So I want to discuss this before we get into all the elections today with the panel. This came, this was published by ABC News just a few minutes ago. My initial reaction is pat cipollone when the January 6th stuff came up in the January 6th committee, he was somebody who pointed who pushed against what he considered the errant voter fraud claims by former president Trump. Rick, would you imagine that as it relates to the storage of top secret documents, cipollone must have pushed back against this or what is the significance do you think in terms of the interview at pat cipollone and pat philbin, both interviewed by the FBI? Yeah, I think it's a really fascinating report because it indicates what we really don't know about this investigation. I mean, this investigation really came into the public eyes during one of our earlier shows. During the search of Mar-a-Lago and since then, we've been getting a drip drip drip of information about potential grand juries and what the affidavit says. And we've just been learning in real time. What the impact of this is going to be. I got to believe that everything we've seen of pets of Bologna is that he's been a cautious and concerned counsel in The White House who had the responsibility for the transition of these documents to the archives. And he probably did everything he thought was in his abilities to do. And it'll be fascinating to learn someday if we can, whether or not he even knew that these documents were taken out of The White House and down in Mar-a-Lago. So I got to believe his side of the story is going to be probably vanilla. This is how we handled it The White House. And then there was a whole other side of the story, which is what Donald Trump did in his last minute packing and scurrying off to Florida. Yeah, you wonder, this seems like such a serious issue that they're investigating there must have been numerous failures, or maybe one person in the former president, putting some stuff in a bag on his way out. I don't know. That's what I do when I move. I don't know what ends up in what box. Let's talk elections. And I think we've got to start of all the elections that are happening today, some really interesting primaries and a special election. We've got to start with congresswoman Liz Cheney and her reelection. The polls that have come out do not look good. She faces Harriet hagerman, who's the Trump anointed challenger in the Republican race for the Republican nomination in Wyoming. Let's play some sound from Liz Cheney's ad. Her latest ad, just to get a sense of exactly what she's campaigning on. Here's congresswoman Cheney's latest ad. No matter how long we must fight, this is a battle we will win. Millions of Americans across our nation, Republicans, Democrats, independents. Stand united in the cause of freedom. We are stronger, more dedicated and more determined than those trying to destroy our republic. This is our great task, and we will prevail. I hope you will join me in this fight. So you usually don't hear a member of Congress doing a campaign ad in their Republican primary calling on Republicans Democrats and independents in this valiant effort. But there is the idea that maybe Democrats and independents will register and vote in this Republican primary. Roger, what are the chances of not Republicans, but Democrats and independents saving Liz Cheney in this primary? Well, I think her problem is just mathematical, right? I don't think there's enough Democrats in Wyoming to do that. But it is interesting. And you know, what I might take away from it is you can kind of see in here looking past this election to weave together some of our thematic strands here and to build on your discussion with congressman Smith and how I mentioned he was a little bit of a welcomed throwback. I remember in the Clinton impeachment how, you know, these very lofty speeches about how you can't lie. And the GOP's message to president Clinton was you can't lie. And now the GOP's message took Liz Cheney Cheney is you must lie. You must embrace this big lie about 2020. And that's extremely troubling. And I think she looks at that and she realizes she might have a lane to not necessarily win national office, but certainly play some kind of a torpedo role. And I think she would really enjoy playing it. Yeah, not necessarily about winning is my takeaway here. Using the phrase destroy our republic, it seems like she's going for something bigger and broader than reelection. Rick, I guess it's one question to say, does she know she's gonna lose and she wants to make a stand anyway, but also, is there something else she's gunning for? Is it gonna be a super PAC that she sets up or a nonprofit or does she run for president or I mean, what is she preparing for? Well, I think the first thing that you've pointed out, Jack is that she hasn't actually been running for reelection. She hasn't been talking to the people. Of Wyoming about inflation and the rampant spending in Congress and the impact it's going to have on their taxes and I mean, these would be normal things that typical House member would say to their state in this case. And she hasn't done that. From the very get go said, my reelection is going to be all about Donald Trump and keeping him from ever being in the Oval Office again. And she stuck true to that. Every ad she's produced, even with her father, it's all been about Donald Trump. And so she's effectively used this platform to basically say, look, I know I'm probably not going to win reelection. Probably don't even want to try. I'm going to try and defeat Donald Trump and any ambitions he has in the future. And I have absolutely no doubt we should watch her speech tonight if we can stay up that late. And see what she says because I think like what roger was saying, listen to what she says. She will give us an idea, even though she won't lay out in full form what she's going to do next. She will give us an idea