through the long process Sports franchises resort to extreme legal maneuvers to protect a new name and brand Joining me to discuss the process is Susan decker Bloomberg patents reporter so sue tell us about some of the legal tactics that teams use to prevent the name from getting out ahead of time They are going to file their trademark application in another country They're going to file and Trinidad and Tobago and Mauritius like these island nations that don't have a whole lot of Internet access and don't have a lot of public access and have policies that don't allow them to be public This way you get the protection because the trademark application is good from the date of the first application but you don't actually file the application in a country that has public access like the U.S. for 6 months You have a 6 month lead time so that you can get everything together You have the protection but you can get all of your splashy marketing stuff all together And when you announce that you're still protected And you're not going to have to worry about someone running to the trademark office to file an application on the name that you've chosen And what are the favorite countries to file in Right now it's tonka and Mauritius It used to be a lot of the Caribbean nations were very popular to make it used to be number one and then they upgraded their system so people stopped filing it in Jamaica to see tongue and Mauritius both have a policy If you want to look at the applications you have to physically go there and look at the applications And tongan as a matter of fact you can only request that the employee of the trademark office do the searching for you And what they do allow the public to see isn't available for weeks and sometimes months So you can try to hire somebody and Mauritius to scope out the trademark office But they're not going to be all that successful And the Cleveland Major League Baseball club filed in Mauritius They filed in Marissa's yes And they filed into their own name under the Cleveland Indians name which was their former team Some companies like Apple what they do is they'll set up a shell company and they'll set up a company that has some innocuous name like IP management and those file the application and the apple's case they filed for that tobacco for the iPad They filed it under this innocuous sounding name in this remote trademark office And then when they were ready to announce the product they filed their application in the U.S. and then they quickly had that company subsumed into the Apple companies Does that give an added layer of protection Yes you're going to turn that into bogo to look for trademark applications You're going to look for something by Apple So you're not going to be able to find it It's going to be much more difficult to find You're going to have to guess what the name is and then try and put them together And there's kind of a little marketplace of companies or individuals that are filing trademark applications on names that they think somebody will try to use They're called trademark waters And what they do is they file save for instance you're going to set up a company called Grasso Inc and you're going to be a big splashy company I would go and I would file maybe grass olay I'm going to file a trademark application for Grasso lay But that's the name you want to use So you're going to pay me to turn over those rights because I've filed the application And what kind of trademark searches do you have to do before you decide on a name You need to get the trademark on all the merchandise on the video right on the TV rights You need to get the websites you need to get to social media accounts And you need to make sure that you can get the same name for all of these things And in trademarks in particular the trademark is only for a specific type of good That's why for instance you can have Delta faucets and Delta Air Lines because there are different companies in different areas but they still have the Delta name So when you have the Washington football team or any football team you have to have that name that can be used for cups and hats and clothing and software and products that football teams or any sports teams use for branding purposes And you see that they just had a minefield that they had to go through They explained that minefield in the video and they had their chief legal officer Damon Jones explaining why they couldn't use a fan favorite name which was wolves or red wolves Yeah it is a minefield There's variations of the name wolves for a lot of products And you want to make sure that you have those clear rights Trademark is something used by the brand owner to protect their property Once the trademark is registered you have a lot of legal rights to shut off counterfeiters And you want to make sure you have that registration You can get a common law trademark anybody can have that There's millions of them but you only have that registered trademark and the patent and trademark office will only give it if it's unique and only for that good So you want to have the trademark registered for anything after a surprisingly strong sales forecast adjusting its making further gains on Intel's market share when it comes to computer processors You have xilinx XL and X which