From a party when, ROY Oliver opened fire hitting him. In the head, Oliver was fired shortly thereafter and earlier. This week a jury convicted him of murder following the, verdict. Jordan step mom applauded the. Jury's conviction Ever grateful niche I'll seen your hearts It was wrong but the. Family's attorney told local TV. Station WFAN. The sentence was disappointing What the jury's sentencing. To me says, that they're going to give Mr. Oliver a chance. To redeem his life But what he did get my client has no son they get nothing from this still it's the. First, time in forty five years that an on duty officer in Texas has. Been convicted for a fatal shooting meanwhile in a window. Of just five years between twenty ten and twenty fifteen the. Texas Tribune found at least two hundred, and forty seven, people in Texas had been killed by on-duty police officers Philip Stinson. Is a criminologist at bowling green state university and he's. Research, convictions, and prosecutions of police. Officers across the country. He. Joins me now to discuss this case Hulo Philip hi, Matt thanks for having me it's always a pleasure absolutely so we know this conviction is incredibly rare for Texas but just how unlikely is it nationwide? For, police officer to be convicted of murder or any crime at all when they kill someone on the job well the best estimate that I, can give you is that between nine hundred and one thousand times each and every year in on-duty police officer Shoots and kills someone, at agencies all across the country and of those nine. Hundred two thousand officers who shoot and kill someone while they're. On duty h year only a handful, of those officers, are ever charged with the crime in more specifically murder manslaughter so. I've been researching this for about fourteen years and by. My, count. Ninety three officers have. Been charged with murder. Manslaughter. Resulting from an on duty shooting since two thousand and, five so it's it's very rare that an officer charged it all and it's even more rare officers convicted and when it comes to sentencing for those? Who, were convicted Oliver was sentenced to fifteen years how does that time square with the sentences of other officers who have been convicted and sentenced Well it's really. Difficult to try to make sense of this because we're dealing with different? Jurisdictions across the country but I went back and looked at some? Of the data? So, his sentences for fifteen years and, I don't think he'll serve all of, that he, probably will get out before that but when I went back and looked at it it's, interesting there are seven officers including ROY Oliver who have pretty significant prison sentences the high sentence was forty years in the low sentence was about seven and a half years so actually, when you stack up the seven officers and it was actually five different shootings but the seven. Officers in those case of ROY Oliver sentence of one hundred and eighty months, fifteen years comes right in the middle what was it about this particular case that persuaded the jury to. Convict was it the body camera footage that was released during, the trial did that help well the. Body camera footage is important but we've also seen in other, cases high profile murder cases involving. Police officers and on-duty shootings where it's actually not seemingly made a difference but I think they're There's two other factors one other factors that is just a bizarre situation that, can't rationally be explained and then the other thing is that. A police officer who was on, the scene Tyler gross actually testified at the first. Day of the trial that he did. Not have any fear of deadly force being used, against himself or someone else he did not perceive, any such eminent threat so is. This conviction and sentencing just an outlier given these circumstances that you just laid out or should. We look at this conviction as a possible bellwether of changing perceptions of police culpability and, use of force by police I don't think we, can draw any conclusions or CNN sort of. Changes all of the cases in this. Sample are outliers so it's a strange thing but it's very hard to? Try to look at any sort of patterns but when I look? At these cases? Since, two thousand and five they go, up and down in terms of just, single digit, numbers or maybe up to the high teens in terms of the officers being arrested in, a year but we I. Don't see any changes it's business as usual for law enforcement on, the streets of the United States Phillips Stinson is.

"The jury in. The ROY Oliver murder trial sent home for the weekend after testimony wrapped up KRLD's LP Phillips has been. Covering the trial wall to wall for the. Last week and he joins, us live in studio to talk about it the, first thing I ask does it tell us anything. That the defense decided to put ROY Oliver on the stand yesterday. Interesting strategy I here's my take on. That in most cases the defendant does not testify and that's because they don't want to be incriminating themselves, this a skilled prosecutor can triple mop can get him to confess to, something in this case there are a number of issues that were not in dispute first of all it was never in dispute that. ROY Oliver, shot Jordan Edwards that was that was indisputable the second thing was he. Had. Given. Police. State Admits he. Had given a number of statements, to attorneys in this thing so his his recollection was already on the record the decision by the defense was given that, could he helped persuade the jury that what he did was justified. And he was very poised, in what his testimony was, that he was he was not rattled but it was clear that there. Was contention between him and the prosecutors on cross examination they didn't get them to to break down and say I shouldn't have done it. He he's lying wasn't a, look like a well rehearsed line given what I know now it was probably not the best? Choice but, at, the time I did what. I thought was, appropriate so what happens next when they come back on Monday morning Monday morning we'll. Have the person closing arguments and that's, following the instruction they call it the. Charge were the, judge reads the instructions the jury will have to follow while. They're deliberating then, they'll have the closing arguments and this, is the. Chance for, both sides to make their. Cases to why he is if you're the process Why this was murder if you're the defense don't be surprised if there's, a lesser included charge of manslaughter in there or something that's. Unlawful use of a gun or something like that I'll lesser charge l., push for now that'll be decided, during the charge conference then. The jury will. Go deliberate now if the deliberations if they. What we've read for months on the story so The cops get to the door they're let in everything's fine and then while, they're in there with. The kids in by the way there's some jokes that some people think well that's a little rude. But it's. Fine. There's nothing negative and nothing racial in. The conversation with the two officers and the kids and everything's going fine and then all of a sudden you're twelve a gun shots which you're gonna here in a second, twelve gunshots, okay now I hope you. Agree with me that's, when you run. Out and go shoot to kill whoever is to, shoot a gun shots when you. Got when you know this to three. Hundred kids at this part this party and then they're all. Leaving some are running away which is understandable some, are walking out because, they've been told believe you know that kind, of stuff but this is a code red man this is. A massive alert emergency where you go. Out there I would. Assume guns drawn. Because is twelve shots turns out the shots unbeknownst to them. Are right. By them. Obviously because you'll hear them when I play, this, in the second it's totally obvious that there were, shots there was, absolutely possible they were kids some kids shooting. Somebody No right so I know you, what he wanted to do at that point sip Agnew rather. Fine either black let him die and. Then what you what. Would you expect. The cops to do So they go out there armed, guns drawn the trial for murder grabs, his rifle out of the car Cox it And the his partner there's, some vehicles driving away and they're yelling stop stop stop you'll hear the audio at least. I think in this version one of them has, it in their young stop, and they don't stop at that point the officer who testified not. The one on trial but the other one said. I walked up the vehicle. Backed up and back north, on shepherd I stepped. Into the road ahead of. The vehicle I continued toward the vehicle it then drove past me, he hit the car this is the innocent. Cop he hit the car. Is now on trial which broke its, window and then immediately heard a series. Of, gunshots Which you'll hear the officer then the trial, says he asks his partner are you okay He says he was trying. To hit you And the. Asked they, asked the that officer the partner are you were you? In fear for. Your? Life at that point because that's key right he says. I was not in fear at that point However listen closely there you go yeah Hey hold on. Relax The officer that was almost hit was twenty. Inches from the car and he argued that at, Oliver's point of view the. One was on trial he said it could have led him to believe that he was about to be, run, over here, that What alert alert l. idiot alert any it alert attention attention Chris crock has been right since day one He says well I wasn't in, fear I was twenty inches away. Here you'll, hear, what he's been doing. Anything wrong that's what one, of the, kids said at one of the people testified he was innocent, child doing nothing wrong that night And The driver actually was I, actually I guess you could say that's not, right but whoever was in the, car they don't.
