that suggests we're getting pretty close to the end of the work that the special grand jury needs to do. And I say that because judge mcburney obviously has a lot on his plate at this point. And so does the district attorney. So to start dealing with logistical issues about how their final report is going to be prepared and delivered, I really think that's going to come at the end of the case. And another indication of that is the fact we're now seeing targets being required to appear in front of the grand jury. Usually that happens at the very end of the investigation. When you've got enough evidence to identify them as a target number one, and two kind of put it on them to say, okay, we now think we know what you did. Let's see if you've got a different story for us. So I think both of those facts, those circumstances indicate to me that we're getting close to the end of the work, at least for the special grandeur. WAB legal analyst page paid

The FBI search of Donald Trump's home is just one of several criminal proceedings involving the former president. The court authorized search recovered boxes of documents, marked classified or top secret. The warrant included possible violations of laws, including the espionage act, a different investigation examines one of Trump's many efforts to overturn the 2020 election. A Georgia grand jury is studying his pressure on state officials to quote find extra votes so he could win by exactly one vote. Now a lawyer for Trump adviser Rudy Giuliani says he is a target of that investigation. Stephen Fowler of Georgia public broadcasting joins us once against even good morning. Good morning. Why would Giuliani be a target of the Georgia investigation? Well, it's important to remind people that Rudy Giuliani is right there in the middle of Trump's efforts to undo his loss. And why the DA's office here notified him, he's moved from a witness to a target of their investigation. He's been one of the biggest megaphones for Trump's faults claims of voter fraud post 2020, and it's being sued by voting machine vendors and poll workers alike for some of those claims. That's where Georgia comes in after the presidential election. He appeared in front of state lawmakers and made a number of far fetched claims that officials debunked, including the two black election workers were manipulating election results, like he said here in 2020. Quite obviously surreptitiously passing around USB ports as if they're vials of heroin or cocaine. I mean, it's obvious to anyone who's a criminal investigator or prosecutor. They are engaged in surreptitiously illegal activity. Again, that day. That, of course, is not what happens to you. The women testified to Congress that they had passed a Ginger mint. And these women faced death threats because of those false claims. Ginger mint, USB, difference between friends, I guess. There's news of another Trump supporter here, Steven senator Lindsey Graham of South Carolina. We know that Trump made phone calls to overturn the election and Graham also phoned the Secretary of State Brad raffensperger what to investigators want to know from him. Well, so Graham is a witness and not a target. That's an important distinction. Raffensperger said his impression of those calls was that Graham wanted him to reject absentee ballots that had already been counted. Graham disagrees with that characterization and also said he should not have to testify about the call under several privileges that come with being a U.S. senator. A federal judge disagreed Monday a ruling came down that said Graham's call to the Secretary of State fell outside certain constitutional protections and that the grand jury seemed to have questions about things other than calls with elections officials. So he should answer them. Well, Trump is the one who was recorded calling raffensperger and saying he wanted to find 11,780 votes so that he could win the state by one vote to prosecutors want Trump to testify. It's unclear if and when Donald Trump will face a subpoena, but he did just hire a well-known local criminal defense attorney in Georgia to help handle what might be coming. This lawyer drew Finland is most known for representing famous rappers and other high profile clients, but this obviously might be the biggest case yet. Besides that, they're still plenty of other witnesses to come. Rudy Giuliani still slated to appear tomorrow in Atlanta. Lindsey Graham is appealing the decision ordering him to testify and several other figures inside and outside Trump's orbit have been subpoenaed to answer questions in this far reaching probe. And now he's supporting her, but how does this special election in Alaska work? Oh, it's very unusual. We have a new system. It pairs an open primary that's nonpartisan, all the candidates on one ballot. The top four advance from the primary and at the general, we have ranked choice voting and this election is actually two elections in one. It's the special for U.S. House to fill the remainder of the late congressman Don young's term, and then it's also a primary for all the other races. And on that, it's pick one. So there's a potential for voters to be really confused. Well, let's try to be as clear as we can, who are the other key opponents of Sarah Palin in this vote. In the special, she's running against Nick begich the third who comes from a prominent democratic family. His grandfather and uncle served in Congress, he's running as a conservative Republican and even though Trump is supporting Palin, begich has a lot of support from pro Trump conservatives. And then we have Democrat Mary peltola, she served in the state legislature for ten years. She's Alaskan native. And she's has the support of begich's democratic family members. Because this is what I mean by they have that Liz Cheney is going to go after Trump and they are focusing a lot of their energy just on Trump. And some of the lawyers around him like Sidney Powell and Rudy Giuliani and eastman. But they are going to avoid things that undermine republicanism in general. And it's like, we didn't get here without people like Liz Cheney. We didn't get to this point without Liz Cheney without Dick Cheney without Mitch McConnell without all of them. But they are trying to cling to that non Trump republicanism and save it and one of the ways to do that is to make sure they don't do anything to weaken their hold on the Supreme Court at this point. So I don't expect Ginny Thomas to come up at all if you want Liz Cheney to still be on board with going after Trump.

