"CBS News special report campaign 2022, America decides. The polls have closed in 6 states so far on this election I, Georgia, Indiana, Kentucky, South Carolina, Vermont and Virginia, a key race in Georgia could determine which party controls the U.S. Senate. I'm Jim crystal and Atlanta. The high profile race between incumbent democratic U.S. senator Raphael Warnock and Republican challenger Herschel Walker is thought to be so close. There's already talk of the possibility of a December 6th runoff election. Warnock has told voters walker is unfit for Capitol Hill. Walker has cast Warnock as a rubber stamp for president Joe Biden and Democrats. CBS jury Duncan is in Philadelphia. Senate race here in Pennsylvania is a key race. A lot of people looking at this because it also could be the determining factor of who has power in the Senate. Democratic lieutenant governor John fetterman faces Republican doctor mehmet Oz in Pennsylvania. CBS News pollster Monica McDermott says the overall mood of voters is negative on this election day, 73% are dissatisfied or angry with the way the country is going right now. These are the highest numbers we've seen since the 2008 election. Some of this is no doubt due to the economy, some of it might be due to the condition we're facing in our democracy right now. Polls will close soon in North Carolina, Ohio, and in West Virginia, CBS News special report. I'm Linda kenyon. We've got some Senate results already. I think this would qualify as the low hanging fruit, the unsurprising results, but Republican Tim Scott is projected to win reelection to the U.S. Senate from South Carolina. Then Democrat Peter Welch, he's projected to win another 6 years as a U.S. senator from Vermont. A couple more here actually just one more Republican Rand Paul, winning reelection to the U.S. Senate from Kentucky. Also still waiting for some results out of Virginia. Other news this evening, another arrest has been made in the murder of a D.C. teenager, the latest suspect is just 13 years old. The 13 year old is from northeast. He's being charged for the murder of 15 year old Andre Robertson junior in mid October, Robertson was sitting on a porch, a few short blocks from Kelly Miller middle school when he was shot. The shooting happened as dozens of kids were getting off a school bus nearby. Last Friday, another teen was arrested as well. After Robertson was killed, police said they were looking for three suspects who drove up to the house, jumped out of a car and started firing. Robertson's father was killed in the same neighborhood, only about a year before Shayna still in WTO P news. And there is a winner in the $2 billion Powerball jackpot, the largest in American history, a ticket was sold to Joe's service center that's in altadena, California, just northeast of Los Angeles. "The bowls are now closed in all the states holding primaries tonight, Vermont, Connecticut, Wisconsin, and Minnesota. In Wisconsin, lieutenant governor Mandela Barnes is projected to win the democratic nomination for Senate, taking on incumbent Republican Ron Johnson. And joining us live on Skype this evening political junkie podcast host Ken rudin, who has coordinated political coverage of both ABC News and NPR. Welcome back Ken talk about the history here and what you see in this Wisconsin battle now between Mandela Barnes and Ron Johnson Ron Johnson I noticed already sent out a news release calling Barnes radical. Well, he certainly liberal. I don't know how radically he is, but he certainly liberal, and that's what the Republican line is. It'll be about Mandela Barnes. Not only is he lieutenant governor of Wisconsin, but he's also African American. And we've seen a lot of cases of Republicans who are running against African American candidates calling them radicals. So we'll see if that works. The fact is Barnes has already won statewide in Wisconsin. And so voters know him. Ron Johnson, on the other hand, may be the most vulnerable Republican of any Republican seeking reelection this year. It's going to be a tough race. And again, you know, the whoever party winds up winning control of the Senate Wisconsin could go down. It could make it make the difference. And we know over to Wisconsin now construction company co owner Tim Michaels has Trump's endorsement in the governor's race and the established Republicans, including Mike Pence in former governor Scott walker, have endorsed Rebecca clayfish. So how is that looking for all of them? Well, you know, we do mention that Michaels does have Trump's endorsement and he does. Michaels also has close to $10 million that he spent in the primary. He's run once before back in 2004. He ran for the Senate against Russ feingold and back then feingold called him a rubber stamp for president Bush back then that was a day when Republicans didn't win in Wisconsin and now you know they could win the governorship Tony Evers is considered very vulnerable and so we'll see what happens with that, but clay fish does clayfish does have the endorsement as you say of Scott walker and Mike Pence and of course the media loves to set up these pens versus Trump rivalries and conflicts. And of course, if Wisconsin is considered one of those, it may be a good thing for Donald Trump if Michael's wins. Right now it's very, very close, less than half the vote has been counted and Michaels has a slight lead. Now, there are a lot of other directions we could go in and of course it is your choice if you have another thought, but I thought it was very significant that in Vermont, Becca balance could very well become the first woman to serve in Congress from that state ever. Yes, I mean, I'll try to make it fast, but Peter Welch who was the congressman is giving up the seat to run for a pet Leahy Senate seat. Ley he's giving it up after 48 years in the Senate. Ballot won a tough primary. She ran as a true progressive. The two senators of Vermont were against each other Bernie Sanders backed balance and pat Leahy back the Molly gray her opponent. So we'll have a clear advantage over the demo of the Republican nominee Vermont is still a very democratic leading state and he, as you say, could make history in the first woman to be elected to Congress, House or Senate in Vermont. And its campaign 2022 on WTO this