"On Friday US Supreme Court. Justice Ruth Bader Ginsburg died of cancer at the age of eighty seven. A candlelit vigil was held the following day outside the Supreme Court. Justice. GINSBURG was only the second woman appointed to the Supreme Court after being nominated by Bill Clinton in one thousand, nine hundred. I. In. Solemnly swear he was a champion of women's rights, and later in life she achieved restore status especially among young women. Now her death has set the stage for a divisive battle to replace her on the court. She was born in Brooklyn to an immigrant Father Dad was from Odessa in in Russia and to a first generation mother she was Jewish John. Fascination is the economist Washington correspondent and she was a trailblazer throughout her life. She was one of only nine women among five hundred men at Harvard law school, and when she arrived. GINSBURG was not like that she spoke very slowly very deliberately, which mirrors I think how she wrote and how she argued and how she thought she was meticulous. She was precise she she was not a showy justice. She came onto the court actually considered a moderate. There are a lot of people on the left who were upset when she was appointed because she was considered sort of two centrist. But as the court steadily moved rightward during her tenure, she has found herself the de facto leader of the courts liberal wing. Junk she spent a long time on the court. What did she achieve? Well, she was on the Supreme Court for Twenty seven years, and before that was on the DC Circuit Court of Appeals, which is widely considered the second most important court in America for for thirteen. So she was a judge for forty years I was age sixty when I was nominated in some people thought I was. Too Old for the job. Now I'm into my twenty-seventh starting my twenty-seventh year on the courts on one of the longest tenured. Justices. So if you worried about my age. It was unnecessary. Before that, she argued six cases before the Supreme Court and she was involved with thirty more as the first director of the US women's rights project. The first of those report court cases was in Reid versus Reid for which she wrote a brief arguing against the law in Ohio that preferred men to women in naming executive estates. She won that case in her first oral argument before the Supreme Court. She argued against the military policy that denied many husbands, officers, the same housing and medical benefits that automatically provided officers. Wise. The thinking was that women are somehow inherently more dependent on their husbands and husbands on their wise. Now, in that case, remember she effectively represented the husband she represented family but she represented the shoes argue in favor of the husband's benefits and she austin said that she was not arguing for women's rights she was arguing for the constitutional equality of men and women. Her death is come at a critical time in American politics. It's just six weeks away from the election. So what impact does that have? Well I think it's a little too early to say that definitively. It looks as though both sides are gearing up for battle, but they seem to be quietly circling each other in two thousand sixteen. The Supreme Court is central to Donald Trump's success I think because. There is an open seat in two thousand, Sixteen Justice Antonin Scalia died, and Mitch McConnell who is then the Senate minority leader rather than hold a hearing on Barack Obama's chosen replacement for Justice Scalia whose Merrick Garland he came up with a rationale disguises the principle which was that the causing election was coming up the speech beheld open. So the voters could decide now that had never been done before it was clearly a power play. It was a live sort of issue for Republicans impelled I think a lot of them who otherwise would have held donald trump at arm's length to decide that just had to vote for him this time I. Think Donald Trump is hoping for a similar effect this time, but he also wants to get the filled as quickly as possible. For Democrats donations had started pouring in, they have been pouring all weekend. Democrats seem riled up by this. I think in their view if Donald Trump managed to get a successor onto the court, this'll be the seconds effectively stolen seat right? The I was Neil Gorsuch. who was given the seat that was held open by Mitch McConnell, and the second would be whoever donald trump nominees to replace justice GINSBURG who gets the seat because Mitch McConnell did not follow the principle he set up in two thousand sixteen. John Do you think Senate. Republicans have the numbers to they have the votes to get in trump's nominee through before the election. Well this is the question on everyone's mind. Right so far Susan Collins and Lisa Murkowski Republican senators from from Maine Alaska, had said that they will not vote for replacement before November third they have said that the president who wins on November third you choose the replacement now that only gets Democrats to forty nine and they need fifty one because in the case of a tie Mike. Pence cast the tiebreaking vote Lindsey Graham had previously said he would abide by Mitch McConnell's rule from twenty sixteen. He has now gone back on that apparently because he's angry Democrats didn't roll over for Brad Cavanaugh Chuck. Grassley, who's a senator from Iowa has also previously spoken in favor of McConnell's precedent. I, have a very hard time imagining that when push comes to shove, he'll stand by his. Word and so there really is nothing Democrats can do unless they can persuade two other Republicans to come join them, and if they can't persuade those Republicans and tip the balance what happens. Then what are the consequences for the years ahead on American politics? It's clear that what McConnell did in two thousand sixteen was a tremendous violation of norms I think it's not a good principal to. Uphold I think arguing that this is now how Supreme Court seats should be awarded that in an election year, you effectively have to hold the seat open until the end of the election is a bad precedent but I think there's a difference between saying Republicans should be consistent for the sake of consistency and Republicans should follow this principle because that's how court seat should be given out now. From the Democratic