Daily it's <music> from wonder I'm David Brown and this is business wars daily on this Tuesday July thirtieth today we we return to a story we first reported last spring about a fierce fight between the meat industry and the fake meat industry back in April four states had made it illegal to describe describe plant based foods using terminology otherwise reserved for meat among them Burger and chicken ten other states were considering similar bills flash forward only three months and the battle has grown even more intense bills attempting to control the language on plant based in lab grown foods have been proposed in in twenty five states some past summer pending and a few have been killed last week. One of those laws took effect in Arkansas where it is now illegal to describe a meal fuel made from soy based protein as say a veggie sausage that doesn't sit well with veggie brand tofurkey which sued Joining the lawsuit is the American Civil Liberties Union tofurkey had earlier sued the state of Missouri. When it's labeling law passed last year the rush to legislation comes comes from federal and state cattlemen's associations which view plant based meets as a serious challenge to their livelihoods plant based alternatives like faked beef from impossible possible foods and beyond meat are surging sales of non meat meat's were up twenty two percent from twenty seventeen to twenty eighteen industry publication food dive dive reports that the plant based alternative industry is worth some four billion dollars right now and could reach eighty five billion by twenty thirty still regular meat sales sales have not declined but maybe the operative word is yet ranchers and meatpackers feeling threatened or looking to the example of dairy dairy industry as alternative milks made from? Soy Almond and Hamp have grown in popularity consumers have been drinking less and less milk from cows as the dairy industry industry goes could meet producers follow with us the fear but they can't say that in legislation rather meat industry lobbyists argue laws forbidding the use of terms like meet Burger hotdog and Bacon are necessary to protect innocent consumers from confusion. The argument is that the unsuspecting shopper could wind up with with a mouthful of soy not cow by accident tofurkey says bull the company argues that virtually no one is ever mistaken a veggie Burger as coming from a cow or a soy based hotdog is originating from a pig. The point to Turkey says is that consumers by plant based foods precisely because they're not animals no. Owens trying to hide that fact in fact. It's just the opposite they say. tofurkey suit claims that Arkansas law like Missouri's is an unconstitutional restriction on on free speech furthermore tofurkey argues. If the law remains in place it will effectively restrict the company from selling its products in the state. They say it would be too it difficult and expensive for Tofurkey to invent new language and recreate its packaging. The plaintiffs argue that the point of labeling laws is to prevent companies from deceiving consumers adding adding that descriptions like Veggie in the term veggie Burger make it quite clear what their products are made of rather tofurkey argues. The real reason for the Arkansas law is to unfairly restrict competition and the government has no place in deciding who wins and who loses briefly it looked like a settlement in the Missouri lawsuit suit would clarify the issue and provide some precedent for deciding cases and other states that settlement was due in May but it didn't happen early this month. Tofurkey said the two besides reached a stalemate and that the case would proceed to trial. There's a lot at stake for both sides in any single states legal battles other other state courts would be likely to follow suit should the plant based alternatives lose. They'll be forced to come up with different language to describe their products that they say would actually naturally confuse consumers in the meantime. Some states aren't restricting themselves to worrying about what to call meatless meet in Arkansas the lowly cauliflower one of. The hottest new alternative foods also found itself in the crosshairs of labeling laws not fair to call a little tiny pieces of cauliflower rice according adding to a new bill but wait a minute. I'm David Brown and this is business awards daily on this Monday September ninth while you probably heard the headlines Walmart will no longer sell handgun ammunition in announced the change one month after twenty two people were shot and killed in a Walmart store in El Paso Texas. You'll also stop selling certain kinds of ammunition intended for hunting rifles but which can be used so-called assault style rifles as well. USA Today reported Walmart Mart currently sells about twenty percent of all ammunition sold in the US these actions it says will reduce that percentage to somewhere between six and nine percent. Walmart sells far fewer handguns ammunition. Currently the chain sells handguns only in Alaska. Those sales will end as well. The company stopped selling selling assault style rifles in two thousand fifteen and