and my guess is that ideas she's going to continue to fight that she's waging against Donald Trump, however it manifests itself. "Obviously the hubris in this reporting, the Trump is, oh, I'm not concerned witch hunt. It'll be fine. But I mean, this is obviously we know from the two pat subpoenas this week that this has reached into the Oval Office, and obviously there is reporting that Trump's attorneys are counseling him that he may be indicted. So what do you take from all of this? From the latest recording. Three, really important data points, staff one. We saw the Rolling Stone reporting that Donald Trump's legal team is preparing for him to be indicted and this is what I love. This is why Donald Trump's legal team is like the worst legal team imaginable. Except for Alex Jones. Yeah, the good point. They're saying, we are preparing a defense that will be putting it on quote the fall guys. What did we see a couple of days later in last night's CNN reporting? Donald Trump has been counseled to cut off all contact with and not talk to Mark Meadows. The only reasonable inference we can draw from that is Meadows is flipping, right? Maybe he has flipped, maybe he hasn't flipped. That's what you counsel somebody when it comes to, you know, one of your buddies who is now cooperating with the feds do not talk to him anymore. And then the third data point is the pat cipollone subpoena to the grand jury and Steph all testimony is not created equal. Because the J 6 testimony that pat cipollone gave, we all saw it. Some of it on videotape, he wouldn't answer the big questions. He wouldn't talk about what Donald Trump said or did. He wouldn't talk about Trump's crimes. He gets away with that in the January 6th committee because they don't have a way to compel him. They can't test that privilege once he asserts it. When we get witnesses in the grand jury, we can test that privilege. We can overcome it in real time because when pat cipollone and the grand jury says executive privilege, I've done this a hundred times, not with executive privilege, but with attorney client privilege. Fifth Amendment privilege against self incrimination, spousal privilege. Well, as we've been reporting today, shareholders in Tesla proved a three for one stock split, joining us to talk about this more in ludlow, Bloomberg technology reporter and Ed the timing of this looks to be pretty good. Yeah, I mean, it was expected, you know, no one thought that the resolution wouldn't pass. Partly because it was so telegraphed, Tesla tweeted in March that they wanted to do it and the annual shareholder meeting was only scheduled a month ago. So, you know, saw some muted share reaction in after hours, but it's important because it lowers the price to around $300 a share. I would note very importantly for any shareholders listening, they did not set any dates or terms on when the stock split comes effective. So we still need to hear more from the company, but they've done it before in August of 2020, and that was effective at 5 for one stock split, and it kind of democratizes access and it has proven to be a boost for the stock over a longer period in the past. Even though it was made official today, I think the market had been in the process of discounting the likelihood of this outcome. So the question becomes, was it necessary to kind of put the defibrillator on a Tesla shares? I mean, is it going to resuscitate the stock and bring it back to life as it were? Yeah, I mean, taking the kind of series of events from the annual shareholder meeting overall, the main takeaway you have is just how crucial the retail investor is in all of this. They lied about Eric hershman, White House lawyer, the light about the note written Cathy Hudgens that she wrote it and there was a person said, no, no, I actually wrote that note. They lied about the Secret Service. We've had Secret Service come forward and say that what she testified to was not accurate. And they lied about me twice, they lied about a text message I had forwarded to The White House chief of staff. They said it was from me, a member of Congress when it wasn't. I had forwarded to him from a respected lawyer former inspector general for Don rumsfeld. And then they also took a video quickly where I was on Fox News talking and I was on Maria bartiromo show and the video clip started off with me saying January 6th is the ultimate data significance in a presidential contest. What they left off was the sentence right before that where I said the late justice Ruth Bader Ginsburg said that January 6th is the ultimate date of significance in a presidential context because that's when you actually approve the electors. And that changes the entire context of that statement. So we saw that and then, of course, maybe the most important was when Zoe lofgren I remember the committee said, we don't corroborate witnesses testimony. And they didn't ask pat cipollone when he was deposed if what Cassie Hutchinson said about him was true. And his lawyer reported afterwards that if he had been asked to say it wasn't. So that's 8 different false things we've gotten from this committee. And Todd, we don't get to see the evidence. We don't get to sitting on the depositions. We don't get access to the transcripts of the video, the documents they have. We don't get any chance across examine. And so imagine how many other lives they've told the American people if we've caught him in 8 with that limited amount of ebb and we get to see.

