Act in house armed services committee chairman democrat adam. Smith says lawmakers will have no choice but to come back in the session and vote to override the veto. Biden makes unexpected campaign stop in Pennsylvania

"To it. But to tell you truth, I don't think much will change. But anyway, I wanted to ask you about Joe Biden Yesterday. I the Early indication was that he'd put a lid on his campaign but apparently was convinced to do something because, after all, it is only a week to go. And what they did is they drove in 45 minutes to Pennsylvania for a quick little Ah, Photo op and getting speech. Do you think it's kind of odd that he's with one week to go that that's the best they can do on that particular day yesterday? Well again, if it was something that was unplanned, and they hadn't done it asleep by the books like I mean, if you look at the rest of his weak here, it's pretty filled up with stuff. But when you and then frankly going into early next week, but if this was something that was unplanned, then I think it was, you know, an opportunity that they took advantage of on some level, certainly with president from doing three different events, But Biden was in Pennsylvania the night before, so Sunday night. He was in Pennsylvania having an event. Trump had his three events there yesterday. So I guess just having Biden go back to Pennsylvania is no big deal the next date over so but it would seem is, though there was a little bit of pressure put on him to do something on some level and you're going to see him in Georgia today. Right now, we have no announcement for what's happening on Wednesday Thursday. He's going to be in Florida Friday in Iowa and Wisconsin Saturday in Michigan. Nothing yet on Sunday and then on Monday in Ohio. So when you look at his weak compared to President Trump's president Trump, of course, have those three rallies Yesterday. He'll be in Michigan, Wisconsin, Nebraska today and then in Arizona and Nevada on Wednesday and then nothing else. We've got nothing else scheduled for President Trump going up to Election Day, So I'll be interesting to see how this all plays out, especially because there seems to be plenty of availability. If either one of those candidates wanted to make a stop in Texas or any of these other states that air seemingly quickly turning into battleground states.

Joe Biden has referred to himself as a transition candidate. And many were asking transition to what Last week. Democrats didn't talk very much about their agenda. And if I were them, I wouldn't either. Bernie Sanders did tell his followers of Joe Biden would be the most liberal president in modern times. In fact, He said. And I quote that many of the ideas he fought for Just a few years ago were considered Radical. Now mainstream. In the Democratic Party. At the root of their agenda. Is the belief that America is driven by envy. Not aspiration. Millions of Americans Harbor ill will toward our neighbors. Instead of loving our neighbors as ourselves. The radical left believes that the federal government must be involved in every aspect of our lives to correct those American wrongs. They believe the federal government needs to dictate how Americans live, how we should work. We should raise our Children. In the process, deprive our people of freedom, prosperity. And security. President Trump Holds Press Briefing On China and WHO

"Begin with the latest out of DC following a news conference with President Trump. This afternoon where he ratcheted up the rhetoric on China and the World Health Organization. Let's go to Kayla Tashi in Washington Kayla there. The White House took an opportunity to redouble. Its hard line on China by very clearly outlining some policy positions that have been telegraphed previous administration officials in recent weeks in a policy package unveiled today the president said the US would be revoking visas for students and researchers with Chinese military ties the US would be studying accounting practices for possible delisting of Chinese companies. They'd be eliminating special treatment of Hong Kong and severing ties from the World Health Organization. Chinese officials ignored their reporting obligations to the World Health Organization and pressured the World Health Organization to mislead the world when the virus was first discovered by Chinese authorities. Countless lives have been taken in profound economic. Hardship has been inflicted all around the globe. The president stopped short of disrupting the phase. One trade deal or sanctioning top party officials even so the event was immediately panned by China. Who's global times? Newspaper called it a recklessly arbitrary move that builds on trump's bullying tactics and says the US will pay a hefty price for specifically any change in Hong Kong as for the move on the World Health Organization. Not everyone in. The President's Party was pleased with that. Lamar Alexander Tennessee Republican and the top Republican on the Senate Health Committee Put out a statement saying this thing. Certainly there needs to be a good hard look at mistakes. The World Health Organization might have made in connection with the corona virus. But the time to do that is after the crisis has been dealt with not in the middle of it and these broadsides come during the ramp up rhetoric in the election season that is just getting underway and is building up steam campaign officials. Say expect the heat to get turned up on this rhetoric going into November. Even if many of these policy actions are held in the wings until after the election is over with Sarah but one thing is very clear. Many strategists see this election as a referendum on president trump president trump in it sees China as a popular opponent

