Defacement or damage in remember. I brought this up last last friday. Dana i'm not so much worried that they're going to just fake some counts. I think they're going to try to damage or alter these ballot absolutely and company workers have been spotted examining ballots with blue pens in their hands. There are only allowed to use red pens arizona's elections procedural manual states that anyone involved in a ballot recount cannot use pens with blue or black ink. Which can be read by a ballot tabulating machine and could be used to change ballots or render them unreadable. You think republicans would be used to using reading not blue and kenny way. Katie hobbs folks are we'll see something and report it and get an injunction put on this farcical exercise or maybe the department of justice will but we'll keep you knew that the department of justice was going to have to start fighting ninjas but here we are people here we are this next story. Prosecutors are asking a judge to give derek chauvin a more severe penalty than state guidelines. Call for when. He's sentenced in june. For george floyd death arguing in court documents filed friday that flowed particularly vulnerable and that chauvin abused his authority as a police officer. Now defense attorney eric nelson. He posed a tougher sentence saying the state has failed to prove that those aggravated factors among others exist to win. Show arrested floyd on may twenty fifth. I think he means murdered. But whatever even though chauvin was found guilty of three counts under minnesota statutes. He'll only be sentenced on the most serious one. That's the second degree murder charge now by that count carries a maximum sentence of forty years experts. Say he won't get that much. And i think we all know that that's probably true. Prosecutors did not specify how much time they would seek for chauvin now under minnesota's sentencing guidelines the presumptive sentence for second degree unintentional. For someone who doesn't have a criminal record like chauvin would be twelve and a half years so judges can sentence someone as little as ten years and eight months or as much as fifteen years and still be within the advisory guideline range so to go above that judge. Peter kay hell would have to find that there were quote aggravated factors and even if those are found legal. Experts said chauvin would likely not face more than thirty years now legal briefs friday prosecutors said show and should be sentenced above the guideline range because floyd was particularly vulnerable with his hands cuffed behind his back and he was faced down the ground and that he was intoxicated. Now they noted. The chauvin held his position. Even after floyd became unresponsive and officers knew he had no pulse. Prosecutors also said chauvin treated floyd with particular cruelty during the lengthy restraint sing chauvin inflicted gratuitous pain and cost psychological distress to floyd and to by standards. So we'll keep you posted on this. We'll see how the sentencing turns out. I believe in in june right. Early june Yeah and i think it's of particular importance. The distress caused to the bystanders. We saw them all testify there. I mean they all witnessed dot trauma. And and that's one of those aggravating factors. we'll see if they specifically ommander supplement this filing to request a specific amount of years. But you know right now as it stands with no aggravating factors like you said twelve to fifteen years with. They don't expect it to go above thirty but thirty would be more than twice the minimum sentence so you we'll see what happens and from the washington post the controversy surrounding the embattled representative matt gaetz. That's so nice of them to refer to him as the embattled rep matt gaetz took a wild new. Turn thursday night because this. This story doesn't already have enough. Wild new turns the daily beast reported. That joel greenberg wrote a confession letter. Implicating both of them having sex with a seventeen year old girl and perhaps not hugely surprising roger. Stone suddenly involved. Now i wanna say washington post they roger stone's suddenly involved but he's he's already been involved because involved. Yeah if you if you remember Matt gaetz made a payment to drake ventures for five grand the day after the story broke but but now roger stone is involved even further back because the daily beast obtained alleged drafts of the confession. Letter that greenberg wrote and text messages between greenberg and stone indicating it was all part of a plan to obtain a pardon for greenberg from trump and greenberg stone also reportedly discussed green pinkston. Two hundred and fifty thousand dollars in cryptocurrency because of course if the pardon effort was successful which it was not the post has not obtained or verified materials in the daily beast report so no one else has seen this letter besides the daily beast but getting to the logical question..

