"Norfolk Southern CEO is set to testify before an Ohio Senate rail safety panel today. More than two months after a fiery train derailment rocked the village of east palestin. CEO Alan Shaw has promised millions of dollars to help the Ohio Pennsylvania border community recover. The company is facing lawsuits, including one from Ohio's attorney general over environmental cleanup costs. No one was hurt in the February 3rd derailment, but half of the nearly 5000 east Palestinian residents were evacuated for days. Many say they are suffering from health problems because of an intentional toxic chemical release which was conducted to prevent uncontrolled explosions after the derailment. I'm Julie Walker

The state of Ohio is suing rail company Norfolk Southern over last month's toxic train derailment in east Palestinian near the Pennsylvania border. The suit seeks to make sure Norfolk Southern pays for efforts to clean up and monitor the area's environment. No one was hurt by the derailment, physically heard at that moment, but locals are left with health concerns after responders intentionally burned toxic chemicals to prevent an uncontrolled explosion. Let's take you live tonight to CBS News correspondent Steve futterman to learn more here. What other details have you learned about the lawsuits to even and what they're seeking from Norfolk Southern? Well, they're seeking basically to make sure that Norfolk Southern is going to be responsible for all these ramifications you discuss the cleanup environmental protection. There's going to be lots of monitoring of water of the environment for many, many years, maybe even decades. They want to make sure that Norfolk Southern is responsible for paying for all this. So it's almost in some ways a protective lawsuit. Now, there's going to be many, many lawsuits that we are sure that it's going to be many civil lawsuits from people who live in east Palestinian in that area. But this is a very, very major lawsuit. The state of Ohio basically trying to get in and just to establish what the company is going to be responsible for. They even say in the lawsuit, they are unsure the extent of the damages. They are unsure how much money they're talking about. But they basically want the company on the hook for these costs, not just now, but in the years ahead. How is Norfolk Southern responding? They basically have not said anything pro or against the lawsuits right now. They have been if you've heard some of their CEOs, their officials there. They have been very responsive saying that they accept responsibility that they will pay for much of this. But again, in the lawsuit, they want specificity, the state of Ohio. They want it not just to be what Norfolk Southern is going to say. They want a legal sort of document to say, you're going to pay for this, this and this, and it doesn't matter what the costs are, or if there are limits on the cost, it would establish that they want some basic legal documents to make sure that the companies on the hook, not just the company saying we will do this. Now, I know that the people in charge, whether it be Norfolk Southern or even the government people that quickly swarm that area and got to work, say they've been testing the water they've been testing the air, but there are some allegations that maybe either the devices they're using are not as precise and maybe that environment is not as clean as officials say it is. Listen, if you live in an area where you've had an environmental problem like this, you are always a bit worried. It's not just fine. Tell me it's okay, but I'm not so sure it's okay. There's some hesitancy to accept someone saying yes, this water is fine. You are worried about it. So I think that's going to go on for some time. And again, that's why you have the monitoring that goes on for years. And like I said, sometimes decades when you have these environmental disasters in certain areas. Great to hear from you, Steve. Democrats seem to believe that solutions can only come from bureaucrats in Washington. House judiciary committee chair, Jim Jordan, who led the hearing in Yuma, Arizona. The GOP lawmaker says encounters of migrants at the southwest border have soared since President Biden has come into office. With the Yuma regional medical center, says his hospital has spent $26 million on uncompensated care for migrants. It is an unsustainable model to have a hospital like ours bear the entire burden of paying for migrant healthcare. The Biden administration says it continues to make reforms to address the situation, but Republicans say they fall woefully short. On Capitol Hill, Mitchell Miller WTO. Two 35. D.C. mayor muriel Bowser and attorney general Brian Schwab are now asking this week the U.S. Senate to vote no on a bill that would block changes to D.C.'s criminal code. In a letter sent to Senate leaders recently, Bowser says it's an insult. She thinks that D.C. laws be subject to review and oversight by officials not elected by D.C. residents. Bowser herself has issues with some revisions in the criminal code, especially when it comes to reducing penalties for some gun crimes. She has introduced a new bill amending that aspect of the criminal code swab since a separate letter we're told to send it majority leader Chuck Schumer asking him that the Senate respect the district's right to self governance. The House passed disapproval legislation on D.C.'s criminal code. The Senate has until March 7th now to take action on that legislation. There is a new development Friday morning of the special counsel investigation into the January 6th attack on the capitol. CBS evening news anchored, or O'Donnell, Friday morning. CBS News is first to report that federal prosecutors have asked a federal judge to compel former vice president Mike Pence to testify in that investigation. Lawyers for former president Trump are trying to block pence's testimony, arguing that private conversations with the president should remain confidential. Federal judge, on another case, ordering that former president Donald Trump and FBI director Christopher wray provide depositions, it'll also brought by two former FBI employees. Now, in this suit, former FBI agent, Peter strog and former FBI agent