Rudy Giuliani's the same level of not quite the same amount of repetition, but there's a lot of this repetition, right? Because it was multiple times a day every day this huge, steady drum beat. And this opinion pulls no punches, right? It begins by describing the situation. It says, after the polls closed across the country on November 3rd, the first presidential election in U.S. history to be conducted in the midst of a deadly global pandemic, the results in some states were immediately called with either former vice President Biden or then president Trump declared the obvious winner. In other states, including Georgia, the margins of victory were substantially closer and voters in candidates went to bed that night not knowing who had won. As days passed, local and state election officials diligently conducted the counting of absentee ballots and manual recounts. But the void of clear results became filled with increasingly outlandish paranoia from those claiming that the election was being stolen. I'm only going to read that next pair of guy. I could read the whole opinion. It's this one of the beautiful. Defendant Rudolph Giuliani, a current media personality and former politician once dubbed America's mayor, propagated and pushed that false narrative. Caught in the crossfire of Giuliani's campaign to undermine the legitimacy of the 2020 election, were plaintiffs ruby Freeman andria Archie. Moss, collectively, plaintiffs. Freeman was a temporary election worker with the Fulton county registration and election departments in Fulton county, Georgia during the 2020 general election, while moss worked on Fulton county's absentee ballot operation. After Giuliani made a litany of statements and accusations against plaintiff's concerning their activities as election workers, Freeman and moss initiated the instant lawsuit in December 2021 against Giuliani and others for defamation, intentional infliction of emotional distress and civil conspiracy, Giuliani moved to dismiss and we are denying that motion to dismiss in its entirety and it is allowed to go forward. I could go through, but again, this is just a victory for common sense, right? There were a number of supposed technical defects involving the statute of limitations from the first time that Giuliani said something, but you know, you know, measure the statute of limitations for defamation purposes from the first time somebody says something. You measure it from how the continuing for the last time that they say. Every day of the month, Andrew, I punch you in the face for like ten years. You can't be like, well, the first one I ever did, that's expired by now. So therefore, I can keep on you as much as I want. Right. The tort continues. And this is, I think, notable as a handbook for the way in which judges are likely to view things that relate to the big lie, right? So this is Georgia and I'm waiting on pins and needles every single day for that Fulton county indictment of Donald Trump to come down. We're outside the election range. While runoff though, do you think they'll wait till after the runoff? You may, but the runoff will be done the first week of December, so. That's true. That's still pretty soon. So this is unambiguous good news. And again, if I were Rudy Giuliani, like I said, there is no amount of money I would not pay to make this lawsuit go away. They're coming for your hair oil. They're very stock up or don't. I don't know what's better, what's better in this case. All right, well, I love it when bad things happen to Rudy Giuliani, because frankly, he really deserves it. All right, well, we're going to move on to our main segment, Andrew, and it's kind of related, which is the right wing's war on the First Amendment. Lots of First Amendment litigation in this episode, I suppose. How is this time the right waging a war on the First Amendment? Yeah, again, this is just another data point to keep on board when you're arguing with cool dude 69 on Twitter, whatever, and he's got proud mega warrior hashtag one a in his, and it's always a he in his profile. Republicans are absolutely no friend of the First Amendment, and there is no bigger stage on which they wish to fight about this than the stage of trying to sue to intimidate journalists into silence, particularly when those journalists are expressing political opinions that are perfectly valid and need to be a part of the public discourse. And we're going to start off with and you'll see how it connects. My former law professor. Alan Dershowitz. So someone who should really know better in terms of what the First Amendment stands for. Someone who knows exactly what he is doing. Let's start with this. On September 15th, 2020, Alan Dershowitz sued CNN for defamation. It is, and I'm going to read directly from Dershowitz's complaint. This was complete nonsense from the outset. Here's what Dershowitz says. This is paragraphs 7 and 8 of Dershowitz's complaint. So paragraph 7 says the relevant part of plaintiff's statement, and this was said during the impeachment hearings. Is this big long thing? Paragraph 8 then says, but CNN entered into a secret conspiracy with all of its reporters to only say this part. And this is the part that you may in fact have heard. Alan Dershowitz, when asked about the propriety of impeaching president Trump over withholding aid to Ukraine, conditioned on president zelensky, announcing an investigation into Hunter Biden. Said this. Every public official that I know believes that his election is in the public interest, and mostly you are right. Your election is in the public interest. And if a president does something which he believes will help him get elected in the public interest that can not be the kind of quid pro quo that results in impeachment. And as a result, everybody basically came out with stories that say Alan Dershowitz has lost his goddamn mind. Oh, could that be because he's lost his goddamn mind? It might be. Says that the conspiracy here was that CNN ignored the fact that that came after several minutes of burping and I'm going to read only some of it to you