"But wise guys, this movie is going to make De Niro. It's a period of peace. He's going to tell the story of Vito Genovese and Frank Costello. Who are a pair of Italians running two separate crime families during the mid 20th century, Genovese tried and failed to assassinate Costello in 1957. But then, well, it's a great story. The in Costello got his revenge. And De Niro, you ready for this? Is playing both roles? What are we doing? I love De Niro. In my mind, he can play anything. I'd watch De Niro play an Uber driver. I don't care. He's the best, and I know he's done some roles in the last 20 years, which are embarrassing. You know, yeah, I have to remember. When actors get to a certain age and their grandpas or daddies, they tend to do things that their kids are grandkids want to see. So you can't get up there and ask too much. De Niro did a rock in bullwinkle. He knows it was a piece of shit, but he wanted his grandkid to see him in the movie, or hear him in a movie. You know, you can't. But De Niro's playing both these roles, Genovese and Costello. Nick pileggi has written this script pileggi wrote Goodfellas. He's the best in the business. And he wrote the book wise guy, but that's not what this movie is based on. Unfortunately, the producers Irwin Winkler, he's the fuck face who keeps squeezing Sylvester Stallone, and won't give him a percentage point of the rocky movies, so Winkler is producing this which sucks. Barry Levinson is the best. He'd made movies toys, bugsy, rain man, good morning, Vietnam, ten men, and diner among others. He also did the HBO Emmy nominated series, the survivor, he did two episodes of dope sick with Michael Keaton. This guy, I mean, look, you can't get better people. But De Niro playing both roles, I wonder what that's gonna look like, you know?

And he has an incredible Wall Street Journal op-ed, which says whistle starts to blow at the FBI. I have so much to ask him. I'm so glad he's with us right now. Thomas baker, welcome to the program. Charlie, good to be with you. Thank you. And congratulations on the book. So let's just start here. I'll be very plain and blunt. I've lost total and complete faith in the Federal Bureau of Investigation. I believe it's become politicized and at that actors are not removed. In fact, some people believe rightfully so and I agree with them. The FBI is actually being used against citizens. Is that a bridge too far as someone who served in the bureau for 33 years? I know it's not a bridge too far. And a lot of people share those sentiments, my take is a little more precise, slightly different than what you just expressed. I think what's happened, the root of what's happened is a change in culture at the bureau that begun began on the director Mueller, bob Mueller. And a lot of these bad actors is the term you just use, have been removed that the bad actors you can name them all in the cave and call me et cetera from before and even more recently with the gymnast case and other, they keep getting fired. They keep getting dismissed. And unfortunately, current director ray and others around him keep pointed to that and say, well, we're getting rid of the bad apples. We got rid of the bad apples. And my contention is they're not looking at the underlying program problems, excuse me, the cultural change that took place beginning under Robert Mueller's leadership.

"Door. What did you make of that. Well i actually keyed in on his last line where he said well he was an adult. That wasn't when we were kids as if maybe that was okay. If they were adults they were on even ground. I thought it was odd that he remembered exactly how much he paid for the monthly rent in vermont but didn't remember that incident. Well i'm not sure that he wouldn't be reluctant to own up to that. And those kinds of cruelties in indignities were probably so commonplace for him that i actually wasn't surprised that he didn't remember that i just took it as something that he did sort of matter-of-factly and he got a laugh out of it in the moment. And then he forgot about it whereas it was traumatic for thomas understandably charlie odd kept mentioning the psychiatrists that he had seen over the years and lewin objected every single time. But i was just wondering if you have a sense of what his strategy is there. Do you think he's going for some kind of insanity defense. Well it's funny. We knew that. Bob at the age of About eight or nine was fighting with his father and his brother so much that they decided to send him to see a psychiatrist. Bob is now saying that you know he was constantly going to psychiatrists. You know the shrinks were adam trying to get inside his head i. I'm not sure what that's all about. But i do think you're right. The prosecutor john lewin seems to think he's going somewhere with that that there is a purpose to it. I think lewin actually said what he thinks. The purpose is what lewis said was in this case. The defense is not presented any psychiatric testimony but what they did in texas was. They asked a lot of questions about psychiatrists with the prosecutors. In that case never oppose. And