A black woman said something the other white guy going. I know she did. Can you believe it. You might where just because a black woman out. I mean that that was that conversation grounds repeal. No that is not grounds for mistrial. But they're good troy. And i think one of the things that people have to steal themselves for is that even if we have a conviction in this trial which is not something. I'm counting on but hoping for but even if we have a commission in this trial it's not going to end their the. The first thing that happens is that the the nelson is gonna move for mistrial and moved to have the judge. set it aside As a matter of law. I don't think. Peter kay hell who has not covered the judge. I do not think he has covered himself in glory in his administration of this trial. But i do not think he wants to be ground zero for white supremacy by setting aside the verdict but absolutely they will appeal. The chauvin people will appeal this to the spirit records and minnesota trying to get this case turned turned over Sorry overturned yes. They're going to use. They're gonna use whatever they can use to try to argue for a mistrial to argued for an error in law in convicting and convicting up for murder. If that impact happens so this is not gonna. This is not gonna end. As frederick douglass might say power concedes nothing without demand and in this case white cops will not will not accept just as they will fight and fight and fight to the last to escape accountability. His campaign seems to have recognized that they actually issued a statement last night saying quote. He was just warming up fully. Expect Mike to continue to build on tonight's performance when he appears at the next debate but he didn't seem to command the stage or vault over the charges to to Present his own biography and vision and they're worse some tough exchanges between Sanders and Bloomberg. Here is one of them. Well we have so. Many people go to work every day and they feel good about their jobs they feel like cogs in a machine. I want work is to be able to sit on corporate boards as well so they can have some say over what happens to their lives. They have a large company. Would you support senator? Sanders is proposing absolutely not. I can't think of a ways that would make it easier for Donald Trump to get reelected and listening to this conversation so if that was the general election that would be pretty strong argument but this is a Democratic primary and when it came to closing arguments which are the chance for candidates to give thirty second version of their vision. Mike Bloomberg's was pretty technocratic. He said the country needs a good manager who can build a team with experience and credibility. He didn't give his biography or a big vision or an agenda. What about Bernie Sanders? I mean he's enjoying kind of a cushy lead right now does he benefit when all the other candidates kind of pile on Bloomberg yes certainly does. He had a good night because the debate didn't seem to have been a game changer. There were some moments where he got flustered and looked thin skinned when Bloomberg needled him but for the most part it was a circular firing squad of candidates going after each other and one of the undercard fights was amy Klobuchar versus to judge who clearly cannot stand each other. All they spend precious minutes going after each other instead of uniting as centrists against Sanders and for those centre-left Democrats who are fighting for reelection and competitive districts and states. Who were hoping to have someone at the top of the ticket that can help them. In their opinion it's not sanders. They certainly didn't get anything out of last night's debate so yes. Sanders comes out with his front runner status not seriously challenged after the first time he stood next to the only other candidate with the resources to go against just briefly on Elizabeth. Warren I mean she she. She needed a strong performance her last debate. She didn't really get a lot of speaking time. That changed last night. But what is her path right now. Well I don't know what her path is but she said that she had her biggest fundraising night last night remember. She ran in Iowa and New Hampshire as a unity candidate. In that failed she went back to being a fighter against pretty much everyone else. She along with Biden and club and Buddha judge. Still looking for a breakout moment. They clearly don't think the time is ripe yet to unite around a centre-left alternative to sanders. Sorry NPR's Mara Liasson. Thanks Mara. Thank you president. Trump's longtime friend Roger Stone will be sentenced today. Unless there's remember the build up to this day and all of the controversy president trump weighed in saying that Roger. Stone's should get a more lenient sentence than the Justice Department revised. Its sentencing guidance. In this case and the entire prosecution team quit in protest the remorse tweets from the president. There were questions about attorney. General William Bars independence and finally bar does a TV interview and says the President's tweets make it impossible for him to do his job and since then more than two thousand former Justice Department officials have called on the Attorney General to resign. Npr Justice correspondent. Ryan Lucas in studio heroin. Are there all right? So all of this back and forth about the sentencing of Roger Stone in the end though it all comes down to the judge right. It is her call to make the decision on how much time stone spent behind bars is up to judge. Amy Berman Jackson and she'll take a look at a whole range of things to make her call on stone sentence. Only one of those factors is the sentencing recommendation from the government. That has been the source of so much controversy over this past week. The Justice Department attorneys who prosecuted the case recommended seven to nine years as David referenced. The attorney general overruled them to ask for a lighter sentence although the department deferred to the judge on how long that should be but long story short. Yes the call here is the judges remind us what