"Person who inquired and most of the leads just went away when i don't know whether they were just sitting in front of the tv. Oh here's a nice cottage. "Know so so then we start talking about real estate and that's the way it goes but but The laundry you're in business. Of course in you know this is your business gets more and more based on referrals and You know it gets back to brian. feeney You know as a trainer who. I like that. I'm brian but feeney mentor. So and and tom ferry also and they and they have two totally different approaches to it so You know without getting into the you know what they teach in what they do. Is you get more and more referral based and it's telling stories to people and talking about it and then eventually i certainly don't start conversations about real estate. I get other people that do. Oh we're thinking of maybe going to perry saw maybe getting a cottage maybe retiring you know so once the doors open you know then you then you go down a different path. So that's all you're looking for. You're looking for a relationship and it starts usually the stories absolutely. I think again going going right back to something. I've said on my podcast and actually one of the episodes i did this. Week is the sheer sort of almost denial. Or i would say Just you know just ignoring the fact that you know if there's one hundred year old house which is the one. I'm working on right now with a client of mine if there's one hundred year old house there's one hundred years of stories you know tucked away in there that again. loan that that would be better we all know that but specifically what would somebody have to be able to do in order to make that happen well if you've got a creative lead but they're not that's going specific do you go from a to a to a conventional depends on your debt to income ratio of your debt to income ratios are still below I first sat thank you for that to a conventional loan product on the differences all right the difference is not that student loan you can be put on a forbearance program based on the fact that you have limited income and you might be put on the forbearance for twelve months or twenty four months and that on the credit report that's not impact your credit score it does not impact the consumer negatively in all night Barrett did impact on mortgage like I said in my understanding that this is not going to impact consumers unlocked the consumers are not working with the servicer and so fell for folks that don't really know what a servicer is the servicer is who the mortgage company sells the loan to and that's who you make your payments to correct absolutely so and I know they're not no I was just gonna say if people need to know how to get a hold of their service or they didn't really know them as a servicer they can just go to their mortgage payment statement the coupon book correct whoever you pay to rock that is who you need to reach out to now is there a special department that you know what that would be the best place to start I know that I was reading somewhere where you need to call and do things by the letter of your last name that would be like so that they can control the trip that flow of these applications from what I'm being told yeah go to your mortgage statement call the phone number I understand right now all times are wait times throughout the industry from what I'm hearing anywhere from eight to ten hours on hold they have to be patient they're gonna have to get that they may end up having to call them back it's my understanding that the customer service department all the major banks and all the major servicers are working with their consumers and happy compassion and humanity with that specific situation but it's really up to the consumer just don't make your mortgage payment folks you do that a year you're potentially looking at not getting the help that you would have received had you reached out to them okay sell sell I think that was a little confusing let me let's just reiterate what that what you mean you and I both recommend if you have the where with all to make your mortgage payment to make your mortgage payment correct absolutely and the reason for that is why the reason for that is the one that we there's so many unknowns right now I mean there's nothing set in stone by either Fannie Mae Freddie Mac the federal government Jeannie mai how can it be reported on the credit report so for those that have the where with all to make your payment make it for those that have the where with all to pay their rent pay your rent payment right now we're seeing I mean it's crazy in the rental market as well you're aware about me yes you know so everybody everybody it's it's a whole train it's a domino effect one person doesn't get paid if it's a hardship on another person another person on another person and so it's important that we all do our part to try and and help everybody out including ourselves felt so let's talk a little bit more about the moratorium on evictions yup my understanding on the moratorium on objections right now all I hear there's a six month moratorium I'm I'm not quite sure if that's a hundred percent correct can you help me out on that many yeah I was hearing something similar but we will have to verify that but never the less if you are laid off and you can't make your mortgage payment similarly you would want to reach out to your landlord and see what sorts of situations that you could work out together right tell yep the other thing I would encourage our listeners to do yeah you talked with the landlord talk with their service server and so let's just say hypothetically you run to the go to your landlord and yeah he hello but I can pay you five hundred see if you can work out a deal with the servicer to pay what you pay because ultimately ultimately mortgage payments are going to have to be paid back and ultimately ranked is going to have to be paid back so I would just encourage people to work with people and I think everybody right now there's so much humanity and they're all there that I think people will walk with you to "Remax before and it's one of those deals where they have a they have one of those pod parties that wants to buy that thing and not have to go through real estate they're not going to do that H. willing to make an appraisal they ask for appraisal and he's trying to avoid paying the six percent so what I'm suggesting is I know there's a sentimental value which I think my wife and her sister at there's also a market value so my question is how much do you base an appraisal on it for the sale price out of the of the listings well I mean if I if you know who also part of the box for a minute and just it and put a common sense out on for a second to deal with your question so you know when when looking at the property to to not be emotionally attached to it I would talk all get three different opinions you can get in and you can pay you can pay for an appraisal talk to the praise and get an appraisal and you can have them approach it the the problem with with for an appraisal from a bank standpoint all from a refinance standpoint is that it's based upon the past so in other words an appraisal when I do alone on a property is going to be based on what's the code over the last six months the comparisons that are listed in the appraisal have to be six months old so what that means is what happens if you are in an upswing market with democracy appreciating it two to five percent per month Ole somewhere in between a little bit less but still going up so when you look at it from that standpoint it doesn't take necessarily what that property is but so that's one point yeah you can talk to different realtors and get their point of view what they would list the property what if they were to list it and then there's going to be a price point in between all of that but which that you would sell for now what it doesn't take into account the six percent or whatever that whatever the commission is one of the expenses for selling a home that's not a bad thing because we just talk about multiple office situations all it takes given what given what the property is if you able to market the property and expose the property to the right by a four to a buying pull that says gosh this is the property for me all with two people want to buy the property then there's a little competition and then all of sudden everything goes I mean the price could be a little bit above that per se so it's been proven that probably that are not listed sell for less it's been proven that properties like don't go through the process will also sell for less so high type of just a couple would just coming to a break elected you feedback on that and also have the the guys jump in as well number.

