Now, this is with less than 1% of the votes in and this is the U.S. Senate race in Missouri to replace the retiring Roy blunt on the Republican side, Eric Schmidt is in the lead with 38%. Vicky hartzler and second place 30% Eric greitens in third place at 16%. Former president Trump last night just said he's endorsing Eric leaving it up to people to decide whether he meant Schmidt or greitens. On the democratic side, trudy bush Valentine with 50% of the vote over Lucas kunz, who was at 27%. That's the democratic primary for Senate in Missouri, popping over to Michigan. Other news tonight, two Arizona Republicans recruited to help former president Trump stay in office after his 2020 election defeat, told one of his lawyers they feared their actions could be viewed as treasonous. The New York Times reviewed emails, which indicated that Arizona Republican Party chair Kelly ward and state senator Kelly Townsend were concerned about the legality of a plan to present fake electors, a fake slate of electors claiming that Trump had won an Arizona ward ultimately did sign on to the fake electric scheme, townshend did not. And she said, she was interviewing people in small towns in western Pennsylvania who said to her, look, I can't find baby formula without going to four or 5 stores. And I can't afford the gasoline to go to four or 5 stores. So Joe Biden is hitting me and every possible way. And I think what all that's doing is we have to remember, African Americans are as pocket sensitive as Latinos or Asian Americans or for that matter, caucasians. And they're looking out there that say, it ain't working.

It's president Trump saying, quote, we're talking about a wall for our country for at most $20 billion. I could do it cheaper. I need about at most $15 billion. And it'll be better than anyone could ever see. So president Trump with a Republican House and Senate was asking for the same amount of money nearly the same amount of money that our Republicans rushed and were enthusiastic to go send to a country in a far distant land that we do not have an allegiance or an alliance to that is corrupt, laundress money and full of oligarchs, and yet when Trump asked for it, no Republican leader was willing to fund a southern border wall as we saw 2 million people cross into our country illegally last year. I like the argument to say, Look, you've got nine justices representing nearly 40 million people a piece if you were to do the breakdown, Okay, That's It's a lot, right. However, you've got one piece of paper that oversees all 333 of 40 million of us right now, that is the Constitution. So how many How many different ways do you have to have in on that? Okay, I'm okay with expanding the court. I'm actually all right with that. And I'm pretty traditional guy. I like to see things moved pretty slowly. I'm okay with expanding the court. But because I like to save things move slowly. With Biden wouldn't put out A plan. Is Rick just said, you know, maybe he expands it to 11. If you were expended to 11 And then your judicial appointments would be probably more Democrats more of the democratic persuasion. Then you'd have a 56. With Roberts is sort of a swing vote, so would be a pretty even court. But put together a plan. Let's say you want to get up to 15 justices. Maybe you propose That the plan is we expand, too 11. And then it expands to 13 in 2025. And then it expands to 15 in 2029 in doing so, you're actually giving the voters the opportunity to say Okay, this next presidential election. holding it if he the Senate is now taking it up next Tuesday that's thirteen days away from Iowa who's advantaged Joe Biden who does the establishment one another's they're back to doing the same stuff to Bernie Sanders that they had done before they are in chaos and then we have a jury that's already pre determined what they want to do with this president without listening but there are no facts in marriage to this case if you took the two articles in which the impeached from every president that had already been in office would have been impeached this is I think Jonathan Turley who's probably one of the most respected constitutional attorneys yeah thank you didn't vote for president trump he's not a Republican but he said the only abuse of power is it the Democrats move forward with this they're abusing the president and those who want to call from going to the courts from the three branches of government have a say whether they come and for Nancy Pelosi to have this Now, we mentioned to you on the broadcast yesterday that Vermont was considering legislation and we wanted to get our voice in. So I let me take you back, and I'm going to Bobby setup. Exactly what was going on in Vermont. And I'll tell you what we did. So Abby, what was it? What is at stake with this Vermont legislation. Okay. So with the Vermont legislation the attempts being made by Democrats are to remove the obstacles to late term abortions abortion till Barth, essentially and to also remove some of the criminal and civil penalties for. For a boarding the child too late. So the bills actually entitled this. I think the the language of these bills are interesting the one in Massachusetts, you got one in Massachusetts removing obstacles and to expand abortion access. So it seems to me that what what the obviously is Planned Parenthood and they round because plane parents sent on a fundraiser yesterday abortion is healthcare period. That's their that's their fundraiser that you've got these states. We're talking about very late term abortions. I mean abortions during the delivery process here. Right, right. That's exactly the they're removing the obstacles to that. In one state. It's three physicians have to agree. In another state. There are criminal penalties for aborting the child as the child is being born all those are being removed all of those are being removed. So any it goes back to what we said yesterday, and in that is as a prosecutor if you remove if you remove the parameters of criminal, liability or civilized ability, or in these cases would be saying is both. I mean, there's basically, no liability right? When something doesn't happen, right? Something goes wrong. What happens? Well, the prosecutor has no no right to do anything. I mean, it is in a sense