Whistleblower complaint alleges virus warnings were ignored

"Remember Dr Rick Bright. He was the guy who would be in charge of the government's efforts to find a corona virus vaccine and two weeks ago. He was removed from this extremely important job with zero explanation. Then Dr Bright claimed he was fired for pushing back on President. Trump. President trump push for an unproven malaria drug to be essentially distributed on demand. Today he filed a really revealing and shocking whistleblower complaint charging among other things and abusive authority or gross mismanagement. He elaborated on a conference call reporters this afternoon two years however had been beyond challenging time. After time I was pressured to ignore or dismiss expert and scientific recommendations and instead to award lucrative contracts based on political connections in other words I was pressured to let politics and cronyism dry decisions over the opinions of the best scientists. We have in government Dr. Brian also described his concerns about the lack of government response to the growing outbreak. As far back as January after bright relayed concerns from domestic surgical mass produced that quote the mask supplies at imminent risk. Nothing happened for Week. Leading the mask producer. Email bright quote rick. I think we're in deep shit joining me now. Sam Stein politics editor of the daily beast reporter. Dr Rick Complaint today and Sam. It's it's a long and detailed document and it is quite revealing. What jumped out to you? Well two things. One is the stuff that happened prior to the corona virus outbreak. Which is he details. The systematically corrupt HHS process in which Huge contracts being awarded to people who are very close to top officials at the Agency. The more pressing thing obviously many detailed an administration that was basically had their heads in the sand. I with respect to the corner virus outbreak in China for weeks. Not Months you touched on a bunch of stuff early on but just warning for seeing that a shortage of n ninety five masks was going to be a huge problem and being unable to convince anyone up the chain that this is something they had to deal with also a or lack thereof around getting a vaccine in the developmental process which we now see the administration. The president has but he was talking with officials. January early February about the need to prioritize the stuff and of course got nowhere. But I think the larger thing I was it was interesting to hear. Kathleen civilians. Talk about this is that there's sort of a bigger picture here. Which is that. The careerist and the scientists in the administration were more or less ignored or pushed aside and have been since the onset of the administration's not just the disbanding of the pandemic units. But its people like Dr Bright who are dismissed as alarmist even though the scientist nistration and this is sort of common pattern that you see with his presidency where he goes more with his political guts and how he's thinking than actually doing any long term strategic planning and it's more than guts and there's an allegation of essentially corruption. Here right that that that you have career. Scientists and civil servants were making determinations based on the science and there's pressure from above from the trump administration to steer things in the direction of people that have a a monitor interest because they're buddies of the president like that. And that's one thing if you're talking about know a contract for buying pencils for a federal agency it's another we're talking about vaccines and lifesaving drugs right now. There's so there was this story which detailed the president's push for hydroxy chloroquine as therapy drug To be stockpiled against all sort of prevailing scientific evidence or lack thereof that it was effective in Dr Bright raise. Those concerns admitted that he brought to the attention or confirmed an inquiry from a journalist which ultimately led to his dismissal from his post. So that this is a case of someone saying this is really crazy. What we're doing is borderline not completely unethical. I mean stop and he took provocative steps to stop it. There was another story today. Involving a jared Kushner is Coronavirus tasks in which one of the complaints made against that was that Fox News personalities were able to jump to the front of the line in terms of getting people to hospitals that they deemed helpful. Or you know emotionally close to. So you're absolutely right. There's a horrific way to do this. In the trump administration is basically hitting every which is cronyism favoritism and dismissal. The science I want I want play. What a bride had to say about H- dismissal the of high hydrochloric being the kind of breaking point in terms of Administration take a listen. Americans need to have all the fax they need to know the truth about this pandemic need to be able to trust their government

