"Heike haidara how you doing all right. Thanks for joining us. So when we talked about doing the podcast laura vapin. Er was your first thought. Why was that. I thought neon sign went off of my head. I've read the store many times but this was one of the first stories that you know From the magazine that i read and then it stuck with me for a really long time and since then i've read her older stories in the magazine but also all of her collections. Her novels i think her most recent one about her mother Right divide by. Sarah is a great example of being introduced to a very small piece of a writer's work and then wanting to read everything about what she's written and seeing what kind of terrain she covers them. So she's one of those writers that i'm always recommending to everyone. What was it when about this story when you read it. That made such an impression. I think she does a great job of being very laser focused on an experience from childhood. That has an impact in in adulthood for this protagonist and Her friend while also taking on something as large as may be the immigrant experience but having that happened mostly off stage and i found that incredible that the first half is mostly set. You know in a foreign country with Girls who are just like girls in any country and somehow we end up in a different place by the end of the story. I'm just amazed at how much time and also territory was covered with very very specific characters and just dolls and you also right Fairly often about the life of immigrants in the us and roy The story is about. Russian emigrants not immigrants from china but Do you feel that. There's overlap in your interests right. I did feel a certain kinship about that experience very familiar train. It was eerie. When i read it because i understood so much about the interior of the protagonist in that relationship but also just the backdrop of what was happening and class class within immigrants class in your native country in your new country. I found that was done expertly but very very very subtly.

Wow and i was watching it. I wondering if it was for comedy or for real than quickly recognized what it was doing single camera no laugh track faux documentary with people who felt real and i kept watching and started laughing. And it's really hard to make me laugh. And i was falling in love with the show in that moment and then i started thinking about it the next day in the morning and i asked henrietta if she knew ricky gervais as and she said no but her friend dan. Mazer did and we organized and had dinner with dan that night. Which are twenty four hours after you after you see it for the first time on television. You're having dinner with someone who could get you to ricky. Yes and additionally. I also wanted to be with dan. Dan was sasha baron. Cohen's partner allergy was on television. Was allie ardor your then no in the uk okay. But i'm with dan mazer yep. Dan is lovely brilliant in his own. Right and i start peppering questions about the office. And he gives me ricky cell phone number and so the next day. I call ricky around eleven o'clock in the morning and introduce myself on the phone and say i'd love to meet you. Are you in town. He goes actually. Yes me in soho at the starbucks this afternoon and i coordinate a meeting and i spent an hour with ricky talking about the office and very quickly we got along because we both love television and he truly was making me laugh even in those moment right over over the coffee at starbucks and so he clearly had chosen the location of the starbucks because he then says to me oh good news. My agent is right around the corner. Let's go meet with them so it was almost like he met me confirmed. I was okay roy. Conversation was interesting and then we walked over and met with dunkin' as his agent. And then duncan and i began a three month process to secure the rights. And it wasn't until dunkin. Help me unlock it. All that i realized. Both the bbc and ricky controlled the rights. I needed ricky and stephen merchant to actually get it done and agitate to get it done otherwise. It was never going to get done. Got it so you you deal with the bbc. And you deal with ricky steven. You have this partnership in place and where do you go into the united states. I immediately start making phone calls and saying. Are you aware of the show the office. Do you know what it is. Do you think it would interest you. And this is probably now a month after are so run. The show has started to gain buzz. It's aired its cycle in the uk. Its initial six episodes and so it has an awareness. Now it's a thing right not a big thing but to anyone in england it in the television industry. You're aware so. I'm i'm back at the states reaching out to people one of the incredible things about hollywood which was a huge advantage for me to do. Well was that people in hollywood are pretty insular and don't like to travel. They think you need a passport to get from burbank to beverly hills. That is travel and so many people at this time in american television had no clue connection about anything beyond la. Right and only one exac at the time knew what i was talking about was a guy named nick grad. Who worked at fx and he knew what the show was and he loved the show. Kevin riley was running fx. At the time. I'd gone to less mooned us he passed. I went to gail berman. She passed immediately. Didn't get it. Hbo said we'll never do a remake. They clearly have altered that thinking that that time they were like. We won't do a format and showtime wasn't doing shows like this right. I didn't go to abc. 