One of the defendants in the case, Kelly mags also told another oath keeper that Brown had explosives and the RV prosecutors are not sure if the grenades were kept in the RV, which was parked in college park, Maryland, or stashed at an Arlington comfort in during the riot. "Washington at 5 41, former White House counsel pat cipollone testified Friday behind closed doors before the January 6th committee, which is also getting ready for two more public hearings this week. Next week I should say, WTO beast Michelle bash talked to CBS News congressional correspondent Scott mcfarlane about what we could learn from cipollone's testimony. Well, we know it was behind closed doors, so information is going to be sketchy for a while, but it was recorded according to multiple sources, which means there's a possibility we hear and see excerpts of it at one of these forthcoming January 6th committee hearings. That's really been their practice to play key deposition clips during their public hearings and they have a hearing set for Tuesday if not more later this month. As for those two hearings, one of them is supposed to be in prime time. What are you expecting there? Let's talk about the Tuesday one, because that's where the information is a little firmer. This committee has a way of moving the goalposts on us. The one that sits at for Tuesday is going to be about what the committee calls the mobilization of the mob, including by far right groups and domestic violent extremists. How that mob moved, the planning ahead of time, the conspiracy, applauding. We expect some references to those far right groups, which are also charged by the Justice Department with seditious conspiracy that would include the group of Proud Boys and the group of oath keepers. And Thursday, a lot of it, as you said, is still up in the air. We just aren't sure yet. Yeah, the committee had told us a couple weeks ago, they were going to go quiet for a while and do some work. Then they scheduled a hearing at the last minute with Cassidy Hutchinson that former White House aide and her blockbuster testimony. So the committee keeps saying things are changing and can change in a moment's notice and they've proven that's true. So we think we have a pair of hearings coming next week, but who knows how much more will be scheduled or how things will shift? What other January 6th related developments were particularly significant in your opinion this week? I'm trying to keep my eye on the Justice Department prosecution. There are two separate investigations here. There's the January 6th select committee. And then there is the criminal prosecution by the Justice Department, which is the largest in American history, a new update from the Justice Department says to expect another 250 to 350 arrests. And that may be a low ball number. They are still out there looking for people and just today, they announced the rest of a West Virginia man for allegedly kicking in a door at the capitol January 6th. Incredible that there are still that many outstanding arrests still to come considering how many people have already been arrested. What's more, they've been pretty clear a majority of them are many of them who are still being pursued or wanted for assault or resisting police. These will be some high level defendants once they're arrested. That CBS News congressional correspondent Scott mcfarlane coming up in sports will tell you about one caps forward who's swinging for another championship, this weekend. It's 5 43 now in Washington. We've learned more this morning about the indictment of a man accused of shooting and killing three coworkers at a machine shop in smithsburg last month. Joe Lewis escovedo has been indicted on 34 counts connected to the workplace shooting at Columbia machine in smithsburg, investigators say he won to his car after working their shift, got a gun and killed three coworkers. Another who survived told detectives he knows and works with eskil. When his car was stopped, ask Bella's charged with shooting a state police trooper before he was shot, charging documents say as Escobar was being transported to the hospital, he told a sheriff's deputy. He was the one who shot the others at the machine shop. His first court appearance is scheduled for August 22nd. Nia law can stay in W TLP news. The U.S. park police department is supposed to record all of its radio and telephone communications, but that hasn't been happening. In fact, a government watchdog has discovered the department's radio channels went unrecorded for two years. The interior department's inspector general review was triggered after U.S. park police discovered they did not have recordings of radio communications during the operation to clear protesters from Lafayette park in June 2020. The IG review found park police had not recorded radio communications on one channel from at least March 2018 through August 2020 and another channel from October 2018 through June 2020. The watchdog said they found no evidence this was intentional because there was no policy to monitor the equipment, the failure went unnoticed until the June 2020 recordings were requested, moving forward, the IG recommends U.S. park police developed policies for maintaining and monitoring the equipment and the recordings. Sarah Jacobs news. Has reached out to the park police for comment. Washington commander's owner Dan Snyder now saying that he wants to appear before a House committee investigating reports of misconduct of the team under his leadership. WTO's Mitchell Miller has more from Capitol Hill. A letter from his lawyer states that Snyder is willing to cooperate with the House oversight committee, which issued him a subpoena last month. The panel has been investigating what it's called the team's toxic workplace over the years, which has included allegations of sexual harassment from former cheerleaders and women who worked for the organization. The committee originally wanted Snyder to appear before lawmakers, along with NFL commissioner Roger Goodell, who did testify last month. Snyder's legal team says he will be in Israel for an event to pay homage to his mother who died a year ago, but says he could testify virtually at the end of the month. The committee says it's reviewing the correspondence and is still committed to getting Snyder's testimony. On Capitol Hill, Mitchell Miller, WTO. Well, if