I mean not not just Supreme Court but like the DC circuit court. There's an there's an asymmetrical war the left fights On the courts and the reason. Why is that Republican? This is going to be my second point here so the site is one market argument but the Republican politicians for generation has done an excellent job of explaining to their voters. Why the Supreme Court is important? Okay so it's not that look. It's not that some Republican voter in Iowa is anymore like legally you know aware than a democratic voter in Florida. That's not what it is the differences that the Republican candidate and Iowa tells his voters. Hey the reason why I can or cannot do. This is because of judges right and it's and it's and it's wrong and it's disgusting. But they do it all the time you know. You don't like them men kitten well. It's the Supreme Court's full. You don't like that woman who seems to have control over her own body. That's the Supreme Court's fault that they tell their voters directly that the Supreme Court is why they have nice things liberals on the other hand especially our elected officials do not tell our voters how important the Supreme Court is so when bad things happening you brought this up. And it's so important The John Roberts court has been the most pro business court in American history by far and it was before she got a Republican. Majority all right. The Roberts Court will go down in history as the most pro business court ever in American history and most Democrats do not know that because most democratic politicians have not told their voters why these things are happening right so when we talk and I'm not slamming Gurney here but when we talk about millionaires and billionaires and all the we we don't make that second level connection of like the reason millionaires and billionaires have been able to dominate. The system is because of the Supreme Court. Don't make that second level connection to our voters to get them motivated and kind of on the ground ready to vote for. Democrats not because they agree with policy extra policy. Why because they know that the Democrats will nominate judges? That are I mean. I share your frustration. I mean I feel like Sanders does not articulate this. I think to a certain extent because of his I think you know Democratic Socialism. does not engage or does not engage some of the sort of the structural. I think realities of of the American government on the other hand Joe Biden is not saying anything because frankly I think that he and his ilk appreciate not having to litigate these things publicly. They're happy where it lands. I mean that seems to me to be the dilemma that we have is that To the extent that the there's a left in the Democratic Party that has a problem with these decisions. They do not focus on the structural issues. That are there And to the extent that we have another part of the Democratic Party they are. You know they're like well. The referee said we can't do it so we can't do it or the referee made this call. And so you know what can we do? And I'm not convinced that that's not convenient for them. I mean why else would Chris coons get out there and say we need to reinstitute the filibuster if the Republicans if we take power I mean. That's just absurd. I think there are two issues imply. That Biden is at the center of two failures in the Democratic Party. On this issue One is the long standing reluctance of democratic elected officials. Male democratic elected officials officials to fight the abortion. Fight in the trenches right. They are still of a time. People like Biden are still at the time where they thought the right answer was that abortion should be safe legal and rare it. I mean and when I say all the time that's also what lasts nominees. Vice President Tim's vice presidential nominee. Tim Kaine used to say safe legal. And rare right. They don't want to fight the abortion issue. The Supreme Court makes you fight the abortion issue. And so they're afraid of running on the Supreme Court because they're afraid of having the abortion issue front and center and it's one of the reasons why we have lost the abortion issue. You know why. Why were they lose a twenty year losing streak on the women's right to choose women? Democrats are willing to fight it. You know to seal Richards will be. We'll we'll we'll be the first woman to Santa Post if it needs to be fought for right but male. Democratic leaders are not willing to fight this issue in the way that it needs to be fought and that devolves into a weakness when it comes to Supreme Court. That's number one number. Two people like Biden are are desperate for return to normal or return to institutionalization and that also means a return to a de politicized. Supreme Court. That is one of the problems that I've had in the past with the American constitution size. Acs Federal Society. You know a a liberal version of it that you mentioned earlier Now they have a new leader. West Feingold former senator. Russ Feingold he might change of that organization quite a bit but previously the ACS has been an organization committed to de-politicising the courts. That's not what the Fed sock does the Fed sought politicises the hell out of it and wins right The Democrats have been unwilling to understand that. The courts had been politicized and so we need to fight for them with the political tools. Available to US right. Biden doesn't WanNa do that quite frankly and you know love. The guy had picture on them. All but Obama wasn't either Obama was fundamentally a Supreme Court de-politicized int- institutional list And he approached his Supreme Court appointments in very much that way. The kind of reserved slow. Look at look at the Garland Obama's speed of appointments versus trump's right. That's all trump. Mcconnell WANNA do is appoint judges Obama was considered. They've vetted them very deeply. They made sure they were credential. The mobile mobile sounds just like. Hey you republican come on down you can be on a court The Republicans have been willing to politicize the court. The Democrats have tried to de-politicized courts. That is why the Democrats are losing the political battle for the courts I mean there's a lot to talk about one. We should say that Brian Fallon a former Obama. Official is set up basically a An organization that is developing the lists that the abandoned lists demand justice. I love those guys. I've into a couple of talks with them. Fallon Fallon gets it. Having been through the Obama Administration having worked for Hillary Clinton on her campaign fallon. Get how. And why we've lost the courts and