Roger Stone was convicted of so the case against own is actually part of the Russia investigation. It was brought by special counsel Robert. Muller last year stone was indicted on seven counts. Obstruction witness tampering in line to Congress and in November a federal jury here in DC. Found him guilty on all seven counts the charges taback into stones efforts during the twenty sixteen campaign to get in touch with wikileaks about the thousands of democratic emails that had had ultimately released during the race. The case against stone fun fact was the last individual he was the last individual charged as part of Muller's investigation. So the president has tried to make this personal as he often does. He's attacked Judge Jackson on twitter. You've done a lot of reporting on her. What have you learned about her experience? That could inform how she's can approach the decision today. Well I've spent hours in the courtroom with her. She's handled several of the cases including Paul Manafort's case here in DC These are extremely high profile cases. And she's handled them with a pretty patient in steady hand. I have also spoken to a number of people who either know her or have tried cases in front of her. They say that she's very smart. She's well prepared in very much in command of her courtroom and they told me that she won't be intimidated. She will be transparent in her thinking and make her decision on stone. Sentencing based on the facts of the case and the law. So Jesse Jackson gives her decision today and then what Roger Stone goes to prison. That's it that's normally how this would work. Yes but of course. There's been speculation for a long time since stone was actually indicted whether the president would ultimately pardon him. Trump has certainly made clear that he thinks that stones good guy and that he's gotten a wrong deal and been horribly mistreated. The president's feelings about the Muller Investigation Writ. Large are certainly clear. He feels that it's been a witch-hunt trump has been asked repeatedly about whether he would pardon stone he hasn't said yes but he pointedly also has not ruled out. Said no all right. Npr's Ryan Lucas for us. Thanks we appreciate it with like you. all right. We're going to turn to Germany now because there's been a mass shooting in the town of Hanau eleven people are dead including the suspected shooter. German media reports that an online video and a written confession linked to the suspect indicate that he may have had a far right motive. The turtle to these media reports. There's this confession and the suspect rights that certain races need to be eliminated Germany's prosecutor's office has reportedly taken charge of this investigation and they will be holding a news conference later today. German police said they found the suspected shooter. Dead at his home address. Me also found a second person that they're all right from Berlin we've got NPR's Rob Schmitz on the line. Good Morning Rob. Good Morning Rachel. All right so this just happened last night. Obviously details are still sketchy. But what can you tell us right now? Well we know that last night at around ten o'clock a gunman opened fire at a hookah bar and then at another one in the city of Hano outside Frankfurt. He killed at least nine people and injured several others clientele. Both bars are predominantly Turkish and Kurdish Germans in after the shootings. I suspect then returned to his apartment. And that's where police found his body and the body of his seventy two year old mother. Police believe the suspect is a forty three year. Old German citizen a resident of Hanno authorities in the German state of Hesse say they're investigating the crime as a probable right wing extremist terror attack the Interior Minister of the state of Hesse. Peter Boyd Hell. Those short press conference this morning about the shooting. Here's what he said voids however flood him under non go up. He's saying here that flakes throughout the country will fly at half-mast today and that his deepest sympathies are with the families of the victims. Any wishes the injured survivors. Quick and full recovery. So what can you tell us rob about these reports from German media and there was this letter that the suspected shooter left behind and some kind of video. Yes thirties having confirmed this yet but several German media outlets reporting that police found a written confession at the suspect's home in which he wrote that certain races needs to be eliminated. They're also reporting that he left a video indicating he was a racist and head right wing extremist views. I mean obviously. Germany has been trying to manage far right-wing expression for generations. But it's gotten worse in the last few years hasn't it? Yeah Right. Wing extremism here in Germany has been on the rise since twenty fifteen when chancellor. Angela Merkel made the difficult decision to allow hundreds of thousands of migrants from war torn countries in the Middle East and North Africa to find refuge here after that there were a string of terrorist attacks by Islamic extremists and that was followed by terror attacks by right wing extremists. According to government data the number of right wing extremists here in Germany has risen by a third last year alone. German intelligence now suspects there are more than thirty two thousand of them in half are considered potentially violent with a high affinity for firearms in. This attack comes after another shooting in Berlin four days ago and it comes four months after right wing. Extremists shot and killed while trying to attack a synagogue. In the city of I just briefly is a German government. Authorities trying to approach this problem in a different way. Well Gun laws. In Germany are among the most stringent in the world. And the government. Right now is planning an overhaul of its domestic intelligence and law enforcement agencies in an effort to crack down on Roy extremism. So we'll we'll see more about this in the coming months. Alright Rob Schmitz international correspondent in Berlin. Rob We appreciate your reporting on this.
