by Bloomberg powered by twenty seven hundred journalists and analysts in more than one hundred twenty countries in Hong Kong I'm Brian Curtis this is Bloomberg this is Bloomberg all week June Grosso from Bloomberg radio copyright clash before the Supreme Court did state power against public access any dispute over whether the state of Georgia can copy right it's annotated legal code during oral arguments justice Neil Gorsuch pose the question at the heart of the issue why would we allow the official law enacted by the legislature approved equipment being approved by a judge in annotations as justice Ginsburg indicated why would we allow the official law to be hidden behind a paywall joining me is intellectual property litigator Terrence Ross a partner Kattan Yujin rose and then your case bearing the caption Georgia versus public resource org ink and involved in an administrative body within the state of Georgia government called the Georgia code revision commission and the Georgia code revision commission is tasked with collecting laws that the state legislature in Georgia passes and publishing them in some sort of organized way so this commission is the official publisher of the official code of Georgia annotated mailed support explain what it is and I paid it code in in most states and the federal government the law is published as it comes out of the legislative body it is simply organized within a code it's given section numbers and chapter or title numbers so that people can easily find what they need to refer to however in a handful of states such as Georgia there are annotated official codes and my aunt paid we mean yes the language of the law that was passed is there but in addition there will be some sort of commentary that immediately follows an applied to each section so for example you could say that this section of the law was passed by the state legislature in order to a man another section that previously existed it's almost like a historical footnote but if I can encompass enormous range of informational material and that becomes important here so what happens is that a public interest organization called public resource dot org went out and bought the into higher current official code of Georgia annotated many many volumes at a very significant cost thousands of dollars they then digitalized every page of the official code of Georgia annotated and they posted it on a website where they made it available for free to anyone who wanted to read the law of Georgia people say that your your coverage information was a little bit upset about this because they have a copyright in the official code of Georgia annotated and so they brought a copyright lawsuit against public resource org alleging infringement through the publication on mon of the entire code on the internet so it seems like they have a good clean what's the issue W. she was whether or not this Georgia code revision commission is an officer within the meaning of the Copyright Act such that he can actually owned a copy right in the official code of Georgia annotated and therefore be a plaintiff to enforce copyright against infringers and the eleventh circuit ruled that the Georgia code revision commission what is not the author of the official code of Georgia annotated and therefore could not take out copy writing it and could not bring a copyright infringement lawsuit against public resource dot org so in the decision could the justices make a distinction between the official law and the commentaries there is out there and which attempts have been made to copy right purely the statutory enactments without any commentary and those cases uniformly say that that's not allowed so the fact that this is an annotated code makes it different and which is why the Supreme Court accepted this case in order to land some clarity in this area has to that particular distinction yeah the court below in what I thought was one of the best opinions copyright case I've read in some time hi res Jerry yes it is judge markets who wrote the decision below wrote a decision that every American should read just quite simply it is both elegant and profound and goes to the nature of what we are all about as American judge markets says and I'm quoting here the people are the constructive authors of official legal promulgation of government that represent an exercise of sovereign authority and because they are the authors the people are the owners of these works meaning that the works are intrinsically public domain material and their full on copyrightable he was laying down a line in the sand that says I don't care what excuse you have four copy writing the law you can call it an annotated work a commentary on the work but you cannot take away the right of the people to unfettered access to the law it is a very very important decision one that carries great consequence beyond copyright and goes to the heart of the American experiment which is who owns the law who pulled completely is the sovereign authority and judge Marcus concludes that the people are the old farmer's not the legislature and certainly not the Georgia conservation commission and therefore this is not copyrightable coming up on June burned a long black beard **** at the Supreme Court this is.