Base, there's been a tremendous push to threaten Republicans with repercussions if. Retake. The Senate and the president in that includes making Puerto Rico in Washington DC states, which would effectively at least in the near in medium-term Give Democrats four senators people have also been talking about expanding the court. So the reason they are Nice Ring Court justices is not constitutional legal. It's just a statute. So if they were minded and had a majority had a president who would sign it into law, they put eleven or thirteen justices on the supreme court. The problem with that for Democrats I think is that it sort of shifts the terms. Of the debate that they are now winning I think the way Joe, Biden has pitched. This campaign is on the one hand. You have the sort of chaotic destructive Donald Trump on the other. You have Joe Biden Palm known figure who will get us back to normal. If, he comes out and endorses expanding the court or State of DC in Puerto Rico, which to be clear he has not done. He is actually a opposed expanded from court but if he comes out if Democrats threaten this, then the debate becomes a lot murkier. Then it becomes the radical change that Joe Biden wants to do right take fifty, two states and putting thirteen on Supreme Court against Donald Trump will keep things as are I think that debate does not play out very well for Democrats. I think to start though just wanted to take a step back and talk about his role in the trump administration his relationship and ship with the president sort of the the state of that in our understanding of that was I remember this partnership in Twenty Sixteen when When they teamed up just before the Republican convention it seemed like a bit of an odd pairing A couple years later a couple years into the trump administration what do we know about Mike. Pence's relationship with Donald Trump. Right now he was so I heard those twelve years in Congress from two thousand to two thousand twelve. He then went on to become the governor of Indiana. You know he's the old classic Nick Christian Conservative from Columbus Indiana Place. A forty thousand people a true hoosier and so when he suddenly was elevated to be Donald Trump's running mate he was shot onto the scene. I was actually. It was the night that he was. Selected is on trump's running mate in its first interview. It was with Sean Hannity and I've looked back at this moment a lot over the last three years. He Sean Hannity asked him said how will you disagree with President Trump. And what does that look like. What are you doing you disagree well? Well I've been in positions before like that. I served in the leadership of the Congress. A shut the door you tell the boss exactly what you think but when the door opens the job of the vice president is stand right next to the president and implement the policy that he's decided and over the course of the three years you've seen pretty much do just that do we have a sense. How how trump trump regards him? You know there's been talk over the time Ray would would. He looked to replace Mike Pence. But every step of the way pence has been in lockstep walking that very tight tight-wire and essentially always defending the president when you're looking at trump. He is not spoken about word about pence. And if you look across administration there's not many. They have made it this far and pence new getting into this that he was going to have to do that in order to stick around and it looks like he's in it and He's prepared to do whatever it takes to stay a part heard of it. What is pence is relationship with Republican leaders on Capitol Hill? Like has he been a conduit for them to the administration Has the nature of that changed now that he's a loyal partner of trump to. What's what's his reputation there? This is what it was during the two thousand sixteen campaign when there are a lot of hesitant Republican officials. It was Mike Pence. The one that was going and massaging those relationships he was the one that was carrying on the fundraisers. He did it. During the midterms he was the one that largely went out from Congressional District District Congressional district fundraising and campaigning on behalf of Conservative lawmakers. He has been the one that is continued to be sort of that. That quiet quiet voice to help that relationship between the White House and still a Republican Party. That is still obviously grappling with how it's GONNA handle itself into the future. So let's talk about pence in Ukraine pence in this Ukraine investigation He enters the picture on this as I understand it. Maybe you can you can flesh this out back in in May is that right amazed. Alinsky is supposed to be sworn in pence is supposed to play a role. Exactly we should note. The vice president has not answered a slew of these questions directly. And we're still trying to figure out but it was. It was in May was the inauguration of Zalewski in the initial plan was to have vice president pence. Go to that inauguration ultimately what we do know is that he never went there. The question is did the president or anybody around the president directly requests. VP or to his office that he not attend inauguration inauguration. I think this is the larger Mike Pence Story. To what extent is it willful ignorance or complicity. And when I say willful ignorance de eh the vice president ever ask the administration. Why am I not going to this? Inauguration now we don't have that answer yet and Or did the vice president's office just sake the administration's word and not attend rick. Perry the energy secretary ultimately went in his place. There's testimony this week from pence aid from Jennifer Jennifer Williams. She was on the July twenty fifth. Call Trump insulin ski that famous July. Twenty fifth call Pence himself wasn't do we. We know if she told him about that call. He found out anything about She comes from the Foreign Service background. She is somebody who is not a political figure in. She was one of those two individuals that was on that Dylan call from the vice president's office and that call is important in what Jennifer Williams knows because ultimately it was on September timber. I that Vice President Pence went and had his own meeting with Celeski in so the question is did vice. President pence ever read the transcript that July