"His conviction on charges of drugging and sexually assaulting a woman, Andrea Constand at his home years earlier. NPR's Elizabeth Blair has been following this story. Good morning, Elizabeth. Good morning, Noel. What are we hearing from the other women who say copy assaulted them. They are stunned and disappointed to a lot of them. It's hard to understand how, after all of these women have come forward after a jury found Cosby guilty that he could still be released on a legal technicality. Are also concerned about what the news will do to victims of sexual assault. I spoke with Angela Rose, who is the head of a nonprofit called Pave, which stands for promoting awareness victim empowerment. Here's what she said. I fear that this is going to really hinder other survivors from coming forward. And so you know this case, The Bill Cosby case was truly one of the first cases in the Hashtag Metoo movement, and it really paved the way for other survivors of high profile influential perpetrators to speak out, so I don't want that to be lost. Rose was in the courtroom supporting the alleged victims who testified in the Andrea Constand trial, She says the news of Cosby's releases like a knife in the heart for them At the same time, there were some people who publicly expressed support for him. Interestingly, his co star on The Cosby Show, Felicia Rashad for many years, said very little about all of this. Yes, Phylicia Rashad, who played Cosby's wife on TV for many years, was at first, very enthusiastic. She tweeted. Finally, a terrible wrong is being righted. A miscarriage of justice is corrected. She later back pedaled and sent another tweet, saying she supported survivors of sexual assault coming forward and that her earlier post was quote in no way intended to be insensitive to their truth. And I imagine that was because I mean, I saw this happened yesterday. People online were outraged. Very much. So Rashad was recently appointed dean of Howard University's Chadwick Boseman College of Fine Arts, and a number of Howard alumni feel the comment was really inappropriate. Soraya McDonald is a Howard graduate and culture critic for ESPN's The undefeated, She says Rashad's comments could have a chilling effect on students. You know, I try to imagine if you're a person who has been sexually harassed her is being sexually assaulted. You know by a fellow student who is also in the college of Fine Arts, and you think Well, Should I go to Dean were shot about this? I can't imagine thinking that you know that is someone who is who is going to support you. I wonder, you know, as we heard earlier, this was one of the first high profile cases of the me too. Movement. Is this a setback for that movement? Can we say Some activists are saying yes, this is a setback and we can see it's lost some steam with the general public, but the champions of the movement are still added Attorney Gloria Allred, who has represented some of Cosby's accusers held a press conference yesterday. She made it very clear that she is moving forward with the civil case against Bill Cosby in Los Angeles County. He's representing a woman who claims Cosby sexually assaulted her when she was 15 years old. Cosby has denied causing any harm to her. NPR's Elizabeth Blair. Thank you, Elizabeth. Thank you. All right. So why did the Pennsylvania Supreme Court vacate Cosby's conviction? It is very complicated. In fact, with me now is Nikki Wise and see Egan. She's an investigative reporter who covered the case. She also wrote the book chasing Cosby and hosts a podcast. Of the same name. Good morning, Nikki. Good morning. You've been following the accusations against Cosby since very early on. Did you see this coming? Well, I haven't actually following it Since the first day, the story broke in 2000 and five. I really had a sense that the the state Supreme Court was not going to rule in the prosecution's favor. In December one, I watched the oral arguments because the justices questioning of the prosecution was very hostile. In fact, At one point, the chief justice just walked away from his screen and his screen went blank for 10 minutes. It was on YouTube because of Covid. It was just extraordinary watch. I had never seen such unprofessional behavior in my life, so I expected they were going to rule in his favor, But not on this issue. I thought it would be the issue of the other accusers who were allowed to testify. This was a non issue. In my view. I mean, there is no proof that there was an immunity agreement zero proof. Ha ha. Let's talk about your mentoring an issue and we haven't actually defined what that is. What was it issued The Supreme Court vacates the conviction and says, We are doing it because of X. What is X? They believe that Cosby's due process rights were violated, because, while um Bruce Castor, the former DEA claims the press release he put out announcing cause he wasn't going to