"This is All Things Considered from NPR news and Michelle Martin now to Pensacola Florida where a gunman killed three people and wounded eight others at the Naval Air Station yesterday just outside the gates of the base olive Baptist church in for service member Nicole bodhi attended a prayer vigil she was on base when the shooting happened yesterday and spent the rest of the day and walked down inside her apartment she said this was the first time she's been out but felt she had to come there were some bags that it can happen anywhere and we're also service members so just about right to be here NPR's Greg Allen is in Pensacola and he is with us now great thanks so much for joining us you're welcome authorities have said that the shooting was done by a Saudi national a member of the Saudi airforce at the base for training have they sent any more than that well very little Michele the big question of course here is whether this was an act of terrorism and on that issue authorities won't say at this point some elected officials including a congressman and Florida senator Rick Scott say it is terrorism but have provided any details in the meantime troubling information has been emerging although very little has been confirmed yet by authorities one key detail involves a Twitter account that appears to belong to the gunman it talks broadly about American crimes against Muslims it was posted apparently just before the shooting occurred and later in the day Twitter suspended the account but that's all we know about that at this point so what can you tell us about the condition of the victims well today we learned the identity of one of those who was killed it's Josh what Caleb Watson is a recent graduate of the US Naval Academy he was at the Naval Air Station there for flight training his brother posted information on Facebook today on the post he said Josh will quote saved countless lives day with his own after being shot multiple times he made it outside and told the first response team where the shooter was in those details were invaluable and then what's his father spoke to the Pensacola news journal he said his son was taken to hospital didn't survive on arriving there at today's prayer vigil in here in Pensacola the chief deputy sheriff in Escambia county chip Sims had a few details and some of those wanted he talked about two sheriff's deputies and some of that he identified as a navy policemen were among those were wounded one deputy was treated and released the other officer in the navy police and he said we're doing well and in good spirits now he has a little more would have to say it shook us all it shakes the first responders six law enforcement they did gets there but we know this that that the training and the support that we get it from our community from this community from you guys is gonna is what's going to help Pensacola Escambia county get back to where we need to be a good tell us what we know about the investigation at this point well it's all being handled by the F. B. I. in there not known for being really free with details although as I say there's a lot of information that's being sourced by various news organizations but has not they've not confirm publicly today they released photos of personnel working the crime scene and collecting evidence they say they're focused on conducting additional interviews in a tweet today the FBI said members of the joint terrorism task force are part of the investigation that they have been determined the shooter's motivations so those are some what the F. B. I.'s and saying meanwhile reporters asked to defense secretary Marquez for about this he was at a conference about what he thinks whether terrorism is involved he says that he wouldn't say he says too early to say about that they said they are taking a look at how the U. S. government grants for nationals access to its military bases here in the US thanks that's in pairs Greg Allen and Pensacola Florida great thank you you're welcome.

"Pensacola Florida and welcome back to coast to coast are special tribute show to the great late rose merry Ellen godly it over about a year ago I had an opportunity to talk with her about the history of Christmas and angels and nobody talks about them better than she does so here we are just the season right there were Christmas right around the corner I can't believe it's next week let's talk about miracles angels and some customs and traditions first of all what have you discovered about some of the origins of things tied in the Christmas like the tree and Santa Claus white people send out cards what's going on here what are the way we observe Christmas really has an interesting history as we've blended a lot of things together over centuries to develop the customs that we have today and some of them come from pre Christian times that were absorbed into Christianity let's take the bait of Christmas for example in the Bible really doesn't say exactly when Jesus was born to how we come up with December twenty fifth is the date and it has a lot to do with the way Christianity absorbed pagan customs and festivities and an old religions there were a lot of festivals and celebrations around the end of December to celebrate the turning point and solstice where the days start becoming longer the sun is welcomed more and more in onto the earth and there were a lot of festivities along those lines and so the the early church fathers very early days of Christianity astutely I believe that if they had their own celebrations and festivities at about the same time it would be easy to absorb those interesting customs activities into the church it was that really more customary to celebrate things for a long time at new years instead of a Christmas gift giving festivities things like that and over time we've shifted our emphasis to December twenty fifth how long has that date been used as Christmas what was actually sat are quite some time ago centuries ago and as as a way of having an official calendar mark up for us to orient our religious observances on they even sell well into the Middle Ages and even tutor times Christmas remain one of the lesser celebrations at Easter far out weighed in importance and there were some other Christian holidays as well that I got a lot more emphasis so it's only been really since about the nineteen century.
