The years endorsing violence His basic argument in trial was that you shouldn't take him seriously when he used words like fight that a lot of other people use bay showed that taken in the context of how often he had advocated violence and endorsed violence and approved violence after that happened That it was fair for his supporters to understand that their call was violence. The the former presidents attorneys countered by saying you never actually heard the former president. Use the words. I call you to violence or something that that would be technically or more most precisely and incitement. Where were they effective in. Where did the president's council fall short. I think they were effective in showing that the president has approved of storming the michigan state capitol earlier. It had praised the people who had done that violently. They had been fighting and he he did not say. I wish you'd been nonviolent. He may have pardoned himself and felt that not disclosing it would be helpful in getting republicans to vote to acquit him In this proceeding so I think it's far from clear whether there will be criminal charges. Stay criminal charges have been discussed in new york Georgia possibly other places and any pardon. He might have issued himself. Wouldn't apply there. It has anything along. Those lines is is very preliminary. It's very hard to guess whether those will go forward. I was going to ask if you could imagine. A biden justice department actually bringing in case. The president clearly has no appetite for this on the other hand. One of the things he said over and over again as a candidate is he wanted to de politicize the justice department and so it's very possible That he would not intervene His attorney general is someone who served for a long time as a judge is accustomed to making independent decisions Apart from politics so it's certainly possible that this decision would be made by career prosecutors based on the evidence that they amass and that both the president the attorney general would let them make the call. Let me pull recline our political director back into our conversation for a second rick. We heard the senate republican leader mitch. Mcconnell with a forceful rebuke of former president trump after the vote to acquit. Does that signal that mcconnell could be open to some kind of criminal prosecution here. Justice department does decide it wants to produce to pursue something you will now have the words of the senate. Republican leader is saying it. It's appropriate and that this is the recourse that is in place and the appropriate one to pursue. When it comes to an outgoing president there will also be the words rick of congresswoman. But then backtrack and just a just a simple reading of her statement into the record. What would I believe my oath and the constitution demand me for the sake of partisan end it would I fear expose my character to histories rebuke and the center of my own conscience? I'm aware that there are people in my party. And in my state who will strengthen strenuously disapprove of my my decision and in some quarters. I will be vehemently denounced. I'm sure to hear abuse from the president and his supporters. Does anyone seriously christly believe that I would consent to these consequences. Other than from an inescapable conviction that my oath before God God demanded of me I saw it to hear sought to hear testimony from John Bolton not only because I believed he could add context of the charges but also because I hoped that what he might say could raise reasonable doubt and thus removed from me awful obligation Asian to vote for impeachment like each member of this deliberative body.