that began with the only thing that would make a quid pro quo unlawful is if the quo were somehow illegal. Never minding the fact that that sentence, I can't even purse today with that sentence is supposed to mean. And it is completely inarticulate and impossible to decipher. That wasn't said immediately after the public official thing. That then had a bunch of stuff in the middle that had now we talked about motive. There are three possible motives that a political figure could have. One, a motive in the public interest, and the Israeli argument, and that's not important what that is, would be in the public interest. The second is his own political interest. And the third which hasn't been mentioned would be his own financial interest. His own pure financial interest, just putting money in the bank. I want to focus on the second one for one moment. Every public official and then it goes into the statement. This statement got analyzed on CNN and reported widely as not just Alan Dershowitz's lost his goddamn mind, but basically a version of the frost Nixon statement, right? Like when the president does, if it can't be illegal. And der says, no, but look like a paragraph and a half earlier, I said it could be illegal if the underlying quid was itself illegal. Leaving aside that that makes virtually no sense, this is an incredibly strange basis to try and sue someone for defamation. Yeah. You defamed me by publishing my words. And by in fact, publishing a minute long segment of his right right, they left a huge chunk of this 8 minute thing of word salad intact, and I have no idea how a news organization could possibly know, like, how much context do you have to give?

So I know when it's been good and when it's been bad and I lived through all of this, what I see, how happening in the streets is that the evil is loose, there's no restraint on them because they feel like they're complexion is that protection and they do whatever they want because once they get in front of the judge and the prosecutor or whatever, they play the victim card and then you got the little legal aid hugging them and robbing them and it's sickening. And we all know it from the Durham investigation and assessment trough. So I mean, they're doing this right in front of our eyes. I mean, they've been perpetrating a sabotage and a psyops operation against the American people and it gets Trump since he came into office. And they framed Carter page. They framed general Flynn set them up in a perjury trap. And then Jim Comey brags about it to the media that he did it. And I mean, and this right in front of our eyes and they're getting away with it. So, man, it's shocking. But how can we agree? I agree, Todd, I agree. I agree. So NBR's books we love project used to be called the buck concierge, but whatever you call it, it's a great way to find a book for any occasion, any reader, and any set of tastes and interests. It's a labor of love and literacy, put together by a wonderful team and dedicated to our dear friend and colleague, NPR books editor of Petro mayor, who died in November. And one of the tags that they use to help you find books is called the states we're in, which focuses on books about life in the United States. Some are about history, some are about politics and current events, Eric picked several books from this category, and he's going to make some recommendations. Eric, what is your first pick? Okay, so my first pick is landslide, the final days of the Trump presidency by Michael wolff. Now, of course, we had over the past year, a virtual landslide, see what I did there. A virtual landslide of books about the Trump presidency, but Michael wolff is an author who's always seemed to be able to get under the skin of president Trump. And talk about his psyche and how that affects what he did as president and how that affected how we all react to him. And so I was really excited to read landslide and true to form it is both a personal account of what happened and gives you an up close look at kind of his dysfunction in the increasing dysfunction of the people around him, particularly after he loses the election to Joe Biden on November of 2020. And it's set against, of course, the backdrop of all these events that we know, the advancing pandemic. And the insurrection. At times it's gossipy, even. And in a weird way, I kind of wanted a little bit of that. Yeah. Michael wolff landslide the final days of the Trump presidency. I think it's safe to say if you want a Michael wolf book about the Trump presidency. That is the one to read. And you know, you always wonder when you read these books like certain people come out looking badly. Other people don't. And in some ways, you can wonder, well, the people who don't come out looking so bad were they the sources. You know, with these books, the sources are largely anonymous. There's not a lot of on the record pronouncements. But Rudolph Giuliani in particular looks really bad in this book. He's depicted as somebody who's increasingly disorganized, increasingly irrational in his claims about voter fraud and someone who constantly passed gas, for example. Now, I told you, it was gossipy. But ultimately he sort of used to show how particularly after Trump lost the election to Biden, the more reasonable people began to sort of separate themselves from Trump. And Trump increasingly began to be surrounded by these people who would tell him what he wanted to hear, which was that Biden was not the rightful and fair winner of the election and that challenges to the election result could actually result in him being able to retain the presidency. One of the lines that I love from the book, he said, it's a truism inside the Trump White House that one way to take control is to just take control and say you're in charge. And so Giuliani and later on Sidney Powell and Jenna Ellis, you know, some of these more vocal supporters. We'll just do that. They would just stand up and tell the president what he wanted to hear and try to take control of the situation. And it just produced the chaos that you would expect..