charge. Cosby in 2000 and five was also an immunity agreement. And because of that Cosby cooperated more fully during the deposition in Andrius case than he would have made those incriminating comments, which were in turn used in the trials against him. I want to play a clip from Victoria Valentino. She's one of the women who is accused Bill Cosby and she talked to our colleagues on all things considered yesterday. Let's listen. When he was sentenced when he was found guilty, Our faith was restored. And now even though maybe there is a legal glitch That can support his false claim of innocence We have to carry on. Regardless, I wonder what you think of this term legal glitch and whether this is similar. What Miss Valentino is saying there is similar to what you've heard from his other accusers. I mean, Yeah, I've heard mixed things. Some were just confused and very upset. Tamara Green, who is a lawyer herself with a little more pragmatic about it pointed out. Hey, he did serve three years and he's 83. That's something I mean. The shocking thing here is the remedy that the court decided was to bar him from being tried for a third time and release him immediately from prison on an issue that there is you can call it a legal clinch, but there's there's no proof that there was any such agreement an immunity agreement..

Yeah, And I think he might have been thinking like, Oh, sorry that we had you out here on this kind of a day when we're not getting a lot of foot traffic, right? It happens What it happens. Speaking of foot traffic, Bill Cosby walked right out of jail yesterday. Oh, God, I just can't even Believe this no one there wasn't even a build up story to this. Like we might get out. This appeal was happening. Well, I knew they would appeal. Absolutely. But again in prison for three years or jail. Whatever. Nearly Yeah. No, he was in prison for sure. But the pen Pennsylvania Supreme Court overturned his conviction. I mean, it's so this has got to be so awful for the victims, especially on the one woman, Andrea Constand. Who this trial was, you know all about, but there were like 70 women who came forward and on a technicality. He doesn't serve his full sentence. Yeah, I mean, just it's very frustrating. I think one of the last stories as I am looking forward on on TMZ and realizing how shocking it was when everybody found this out yesterday. Um, maybe the last story before that release was from March of this year. Oh, my gosh. No, it wasn't. My word. It was may not March May 27th of this year and the headline on TMZ read. Bill Cosby denied parole. So if you saw that headline a month ago, you just thought all right. Well, I guess that's not ever going to happen. And then he goes from that to being just walking at least So he was sentenced for what 10 years. Yeah. 3 to 10 years, Okay? And so he did. Almost three. If you're the the prosecutor, you gotta be like just feeling really bad about this because what? What actually, was it, um That So there was another got overturned. There was another case where he had a deal going on with that a different prosecutor. And then, uh, that They got him to confess to buying Quay ludes, drugging women, They said. If you tell us this You know you won't go to jail essentially. But then the civil case with Andrea Constand Stead was a different prosecutor, and they used his statements where he admitted to that against him when they promised him, another prosecutor promised him. That they would never use it in court, and they did. So That's the situation. The technicality that got the entire thing overturned, but they didn't know how many people were going to come forward at the time. That prosecutor also was focused just on that case for that. Victim. So That's what Elizabeth Rees told us today in the dirt alert. Oh, my gosh. Well, we do have, um So first of all, the court ruled what I'm reading is that He was denied that protection against self incrimination. So that's what basically comes down to all of these deals that they make. Doesn't it feel slimy? Yeah, it is, But it's a game that they all play. Yeah. Because it's all about you know, the prosecutor will give you that wanting to get the the conviction to some degree and then the defense attorneys wanting to do the best for their clients, and everybody deserves representation. It's just it's I just feel bad because people wouldn't like other criminals wouldn't come forward or people wouldn't come forward. That were involved in crimes without any assurance that they weren't going to go to jail. So that's why deals happen. It's just but but it's okay for it to feel. Jackie? Yeah. You know what? I'm even people who take a deal Who Swear that they're innocent. Take the deal because they think they're going to lose. If they go to trial. Mm. And their lawyers are pretty sure they're going to end up with a harsher sentence. So it's just that's crazy. This