evening's primary elections in Wisconsin, Minnesota, Connecticut and Vermont come one day after former president Trump's Mar-a-Lago Florida home was searched by the FBI. It sent some Republican strategists scrambling, especially those with a Trump endorsement tonight, some of the election results could be a clear indication of the former president's hold. Joining us live on Skype, political junkie podcast host Ken rudin, who is coordinated political coverage at ABC News and NPR, and Ken, let's begin in Wisconsin, construction company co owner, Tim Michaels, has Trump's endorsement in the governor's race, establishment Republicans, including Mike Pence and former governor Scott walker, have endorsed Rebecca clayfish, but it's important to point out that both candidates have said some things in denial of the 2020 election and Joe Biden's victory. That's absolutely right. A matter of fact, Wisconsin is like Arizona, the state we saw a week or so ago, which is also had a lot of Republicans running for office there that spent most of their campaign denying that the 2020 election resulted in a Joe Biden victory. So it's interesting that Tim Michaels has been endorsed by Donald Trump because clayfish, the former lieutenant governor, has also had questions about the 2020 vote. But whenever it is, Tony Evers is a democratic governor there. He has spent a long time a lot of his tenure blocking Republican efforts to rewrite election laws and he is a top Republican target. The battle between clayfish and Michaels thought to be very, very close. What's happening in the Wisconsin Senate race. Well, it was going to be a very interesting race Mandela Barnes, the lieutenant governor there was probably the favorite, but he had three democratic challenges. It just so happened that last month all three dropped out of the race and endorsed Barnes, Barnes is African American, as I said, he's lieutenant governor, and he's running against Ron Johnson, the Republican senator who may be the most vulnerable Republican in the Senate is a question whether Barnes is too liberal to win, and in Wisconsin, but again with Ron Johnson's numbers, always below sea level. This can be another key race if the Democrats are going to hold on to the Senate. In Minnesota, progressive democratic congresswoman Ilhan Omar is facing a challenger is there anything for her campaign to worry about? Well, there's always something to worry about because she has a lot of negatives and a lot of opponents around the country and in Minnesota, but she should win. I think the most interesting thing in Minnesota, there's a special election in the first district to replace Republican congressman who died of cancer back in February. This Republican candidate Brad finsta, he could very well win the special election today, but lose the primary at the same time. So, you know, the long congressional career of Brad finstad may only last a couple of months. And now asking you to do the impossible in our remaining few seconds, what else is kind of on your radar in Connecticut and Vermont? Well, from a not too much to talk about in Connecticut, but if we only have a few seconds, I would focus on for a month. Of course, Peter Welch is a congressman is running for pat Leahy's Senate seat. He's giving up, but the battle to replace Peter Welch in the house is between a woman whose backed by Bernie Sanders and a more moderate woman backed by pat Leahy for a month has never elected a woman to the house or a Senate. We've established relationships with organizations and entities that are potentially flying or developing platforms, and our goal is to continue, he said. We have a process to de conflict activities to ensure that we are not potentially reporting on something that may be a development platform. Certainly, it seems logical that if the military were both testing new technology and sending aviators up for routine surveillance and training flights, it would make sure to keep them out of each other's way, but while there haven't been any collisions between UAPs and pilots, there have been at least 11 near misses bray said. He was saying it was gonna be rigged. He lost, he claimed he lost because of this rig. Aziz really incited all these folks to do this? But I thought at the end of the day, there'd be security around the capital in that contentious is the debate would be we would have to debate We decide the question and we certify the election. Joe Biden, Thomas Harris in that remains our task. We have to do that. But it is a stunning, stunning event that you'd only see in in in South American capitals in the oldest. Where lives on the outside, incited by our comp elected officials, Donald Trump actually stormed the capital reached it. And engage in violent activity. Trump says will 'strongly consider' testifying in impeachment probe - but would it ever happen?
"Back to the daily DC. The Impeachment Watch I am Zach Wolf. Alex Marquardt is still with me. And we're pleased to welcome CNN. Legal analyst Michael Zeldin. Thanks for joining us. Michael my my pleasure to things kind of interesting happened this morning number one Responding to Nancy Pelosi from over the weekend Donald Trump president trump suggests that he could be Willing to testify or at least to give written testimony to the impeachment inquiry. He said essentially to move it along so the Democrats could get something done for the country. That's thing thing one thing too. Is the house. Democrats made clear that they're investigating now. Donald Donald Trump and whether he Lied to Congress essentially As part of the Mueller investigation when he offered written testimony or answered questions wins in writing for Robert. Muller in this part of They're a lawsuit to get hold of grand jury Documents and testimony any from the Muller investigation this now ties into the impeachment investigation. It's all meshing together but these two things about Donald Trump and testifying before Congress which would be pretty much unprecedented I think And number two This idea that he may have said something that was incorrect about wikileaks. Not Leaks and what he knew to Robert Muller what is going on with those two things in your mind so the first thing that comes to mind is my expectation of his qualified offer. Potentially offer