The American people can feel comfortable that this election is being conducted fairly, and I've got to say that when you have record turnout I've been pleasantly surprised at how smoothly it's all gone. We should be proud of ourselves as a country and as a democracy, particularly given the fact that we know foreign actors led by Vladimir Putin and Russia have been working as hard as they can. Now as we know the president cannot be prosecuted as part of a traditional Legal investigation it. There is a special process. The founding fathers of the United States for better or worse put into place with respect to holding the president legally accountable and that is the the impeachment process. Which of course begins with the House of Representatives? The Lower Chamber of the Congress deciding whether to charge the president with a particular offense Which has done that is why he's been impeached? And then it goes to the Senate to decide Whether to convict him the offense and if they do convict him of the events he will be the I president. US history removed from office. And that is where we are now the opening formalities of the Senate trial of happened. We've had the swearing in of jurors as we know the Senate is controlled told by Donald Trump's party the Republicans will the jurors be impartial. Well that's the big question. We're learning to find out so A month ago Mitch. McConnell the the leader of the Republicans in the Senate said that he didn't intend to be an impartial juror and he emphasized that this is a political process And of course there's a sense of what she's he's right that it is a political process. This isn't a standard ordinary legal process. It is a a decision that the senators get to make for themselves. They get to ask themselves. Do we think that this conduct that the president has engaged in amounts to what the constitution refers to as high crimes in misdemeanors has the president by allegedly abusing. His power demonstrated that he is fundamentally unfit for office such that he ought to be removed. That is not a matter of showing that the president violated highlighted some particular law on the books. It's it is a political judgement but that doesn't mean it has to be a a a narrow minded self interested partisan judgment political judgments can still be moral judgments and so when the chief justice of the United States who very intriguingly to preside over. This whole process swore the senators in in yesterday He got them to swear that they would do impartial. Justice in this context with that means I would argue is that they need to Genuinely we look at the evidence. Look at the facts And that really goes to the question of whether this will be a fair trial because we do not know for sure yet whether there will actually be witnesses called or or whether it will be a very quick process where they have opening statements And then basically closing statements and then it ends because trump had originally said he wanted witnesses. Well it's it's not exactly clear what the president wants here One thing we know for sure is that if the president if we do have witnesses in this process For example the former national security adviser of the United States John Bolton long celebrated and regarded as a very important vigour by Republicans but who is said to have referred to Rudy Giuliani's little inquiry in Ukraine as a as a drug deal that he didn't have anything apart a part of he has said that if he's subpoenaed he'll be willing to testify. No doubt if left parnassus subpoenas. He would testify Now it could be that some of the more. Moderate Republicans pins people like Susan Collins from Maine who are going to rely in their next reelection. On more moderate members of their state voting for them will want to be seen as not just in the tank for trump as somewhat more independently minded Someone like Mitt Romney. For example the senator from Utah also wants to be seen as an indeed is more independently hundley minded. They may well go with Democrats in supporting calling witnesses. You might even get more Republicans than that to support calling pulling witnesses. But then they'll perhaps want include witnesses. That don't seem to have much particularly to do with whether trump is guilty not such as Hunter Biden and so if we start seeing people like Hunter Biden called in this thing could degenerate into a circus quite quickly and I mean such a huge week ahead then for the US and not just for the Republicans for the Democrats. Not Because of course we have Iowa coming up on one of the unintended consequences of this. Trial is the fact that two senators who are also running for the Democratic nomination not table to get on that campaign trail so Elizabeth Warren and Bernie Sanders both needing to be in Washington to actually be at this trial absolutely absolutely and so then. They're going to have to go so there. I don't know if this is normal for a subpoena but according to the Wall Street Journal these subpoenas reportedly list more than half a dozen potential charges is under consideration including obstruction of justice money laundering conspiracy to defraud the United States of America making false statements to the federal government serving as an agent of a foreign foreign government without registering with the Justice Department donating funds from foreign nationals making contributions in the name of another person or allowing someone else to use one's name to make a contribution and plus mail fraud plus wire fried anything else.
