shortly thereafter What was the technicality was a jury instructions how was it that he got out He was convicted based on his own testimony in the deposition that he gave in which he basically admitted to drugging and sexually assaulting them and the problem was he did so under an agreement allegedly by the former Montgomery county state's attorney or prosecuting attorney who had made a deal with him that in exchange for his testimony he would not use that testimony against him well He left office and the new prosecutor came in and said I don't know of any deal That wasn't written down I didn't agree to it So to that I'm going to use that testimony in the Android constant case and that testimony obviously proved crucial to that jury finding will cause the guilty said that that's not fair you can't make an agreement with him use his testimony against him and then turn around and use that testimony in contravening contrary to that deal and prosecute him so they release them on that whether that's a technicality or not depends on I think your perspective Well actually it seems reasonable that at least we abide by the rules but why did they cut him that deal to begin carried out is a different question Yeah so I wondered about that Illinois had a moratorium for some time on the death penalty federally there is a moratorium on the death do not some states put people to death still President Biden well this is a federal conviction So there are state there are states that still have the death penalty for state offenses This is a federal federal sentence So there is a moratorium currently by the Biden administration and they say they're studying whether they should reinstate that justice Breyer than now retiring justice Breyer in the sense in this case
