with very little professor UC Hastings college of the law can you tell us a bit more about what's in this manuscript that you think strengthens the case you do think or don't think straightens a case for witnesses yeah you know excuse me I'm fighting a bit of a cold the the issue here is how seriously the Senate takes this entire idea of a trial if if there is a real trial and they take it seriously John Bolton provides the first hand testimony which says yes I heard the president say that his interest in restricting the funds that you claim was connected to investigating the Barden among other things among other things like corruption in general reducing fine agents like that that's the first first hand words from the president's now that we've heard and in a real trial you would call that witness now whether that witness is to be believed whether that witness is accurate or not yeah is for the trial your findings of fact nope they're not really take it seriously because they know that there is not gonna be two thirds of the Senate to vote to convict the president then I'm not sure any of this is really worth the time and expense but I hope they take it seriously because impeachment is a constitutionally provided mechanism which is being used in this case I think entirely appropriately even if it doesn't result in a final conviction what's so interesting about watching this process is that it's a trial but then it's not you know there are some rules that are being applied now there's an art yeah I mean it nobody really knows they've only been to impeachment two trials in history one was so long ago nobody can remember to really what it was like any other is the Clinton impeachment trial which is very different than this one but which of course had witnesses and went on for I think five weeks and and even at the time people were relatively sure the Senate would not connect so we really don't have any guidance as to how this is supposed to go the Chief Justice should be providing my view is that this is the Chief Justice some of the worry too both you know issue subpoenas to witnesses control the party is you know any any trial judge whose defendant tweeted over the weekend a sort of threat to the prosecutor would be admonished by that judge so far she just as Robert hadn't said anything yeah it makes it makes you wonder whether he's going to take more of a role as things get moving I mean he he he did make one little step last week yeah you know my guess is in it privately the Chief Justice is not happy to teach us this is kind of steaming about how this is going you know the Supreme Court has no authority to enforce their judgments on others of the Chief Justice says well I order the president not to tweet he has no you know police force to go in force that it will take the Senate's backing to make that stick so again it depends how seriously the senators take this and I think that you just have to be careful not to expand his authority in a way that ends up looking completely helpless right and on the other hand you know the the Supreme Court made a decision today on immigration law that I'm sure the president is happy to see it in a to comply with well I get right to politics go in all directions and the president needs to be careful not to offend all the members of the Supreme Court because he's got at