Upstate New York and that is he has learned from his father because I did begin a race the Senate and I've always had an interest in upstate New York. That what's been done to upstate New York by our governors for the last number of years is disgraceful. You've got a lot of people who don't know the rich people who are living on that on that vein. And they are rich people in Pennsylvania and West Virginia, but not New York? The guy was resistant, but then after 6 hours, he agrees and he got rid of the prosecutor. Now, what he left out of it, which is very, very damning is his son. His son's company and his son's boss was one of the most crooked men in Ukraine. The case is fixed as a result of that. And it was a case that had been going on. And the minute I got that information, I knew I told my colleagues, they're going to give us a hard time with Biden because they protect that dummy forever and ever. And he wasn't running for president then. I didn't even think he would run for president when I would see him on television. He looked to me like a deteriorated man from the man I knew. I have literally never seen before And again i have advised on attorney grievance case so this is an order as we are recording the show thursday june twenty-fourth that grants interim relief to the attorney grievance commission which i want you to think about as applying a similar standard as a preliminary injunction. Okay so usually what happens is so for example. We had our listeners. Referred to the florida bar the series of complaints about matt gaetz. What happens is the florida bar then. Tweeted back at us and said okay. Okay opening arguments like we. We got it We have opened an investigation into gates will let you know what what what's gonna happen. And then they decided not to move forward with a referral look great. In retrospect it does not look great. So can you have get with it. florida bar. But even in meritorious cases you still get when you were under investigation for an attorney grievance commission rate for violating the ethics codes. You're still allowed to practice. Law pending the outcome of that decision. This is being called interim relief and suspending his license. But let's put that into context what this means is the grievance commission has said while you're investigating and figuring out what to do with rudy giuliani. He must be suspended from the practice of law in order to protect the public so in other words we want injunctive relief now and five settlement. I want relief now. Yeah exactly five. Oh decision by the new york appellate courts applying those two standards right so gay kind of like when when you have when you get injunctive relief you know right. The two main issues that come up are irreparable harm to the party seeking the injunction and likelihood of success on the merits the standards for for granting interim relief. Our number one. There must be uncontroversial. Claims of attorney misconduct. That is no defense to things that are clearly violative of of the models of professional conduct. And you must posed quote an immediate threat to the public. So that's what was found in suspending giuliani's license. I am as confident of anything in the law. That in the same way that when you lose on injunctive relief it means it's not. It doesn't adjudicate at that point in time that you're gonna lose on the merits but it is the judge who will rule on your case on the merits going. I think there's a substantial likelihood the to lose on the merits right so it's a really really strong indicator. I think. Giuliani will be disbarred. Wow yeah this is talk about likelihood of success on the merits. You know like this sounds like he's so obviously a disaster that they're like we got a quarantine this guy from even doing any loss stuff. I it it so if anything. This order says it even more strongly than you to said quote for the reasons that follow. We conclude that there is uncontroversial. Evidence that respondent residual yanni communicated demonstrably false and misleading statements to courts lawmakers in the public at large in his capacity as a lawyer for former president. Donald j trump and the trump campaign in connection with trump's failed effort at re election in two thousand twenty. These false statements were made to improperly bolster responded narrative that due to widespread voter fraud victory in the twenty twenty united states. Presidential election was stolen from his client. We conclude that respondents conduct immediately threatens the public interest and warrants interim suspension from the practice of law pending further proceedings before the attorney grievance committee. Now McConnell, who's in charge of the Senate, with the Republican majority. They may or may not go through with this, depending on what happens now we already know that become McConnell and Schumer. Was going to try and come up with a funny name making for the both of them, like make Schumer but make Schumer The love fair, known as