is going to be an AMD acquisition pretty soon rising in sympathy also up over 11% in the pre market We should switch from tech to oil Marathon Petroleum also surging after reporting earnings up just shy of 4% Beating expectations signaling it may also return more capital to shareholders than previously planned Tom The dividend story is so interesting because you have the likes of AT&T cutting their dividend and the likes of Marathon Petroleum potentially increasing it So UPS I believe as well Yeah across the board we're trying to really try to find the yield in the stock market We talk about PayPal It is earlier on Bloomberg surveillance And that is the stock split You've got to be kidding me There are lobbyists in Washington saying to the fancy Silicon Valley guys like you get off your high horse split the shares to make it more accessible to America It's one thing that won't upset Congress people and senators Am I off the mark I think again for them it's about making the stock accessible because of the surge So alphabet has been one of the best performing large cap stocks And you look at the stock price this thing is going up I mean it's up more than 60% And at this pace if they keep delivering on the top line the stock keeps getting expensive so splitting the stock and Apple did that And I did it So it makes it more sense that they're doing it now Pretty good to just cut off for Google search looking for the nearest Starbucks to spend $6 21 cents on a mocha latte What do you call it Caramel latte Caramel latte You should try it Jump in here pretty Yeah well I really want to talk about the cloud piece of the equation Once I'm on ad spend stock split whatever but I think you said something really interesting yesterday which was IT spend is that $2 trillion Cloud spend is growing at four to 5 times faster than IT spend Where does alphabet fall into that universe compared to Amazon and Microsoft Yeah so alphabet is still a distant third when it comes to the cloud infrastructure side They also have the cloud application suite We think that's growing a little bit slower than the infrastructure side And look cloud is the sort.

Except for those people and not those people and not those people not you women, you're not equal, it's just all the white people are created equal. That's what it all was. And yet, and what we did to the indigenous people was, I mean, it is amazing, you know, our history is blemished man between what we did to the African Americans. I mean, slaves, what we did to the indigenous people, I mean, I mean, we are not, and that's why, okay, it's cool to be proud to be an American, but if you're gonna be proud to be an American, you at least got a, you know, acknowledged the fact that we weren't so pure. You know what I mean? You know, I'll tell you right now. And I hate to say it. I've looked at places for the past couple years about where it would be a nice place to become a dual citizen in. You know, because there's so much stuff that goes it's going wrong in this country. You know, I mean, it's absolute horrible. The way we have so many people that are willing to beat their chest and scream, we're the greatest. We're not the greatest. I mean, we absolutely allow our elderly people to die without dignity. We absolutely allow people that are born handicapped to live a life of poverty. And if any of those handicapped people so happy to say, I don't want to spend my life in this house. I want to go out and I want to do something and I want to get a job someplace. The first thing we do when they go to Walmart or they go to that going McDonald's and they get a job grading people, we take away their freaking what little bit of a check that they get. Is right next to the suite for W. M A. L And so we could see their reaction. MEREDITH and I, actually we had we had met the Smith family on draft day. A couple several months before it was April of that year. 2018. It was on this game was in October if I remember right And so we had sort of met them at a couple of events for the for the Redskins, and so we we saw her as she was heading down to see Alex after that devastating injury and seeing what they went through. Did you see this during the game yesterday? This was revealed on on the Alex Smith family. Instagram. You know Alex Smith had to wear this giant brace outside of his leg from from hip to ankle. This brace that it looked like you know, it looked like he looked like a droid. You know this, this giant brace that kept everything in place because he had these compound fractures that were devastating and all of these infections and all these horrible things that happened during this this recovery. And when he finally got to the brace and went into rehab, Elizabeth his westerns Elizabeth, she kept the brace. And had it fashioned into a replica of the Vince Lombardi Trophy. That the winning team gets for winning the Super Bowl and they have it in their houses. Motivation, as you know, is it just to show the accomplishment of getting through this? Not only overcoming this injury and getting to a place where you're walking and then running, but then being able to compete as an athlete at the highest level? In the NFL to be able to take a hit to get tackled. After that devastating injury. It's Pumpkin Spice Season!