as if you're buying a home you want to make sure that you and your agent are on the look out for signs that perhaps it's been a grow house there may be some additional inspections are air quality buying home where there's been evidence of of potential growing operations in there let's switch gears and talk about landlords is there any specific language that landlords maybe should be putting in their leases are are they allowed to put in their leases to protect their property and their interests yes one hundred percent and I have three conditions that I approach my landlords with you that they allow it or don't allow it or they allow it a portion of it in some of that language I have is at the end of the lease always put it depends on the landlord sure the three conditions the use of tobacco and cannabis in accordance with state law is allowed on the premises prior written consent of off from the landlord is required okay before medical cannabis may be grown on the premises okay so that's one another one is this is a non smoking residents no smoking including medical marijuana inside the home or on the premise is permitted however consuming medical marijuana with a vaporizer with so since the approval of prop one I'm noticing a handful of municipalities opting in Mostar opting out in realize even though a municipality may opt it it may be only for one specific license like transport or growth marijuana growth it in some municipalities some of them might not want the dispensaries and along with that there are certain ordinances that the license holders have to comply with and their strict strict rules on in that application at the state level is about three inches thick so so lots of paperwork there now we we we've been talking about I guess licenses are different ways that it can get approved you can opt in or out of certain things as I understand it you can either be a retailer you can apply to be a processor a grower a transporter or micro businesses so there's a variety of options that individuals that might be interested in this can go but then those are also the different areas worse that you can choose to opt in or opt out right correct and there's also the safety compliance facilities westerns personnel that visit the locations to make sure that each marijuana growth operation is in compliance according to what the ordinance says per city that shop so I'm aware that there are some school districts out there that have been reaching out to parents with the their concerns over having large scale operations you know in their communities e.on you're kind of requesting your kind of a call to action by parents to reach out to local officials and things of that nature is this something you've heard of because schools are so tied typically done to her to the housing market I mean good good education good education system this is a match is good your values and homes and vice versa what are you seeing on that and the thing I I have not seen that aspect of it but what we do know as buyers agents that if there's a certain amount of the public in keep in mind that vote was fifty almost fifty fifty on right and it was approved some people don't want to live next to to these marijuana grow facilities dispensaries and as buyers agents we need to listen to our buyers and make sure that we know which Manasseh pill with disparities are opted in opted out if the if some are up to then what did they opt in for we gonna protect our clients and protect ourselves because there's a lot of liability when it comes to being a buyer's agent for at absolutely and and I mention this to you is is you seem to be really doing a good job of as being yourself of really going out there trying to find all the information that you can to be a good resource you know for your clients but clients do bear some responsibility to do their own due diligence is are their websites they can go to can they talk to the local municipality if they're thinking of buying in that area and find out you know for directly from the horse's mouth if you will what's going on I think the best website that a buyer can look up for the medical marijuana facilities is the mystic and the Lara site Michigan licensing and regulatory affairs okay then they can go there and and I know I've gone out there too and it it does list things well thanks They had at the time, you know, questioned the constitutionality of Truman's requests. The president has the power under article two section three of the constitution to call a special session of the congress during a current German Washington concluded the last such session was July twenty six nineteen forty eight. After Truman issued a presidential proclamation. Convening congress. They write their opinion is while it's unclear the president could compel congress to convene a joint meeting to hear a state of the union speech during a congressional session. Well, Reagan did delay his nineteen eighty six state of the union speech, which was scheduled on the same day as the challenger disaster. But the customs since nineteen thirteen has been for the president to appear before a joint session of congress for the state of the union address. But you go back again to article two section three that, you know, he may meaning the president on extraordinary occasions convene both houses me. He doesn't say she says he. Or either of the meeting house or the Senate, but read the last paragraph getting there. And in the case of disagreement between them with respect to the time of a German. He may adjourn them to such time as he shall think proper any show receive ambassadors et cetera et cetera. Now, let me get to the last line. The last paragraph, but given the letters wording. Okay. Or he's going to declare a national emergency probably up to fight through the courts. There'll be a series of court shopping cases, probably California, Oregon anything