MC Schumer they they came up with a plan to create a veto proof majority on the defense bill that Trump said he would also veto because it was filled with pork. So I guess the question Presents itself. What's going on Who's on whose side? Who's fighting for the American people. I think that one is incredibly clear. President Trump Trump is definitely fighting for the American people. However. We can't say the same for each member of Congress because it seems like they're fighting for themselves when you've got 100 some odd million dollars out of the The Overall, massively large bill. Going to the United States and the remainder of it. Going to different pork projects. But not to the people. Huge big number. Not reaching the people. With respect to what happens on January 6th. And honestly, your guess is as good as anybody's. The Constitution lays this out wonderfully. However. It's only been used. Think once before, maybe, maybe twice, but at least in most recent history once And the situation hasn't been like this one. So What happens? I looked at a piece of American thinker. That I thought was really interesting. Now it's it's an opinion piece, so it's not to be taken This fact. They even write out a short Speech of what they think vice president. Pence should say. In order to challenge the votes that are being presented from the swing states. And this stuff gets a little convoluted, So I'm going to try and kind of methodically go through it. But this piece in the thinker, I think, lays it out. Well, not going to read you the whole thing. But I'm gonna read you a couple of portions of it because I think it lays it out well, On January 6th. The joint session of Congress will open up with Vice President Pence, presiding as the president of the Senate. His power will be plenary and UN appealable. You heard that right? As president of the Senate, Every objection comes directly to him, and he can rule any objection out of order or denied. His task will be to fulfill the oath of office to protect and defend the constitution. And to ensure that the laws are faithfully executed. This is a high standard, obviously. I've never been an attorney general, so I don't know what it takes. Every other Democrat except her and one other dude. And I think to myself my goodness, the amount of influence that she's a mast. The amount of publicity that she's gotten. And she couldn't get a single bill passed. What does that tell the people? What does that tell the voters? You're great on TV that you should have a TV show or a radio show. You're you suck as a politician, I mean, because that's what it tells me. But perhaps I'm wrong. But my point is The media. The media since sent sensationalizes certain people. And they build them up and they prop him up and they tell that big lie just like I was explaining in that interview. This big lie. They tell you things like if you're a Republican year for the rich, But if you're a Democrat, you're for the poor. And I think to myself, that's bull. And the first time I heard it, I thought to myself well, I definitely want to be rich when I grow up. So if that's how I make a lot of money, I'm going with that team. And in effect, that's you know, kind of how my thinking was a little kid. But as an adult, I thought, man, I own a business. I was a barb around Barbershop. And as a barber, you work hard. You're on your feet, hours and hours and hours of every day And then you get you know employees and they start doing the same thing. Eventually gets a point where you make some money, and then it's like, Hey, why am I paying so much in taxes? The federal government's got their hands on you. You start to pay attention to politics. So when you hear politicians talking about tax cuts and others saying, pay your fare. Sure. You know, I think I paid Plenty of para Fisher. So you start the laugh of the Democrats ago, bro. No, thank you. I'd rather buy my own health care and make my own money. Keep my money, and I think that's You know the birth of a conservative if you will, At least that's how it was for me. Maybe I think we don't even hear enough about that. But it's not. All we hear about is the vaccine. And yet They don't take it. They don't take it. I don't. I don't get this. What's going on in America? Joe? Thank you, man. Listen, I tend to agree with you there. I think a yes, The mayor did a great job, exposing this stuff and bringing it onto the scene nationally, as did the president so many others. But Rudy's been leading the fight here and really articulating the case, especially in the statehouses across America. Because it's multiple approaches, right? There's the constitutional approach. There's the legislative approach theirs. Now the state suing state approach witches up in front of the Supreme Court, and we're going to see how that turns out. But I think what's going on and again this is just me, surmising. I really believe that there is a class of people that are like and I don't know anything about the mob. I only