twenty fifth phone call between Trump Dolinsky in which president trump urged investigations into the DNC supposed DNC server. In the Biden's they did Williams ever brief the vice president of the United States about President Trump's words. That is what we're looking to understand as to what Jennifer Williams knows right. So that's that seems like a key question We've all read the transcript or the summary of the transcripts that the that is out there. But you're you're talking about this period read between the phone call and the start of September in the transcript at that point is not publicly available. Nobody knew about it. The question of whether pence had read it in period. I asked him about that. What's what's his response? been like Mr Vice President. Did you read trump's twenty fifth meeting Mr Vice-president. It'd be great to talk with you Mr vice-president I asked him this exact question here. Because this was originally president trump was going to go be the one to have that meeting over. It was in Poland On September first ultimately Mike Pence went into his place. One would think that before going in to a meeting with The Ukrainian president that there'd be holy aware of what President Trump's interactions and directives would have been and that's part of that conversation at sued. Frankly be a little bit of a surprise if nobody ever briefed vice president about trump's desire to have the Biden's be investigated or the supposed Deon Server be investigated again. That goes to the question. Is this willful ignorance or is this complicity by the vice president. I asked him and it was Just one month ago on October ninth in Iowa I asked the vice president over the course of about seventy five seconds repeatedly the same question Jin was he ever aware of interest within the administration to have Ukraine investigate. The by nights never discussed issue of of The issue of the Biden's with President. And what I what I can tell you is that all of our discussions is internal.

There's a split between the president's aides and the vice president's aides and that is always a sign of impending disaster. That's Joe Lockhart who worked in Bill Clinton's administration and he has noticed something that has actually become quite obvious. There is a growing rift between Donald Trump and his own vice president Mike Pence as a result of this impeachment inquiry now. How much did Vice President Mike Pence know I know about the phone call with Donald Trump. You Have Donald Trump's aides saying oh pence knew everything and then at the same time you have pence's aid saying well Maybe you didn't know anything at all. We don't know he seems like he's been left in the dark about all of this so before I give you the details on that and it's an excellent detailed report in The Washington Post. I I want to give you a little more of what Joe Lockhart had to say. Take a look. It's a bit of a circular firing squad right now at the White House says people try to positioned their principles and settle some scores in the you know in the process look. I'm struck by lightning suggesting that some grand strategy here but if you look at the big picture there are those who suggest that the White House the President's team is bringing up the word Mike Pence or the words words I suppose Mike Pence because what they're doing is sending the message. Everyone's involved here if you come after me. It's everyone who's going down so take this seriously. I think again I think the pence people tried to put out a line that you know insulated him and the the trump White House send in a message saying if I'm going down. You're coming down with me. There's there's only one story coming out of this. White House and it's not one that protects you it goes to the White House strategy that is you know I mean look at what trump and the team did when Mitt Romney came out and said he was troubled by this. They put out a video that was designed to embarrass him that that wasn't a message to run me. It was a message to the other fifty two senators in the Senate say. If you say something negative about us we will come after you with all of the might of the three hundred million dollars we have in the bank at the campaign and the pulpit that we have here at the White House so I think Lockhart is one hundred percent right and I don't this is just my perception of this. I don't believe that Mike Pence was just completely unaware and just like this dope dope guy just dopey guy who didn't know what was really going on again. That is my speculation but let me give you the details from the Washington Post report before I do so those Jank. Do you WanNa jump in I do. I have a four words to say here. Tick tick tick tick okay all right. Listen listen. They're announced sexy was spot on so pence definitely trying to escape by on Salang but trump made him a henchman as you're about to see so he can't skate on it and and now he's he's having to go all in and of course the president as usual made them walk the plank and now he's out there defending the president so that he's just as culpable as as trump his and if if trump thought he can get away with it by blaming Ukraine getting dirt on the BINZ got another one. That was my pets. Let's like you think he wouldn't do that. He do that do that except he's now incriminated himself publicly so many times and his whole response wants to this impeachment investigation is like Yeah Yeah Yeah. That's what I did. That's what I did because I I WANNA. I WANNA drain the swamp right so he can't blame pence for it but what I think trump likes to do is drag everyone down with him hundred or something. That's what I was giving so. Since there's no way that he could fully deflect the pence then. Why is he doing it. He's just saying like no. I want everyone defending me because if you don't I'm GonNa drag all of you down with me and make sure because what he cares about the Republican Party. Hey here's my principles. Mike Pence his partner the vice president no the only thing that Donald Trump ever cares about is donald trump so if he's got to kill everybody on the way down politically within the Republican Party. He'll do it in a second but that's eventually what's going to cost them the presidency because enough. Republican senators are going to go this guy's. GonNa kill us all man politically so