"Let's. Let's talk a little bit about spices both the spices that go in the pumpkin spice mix and some forged by society. Right we should. We should also mention and I guess the one that I would like to start out with cinnamon, which comes from the inner bark of plants in the genus cinema them. and it is an evergreen tree in the Laurel family and there are several species in growing in various areas and. People might want to if they're into spices, they might want to get you know the Vietnamese version and the Indonesian version or the version you know the from Malabar cinnamon and and just taste them and see it's a spice that has long long been used to not only ceremonially but and in culinary But also, for fragrance and all kinds of symbolic applications as well. I don't think everybody realizes that there are so many different kinds of cinnamon and that they come from different trees and that the flavors are very different. The strengthened the spiciness, the natural sweetness, all of these vary from cinnamon to cinnamon. And I'm very fortunate in Santa Fe. We have a wonderful store called the savory spice shop I took a class there and learned a lot about the different kinds of sentiments. So I actually have a couple of different kinds at home i. think my favorite is the Ceylon Cinnamon. That's the one that I really liked the best although it is much more brittle. So if you're making something with the whole sticks, you have to be a little careful that the pieces don't all break apart but but I love the flavor of that one. Do you have a favorite cinnamon I don't? I tend to. In, cooking I tend to use whichever when I grabbed I. I'm. I will admit but I have ordered several varieties from penske spices which company create. Yeah. Company that I like and So it's fun fun to compare them and to just think about them you know both at their place in history their place in the history of the expiration of the world because you know a good deal of. World, exploration was driven by the desire to bring spices you know back to. Europe? And don't forget. Cinnamon is the inner bark of a tree. That is pretty darn cool. If you ask me who was the first person yeah? Thinking that out it's not the outer bark. So it's not that they just took a piece of the outer bark and chewed on it and thought this is delicious. It's the inner bark and who'd who did that? If I had to guess I would say somebody cut down the tree and smell the smell and. What is that and started sniffing around the tree and figured out where that came from but that's that's you know that's a guess. Well, it sounds like a good guest to me. So we talked a little bit about all spice in our true or false section and I want to. Continue that theme and talk about a spice that I forage for that sometimes called Appalachian. All spice that is the dried fruit of the spice Bush Plant Linda Benzoate, and I've mentioned that. Plant on this. podcast before it is literally one of my favorite forage spices and when I don't have it in my pantry and makes me very nervous because I like to use it in suite applications in savory applications it's absolutely delicious with some natural. Sweetness. It's got the warmth of all those you know Pumpkin pie spices, and honestly it's my go-to spice I rarely use nutmeg all spice and cinnamon anymore because to me the spice. Bush. Kerry. Has It all and it's a wonderful flavor and a very, pretty ornamental plant for yard as well. Well, that's what I was just going to ask you this is not you? Know as as many of these spices from the tropics This is not a tropical plant. This is something that people could plant in their own yard. Yes it's a it's hardy believed to zone four. So that's a pretty tough plant. It's native to the United. States east of the Mississippi everywhere from New Hampshire to Florida there are some isolated populations of it in Texas. But in general, it prefers it's not as happy an alkaline clay soils and that's what we tend to have out here in the West but it's a diocese plan which means separate male and female plants. So if you want to be able to harvest the fruit, you need at least one of each, you can also use the stems and leaves to make a t and they have a slightly different flavor. But for my money, it's the fruit that really is where the love is. Do you picked this fruit when Ans-? Ripe. But not dried and then dry it out. Yeah or is it the seed? Is it the seed or the fruit I'm glad you asked that C. L. because it's both the fruit is is small and read about the size of barbary fruit and I pick it when it's red although if it started to dry on the shrub that's okay and now is the perfect time to go looking for it depending on where you are. But if you're in the northeast the mid Atlantic states now when you should go out and look You can use them fresh and they're they're soft I usually dry them, and then keep them hole in the freezer and grind them as needed. But if you take a fresh fruit and cut it in half, you will see that the orange pulp, the redskin surrounds a soft blackish grey seed. Now, some people say that the seed tastes like pepper and the black pepper and the fruit tastes like all spice and they separate them I kind of think they just do that because. The seed is black and peppers black I don't use it all together and really it. So you're eating both the fruit and the seeds you don't separate the nudist dry and grind it. Very cool. Very cool. Well, you know I don't have any growing in my yard right now but you've you've made me want some. So I'm going to have to check that out for planting next spring.