U.S. Justice Department prepares Google antitrust probe

"The Trump Justice department is targeting is targeting Google for the way they've basically got a essentially what they're saying is a monopoly on search. Now here's the question. His Trump targeting President Trump President Trump Trump. Is he targeting Google, because he feels like it's being unfair to the conservatives or is he targeting because they're just so big. Makes you wonder right? It does. I think I think this is all part of let's go fight the social media, and there's really no downside to him doing it. Because look the left is going after social media big time. Right. So there's, there's no, it's not like suddenly Adam shifts going to run out and defend Google. They're all hitting Google. They're all hitting these, these outlets at the same time and the idea that they're going to target. Google is certainly very interesting. This was telegraphed by the way back last August. Back last August advisors were saying there is a there is an effort underway to look at Google. They are preparing apparently an antitrust probe into this, this reporting coming out of the Daily Beast, right here, saying the Justice department is preparing an antitrust probe into tech giant Google. That's the Wall Street Journal reporting and being reported kinda hate when they do this by the Daily Beast. So the department of Justice is gearing up for an antitrust investigation of alphabet Inc. "Welcome back. This is the Ben Shapiro show. So the president has now asserted executive privilege over the redacted Muller report will that worked let's discuss the legality of executive privilege. Well, here's some of the background on executive privilege. This comes from the Brennan center, which is a more left leaning legal center doing doing legal analysis as hoop with a columnist over there for them lawyer for them. He wrote this going back to two thousand seven this was not designed for President Trump, President Trump, and here's what it says the president's constitutionally based privileges subsume privileges for records that reflect one military diplomatic or national security secrets this would be the state secrets privilege. So the president's is negotiating with China, congress subpoenas those records, Trump has no, hey to communications of the president or his advisers, the presidential communications privilege three legal advice or legal work. That'd be attorney client or attorney work product privileges. So. Zoom ably. He asked Don Mcgann for legal advice that is not subject to congressional oversight. And finally that's liberty processes of the president or his advisers, the two most commonly invoked executive privileges are these so-called presidential communications privilege and the deliberative process privilege privilege, the presidential communications privilege protects from disclosure any communications that are either by the president's reckless or by his immediate advisors in the office of the president. The president supreme court did recognize this privilege in Nixon versus United States and Nixon versus administrator of general services. The Nixon cases were about Nixon being subpoenaed by congress for records of his internal deliberations over Watergate, basically, including the including the Watergate tapes, including the Oval Office tapes and supreme court ruling that he had to turn them over the court grounded the privilege and the need for cancer in executive branch decision making and the supremacist each branch within its own assigned area of constitutional duties in the Nitin cases is court applied the term presidential communication. Privilege solely to communications involving the president. So the president is talking with somebody and he wants to keep that communication secret that falls under executive privilege. However, the DC circuit caution that not every communication with the presidential adviser would be protected the privilege should apply only to communications authored or solicited and received by those members of immediate White House. Advisers staff who have brought significant responsibilities. So in other words, the janitor at the White House doesn't have executive privilege once properly asserted by qualified person, the presidential communications privilege applies to documents in their entirety covers final and post decisional materials as as pre pre deliberative ones critically covers any factual matter containing communication and in. This regard sweeps broader than the deliberative process privilege, which we will get to in just a second. But the presidential communications privilege can be overcome by sufficient showing of need of this goes to court expect the congress will simply that they have sufficient need because they're involved in criminal investigation. And