it is legalizing the act of infanticide and the crime of murder. That's exactly what this has. Because the prosecutor has no discretion at this point if this Vermont legislation passes to decide whether a homicide has been committed it has not and therefore we can prosecute these kinds of crime. So in Vermont, we actually filed. A written testimony on behalf of ready for this virtual period of time eighty eight thousand four hundred people which goes back to I'm going to go to the substance of what we said in a moment pitcher, I wanted to do grassroots politics. We keep talking about that here. In a matter of literally hours. We almost got one hundred thousand six probably close to that. Now, eighty eight thousand four hundred signatures, and literally hours, I think it's because the issue is back into the bathe Streep discussion it's not just within our boots or conservative Lubich pro-life move. It's or even a church or religious discussions about it. Moral discussions about it. But it's back in the forefront of politics that legislating it is a reminder to people that their state level. That's where a lot of this actions taken Lucy. Congress has an inability to act right now of this. It's because one Senator object on any kind of database could sit you still got the sixty vote threshold for legislation the Senate, she don't have enough of a pro-life majority Republicans to pass a lot of significant. Legislation though, the president would would it Ishak getting to the desk, just like the defunding Planned Parenthood ultimately would through even with a Republican House and sit back in the ObamaCare discussion. So I think you look at what the states are doing. And you've got blue states. Tried to expand abortion, Ed, red states tried to put some restrictions in place. And we'll talk about the only states that will be taken to court are those red states tried to put restrictions apply. Yeah. So let's take a look at in Vermont. So we said yesterday this Bill was going on. Let me read you the very beginning of what we wrote for the reasons set forth here in the American Center for law and Justice on behalf of over eighty eight thousand four hundred concerned citizens, including one hundred forty citizens from Vermont have signed our petition to expose and Pete barbaric abortion laws urge the Vermont legislature's vote. No on Bill h fifty seven. So what did we say in our legal position? So the first position and that we know is that abortion is a grave offence against Justice because it Intel's they deliberate killing. Of an innocent human life, and we go on to explain that. A in fact, I'll just read it a justification of abortion must fundamentally rest on the proposition that some members of the human race, do not have even the most basic of human rights the right to laugh. So this goes back to the person who'd argument that we said this is where it has to go. The life issue has to go to this issue of person hood because they're even passing bills or trying to pass bills with legislation that says, the unborn child will not be deemed a person or the fetus will not be deemed anyone in a of an entity entitled to constitutional rights, right? It will be deemed a product that is literally the terms in one of the state's legislation a product. So that and the reason they're doing that is they know that if a especially with these late-term abortions, they they're they're in a very difficult spot. I mean, look, we believe we're completely pro-life here at the j obviously, but for those people even these legislatures they know that the unborn child in the eighth month. And there's an abortion that that is the taking of a human life with what they're saying is. No, no, no. We're redefining human life. So that does not include the unborn child, which raises the question, they call it. You said product. But you know, you could call it whatever you want that does not mean that the that does not mean that that's what the constitutional protection how best, but that's why we gotta fight for person had go. We also address the false narrative by Planned Parenthood that and in this was in their letter last night. The lies cruelty and complete disregard for real experiences of pregnant women. That's that's what Planned Parenthood is a starting that restrictions on abortion. That's what they are. So we address that in our letter, and we explained that in the years since abortion has become widespread. The negative medical affects on women seeking abortion. Are extensive and we go into some significant detail about what those are such as abortion, especially when repeated increases the odds that future pregnancy will miscarry and resultant premature birth way, go into the physical and mental negative effects of women who seek abortions we spend two pages just discussing that. This is not about the health of the lemon and the right of the woman to choose the evidence overwhelming overwhelmingly demonstrates the harm that comes to women who obtain abortions. So here's the issue as I look at it. You said something very important joined that is there are states like North Carolina, Abby is filing a very much a pro-life Bill. They're trying to prohibit put restrictions in place on abortion. There are other states that are doing that. Those are the ones that won't get challenged North Carolina, Mississippi, Florida, Kentucky, Ohio, South Carolina, Tennessee all have legislation. That's been proposed. Interesting enough it Ohio. This legislation has been proposed twice. It was John. No longer the governor who vetoed it because it his mind he said he didn't disagree with it. It's one of those arguments receive it did what the states have to defend in court. So the question. To tell you that is that is that is shame on John case. I can't imagine that is the case though, North Carolina's got a democrat governor. So that that big question there democrat AJ's? I don't see Ron. I think if this gets field Florida Rog Santa's would support the state to fitting it that's important states like Florida now. Hi, oh, hazardous governor. So again, the questions there he was the attorney general though, so was Mike wide advising casick not to do that or see chase. Would he again allow Ohio? This is all a result. To me. This is all a result of the view