'cause i just knew it wasn't abc. Right and i was starting to tease. Nbc with it and kevin than got named the head of nbc. And i bring it up to him. And i say would you wanna do it here and kevin says absolutely little. Did he know he was actually my only buyer that time. He was the only one right who wanted everyone else. All of television everyone else had passed. Now are you in kevin's like let's do it. Like let's let's make it. You know i'll give you a pilot movement and then kevin's boss though. Who is very involved in his life. Jeff zucker didn't really like it that much because it was his single camera. Nola back injury. I got it like it was a hard pill for them to swallow. I was also like they didn't want the game show back in prime time when i brought millionaire. Everyone thought that was cheesy. Daytime like no no. This will change. Tv know you gotta look at it from how to push the genre and pushed the envelope. So that you can expand versus always play for defense right and i was like this is another level and this is potentially transformative of television and with that can come great great

Um, and to be clear all Americans deserve protection and to live in a free and secure society with the fundamental nature of what we expect out of government, right. Secure the blessings of liberty, as we say in the Constitution, United States, um The victims of race based violence, and their families deserve justice. And that's the case what we're talking about here with the tragedy what we just saw her and Atlanta, Georgia. I would also suggest that the victims of cartels moving illegal aliens deserve justice, the American citizens in South Texas. They're getting absolutely decimated by what's happening. Our southern border deserve justice. The victims of Riding a looting in the streets last week. Businesses closed Burn lime started last summer. Deserve justice Way believe in justice, right? There's an old saying in Texas about, you know, find the all the roof in Texas and get a taller tree. You know, we take justice very seriously, and we ought to do that round up the bad guys. That's what we believe. Um, my concern about this hearing is that it seems to want to venture into the policing of rhetoric in a free society free speech, um and away from the rule of law and taking out bad guys. And as a former federal prosecutor, I'm kind of predisposing wired to want to go take out bad guys. And that's bad guys of all colors as bad guys of all persuasions. That's bad guys targeting people for all different reasons, and I think we need t be mindful of that. And so now we're talking about whether talking about China Chai calms the Chinese Communist Party. Whatever phrasing we want to use and it some people are saying, Hey, we think those guys they're the bad guys, for whatever reason. Let me just say clearly, I do. I think the Chinese Communist Party running the country China. I think they're the bad guys, and I think that they're harming people. And I think they are engaging in modern day slavery. And I think that what they're doing the wingers and I think that what they're doing targeting our country and I think that what they're doing to undermine our national security and what they're doing to steal our intellectual property and what they're doing to build up their military and rattle throughout. Between Nineteen, forty two and nineteen seventy seven lightning struck Shenandoah National Park Ranger Roy. Sullivan at least seven times making him statistically one of the unluckiest humans to ever live unfortunate circumstances turned even more tragic in one, thousand, nine, hundred, eighty, three when Roy took his own life. The, incredibly unlikely events of Roy Sullivan's life have inspired countless conspiracy theories, but one question lies at the core of them all. What made Roy Sullivan so unique. Before he died Roy often wondered the same thing himself in interviews he tossed out the idea that his body might contain some sort of chemical or mineral that somehow increased his odds of being targeted by lightning. Medical professionals reached out to Roy expressing their interest in running tests to determine the cause of his lightning attraction they even offered their services pro bono in addition to covering his travel expenses. You know as America, Burns what comes after a very unpleasant weekend, and after the show after we were done talking to an assortment of our friends like we will all week today like we will today, when Pablo Tori joins us in. A half hour to talk about the story that he had about James Dolan being very tepid in telling his employees. "On that wiretap tape you also heard Robert. Peterson mentioned the death of his ex-girlfriend. What you didn't hear was part of it that was redacted when I receive the file you heard him say that he lured Roy Andrews to the cemetery you also heard him say that his ex girlfriend quote unquote tripped and fell in the highway. Well what you didn't hear was Robert Peterson in that confession. Tape also say I stacked them double. What he meant was one Lord Roy to the cemetery. He Lord Him to the place where his ex-girlfriend had been buried over a year prior and he killed Roy Andrews on top of his ex girlfriend's grave in other words he stacked them double. She did not trip and fall in the roadway at least in my opinion however the homicide detectives and the State Attorney upon hearing that reopened her case and they look for witnesses. They looked for any further evidence. That would show that Robert. Peterson may have just admitted to a second murder. Unfortunately when they looked at the case file there was nothing in there that would allow them to reopen the case for manslaughter or homicide. Against