you've walked around the title base and regularly, you've probably noticed flooded pathways, especially on the west side, overflowing from the basin. The National Park Service is looking to fix that issue for generations to come. The problem is that the sea walls that were built are sinking at the same time as water levels are rising. It is settling at the same time that the levels of the tidal basin are rising. Mike litteris with the National Park Service tells WTO P they are now beginning their planning stages to fix the issue. First phase of the project will be the particularly vulnerable areas along the title basin and will address west Potomac park from Arlington memorial bridge all the way into the tidal basin near the FDR memorial. A $124 million construction project will hopefully begin late in 2023. Don't just want to repair the damage that's there now. You know, I don't have enough information in my head because I'm not an expert to know if that was a how probable that was, but oh my God, did you nail it? I can't believe how well you nailed that. And so I think right now the listeners are probably just here, I'm gonna play the Andrew was right music. The whole show, just under the entire thing, the whole time will be the Andrew was right song. Well, I thought that the testimony of Cassidy Hutchinson, if anything was going to push pat cipollone over the line to testify and cooperate with the January 6th committee, it would be her testimony. She was asked by Liz Cheney, we know a White House counsel Patrick was concerned about the legal implications of the president taking a trip down Pennsylvania avenue to the capitol. And he agreed with the Secret Service it shouldn't happen. Miss Hutchinson did you have any conversations with patch apologia about his concerns about the president going to the capitol on January 6th, Cassidy Hutchinson says, on January 3rd, mister cipollone had approached me, knowing that Mark, her boss, Mark Meadows, had raised the prospect of going up to the capitol on January 6th. And I had a brief conversation where he said to me, we need to make sure this doesn't happen. This would be legally a terrible idea for us. We're we have serious legal concerns if we go up to the capitol that day. And then he urged me to continue relaying that to mister Meadows because it's my understanding that mister cipollone and I keep alternating between these two pronunciations as well. So there we go. Thought that mister Meadows was indeed pushing this, right? Her boss, along with the president. And I could read more, but that's sort of the dynamic. You have White House counsel going to the chief of staff's head, staffer and saying, your boss is out of his gourd. What can we do to make sure that he doesn't do legally a bad thing for us? And by the way, I'm the lawyer. And obviously her testimony was moving, you heard the coercion attempts that were made against her. The president provided her with a lawyer and said, well, you know, I mean, I'm not saying you just got to do what's a favor, but you know, the president reads those transcripts, right? Which is the very obvious threat of yet your lawyer is actually a spy for us. And the reason we have access to sealed transcripts is because you as the witness get to review them and so does your lawyer. And they might just happen to wind their way into the possession of the president who, you know, likes to read these things to make sure you're staying loyal. How gross. So I love the fact that cipollone has now decided to cooperate. I want to break down all of what that means. Well, first let me ask you this. You've explained a little bit of it, but for the lay people and for the me, can you answer both a, why you think this happened? And why you were able to predict it, and B what you think the committee did and Liz Cheney and others that helped this goal? The ways that they might have gone about this that ultimately achieve this goal of getting him to be a witness. Yeah, great questions. So on the first part, again, remember, they're not a lot of people that we have crowned with the adjective hero in this situation. I went out of my way to tell you just how much a monster Steve engel was before we discussed the significance of his testimony, right? This is not somebody who's a good guy. All the approbation that is being lauded on Mike Pence, right? Like Mike Pence is a monster to this day. He could be here cooperating with the January 6th committee. Oh, sweet. I wouldn't actually ruin our trip. I don't want to. No, I mean, well, you know, he couldn't be alone in a room with half the people who were here. That must get really cumbersome, like just walking back and forth, like we're playing a game in this room. He walks, ah, my wife isn't here. Mother, mother, you need to follow me to this room. Yeah, that would be. No. Yeah, never mind. Let's not invite him. He could be cooperating with the January 6th committee. He's not because he's still pussy footing around. With the group of idiots that wanted him dead. I think bad you want to say about Mike Pence up there. I'm with you on. And Cassidy Hutchinson, as moving as her testimony was, let's remember this is a 25 year old in Trump world who wanted to work for Donald Trump in January of 2021, okay? I give her and we should give, I think, all people maybe in this day and age a little bit of grace. I think it would help our situation. But she got into this job at the age of 22. Let's go ahead and not assign people as permanently evil for their entire lives for things they believe in 22 signed a podcaster who used to be conservative, like that would be really nice if it would be good to be open and welcoming to people who are going to do better or might do better trying to do better. And look, I think that that is a great plea for grace. So how does that tie into the second half of your question? And where pat cipollone falls sort of on the monster scale.