that the the pro-abortion crowd feels like the they're losing the supreme court. And that's why they're moving show aggressively in these states. What what do you think having? Absolutely, I think this is a direct response. And what do you think? That's exactly right. They see the well. They're being empowered by Roe v. Wade in the sense that they're saying well, the states have the right to legislate in this area. That's what rose says. So let's do it. So the states that are that are liberal, and then left us states enacting these anti lives statutes, these pro pro pro-abortion legislation using the supreme court ruling in roehi way to their advantage and saying if it says we can legislate let's legislate. And that's what they're doing. Okay. So our team knows and people know what's going on here. So we've got a team of responded to the Vermont situation aggressively. We're now looking at each one of these states and figuring out. And they talk a little bit about about a minute and a half left about the foia. Request state for these are not federal forces estate foyers. We are issuing foia. Request to many of these states that are pushing abortion without restrictions, and what we know with regards to some of these spaces at Planned Parenthood is actually participating in the drafting this legislation which is not surprising as is narrow. And so we are issuing for your class to uncover the communications that took place between the abortion industry and legislators as they're drafting this legislation. What was the intent behind it? What were the conversations that took place? So this is at a state level. So understand what we're talking about this a state restrictions or state moves to find out what's going on here. So we're responding to the states that allow us to emit comments. We're looking at every legal.

That's not enough to get a spending Bill to move toward the president's desk. You have to have sixty you need a supermajority. We didn't have sixty and Chuck Schumer wouldn't play ball. Well, I know for a fact that the junior Senator for the great state of Texas Ted Cruz. Had a plan made an offer saying, hey, we can do this for reconciliation. Here's how we do it. Here's how we pay for. Let's get it done. I know he presented that to the White House and didn't get any any traction presented it to Mitch McConnell. Very weak leader. Didn't get any traction. So it didn't happen. When they couldn't get it done with sixty votes. They let it fall by the wayside. The president said I'm not gonna keep signing these bills. Unless you include my funding. So you get a little bit of funding in some spending thing here, and there one one point something billion, but it needs more needs almost six six billion more. Signs Bill about a year ago that many of us who voted for him who support him went. Whoa. What are you doing? Don't sign that really play hardball. And now the house which under Republican will be end of last year passed the Bill including wall funding and the Senate didn't pass it because Chuck Schumer wouldn't play ball. The government shutdown because they didn't have a continuing resolution or or any sort of a a funding Bill in place, the shutdown squarely on the shoulders of Chuck Schumer Chuck Schumer allowed for government workers to go without pay for two paychecks. Because the politics that's it, and he celebrated he loved it. He didn't miss paycheck. Didn't miss a meal to miss anything. And by the way, just as it aside, if you're a government worker, and you missed one paycheck that you know, you're going to get you're gonna receive retroactively back pay is going to happen. And you're at the food Bank after missing one paycheck or you're selling your crap at the at the punt the pawn shop. Or you're like applying for food stamps, do go see a money manager figure out how you're doing it wrong. Living paycheck to paycheck when you're making government salary doesn't make sense to me. Look, I have in my life. Luke paycheck to paycheck, it sucks, and I was working two or three jobs all at minimum wage. It's all if you're gonna do it my life. But once you start making a nice paycheck. And you can cover your bills have an extra month in the Bank of your bills j just a month. But we we know that nobody argues that Pelosi's won't negotiate so Trump civil then the government shutdown, and it's on you yet every opportunity to work with me. And we shut down for thirty days and again workers missed one paycheck. And yesterday Friday. It would have been their second paycheck ever was reopened yesterday or today. Now going to do something, you know with a democratic house. You know, doesn't make sense to me. And even considering the fact that a lot of people were against him. Didn't he have even the slightest idea that the Republicans might or would lose some house seats? That's what's happening now is all part of the plan. We probably won't get a wall. And just like FDR said Roosevelt. If anything happens in politics, you can be sure it wasn't by chance. If it happens. It was planned now it makes no sense for Republicans to not go for a wall. When congress was all Republican that would have been the time that also would have been the time to overturn Roe versus Wade. But that didn't happen either. And I'm barely what I said was true. When when when Trump got elected and promised a wall, I said he will do what he's told. And that's what's happening. And you notice our troops are there still in Syria. You don't want the congress folks, you don't want whoever's in the house of representatives today to go in and vote themselves change in pay affective Monday. So you they at the moment they can only vote to to affect their pay rates or vote to affect the pay rates for the next congress, not the current congress, which is which is why that's happening and beyond that, I'll be honest with you. I don't know what we thought they were supposed to be what they were going to be doing. "Will he continue to try to sell if it goes to the courts and his wrapped up in the courts for a year or two will he continue to try to sell it. Don't waste your time on anything that doesn't get to the heart of the matter of the immorality of the Democrats when it comes to border security. Don't bring up anything else. Don't don't