written testimony was not something that he cleared with his lawyers and that his lawyers are going to be saying. Excuse me but we don't want to do that. Thank you Mr President. Well he didn't say he was GONNA do it. He said he he's thinking about exactly but I expect he's thinking about it without having first consulted Laura's because I don't think his lawyers lawyers would want him to be offering written testimony so I think that's more of a sort of a hypothetical offer than it is a real offer second second with respect to muller the the question and answer that has been raised as a possibility that the president offered false testimony before before Muller in his written statements relate to whether or not he recalled conversations between himself and members of his campaign who themselves may have. I've been interfacing with Ricky wikileaks or whether he had any direct contact with a representative of what of wikileaks. And the thing. I forgot to mention this. Roger Stone found guilty on Friday essentially of trying to sabotage congressional investigation With regard to to wikileaks right so so the lawyer in me says says if the question is asked did you have any contact with a representative of wikileaks. He can answer no to that. Because none of the people who allege allegedly told him anything about wikileaks I would definitely meet the term representative of wikileaks. If he had spoken he would have spoken to. Julian assange essentially For that question to be ally The way he answered now with requests with respect to the question of whether or not his failure to recall whether he had conversations with anyone on his campaign. Am Pain regulated. He he didn't say no he said I don't recall talking to anybody. Don't recall is what his answer was. And that's a smart legal answer and expectation Asian. Is that the documentation that was presented by the White House to Muller contains no indication that the president spoke to anybody on his campaign about wikileaks leaks and so he has the opportunity to come back and say well. Now you've refresh my recollection. Yes indeed I remember speaking to Roger Stone in the car and it was overheard by whomever so I think it's a very difficult prosecution to make. However the appearance that the president is unaware of his interest his own interest which he on on the campaign trail repeatedly touted wikileaks? I love wikileaks. We Russia if you're hearing me. Please release her emails. All is wikileaks. centric in a sense. It's SORTA strains credulity to that. He didn't remember this stuff. But as I said when you ask a lawyer whether or not. This is actionable as a law case case I think it's probably not what about this Offer so to speak that he would be willing to testify in Congress in the impeachment inquiry which actually got a laugh last week During one of the hearings when when Peter Welsh Congressman Walter Democrat brought it up and say you'd be most welcome to sit down is is that another one of these. Is the president just floating something for the sake of it. That almost certainly won't happen. What my recollection of that QNA was the Republicans skins. Were saying the person who has firsthand knowledge the whistle blower a person who they first accused of having only secondhand knowledge but now all of a sudden he has firsthand knowledge. They said the person that we want to hear most from whistle blower because he knows the most and then well said well actually the person who knows the most is the president and he's welcome here anytime he wants. And that's what the left in my expectation. Is that the the likelihood of the president showing up in person raising his right hand to swear to tell the truth before that committee Mitty is not likely. So you've told us about the importance in lawyering Somebody like president trump to give wiggle room in testimony. I don't recall Paul as opposed to I don't or as opposed to know We have somebody we have a real life example coming up with Gordon. Sunland who actually didn't recall recall Some very important things with regard to the impeachment inquiry he had his memory jogged at least one time and then subsequent to that we found out new information mation that About his call. You know the very loud telephone call in the Ukraine Ukrainian restaurant with President trump. So I I guess the question is. Is Somebody like that that in more legal jeopardy or in some sort of legal jeopardy for his the the way he addressed Congress and then had completely changed his story about whether or not there was some sort of ultimatum to the Koreans for military aid. Right so Saad. Lynn says I don't recall then. Other witnesses testified to his direct direct involvement in the thing that he didn't recall and then he corrects the record. And says that refresh my recollection. I now recall. And my testimony is consistent consistent with those others in respect of the homes. Telephone call that was overheard the alcs talked about. He was not really directly asked. That question didn't exactly Give a denial of of that call so he too has room now when he testifies again to elaborate on his prior testimony which I expect that he will do. I expect that he is not gonNa have memory failures like he did in the closed door testimony too much each other evidence out there which links him to this information that if he were to not recall under those circumstances it probably would be seen as a false statement achievement and you can falsely testify before Congress by inaccurately describing your memory as as being faulting so so just to wrap this up for everybody If in in congressional testimony don't say no and if you absolutely can avoid it I don't recall is a lot better. Because it's really hard to prosecute somebody for lying if they said I don't know because your memory can always be shocked. Yes with the qualification. In that there are prosecutions where individuals have said incredulously. They don't recall and that they were the prosecutors. Were able then and to present evidence to say that I don't recall was actually ally and you cannot therefore say with confidence. Just keep saying I don't recall I don't recall and you off the hook because at one point you're alleged failure of recollection is GonNa be tantamount to an affirmatively.