script, this whole system, and here's what it looked like yesterday, right After Cosby was driven, was released from prison, he was driven to his home in Elkins Park. It's about 25 miles away from the prison, where he was serving his sentence. He was helped out of the car while wearing a maroon T shirt had baggy blue pants. Thank you, NBC news for the who were best. Cosby then emerged from the house, They say. A short time later, wearing a T shirt of Central High School in Philadelphia, a handful of supporters cheered him with shouts of which is, of course, in homage to the animated character that voice fat Albert supporters out there. Oh, for sure. In fact, I was reading from TMZ. I mean, Phylicia Rashad, a big time supporter of his his TV wife, T. M's. He was saying that they spoke with someone in the speaking gig. Industry. And they think that, uh, though he will have a limited market of who would want to book him that he should still be able to spend fetch 10 to 15 grand for an appearance in probably 20 grand for a speaking, engage unbelievable. The Pennsylvania Supreme Court did not address at all guilt or innocence here or or the reliability of the evidence, etcetera. This was strictly a narrow legal decision. Based on the agreement that the former prosecutor Mr Castor had made with Cosby's lawyers. That he wouldn't be criminally prosecuted if he testified the civil case. So there is that. But if you are a sexual assault victim out there and you see here is a very powerful high profile, you know? Person that's known all over the world. Bill Cosby get out quote unquote of charts sexual assault charges. It may have a real chilling effect because I'll tell you and working these cases. It's an uphill battle to get victims to even come forward. The estimates are less than 25% of sexual assaults or even reported And so you can see anything like this could really have a negative effect. Are you surprised by this yesterday? No, I'm not because I had heard that that was clearly out there. And you know the question Amanda all along in some legal scholars that I have that I have read since this came out yesterday, you know, sort of question whether legally If one prosecutor makes an agreement with someone, it is the new prosecutor, the newly elected prosecutor bound by that now obviously the Supreme Court in Pennsylvania. Agreed that it was binding, so I don't know. I don't know, but it's it'll be interesting to see as we go down the road in other cases. You know what? Uh, what might happen, But you know the important thing here. Is that the decisions that you make at the time in the justice system Can have, you know profound effects on a case later years later. Our pop culture round up with Eric Deggans, TV critic for NPR. Brooke Obie Award winning film critic and author and Emily Vander Worf, critic at large for box, Brooke, What did you think of jingle jangle? I thought Jingle Jangle was very sweet. I was very excited for my niece and nephew to watch it because it's just something that we've never get to see. I mean, it's black fantasy on DCruz isthmus and just so many wonderful things, but also magic. You know, there are math geniuses. They're two little black girls who are math geniuses on bears. Force Whitaker. This Phylicia Rashad, There's an economic rose. It's a musical. I mean, it just feels like it. Has all of those things that we love about this season. Um, in a way in a story that we've never seen before, So I thought it was very inventive and very cute. I'm overlooking some of the plot holes that existed. Look, it's just Yeah, over looks huge. And my niece and nephew love it, So I'm happy. Well, if you need a reminder that Aneka Noni rose can sing her whole entire face off. Just wait till like the back third of the film. She has this amazing number and she's just such an incredible vocalist. I loved it. It's a great family watch. Well, we got a whole new slate of fall TV this month, and some decided to include the pandemic and their story line or have actors wear face masks on scene. Ah, lot of you're bringing up this is us is a show. You're watching. And this is one of the show's grappling with the with the pandemic. Eric, How are you seeing shows take on covert 19. Well, it's been interesting. Um, that is a choice that every show runner had to make a zoo. The lockdown shut down production of television over the summer. But producers and writers were still meeting and trying to figure out what they were going to do once production resumed, and now we're learning, you know, network TV shows in particular, coming back to new episodes. Um, you know this past week and the week before, And we're Seymour come back in the first week of December. So you have some shows particularly the medical shows and the first responders shows. Of course they're gonna have to deal with. It s so the good doctor had has is dealing with coveted Um you