Robert Peterson so back to the Roy. Andrew's murder case early. That next morning my phone rang. It was the lead detective and he said I need you to come down to the office now. I said what's going on. He just come to my office so I did and I walked through the doors and he was standing by his desk and said what's going on. What's the matter and he told me that they had Robert Peterson in custody and I smiled and he said not so quick here and he handed me a set of headphones as it. What's this and he goes? Just sit at my desk and listen so I put the headphones on and I sat down his desk and he pushed play on the recording device. And I sat there and listened to the same thing that just a few hours earlier. They had heard live after a while he came back and I was just sitting there with a glazed. Look on my face and he said would you think what did I think dude? I don't know what to think I'm dumbfounded I'm disgusted. Makes me sick and he said Yeah. We weren't really expecting all of that and he said to the forensics match up with what he's saying I said GAIA. The forensics did match we had Roy Andrews truck and the bloodstains inside told the story that everything that happened to Roy happened either inside or just outside the truck. We had the blood splatter on Roy Andrews arms that showed a defensive position when he was fending off. The brass knuckle blows by Robert Peterson. We had the projectile in the glovebox. And the fact that it had traveled through Roy before ending up there the supposed- nosebleed that Roy Andrews had the night before that we knew was a complete crock. We had the ball cap. We had all kinds of forensics and everything that we had every theory that we had proposed was founded by Robert. Peterson's own words. After Robert Peterson was arrested. Thrown in jail bond was denied and the case languished for a few years in the pretrial process as depositions were taken and defense attorneys were assigned and reassigned to his case finally after four years. The twelve took place in August of two thousand nine. The prosecution presented all of the physical evidence and the jury watched the video surveillance footage from the hotel hallway that showed Robert Peterson exiting about six. In the morning wearing the black ball cap found at the crime scene and then returning shortly after the murder without it. Timelines were scrutinized. The confession tape from the wiretap was played to the jury and they sat stunned at what they were hearing. The medical examiner testified and showed photographs of the horrific injuries to Roy Andrews head and face. And how Roy would have survived for several minutes in tremendous amounts of pain before the fatal shot was fired his brain stem and on the third day of direct testimony. I was called to the stand and I couldn't wait to give my testimony. The first thing the prosecutor did was he brought out Roy shirt that we had tacked to the cardboard the day of his murder and came out of the witness box and I pointed to the gunshot residue on his shirt collar. And some of the bloodstains on his shirt and the prosecution moved forward to the bloodstains on his forearms. And I pointed out to how that would be a defensive posture on the part of Roy to fend off the blows from the brass knuckles and I watched the jurors and I watched their faces and they were scowling. They were they were pissed. I think they were just as pissed off as we were. And after I got through all of physical evidence and we're going to go through everything but suffice it to say that the jurors were sitting in their chairs and most of them were just staring. Robert Peterson down. They were mad and I think that they were. Ansi to get into the deliberation room. I still had the defense to contend with and it wasn't going to be pleasant the defense attorney postured at the turn and smiled at me. That was not a gesture lost on me. I wasn't quite sure what he had up his sleeve. But I was prepared and unafraid. And the first thing that the defense attorney did was brought up the evidence collected at the cemetery that day he skipped over the ball cap the things that were in Culpa Tori against his client and he skipped over to the extraneous garbage that I had collected. That was a little bit removed from the scene and he focused on that cigarette but that was pointed out to me and at that point I went God damn it. I had a funny feeling. This was going to be a problem. Good afternoon detective. Did you collect a cigarette? But at the cemetery yes and had that cigarette benchmarked and I said well it was just the but so I would assume so. I knew it sometimes collecting extraneous. Evidence can introduce evidence that is not of the crime at hand but extraneous to the scene that can muddy the waters that cigarette but had nothing to do with Roy Andrew's murder and now the defense attorney was going to try to spin that and take out all of the evidence that we had collected an all the work that we had done and spin it to his advantage and I should have pushed back harder at the scene and I knew it but now it was too late and I just had to answer honestly regardless of the consequences and the defense attorney asked what can agencies discover from a cigarette butt and I said well you can get DNA from the saliva on the end and I don't think it would be out of the question to get a partial fingerprint from the paper so the purpose of collecting it for putting it into a bag is to send it somewhere to get it. Tested is that right. Sure and they would look for DNA from saliva fingerprints. Things like that right and he continued. Now this occurred August of two thousand five right right.