they need. See these documents one of the first judicial recognition of an executive branch. Secrecy claim was written by chief Justice. John Marshall endorsed the idea that the privileges feasible. In other words, however, well established the privilege may be it has never been absolute. The supreme court has strongly suggested that the presidential communications privilege must yield whenever a coordinate branches constitutional roles at stake. Nixon the Nixon case concluded that president Nixon had to yields subpoena to preserve the function of the courts under article three another Nixon case held congress could roll back a former presidents privileged in light of the scope of Congress's broad investigative powers. So congress says this particular piece in the Brennan center ought to be able to overcome the presidential communications privilege in any instance, that it exercises its constitutional powers to legislate and conduct oversights. The question will be is this legitimate oversight Congress's attempting to engage in or is this basically political posturing, and that will be that will end up in court, then there is a broader and more powerful deliberative process privilege the. A deliberate process privilege. According to the courts is distinct and different from the presidential communications privilege it protects executive branch. Officers communications that are predisposed and direct part of the deliberative process. A document is predisposed if it was generated before adoption of a policy reflects, the give and take of the consultation process. In other words, President Trump is having a conversation with Don Mcgann about what to do about the Muller report. And it's before a decision has been made. So that seems to fall squarely within that privilege, the privilege has long been recognized by the supreme court. The underlying rationale is that the disclosure of deliberative communications will chill future communications like Trump will never talk with his lawyer ever. Again, thus diminishing the effectiveness of executive decision making and injuring the public interest. Now properly invoked the deliberative process privilege is narrower than the presidential communications privilege primarily because the deliberative process privilege does not extend to purely factual material unless it is inextricably intertwined with policy making processes. In other words, if there's investigation uncovers factual material that's not as liberal process privilege, liberal processes, Mcgann, offering his opinion on the underlying materials, it doesn't necessarily cover the underlying materials themselves. It's also susceptible to congressional or judicial negation the privilege disappears. When there is any reason to believe government misconduct occurred. So will this assertion of executive privilege? Hold up in court, if the president tries to executive privilege over all of this only if the court having looked at the actual privileged material, which will only if the court having looked at the material fines that Don MC that Don Mcgann was involved in legal discussions protected by privilege or looking at the unredacted Mullah report finds that William bar, speaking the truth, and that this material could not simply be released into the public in reality. This is more of a delaying tactic than it is a legal tactic designed to keep these documents secret in reality. I think the courts would be likely to rule against the Trump administration on executive privilege grounds as they did by the way when it came to executive privilege for Eric Holder and President Obama now, here's the truth. There's a long history of. Presidents using executive privilege that in and of itself is not impeachable democrat trying to claim that the president because he is hurting executive privileges in indubitably trying to hide something as I said, there's a very plausible alternative theory, where he's just frustrated and annoyed and we're done, and we're done Mcgann doesn't wanna commit perjury by by accidents miss answering a question or where William bar is trying to prevent himself from committing some sort of federal crime by violating federal rules of criminal evidence. That's plausible theory. A court one of sorting this out suffice it to say that the assertion of executive privilege alone in this particular case does not necessarily mean an Sonian cover up more of this injustice. Second I'll talk about the differences between various types of exertions of executive privilege, historically, speaking. I I know I know you went on vacation. And you felt like okay, I'll go to a timeshare presentation. Then they'll give me a parasailing wasn't. So you go to the time share presentation and go in thinking, no women to buy this thing. And then they sell you..