Lisa page, both argue, they were unfairly targeted because they were investigating the former president's ties to Russia during the 2016 election. The hill reports this week that the judge in the case is requesting a two hour deposition from both mister Trump and mister ray. Now, of course, president Joe Biden can intervene at any time by making executive privilege claims over any aspect of the testimony. Stay tuned. At two 37. So he wasn't able to really address the container and the ship controversies, any of late has not been able to address this catastrophe that has happened in east Palestine, Ohio. And it is horrible. As a matter of fact, it's impacting not just the people in east Palestinian and along the Ohio Pennsylvania border. But this is an environmental disaster. That could impact everyone from Tennessee all the way to western New York. And booty judge is nowhere to be found. As a matter of fact, booty judge was asked about this yesterday, but instead he is more focused on another pressing issue. Now keep in mind it was booty judge who told all of us that one of the greatest threats to democracy was the nation's racist highway system. You might remember that. We've been talking about it for quite some time. But I had no idea there was another big problem. Apparently, there are far too many people of the Caucasian Caucasian persuasion working in transportation jobs, cut number 6. To work with your contractors to work with your community colleges on building a workforce that reflects the community. We have heard way too many stories from generations past of infrastructure where you got a neighborhood, often a neighborhood of color that finally sees the project come to them, but everyone in the hard hats on that project looking like doing the good paying jobs. Don't look like they came from anywhere near the neighborhood. Right. You can build community wealth that will help close wealth gaps in this country. If we can tear down those barriers, but that happens at the delivery level. All right, so there you go.

New this afternoon, a federal judge in Florida will appoint a special master to examine that cache of White House documents seized from former president Donald Trump's Mar-a-Lago home. U.S. district judge Eileen cannon said part of her reasoning for the master is in her words, ensuring the integrity of an orderly process amidst swirling allegations of bias and media leaks. Let's dig in with CBS congressional correspondent Scott mcfarlane. Hey Scott, thanks for being with us this Labor Day. Hey, Hillary. So this is a clearly a blow to the Justice Department. But the judge says the former president has already been stigmatized by all of this. Can you fill in some more details on her decision? The bottom line is this. We all got to get comfortable because this investigation and this story is going to be around a while. The judge has done here and said that a special master independent third party should be approved, should be ordered to go through the items seized at Mar-a-Lago, August 8th, to check for the things the Trump team says that it should be checked for possible executive privilege. And in the meantime, the Justice Department is not to use these records as part of an investigation until the special master process is complete. I think you can measure the time frame here by weeks or months, not by hours or days. They have, through this court order, are the Trump team successfully slowed down in investigation and certainly slowed down the process. Does the Justice Department have any recourse here or they've just got to sit tight? They're not saying if they're going to appeal, but certainly they could appeal and try to get this overturned. They may argue this is dangerous precedent. We have Donald Trump's peculiarities of this case aside. This is a federal judge citing the possibility of executive privilege, even though the Biden administration does not invoke executive privilege. There are some larger scale legal issues at play here beyond just Mar-a-Lago just beyond those boxes. But this is a striking ruling, not just in its timing, coming out on Labor Day, but the potential for really slowing down an investigation and putting a difficult hurdle in front of the Justice Department. And when do does each side have to submit their preferred person, a special master? Yeah, they'll have to have some type of meeting of the minds as to who the candidates would be for this. The judges said a deadline of Friday for that. So they'll have a few days to go over it. If past is prologue, or special masters tend to be law school professors, former federal judges, legal scholars, dispassionate parties, not tethered to any side of a dispute, but parties that are smart enough and experienced enough to know how to navigate complex cases and complex issues, this is certainly one of them. Traffic alright in some parts of the area, turning out to be an active afternoon in the Weather Department. Let's get more now from storm team for meteorologist Mike Standiford. And good afternoon Mike. A flood warning continues for South eastern Fairfax County, the city of Alexandria until 7 45 this evening. This area hit hard by flooding over the last couple of days is not going to take much for areas to flood once again, stunting for radar showing nearly stationary thunderstorm stretching from near Beltsville. Where, uh, the Beltway comes into 95, then a broken line right across the district along I 95 3 95. Then south along I 95 all the way down to a quiet harbor and down to the Stafford area, and these cells are basically not moving at all. So flash flooding is going to be an issue as we go over the next several hours, another nearly stationary storm over far northern Frederick County in Maryland, near the Pennsylvania border, and more cells are popping up along the eastern front of the Blue Ridge. So our forecast for the rest of the afternoon scattered showers and thunderstorms. These will be slow movers. The ground is saturated so heavy rain may lead to flash flooding and the atmosphere is a bit unstable, so some storms could be severe. The means that will be wind damage or has been the eighties to lower nineties. More showers and a few thunderstorms tonight.