I feel like his organization. Demand Justice is is the group that is trying to fight fire with fire. Now they're not as well funded as soccer. That's something else we haven't talked about. The Fed sock is is well. Funded by the coke brothers by the Mercer families. You name me a rich Republican donor and I will promise you that. He has donated large sums of money to the Federal Society. Society is one of the most is one of the best funded political action organizations in the country liberals have no kind of counterpart because our liberal or Liberal Billionaires. When they have their money they run for president with well and on top of that. I think frankly. They're not too displeased. With the way the court operates right. I mean that's your point. About how a lot of these people. They're happy where it lands right exactly. Go about stopping the most pro business. Korten in American history. Why would you agree with me right? Exactly and and I'm curious but maybe we should say this for another day. What your perspective is. I'm fine gold. He was one of my favorite senators but to the extent that I had an issue with him. He was also very much of an `institutionalised in that respect. I'm curious as to where he'll land but let's let's table that for for another day. So what what? What can we do in terms of reform like you know? Let's say that there was Let's say that President Sanders Get in and says you know. I saw Brian Fallon You know As an interview with him. And he's my guy I'm gonNA. I'M GONNA take his list but whatever he says to in terms of reforming the court If he's got ideas I'll do it. What what would those ideas be? First of all we have to pack and I said we have to pack it not because I want to be some kind of FDR Part of saying hack. It's because packing. The court is actually the only constitutional tool available the problem with people to judge his plan. The problem with a lot of other really interesting cool reform ideas is the constitution is very clear. The number of Supreme Court justices is not set in the constitution. But who gets to point them is. That's the president what they're that they are allowed to serve for. Life is very clear in the constitution. So all of your ideas about term limits or what have you Those are constitutionally questionable. And I as I said in my piece we have to remember that. Any Supreme Court reform plan will ultimately be rude ruled on by the Supreme Court stacked as it is Republicans so if there's any legal whatever we can assume that. Republicans will protect themselves on Supreme Court and will not authorize any of these novel interesting Reform plans the one clear. Constitutional tool that we have is to increase. The number of justices is been done multiple times in American history mainly before the civil war. We think we start with six to ten. And then we're back to nine And quite frankly the court has we've already changed the number of the of Justices Spring Court in my lifetime because Mitch McConnell decided that we could have eight justices instead of nine as long as a Democrat was president so we have to change the number. Now let me ask you just one question. One question about the about the the The lifetime point I think Booed Aeges plan had this and I think Matt Ford's from Tr. I mentioned had this feature where it says. Lifetime appointment to the judiciary is it specifically to the Supreme Court because there is some The the the there is a theory. Anyways that what you could do is say okay. You get to spend eight years or sixteen years on the Supreme Court and then you go back to the appeals court. You'RE THERE FOR LIFETIME. You're judged for life but you go back to. The Appeals Court does is that. Or is that too hazy? Do have to do that..

V. outbreak of was not a good one we have to have confidence among state officials all over this country and people all over the world so we need scientists running the operator operation ought docks of pence second of all you cannot have a president who everyday is saying absurd things I mean touting the fact I think just the other day all that he has somehow very very knowledgeable about an issue which he clearly is not knowledgeable about we have to work with the entire world reach out we have to adequately fund the National Institute of health and the CDC we need regular reports coming from leadership in Washington the state officials all over this country we have to make sure that doctors nurses all over America are protected as they do their job because of they get the virus we're going to be totally unprepared to deal with the general population we don't have adequate test kits right now we don't have ICU units enough of them hospital to nurses will tell you that they have not received the kind of instructions and preparations that they need there's a lot of work to be done but bottom line is from Washington the American people need to know that there are scientists there are doctors were running the operation communicating with people all over the world because this is a global crisis when I sing that in Washington from trump I I just have spoke with Dr Anthony Fauci yeah I know you know know him well no its reputation well and he said the following this morning he doesn't think people over certain age should be traveling right now particularly not going on cruises we have an underlying condition that there really does need to be some sort of self quarantining of sorts or are being careful going into large groups let me ask you this as your campaign made a decision on whether to hold large rallies right now well that's the decision we just held a rally in Chicago yesterday that happens with about fifteen thousand people out and and but I will tell you all we are talking to public health officials all over this country obviously what is most important to us is to protect the health of the American people this is an issue obviously not just for our campaign right this is an issue for all of the National Basketball Association earns an issue for every organization in this country that has large events so all I can tell you is that it is an issue that we are looking up we're talking to public health I was just gonna say who makes that call for you I mean if the statement you know the public health official Michigan says you know what I know you have a big rally scheduled here at wherever it is if they say don't do it you're not gonna do it look we're not going to obviously we're not going to endanger the health of anybody in this country but again this is an issue that every organization every candidate now has got to deal with