that's going to drive it to the ninth circuit court of appeals which later will make it to the supreme court where they have like an eighty five percent overturn rate their overturned by higher courts by the supreme court. Fascinating times, really are amazing. Imagine a politician looking at this issue for what it is life and death. At about safety and security. What does Nancy looking out for? "You're listening to the spoken edition of the San Francisco Chronicle. Well, this is new price cuts on bay area homes are surging by Kathleen Pender. They're not exactly doorbuster deals, but bay area home sellers are cutting their asking prices at the highest rating years October is typically a big month for price reductions as sellers try to close deals before the market slows way down between thanksgiving and early February. But the number and percentage of homes with a price cut surge last month to their highest level for the month of October since at least twenty twelve in the bay area and twenty eleven statewide the jump in price cuts, which hit every bay area county is another side that after years of stratospheric increases prices are leveling off and buyers gaining a little more power in what had been a strong sellers market price cuts are a leading indicator because they're reflected immediately said Patrick Carlisle, the chief Mark. Analyst with a compass real estate brokerage although bay area home prices are still going up on a yearly basis home sales median prices and days on the market are considered lagging indicators because it can take a month or longer for deals to close in San Francisco. The number of homes with a price cut in October nearly doubled to two hundred thirty eight from one hundred twenty four last October, according to data from real tour dot com that's nothing compared to Santa Clara county where the number of price cuts rose to eight hundred eighteen last month more than six times last year's number Santa Clara county had been one of the nation's hottest markets this year and the bay area's price appreciation leader until September. Clearly, there's a market shift said rich Bennett, a zephyr agent in San Francisco, he just cut the price on an eighteen hundred thirty two square foot Victorian condo in popular Hayes valley by one hundred thousand dollars. He listed the. Page street home in mid October at just under one point seven million, which was realistic considering it has three bedrooms parking and a laundry porch and is quote, absolutely adorable. He said, but the buyers didn't come in October. We saw more inventory come on the market the economics of the bay area haven't really changed and it said, but if you don't have people beating down your door after two to three weeks, it's time to consider a price change. He has another listing right around the corner, a one bedroom single family home on lily street that he listed two weeks ago at one point one two five million dollars within a week. It had a preemptive author and the sale is now pending single family homes are still a hot commodity in San Francisco. Another condo just down page street from his listing. Also had a one hundred thousand dollar price cut it sold in February for about one point four million and went on the market again at one point. Three nine five million in early October. Now, it's listed at one point two nine five million below its last sales price. That's a good indication of how the market has shifted Bennett said even Palo Alto famous for its multi-million dollar tear downs is seeing price. Reductions Remax realtor. Karen, FANG said she listed a house near Stanford University on a one and a half acre lot with a ton of deferred maintenance for four point one million dollars in mid August since then the average rate on a thirty year fixed rate mortgage has risen from three point five percent who almost four percent the cost of building materials, which the home would need has also gone up after reducing the price to three point five million the Palo Alto property closed October thirtieth for three point eighteen million. Nearly a million dollars less than the original price in San Mateo. Dennis Pantano of Pantano properties. Just sold a house on Texas. Way for one point six million dollars after four price cuts. He listed the nineteen hundred ninety square foot house for about one point seventy five million in mid June. But within ten days the number of listings in San Mateo around that price jumped to nine from two had he listed it in may, it would have had lots of offers. He said it's an illustration that not every house sales at full price or over buyers. Meanwhile, sometimes have to be convinced that a price reduction doesn't mean there's something wrong with the house said Paul kitchen, a compass agent in San Francisco, there are a couple of places that came on the market that were seemingly reasonably priced. He said, but buyers expect to pay ten to fifteen percent over asking we say, let's put in an offer at asking we have to convince them. There's nothing wrong with the property kitchen has a client who offered the asking price on a home that had a price reduction, and it was accepted even though there were contingencies. The buyer was somewhat surprised that they had time to do the diligence. We had encouraged he said oddly, Carlisle said he's seeing price increases on homes that haven't sold until recently egregious underpricing was very common strategy in San Francisco and other parts of the bay area. He said agents would price ten to twenty percent below with the seller would accept hoping to get five ten or twenty offers and drive the price way beyond reason. Now when a home doesn't sell within a few weeks, the agent may increase the price. So as not to put sellers in the uncomfortable, but not illegal position of having to reject a full price offer that was lower than what they would accept.