what's what's the point of saying with him. We haven't gotten to that point yet but tick tick all right well. Let me give you some more detail into what trump actually really had pets do prior to us finding out about this whole whistleblower complaint according to The Washington Post trump instructed pence not to attend the inauguration Shen of Ukrainian President Vladimir Celeski in May an event White House officials had pushed to put on the vice president's calendar when Ukraine's new leader was seeking recognition and support for Washington so you have a White House officials pushing to do this but at the same time simultaneously you have donald trump telling pens no don't do it. It's bad idea don't go to the inauguration and pence didn't go to his inauguration. Okay now that's relevant because it's part of trump's ploy to make this new Ukrainian President Ben to His will and essentially carry out favors for him right because remember Ukraine needs the US to assist them in this military eight. Let me give you more detail now. Instead of traveling to kill as has he was supposed to pence was supposed to for this may thirtieth inauguration pence actually attended a trump campaign in Jacksonville Florida and made an official the trip to Canada later that month now months later the president used pence tells the lead ski that US aid was still being withheld while demanding more aggressive action on corruption the Ukrainians probably understood action on corruption to include the investigation of former Vice President Joe Biden and his son Hunter Biden so when pence finally did meet with Celeski and this was on September first. Here's what happened during that conversation pence told Dolinsky inskeep that aid was being withheld due to corruption concerns. That's exactly what trump wanted him to do. Pence emphasized trump's frustration that the e you should provide more aid to Ukraine pence didn't mention Biden but former officials claim pence mentioning corruption was code for that issue whether pence intended or not what yeah I I actually think that that under sells it so involving pence actually implicates trump more not less as usual trump doing more damage just to himself because he's not smart enough to figure it out because when when trump says in the call listen the US does a lot of things for you guys. He doesn't mention the military aid as far as we know would love to get their official transcript anyway he says but we do a lot of things for you guys now. I need you do me a favor though and investigate okay bye but then he goes up by sending pence to say remember that corruption we were talking about an end. The call trump clearly connects corruption to bind Leiden any doesn't mention any Ukrainian the corruption. It's not like well. You guys have this massive problem. Oh you know what eleven percent of it is the Biden's you know I'm worried about corruption overall no when he talks about corruption he only mentions by okay so then he sends pence over and says now remember. We're not sure about the aid and we wanted you to take action on corruption. The poem that actually is the quid pro quo and any prosecutor worth their salt could prove that as well there are team. They say there are team and one guy I says hey. I want you to investigate Biden. That's corruption. I'm talking about the next guy says remember that corruption we were talking about. That's why we're not giving you a done deal so like like I if you're trump defender no amount of facts or logic will matter to it doesn't matter you will say on the one hand Hunter Biden. What does he know about Ukrainian guess. What is he getting paid for that copy audio corruption when I say now. It's not technically illegal but I actually agree that it is corruption Hunter Biden. Doesn't anybody greeting guests. You know why I say that because I'm a reasonable human being I can assess the fact that a guy who doesn't know anything about Ukrainian gas gets fifty thousand dollars a month why because they neighbors Biden right now when we asked you hey when trump says investigate corruption. I E Biden and then Penn says I'm not giving you the money until you investigate corruption. Everyone knows what they're talking about. The only resume not admitting it if you're trump supporters because you're a trump supporter you're like I don't care about facts care about what the leaders say. You know what you know it you know it and also why is your cult leader having a very public meltdown right now. I mean he's been having a public meltdown town ever since this whistle blower complaint became a public news but here's the thing. I think an important part of the story is holding Vice President Mike Pence accountable and not allowing him to push this ridiculous narrative that he was insulated from all this and he was completely unaware because and I'm kind kind of burying the lead so I'm going to show you one of the most important parts of the story according to The Washington Post reports his own aid and one of his top aides was listening zooming in on that call between Donald Trump and water Mir's Alinsky so the aid is a Kellogg Kellogg pences top National Security Advisor iser listened in on the call from the situation room which was the standard practice did not see it as unusual or flag any concerns about it to the vice president now that's according to aides spoke to The Washington Post but here's one other thing after that call happened literally the day after that call happened pence Hansa supposed to get a summary of the conversation so are you telling me that he received that summary of the conversation and then proceeded to meet with Vladimir Amir's Alinsky without reading the summary of that conversation so the vice president and actually prepare for his meeting with..

But I think you know stepping back what you're saying. There's not a lot to suss out is absolutely right in the sense that like he's a conservative Jew. The term constitutional crisis has come to mean absolutely fucking nothing. It's not a constitutional crisis when you invoke an amendment to the constitution according to the spirit and letter of the amendment. It's not a constitutional crisis. If you're using the amendment for the exact purpose it was written for that is why it is there. I'm not saying it'd be a breeze. I'm not saying it wouldn't be messy.