know what I saw on the news growing up, and I don't know how much of that I can believe. But I will say, you know the way the mob was portrayed like Cosa Nostra that our thing? It was this thing where they all had a racket. You know whether there was the waste management whether it was whatever it was right. They all had a different industry that where they made money on and they did things and they skimmed off the top, and whatever they did, they're racketeering. And I believe the government is no different. When I worked in the state government, I served in the Christie administration. And worked specifically with Family policy and things like that, and I noticed very quickly is a new guy coming from the outside coming from the private sector. That every state contract that went out for different services for the state went to a retired or former state official. Never did it go to. You never did go to the guy next door. Never did it go to anybody else but people that had already worked in the state and the minute I questioned that they looked at me and they said, Well, that's simple. The answer to that is simple. It's because they know how it works because they once worked here, and they know the standards of practice that we have, and they understand it. So in effect, it's kind of hard to find an expert that would be able to do things that way that effectively if they hadn't worked here. And they thought that made sense to me. I heard. So you're saying the system's rate If you if you didn't work here, you can't Get that contract. Wow. I mean, it's incestuous. The whole thing is incestuous. Then why even award contracts? Why not just keep it is part of the state and hire somebody for 80 or 90 grand a year or whatever it is, instead of giving out, you know three or $400,000, or a million dollars in a contract. As it's a racket. That's how they do it. You put in your 20 years 25 30 years. Whatever you cash out with a pension. You cash out with deferred compensation you can up until recently. You could cash out all of your sick days. People were cashing out, You know, six figures. Sick day cash outs. Walking away with tons of money and then saying, You know what? In my retirement? I'm gonna work as a consultant for I don't know, just X Y and Z nonprofit. I'm going to start a nonprofit and I'm going to get a county state local contract. And.

Our thoughts are with him and Jenna Ellis and the rest of the Trump legal team is the convalescing. They get better. And they continue fighting from the hospital bed fighting from their present location. Where can't even take a day off, And that's okay. I mean, you have to, you know, go with the flow. And It's better to hear it from Mayor Giuliani than to hear it from me, and we're going to get to a couple of clips from the mayor. But legislators are playing with fire, in my opinion if they don't uphold the will of the people. Today was a sad day in our republic. Because of the Case that we just saw in the Supreme Court that didn't get any traction didn't get any action. But We have to fight on. We need courageous patriotic Americans to step up and take our institutions back. Because this is a government of the people for the people and by the people, and we need to act like it. So yes, the state legislatures have a duty. And, more importantly, They have a duty to the people, which is more important than a duty to their careers. Supreme Court justices have a duty To America. They have an oath that they've taken and we expect them to uphold. What we're seeing right now is cowardice. And it's not encouraging. But there was an old saying, growing up, at least for me as a kid in Brooklyn. What I eat won't make you fat. So their cowardice doesn't mean I've got to be a coward. Joshua Jocelyn Benson violated the state's constitution similar to what happened in Pennsylvania. And the state's election laws by permitting the counting of absentee ballots without meaningful access for Paul challenges to observe the counting and processing of those ballots. The Trump campaign is arguing that Benson's actions also violated voters constitutional rights. To fair and lawful elections equal protection. Quote, saying Michigan Citizen's constitutional rights are being violated by Secretary Benson's failure to prevent unlawful ballots to be processed and her failure to ensure that the statutorily authorized challengers have a meaningful opportunity to observe and challenge the process. This is a big deal. Because how can you count these things? If you're supposed to have challenges from both sides and again, this is rudimentary stuff. But when you don't follow the rudimentary rules, what's to stop you from following the even more important, bigger rules? And this is, I think part of the problem that we face overall. And Like I said, not a lawyer. I'm gonna look at this through the lens of being practical. You know. American kid born to parents from Puerto Rico grew up in Brooklyn and As a teenager came up in New Jersey.