Mike Pence: "I never think" shutdown was a mistake

"Well, there was no mention in President Trump state of the union address about the government workers who miss paychecks during the shutdown does vice President Mike Pence think the shutdown was a mistake. Former Starbucks CEO Howard Schultz Says He's Considering A Presidential Run

"Four Starbucks. You'll Howard Schultz the first big business heavyweight to consider jumping into the twenty twenty election. So we've got a new segment for you. And we're calling this the fast take where the traders weighing on some of the biggest news of the day. So let's take a listen to what said about his potential presidential run last night on CBS, sixty minutes. I am seriously thinking of running for president I will run as a centrist independent outside of the two party system or living at a most fragile time. Not only the fact that this president is not qualified to be the president. But the fact that both parties are consistently not doing what's necessary on behalf of the American people and argon gauged every single day in revenge politics. So should Howard Schultz? Go from the Starbucks corner office to the White House Oval office, and the reaction so far is very interesting because there seems to be some backlash on both sides of the aisle. We'll my backlashes the independence of it. That's terrible. I think that is just a terrible dynamic that really potentially be counterproductive. Right. I think that he needs to run. He is democrat. I think he needs to run as democrat. Otherwise, if he really doesn't want Trump to be president. I think that this could enable him to become president leading that Trump terrible. If you want Democrats win, it's fantastic. If you want President Trump to be reelected, and if you look at President Trump, President Trump's tweet today, basically daring our to get into. That's he's bathing him to come in. Not smart enough doesn't have the guts those types of thing. It would be it would be a windfall for President Trump. If Mr Schulz ran is. Independent. If I am a shareholder. Should I be concerned shall be concerned that there could be cots from both Republicans and Democrats, and should I be worried that perhaps Howard Schultz could sell some of his stock during this presidential run. It'd be less worried about the capital markets dynamics. I'd be very concerned about a sense that the company's going to do things that are politically correct or politically expedient at the expensive earnings. And there's, you know, Starbucks said plenty of opportunities to digest this posture for the last two years. This is no surprise to anybody that our show was doing this. So as a Starbucks shareholder remains long through what's been very good run. I I'm not too worried about it. I don't think they'll be political though. I just think it's a backlash among their customers now. Yeah. Yeah. Yeah. Yeah. What about here selling his stock either put it in? Question in terms of you know, boycotts will do any real damage though. Rarely do boycotts ever get that long in the tooth in ever really have a resounding effect on the stocks. So I don't think that's the major issue. I think carrying is. It has the biggest issue you wanted to run as a democrat.

Thirty two degrees on this Sunday. January thirteenth this weekend. The partial government shutdown moved into new territory, the longest in US history. South Carolina, Senator Lindsey Graham is asking president. Trump to temporary open the government before he moves to declare nationally -mergency to secure funding for his border wall. Speaking to Fox News Sunday Graham tells moderator Chris Wallace before he pulls the plug on the legislative option. And I think we're almost there. I would urge him to open up the government for a short period of time like three weeks before he pulls the plug safe. We can get a deal if we can at the end of three weeks all bets are off the idea actually has support from Democrats. Also, speaking on Fox News, Sunday, Delaware, Senator Chris coons, Democrats will invest in border security. I'm not gonna sit here on your show and negotiate on behalf of speaker Pelosi. That's led to the partial. Government shutdown. Democrats are exactly hanging around Washington. Waiting to negotiate an end to the shutdown as WCBS Steve burns reports. Fact that eight hundred thousand people did not get their paycheck this week. It's outrageous. She calls the whole thing political ploy by President Trump. We've already passed in the house and the Senate bipartisan bills to fund government. She says the shutdown could and should end today. I wonder what you made of the statement from the president and kind of where the Muller probes. Stance. Now, particularly in light of some of the work. That's just been done. Muller has been trying to get Trump to respond to questions for a solid year. Now, we know from excellent reporting by the New York Times and the Washington Post that there were forty nine questions are subject areas that were submitted to the White House the president as far as we can tell is responding to a fraction of those questions. He is not responding to questions of obstruction of Justice. It is clear to most observers that when the president fired Komi eighteen months ago. Thus kicking off the special counsel investigation by Robert Muller. He did obstruct Justice. Muller is looking into not only the counter intelligence question of whether Americans aided and abetted the Russia hack, but he's also conducting a criminal investigation into whether the president obstructed Justice. And he also has free rein to investigate the president's finances. His taxes his personal and business records. This is going to be a long haul. Let's talk a little bit more about the series. It shows how the FBI's power over investigating a sitting president has played out through four scandals over the past century before we get to that.