raise the age of all gun buyers to twenty one last year following the mass shooting in Parkland Florida in a memo to employees posted the Walmart website last Tuesday. CEO Doug McMillan said that he was moved to action by the El Paso shooting but also by numerous other events just in the past month alone own a few days before to employees were fatally shot by another employee in a Walmart in South Haven Mississippi since El Paso there urban mass shootings in Dayton Ohio and Midland and Odessa Texas all of which CEO McMillan referenced in his memo Social Media Lit up with calls for Walmart to get out of the firearms business immediately. After the passer shooting Walmart employees organized a walkout protesting Walmart's business and an employee led change dot org petition calling for Walmart restrict firearm sales and and both open and concealed carry in its stores received one hundred forty thousand signatures the Washington and Post reported Walmart is now asking customers not to carry guns into both Walmart and Sam's clubs in the twenty two states that have open carry laws in the memo. McMillan says it's doing so because workers and customers have been frightened by quoting here multiple incidents since El Paso where individuals attempting to make a statement and test are responsive responsive entered our stores carrying weapons close quote. He added that some customers carrying lawfully unintentionally created situations where employees call all law enforcement and evacuated stores by asking customers not to carry openly. Walmart is hoping to avoid future incidents. McMillan said the chain will continue to to allow people with permits to carry concealed weapons where concealed carry is lawful. Walmart said it will sell out its current inventory of ammunition. It didn't specify the size is or value of that inventory nor long expects to take before it runs out the chain is attempting to balance the new policies while still serving hunters and other sportsmen and keeping gun rights advocates in mind it will continue to sell long barrel deer rifles and shotguns along with hunting apparel and accessories gun control and gun rights advocates advocates reacted predictably with gun control activists welcoming these moves by the country's largest retail chain and pressuring Walmart to go further on the other hand the the NRA called Walmart's policy changes quote shameful still CEO Doug Macmillan wrote to the White House and Congress advocating for stronger background checks he called on Congress to renew debates on the assault weapons ban stopping short of endorsing the ban outright hours after Walmart made its announcement cement kroger the country's largest grocer also announced it would ask customers not to carry openly in its doors. The supermarket chain ended gun and ammunition sales in the months following the Parkland shooting. Walmart's biggest brick and mortar competitor target has been called the quote Liberal Walmart mostly for its stance on guns runs. It doesn't sell firearms or ammunition. In the early nineteen nineties it stopped selling toy guns designed to look like the real thing and it asked customers not to carry firearms arms into its stores five years ago in twenty fourteen. CEO McMillan says Walmart serves more than sixty percent of America's consumers in any given month month have given Walmart's pervasiveness. It's new gun. Policies may cause real change in part by spurring other companies like Kroger to follow its lead. One thing is for sure. The brand launched a campaign called the do nited states intending to celebrate the uniqueness of all fifty states is it designed bottle specific to each state and promised prizes to soda drinkers who collected all fifty but it made one glaring geographical error over on one map. It mistakenly assigned ownership of the upper peninsula to wisconsin for the record. The upper peninsula belongs to michigan. That's the twenty six thousand thousand acres of land that separates lakes michigan and superior as fast company notes yeah. It's hardly a priority for most fortune five hundred companies but not surprisingly residents of the upper peninsula or the u._p. Is the call. The region were quite miffed. The guy who runs the u._p._s. twitter handle a man named bugsy sailor triple triple dog dared the brand to come out with a special upper peninsula branded mountain dew and to give a free case to every u._p. Resident well. We wouldn't be too surprised to find business schools using this case as an example of what to do when you're caught in a blender pepsico took bugsy sailor seriously asli that's right within a day mountain dew vice president of marketing nico- portwood got in touch with sailor assured him the brand would make a special upper peninsula salah bottle now. They needed suggestions for what to put on it. Portwood asked residents of the u._p. They're called uber's to tell pepsi co. What was special about the remote region then the brand designed new label and plastered on nine hundred six bottles of mountain dew gave the sodas away at the upper peninsula state fair where by the way they also gave the ninety thousand attendees chance