model. Anything don't have any type of gray area. Don't have anything that isn't specific to the immorality of the Democrats, and Eric and I talked about this yesterday. Again, it's this is one topic that we've talked about for years, and we've said the democrat party, maybe not the people that vote democratic, but the democrat party is for open borders there for sanctuary cities for gosh sakes. They believe that they're talk. Gavin Newsom now talking about more Medicaid money. I don't couple of Republican senators are coming in are ready to try to stop the Gavin Newsom is talking about hundreds of millions of dollars for health care for legal immigrants. There a sanctuary state. They believe that if you get across the border, you ought to be able to stay. And I still don't think the Republicans or the administration and hopefully a year from now I can say they've corrected that big time. Because I still think irrespective of what happens you're even if he goes and puts us into the courts, they sh- still shouldn't stop. I still think they should have. They should have town hall meetings on at border cities. They should be constantly bringing the border patrol and the director of homeland security and the DA and doing press conferences on a consistent basis over and over and over again, whether he decides to go the emergency route or whatever. Because you have a win on the morality of it. The Democrats have nothing the New York Times article yesterday proved they have nothing they know they have nothing. They can't argue border security. They can't tell you what they really want. And it's up to the Republicans and the administration to take advantage of that. So there you go. But again, and Amanda, I understand where you're coming from understand your passion because it is frustrating. It's frustrating for all of us. I just bring up the pasta, you know, the possibilities because we don't know how the executive order the the the emergency declaration. We don't know how it's gonna be worded. So we don't know. Really what's going on everything is really speculation. As to how the left may try to fight it. And then you talk about I think it's a great constitutional thing to talk about. All right. How far can the president go? How far do we want a president to go who will eventually make the decision? Because that that's another point when it comes to the president's War Powers. This is war. Every ministration has said, what would congress said means nothing? So it gets to the point of with the president when it comes to war. Now, again, appropriations is is what they can control impeachment and removal from office is another thing if they believe that a president not talking about Trump here. But, but if you abuse, for example, your executive War Powers. And just say, hey, I'm going to bomb Canada tomorrow. At that point. That would be congress getting involved in it because it wouldn't have time to get through the courts at a president would be removed from office. Unless unless they took out the tar sands. "News. They preliminary at seven twenty two the government shutdown continues day thirteen today, and the president still trying to work out a deal that would mean major funding for his border wall. Now, though Democrats set to take control of the house today. Let's see how that influences anything and see if that power shift means much ABC's. Karen Travers is at the White House and joins us live right now. How does it change the discussion? With Democrats in control of the house today. It certainly gives the Democrats more leverage here. One of the first things they're going to do is vote on bills that would reopen the government. First Bill would open all of the agencies impacted by the shutdown fund them through September thirtieth but not include DHS. So that's part. One part two would fund DHS at through February eighth. So kinda give another months to have more arguments in negotiations over the border security issue yesterday. The Democrats were really trying to put pressure on the White House. The president and Senate Republicans trying to box them in a corner on this saying these are two separate bills. Why won't you vote and sign that first one that reopens everything else, why should those agencies and employees and departments be held hostage. That's the word the Democrats used because of this fight over border security Chuck Schumer after this briefing at the White House yesterday told us here at the White House. He has the president many many times why give me a good reason. Why? You wouldn't sign that he said the president didn't answer. Eventually we're told from sources familiar with this meeting eventually the president told humor. He would look foolish if he did that. So we'll see movement from the Democrats today. The Senate is not going to take up this legislation, but Democrats are trying to frame this as them caving into the president's pressure because two weeks ago, the Senate passed almost identical bells all of these same numbers that was the one that the president surprised everybody by saying he wouldn't sign Taryn. I'm going to be a hypocrite because I hate when people keep score in Washington. But I'm gonna keep score at the moment here. The president lost the first round because now he's losing congress to democratic control. Does his job knock it harder in the process to get anything passed and done an open the government. Absolutely. And he's gonna come under more scrutiny than he did under Republican House. The investigations will increase things that were not investigated will be investigated subpoenas. I mean, this is going to be a really intense time. And there's gonna be a lot more scrutiny put on the president his business. His team. Did agencies. And I think that you know, we'll get him upset thirty been talking about harassment by Democrats. But here's the thing. This is a president who likes to go through a list of his accomplishments. He's got reading the paper that he'll pull out in the Oval Office and say, look all we did I did more in the first two years than any other president if he wants to add to that list going forward. He's got to figure out a way to do something with the Democrats, otherwise literally nothing will get done in the next two years in Washington.