know, Chicago Med and in Chicago Fire and places like that have all of their doctors and first responders, emergency people dealing with Cove it there was a controversy with an ABC show called Big Sky. Which was created by David E. Kelley, who you may know from Remember from L. A law on the practice and shows like that, And he has a show that involves these two women who run a private detective agency and its set during the time of coveted they show during the show. That some people are wearing masks. But there are scenes set in a restaurant and said in a bar where most people aren't wearing masks, and it's really kind of weird. They decided to set it during the time of covet, but have a bunch of characters who aren't really sort of obeying. Any of the guidance that you have from health authorities about how you're supposed to be living during this time, and I think that's the problem that some of these shows are going to run into. If you said it during the time of coveted, you are committing your characters to conducting themselves in a certain way, and you're committing yourself. Seo trying to portray the world in a certain way, where there's a whole other level of behavior that you have to sort of portray. And I think a lot of these shows they're gonna have trouble being consistent. Emily, How are we seeing reality shows dealing with the pandemic. You know, reality shows actually have a bone easier time sort of constructing a bubble around their production. Not every reality show but but some of the ones that people know best. For instance, something like the Bachelor. Is really able to construct in essence of bubble where people can't leave and sort of stay in the same place, and that way they can all ensure that they're staying covert free. Another show that's done a good job of that is the ABC Syria's Shark Tank, which constructed its own bubble in Las Vegas. I mean, a lot of this is network publicist saying this so we don't know how non permeable those bubbles are. But we haven't heard about an outbreak in those serious either where there have been outbreaks, another scripted syriza. Where there isn't a bubble. So there is some, you know, idea that reality shows maybe have an easier time of this. Even if you know it's something like Something a little bit more wide ranging, like the amazing race would not be able to be produced in this environment. Eric, How are we seeing covert 19 effect production in the TV industry. Well, as I said, you know, we had a lockdown that affected I think network TV and broadcast TV. Probably the worst. The lockdown commenced in the middle of March. And so that was right when Broadcast shows. We're finishing up their seasons and the broadcast TV industry was supposed to be filming pilots to figure out what their new shows we're gonna be that following fall, so all of that production work stopped except for as I said, writing. So what we've seen happen is that they fall season, which normally Commences in September, and we see a bunch of new shows on the broadcast networks. Like all of that pretty much got obliterated. And so broadcasters were bringing over shows from England. They're bringing over shows from Canada. They're bringing over shows from streaming services on sister Um, you know, platforms whatever they could do. To fill up their schedules until now, where we're finally getting some new episodes of returning shows that have eased back into production and tried to maintain you know these production bubbles or tried to figure out How they can keep people safe. And and as Emily noted, you know, co star on that show. I mentioned the good doctor Richard Schiff was diagnosed with with Cove in S O. So there's been, You know, I think mostly shows have been safe. But there have been some some some issues with some people have come up. Um, you know, testing positive after production has restarted, and I think we're also getting to a point. If you look at the streaming services and the premium cable channels they work further in advance, so throughout the summer They didn't have as much of a problem with keeping new fresh content in front of viewers. But I think now we're starting to see that their covers air getting there, too. And so everybody started easing back into production and trying to bring things back to normal, But As infection rates start to surge across the country and across the world. I think it's going to be harder for these productions to come back to the level of production that they were used to before the pandemic. Shut everything down be tweets. My daughter and I have recently discovered parenthood on Hu Lu and are completely invested surprisingly well written with good acting. And let's see one listener tweets. I actually watched Jingle jangle and it was an excellent movie with an excellent cast. I can't get the image of force Whitaker dancing out of my head, though it was hilarious.