to dunk mountain dew employees in a dunk tank talk about eating crow more seriously. The brand also redid digital t._v. commercials commercials giving the upper peninsula back to its rightful state on the map. What pepsico couldn't do was to sell the branded soda to come out with quickly one thing to navigate the tricky approval processes and regulations necessary to put it on store shelves well that would have taken too long portwood told fast company in the process mountain dew grew hundreds of thousands of new fans on social media mostly from the u._p. And got a boatload of publicity so what could have been an embarrassing flop turned into a refreshing win for a brand that unlike most sodas is still doing well rival coke as the country's most popular soda but surprisingly mountain dew is the fourth most popular soda in the country. Now they'll become one. It'll keep the gannett name. That's a smart business move. The gannett brand is familiar to many of us. The flagship of its two hundred fifteen papers is u._s._a. Today it also owns the detroit free press tennessee in nashville and hundreds of smaller smaller local papers like the chillicothe gazette in ohio the new giant news organization. We'll have a presence in forty seven states and reach one hundred twenty twenty five million unique visitors according to the washington post one reason behind creating such a mammoth business is to fend off ad sales competition from facebook doc in google which together are expected to bring in fifty one percent of all digital ad dollars. This year predicts the research organization emarketer michael read c._e._o. Gate houses parent company said the merger is intended to quoting here reposition both companies for long term growth and importantly to support quality journalism it will do so in part by focusing on growing digital subscriptions but that long-term financial growth will also come from gate houses traditional method cost-cutting cutting executives have announced that they intend to shrink expenses by two hundred seventy five to three hundred million dollars. That's a large amount considering the size of the deal report the wall street journal. It'll need to impart to pay debt on the high interest loan. The parent company's taking to finance this acquisition more than two thousand. One hundred newspapers newspapers have closed since two thousand four that according to a study by the university of north carolina with this new merger reporters and editors all over the country are bracing for more layoffs. If you're not familiar with lacroix you may have seen it's lemon lime and grapefruit flavored beverages in the grocery store in encasing cans almost neon in color just a year ago new york magazine reported that with thirty percent of the two billion dollar market. There's little doubt that lacroix has won on the seltzer wars now. Wait a minute not so fast since then one scandal after another has plagued national beverage corporation the brands owner i it's eighty-three-year-old c._e._o. Was accused of sexual assault. He denied the allegations then last october. A consumer filed a class action suit against lacroix claiming blaming its natural ingredients are natural at all and that the seltzer contained some chemicals that are also used in get this cockroach poison lacroix of course i in is these allegations to for the record the scary ingredient called lines'll is a common when found in sixty three different spices popular or science magazine debunks not just the claims about linda lual but the rest of the lawsuit is well but still the damage was done and lacroix's headaches worsened person in june of former employees filed another lawsuit alleging lacroix had intended to claim its cans were b._p._a. Free before they actually were and that he was fired for protesting the plans. No you might not buy a cow by mistake but I can imagine a few things that could go wrong but let's get serious for a second the system. Amazon John is experimenting with his code named Orville. Maybe after one of the Wright brothers who knows according to popular mechanics hand geometry was first patented in Nineteen eighty-five five making it ancient by high tech innovation standards the F. B. I. Amazon is hoping to Roll Orville out at whole foods within months to use it an Amazon prime customer would create a hand profile and link it to their Amazon account once that's done to check out. You'd hold up your hand to a special scanner. Checking out would take only three three hundred milliseconds. Give or take a millisecond. If you're truly time starved you'll appreciate the dramatic improvement. A typical checkout now takes a full three to four seconds. According to the New York Post right now. Amazon workers are testing out old Orville by hand scanning snacks from a handful of vending machines in Amazon's John's New York offices why use hand geometry rather than say facial recognition concerns over surveillance make most consumers rather rather wary of being tracked that way but Amazon may be banking on the notion that we've gotten so used to using our fingerprints to unlock our phones or access APPs. We won't worry