that's how they got psychiatric evaluations in testimony in the galveston case. Lewin wanted to make sure that kind of stuff didn't get in that way. What that raises for me is more generally what you guys think. Geren strategy is with durst. I think he sort of playing out what he essentially said in his opening statement. And that is. Bob is been this hapless guy more often than not who finds himself in the wrong place wrong time and he runs. I actually think and this is just my impression. But i sort of think that garin sort of using his appearance as a way to gain sympathy. Almost like a racehorse whose on its last legs but seems to want a race one more time. Maybe if he talks long enough you'll be able to humanize himself for the jury. Carry what do you think to garin. Strategy is here yeah. I'm not sure he has much of a strategy. And i'm going to go out on a limb and say he's sort of just winging it and to the degree that there is a strategy. "You know she has hung out with them quite a bit and she's also talked to him quite a bit on the phone while he was in prison. There was a lot of questioning about exactly what she knew about him. And jeannie clark was a tough nut to crack. This is a seventy year old woman on the stand being asked about her sex life and she would not give lewin inch we heard bob in a recording describing how he would like to give her a million dollars and i suppose in the back of their prosecutions mind is will. Why would he give her a million dollars. Bob is nine and especially generous individual. With bob's east coast girlfriend. Susan g. o. Donnell bob had stored sixty four cartons of his private papers that there were family photographs. Were phone bills. That allowed eventually allowed the authorities to track his movements. And bob gave the producers of the jinx access to these boxes so this was treasure trove in her basement. What do you make of the prosecution's efforts to pin them down about whether the relationship was romantic. Well i think what they were trying to get at is to rack what they perceived as Another lie so the probing i think was designed to assess the veracity of anything that they said it wasn't because of some fascination with bob sex life and do you think the same thing would be true of when the prosecution asked susan g donna about how before. She'd really met him and she you know was working with nick shaven and wanted to meet him and she denied having any knowledge of him being from a wealthy family. Do you think there was a similar motivation behind asking her about that. Yes so. I think they were doing two things. One is trying to expose her the truthfulness of whatever she told us. And also it would probably eliminate both her and jeannie clark as any kind of character. Witnesses for ball while bob durst total heartthrob also. Can you talk about the updates. We had this week. I think for a lot of people following along with this case. The jinx was an entry point and i think a lot of people expected for it shoe Play a role in the trial and to hear directly from andrew directly marks merlin And it sounds like that is not going to happen can can you talk about the stipulations. I have to confess a couple years ago. I wrote an article in the new york. Times explaining that that the jinx was going to be on trial when when bob was arraigned in los angelus now as it turned out contrary to my article there were a number of court rulings with respect to this and also a very shrewd decision on the part of the prosecutor and he said from the beginning. I'm not playing the jinx. I'm playing the raw tate of bob talking about himself and responding to questions so you can judge for yourselves. What's true and what's not true. So ultimately agreed to a stipulation that lays out the history of the contacts between bob durst who initiated contact with andrew iraqi and charlie what lies ahead. Now these are the kind of questions we would be asking any of the witnesses that have testified in this case. But where unable to get those answers for mr right now. Have you been able to glean whether the mccormack's knew about this at the time. I don't think that all the mccormack's stayed in touch with him I think that. Jim mccormack certainly did by. I don't think he mentioned this story to mccormick's until fairly recently britney what struck you about that interview as presented on news twelve. Oh my goodness one question. I had was who brings a friend and says excuse me. I'm going to spend the night in here. I guess we'll see in the morning. You know it felt like a little convenient to have somebody else. Who could kind of corroborate some of those details but from the safety of the other side of the door also like Kinda confused about the geography of how all of this is happening. This fall or anything durst disinterest in protocol and rules not only led him to abandon his handgun permit application but helped land him in federal prison as well after his arrest. For the murder of morris black in texas durst was released on two hundred fifty thousand dollar bond. He promptly fled the state when he was arrested.
