"Hey everyone, I'm chrysalis from the point in for David chali and today. This is the CNN political briefing. Here's what you need to know in politics for Monday, September 26th. Wednesday is likely to be the January 6th House select committee's final public hearing before it releases its report. So what does it have in store? Throughout the committee summer hearings, they presented a devastating case that former president Donald Trump pursued multiple avenues to try to overturn the 2020 presidential election. Even after people close to him, told him he lost. We don't know much about what this week's hearing will reveal, because panel members are keeping things under wraps. But here's what committee member Adam Schiff told CNN over the weekend about it. I think it'll be potentially more sweeping than some of the other hearings. But it too will be very thematic. It will tell the story about a key element of Donald Trump's plot to overturn the election. Last week, the chairman of the committee, democratic congressman Benny Thompson, said there's significant witness testimony that the committee hasn't used yet and called this hearing an opportunity to get it in front of the American people. Committee members owe lofgren discussed the committee's choice to air this hearing at 1 p.m. rather than in prime time. It's true, it's not in prime time. I would note, however, that in the past, Fox News does play our hearings if the hearing is in the daytime, so that's a factor. But there's one thing we do know. We probably won't be hearing from Wisconsin House speaker Robin vos. The committee subpoenaed vos over the weekend and demanded he testify this morning. That prompted boss to file an emergency lawsuit where he asked a federal judge in Wisconsin to block the subpoena. That's all according to federal court records. Vos says the committee wants to question him about a conversation he had with Trump back in July. After the state courts blocked the use of some absentee ballot drop boxes and Trump requested speaker boss take future actions. After his attorney spoke with the panel, Voss did not end up appearing before the committee today. But committee member lawn told CNN over the weekend that they would be meeting with Ginny Thomas soon. That Supreme Court Justice clarence Thomas wife. Lofgren said the meeting was voluntary, and that the committee is hoping to learn more about her involvement in January 6th. As for the former president, Trump himself in the former vice president Mike Pence, loughran said it's not likely the committee will be meeting with them. Meanwhile, new CNN reporting provides more insight into the communication between Donald Trump's White House chief of staff, Mark Meadows, and key players who attempted to overturn the 2020 election. And I say more insight because you may remember back in the spring when Meadows turned over more than 2000 texts to the committee. Those texts painted a very telling picture of how Trump's inner circle and Republican lawmakers worked behind the scenes to try to overturn the election, plus how they reacted to the insurrection on January 6th. They also showed how Meadows was involved in all of it. These new texts reveal messages between Meadows and Phil waldron, a retired army colonel with ties to Trump's circle. Text messages in December 2020 show that waldron briefed Meadows about his efforts to get voting machines in key swing states as part of his attempts to find evidence for Trump's baseless claims of voter fraud. The text shed new light on how waldron's reach extended into the highest levels of The White House, and how Meadows was kept up to date on all of these election fraud schemes. All of this comes as multiple criminal investigations into similar efforts to obtain voting machines are playing out at the state and federal level. Some of the people who are targeting in those investigations are known associates of Phil waldron. So even though there's no direct line as of now, there is some overlap. And another interesting new development, a mysterious phone call. At four 34 p.m. on January 6th, 2021, a phone registered to a capitol rioter received a phone call from The White House landline. The capitol rioter is a 26 year old Trump supporter from Brooklyn, New York. The call only lasted 9 seconds. Who placed the call and why it was placed remains a mystery, but here's why it's notable. It was the only known call made from The White House to the phone a variety during this critical time period. The call was first disclosed by Denver riggleman, a former congressman in an interview with CBS 60 minutes. The real aha moment when you see that The White House switchboard had connected to a rioters phone while it's happening. CNN's reporting shows the call was from a landline, not a switchboard. Riggleman is a former Republican congressman from Virginia, who left this job working as a technical adviser for the January 6th committee in April. He's releasing a book this week where he's promising to reveal quote shocking details about the Trump White House's link to militant extremist groups. Committee members have downplayed riggleman's comments and said he doesn't know a lot about what happened after he left the committee in April. Here was lofgren on the matter. We follow up on everything and I don't know what mister regal and is doing, really. So it's unclear if anything will come of that on Wednesday, but it will be interesting to see what the committee has saved up for its last public hearing. I should also know that the vice chair of the committee, Republican congresswoman Liz Cheney, made some interesting comments ahead of the hearing as well. Over the weekend, Cheney sat down with the Texas tribune and talked about the danger of another Trump presidency. I think that Donald Trump is he's the only president in American history who refused to guarantee a peaceful transition of power. I'm going to make sure Donald Trump, I'm going to make sure he's not the nominee. And if he is a nominee, I won't be a Republican. Cheney, along with the only other Republican representative on the committee, Adam kinzinger will not be returning to Congress next year. She lost her battle for reelection in an August primary. It's still unclear if the panel will make a criminal referral after it concludes its hearings and releases its report. Committee member Adam Schiff told CNN that if the panel does make a criminal referral, it should be a unanimous decision. Regardless, the committee is now up against the election clock. Post Hi Jackie He's Scott Thanks so much for having me Now Jackie these text messages that Liz Cheney read were not just from Donald junior They were cabinet officials GOP House members hosts from Fox News All