about sharing our hand. Well mastercard is going all out in a play to associate gate. It's brand with luxury dining experiences last week. It opened what he calls priceless restaurant yet it mastercards well-known and slogan one part art installation one part collection of pop up restaurants mastercard's priceless aims to recreate the world's top dining spots down onto the sounds and smells of their physical environments. It opened last week at a new york. Art gallery called spring the first three immersive dining experiences are replicas of the rock from zanzibar tanzania to resume she a japanese sushi restaurant and lioness a famous london bar the the idea here according to mastercard is allow diners to experience these exclusive restaurants exactly as if they had traveled outside the country the real rock doc restaurant in tanzania for example purchase on a rock in the indian ocean. It's only accessible by low tide or by boat. During high tide. Priceless won't just attempt to recreate its signature menu. It also pipe in the smells and sounds of the ocean surrounding the rock along with visuals intended to make diners feel you like the travelled halfway across the world. The three restaurant replicas will be at priceless through january then mastercard and spring will rotate others in while this concept may sound new. It's actually an extension of an existing mastercard strategy designed to associate the brand with extreme culinary the experiences they call the initial campaign priceless tables not restaurants priceless tables curated expensive meals on the top of a billboard in times times square in new york's museum of natural history and on a rooftop overlooking the duomo in milan and in a twist that may or may not have been intentional attentional mastercard is returning to the culinary roots of all credit cards. Yes diners club. The story goes that one day back in nineteen forty nine china diner named frank mcnamara enjoy a meal at a fancy restaurant in new york when the bill came. He realized he'd forgotten his wallet. At the time. There were no credit cards cash who is king but mcnamara realized there was value in a system that would allow him to dine out without carrying a wad of cash thus the credit card was born and his invention was technically a charge card that could be used only at the issuers restaurant but diners club became a hit and led to the credit card laden world. First chick-fil-a wanted to remind everyone politely of course since since chick-fil-a must protect its reputation for stellar customer service it wouldn't do to be snarky well as twitter wars do this one blew up feeling thing henpecked twitter's had to respond and they did in huge flocks so popeye's which originated in louisiana and is now headquartered in florida fought back with just two carefully chosen southern words words which in other circumstances could inside a schoolyard brawl over a re tweet of chick-fil-a fillets math problem popeye's asked y'all good and with that as buzzfeed wrote the gauntlet was thrown twitter became a buzz as it is wont to do and for a few minutes there the heat was not about political fights but about who makes the best fried chicken sandwich naturally lesser chicken sandwich sellers wendy's shake shack rush to join the fight and every poultry player benefited gaining likes re tweets and followers but none more so ban popeye's which picked up twenty five thousand new followers in just a few days c._n._b._c. reported in the real world popeye's was loving this twitter war and the sales it spurred knowing that a bird in the hand is worth two in the bush. Some customers tried to sell their sandwiches for hundreds of dollars. The washington post reported popeye's ran out of chicken sandwiches in some locations and began warning that they could soon become as scarce as hen's teeth then had happened. They ran out store by store and they had to post handwritten signs on their windows. Telling anxious diners that there were no more of the sandwiches by august twenty six six just fourteen days after launch there was nary a popeye sandwich to be found from coast to coast and that of course spark yet more tweets by customers clucking clucking their disapproval to that popeye's tweeted it will soon bring back the sandwich permanently this time now this being twitter in two thousand nineteen the controversy he did spark a lot of serious discussion and a superbly written piece in vox about the health of factory farmed poultry the labor conditions on those farms and in fast food restaurants and the exhaustion of popeye's workers toiling sixty hours a week because of our love of batter fried birds and it spawned a lot of other political talk to along with discussion about the racial racial differences in the markets for chick-fil-a popeye's but we won't get any of that here instead for the final say or we should call it the final cluck perhaps we'll turn to food writer and soul food scholar adrienne miller who says i thought it was a very fun food fight and nothing deeper than that although like the thousands on twitter miller miller couldn't resist weighing in i've had both sandwiches.