asking Meadows to get Trump to go public and tell the rioters to stop What does all this add to what the committee is looking for That's exactly right I think what it does is two things It helps paint a picture of the extent that Trump's chief of staff Mark Meadows was aware of and involved with some of the activities related to January 6th this sort of confirms as Liz Cheney said that Meadows was well aware that there was violence playing out at the capitol and that those around Trump some of his closest allies his son wanted the president to intervene and thought that he could make a difference and potentially prevent some of the death and violence that we saw I think it also helps illuminate the case that the committee is making fur Mark Meadows to provide more information It shows that he's a key figure in understanding Trump's efforts to overturn the results of the election He can answer what role The White House played in planning the rally that proceeded attack and most importantly he is the person who perhaps singularly can respond most comprehensively why Trump did not immediately come out and forcefully call and supporters to stop their assault Now in hearing last night Liz Cheney also spoke of president Trump's supreme dereliction of duty What might we what might the committee make of that question Yeah that's something that we are still trying to parse and I think what is pretty remarkable about this investigation is how much new information has come out already even though this was an event that happened in January and some reporters have spent a whole year reporting on it But I think that this primarily relates to why the president one didn't issue a public statement to why he was delayed on getting the National Guard to quell some of the violence And then also you know more information in details on the preparation leading up to January 6th and the role that the president played in perhaps contributing to the lack of preparedness amongst government agencies Now as you mentioned the president's communications with Meadows we don't have and he says they're protected by executive privilege Here he is explaining his side to Fox News last night I've tried to share non privileged information but truly the executive privilege that Donald Trump has claimed is his the way it's not mined a wave is not Congress is the wave And that's why we filed a lawsuit to hopefully get the courts to weigh in Hopefully they'll weigh in Now we already have an executive privilege contempt of Congress case going against Steve Bannon The Justice Department now has to decide whether to pursue charges against Mark Meadows at as if the full House votes in favor of this resolution What might the DoJ be weighing as far as whether this would be worth it The DoJ has been pretty opaque when it comes to the decision making process behind whether or not attorney general Merrick Garland will prosecute some of these targets that have been held in criminal contempt They ultimately decided to hold Steve Bannon in contempt Meadows is going to be a trickier case here I think that the 51 page contempt report released by the committee is very compelling and in part helps undermine the legal case that Meadows is making that a lot of these communications are covered by executive privilege Also the fact that his book came out last week and in that book he actually talks about his conversations with the president but on the flip side of this once the Department of Justice decides to prosecute someone for criminal contempt yes that means that they can potentially be punished in the end if they are found guilty But that information that the committee is looking for and that the committee basically made clear last night runs through Mark Meadows might not be available to them because a criminal contempt process doesn't actually resolve The key issue of providing the information that they want This report you mentioned that the committee released what specific important details can we glean from that Yeah Scott for as much of a blockbuster night as last night was there actually was perhaps more new information in this 51 page contempt report The committee details several instances where Meadows personally assisted Trump with efforts to return the results of the election That included an actual trip to Georgia where he personally inspected a quote unquote county audit that was related to election fraud They detailed his participation in meetings with senior DoJ officials about unsupported election fraud claims in the litigation And he also participated in meetings at The White House with private individuals that were quote unquote linked to Trump's reelection campaign during which mister Trump and others discussed seizing voting machines and almost declaring emergency powers for election related purposes Meadows himself instead of sort of shielding the president from some of these conspiracy theories that were coming into his inbox actually became known for entertaining them and setting up meetings with people like Phil waldron the retired colonel who was working with Trump's outside lawyers and was part of the team that briefed lawmakers on a PowerPoint presentation that detailed various options to overturn the election on January 6th Jackie alamani is congressional correspondent Those votes are still in the pool right and so you can say that they should be thrown out but getting them actually thrown out is not the same thing and so the first thing you went through all of these totals of votes that that they considered that i probably would consider illegal votes votes. That should have never been counted nevada. I think one hundred twenty some thousand votes that they thought shouldn't have been counted. Well here's the problem. Let's say you're right. Let's say you can get agreement. Even on the part of the state officials. How do you separate those hundred and twenty thousand votes off from the rest. The two hundred thousand whatever votes that were counted at the ballot that they shouldn't have been counted in wisconsin. Let's say that they're correct. I'm not gonna argue. That came but unless the state officials remove them there in the vote total. And you know you can. You can say all you want that. They shouldn't be there. It is a is a documentary that my clindell produced. He's the my pillow guy and an ally of President Trump, and he put together a documentary I watched actually this morning. I got up way too early this morning and started watching it for I am And it's about two hours long, and I got through all I actually made it to the end. But there's another voting machine company that operated voting machines in Texas, which was also called into question by the by the documentary.
