"Today. The disgraced Hollywood producer. Harvey Weinstein will be sentenced last month. He was convicted of rape and criminal sexual assault and faces up to twenty nine years in prison. Prosecutors have urged the judge to consider what they called a lifetime abuse towards others even though for most of those alleged abuses. Mr Weinstein has never been charged. His lawyers have petitioned for the minimum sentence of five years saying that any longer could constitute a defacto life sentence after Mr Weinstein conviction the Manhattan district attorney Cyrus Vance Junior said. The change had come to America. This is a big day. This is a new day and I hope women will will understand the significance of the jury verdicts. Today is. Optimism was echoed. By some of Mr Weinstein's accusers and their lawyers is a historic. I never thought I would see in my lifetime. Change has come today. So you say the result is a bit surprising and and certainly prosecutors and plenty of commentators have held it up as a sort of watershed moment is a sort of a apotheosis of the of of the metoo movement that essentially was launched. By by these cases. What's your take on that I think? The watershed which is an awful lot immediately after the valid. And I understand it. I mean this was a high stakes trial. Which the Manhattan. Da. Couldn't afford to lose so they threw themselves out this only on the hands. I think as as many celebrity trials we have to be careful with Conclusions hair. I hope it will be a watershed moment. There's an awful lot wrong with how sexual. Violence is is investigated and prosecuted. But I have my doubts. I think the the real test will come when single women also group of women come forward to accuse somebody of rape without the media attention right without. Will the inefficacious if you will of the accuser has been an awful lot of emphasis on how powerful Mr Weinstein is but his accusers. Happen quite powerful as well. Essentially they had public opinion rooting for them. And I think the real test of whether the the Weinstein verdict will have a BRUDER EFFECTS. On how serious criminal? Justice Systems. Juries take these kind of complex claims will only come when we see an everyday victim. Come forward with with a typical claim of sexual assault. So what you're essentially saying. There is that celebrity. Justice is fundamentally different. I mean why do you suppose? That is I- celebrity justice in general is just is only certain. Becerra was it is just different from normal justice putting old big bright lights and attention onto someone being accused in this case Mr Weinstein. That's a typical way of injustice remedy a J Simpson trial which was essentially works like a soap opera. Essentially didn't have that much impact with how of the mothers were investigated then tried in Los Angeles and I think the same will be the case with the wider significance of the wanting conviction. Today that said there is of course important symbolic function to mocking. Somebody like Mr Weinstein up and holding his feet to the fire. So I said he wouldn't diminish the symbolic importance of seeing someone powerful like him wrote into a cooled. Convicted unlocked. Up is just going to be careful with suggesting that. Will the other huddles that stand? In the way of getting justice for everyday victims have now disappeared. I mean the one distinction here between Mr Weinstein's case and the OJ Simpson case is that Mister Simpson was was acquitted whereas Mr Weinstein has been convicted. Don't you think that that at least has sort of knock on effect sort of casts a shadow over over future cases gives future jurors a sense that That that there is an example being set there. Yeah maybe I mean future jurors in reminded with this case that rape doesn't look the way they think looks so it's been very helpful to have this very public lesson. If you will in rape myths that rape is a complex crime that said we pull people every year on their attitudes dissection. Rasmussen doing that. Insensitive metoo movement took off. And in that we don't really see much of a change in public attitudes to sexual harassment and indeed in America way would have hoped that reporting rates of sexual violence had increased most under reported binding crimes often me to after an initial bump reporting rates of back down to what they were before me to see. Anthony Lukas work in progress award welcome Rachel how are you I'm great thank you so much for having me this is an absolutely chilling pork and in many cases women in preparing for their own deaths I was told to ask you first though on your tour right you but you had some experience with domestic violence or something the savage irony yeah well three weeks ago I came home and I to a phone call that one of my closest friends brothers had killed his wife family here and it lives near me my daughter is really close friends with one of their two daughters and yeah so I'm frontline in my personal life with their right now on it just been unbelievable well let me start with this then to this is been about a week ago the twenty fifth anniversary of the OJ Simpson murder case the time it appeared in a criminal way she's got away with murder and attacked the reputation of the victims have at how things change in your mind since that event in some ways they've changed a great deal I mean we didn't have a federal law against child abuse in this country until the nineteen eighty four just a decade before Nicole brown Simpson and Ron Goldman were killed so if you look at it if you if you look at that view of history we've made quite a lot of progress since then what tracking it now we have all kinds of training that are out there we learned a lot but there are so many examples in fact since twenty seventeen three Alan homicide rate in this country has gone up thirty three percent it feels very much like a step forward or step back if you're looking at it from my point of view I know if you know this so but I'll just do it quickly we've had a a woman right in the next town over New Canaan Jennifer Davalos who disappeared and her husband who she had moved away from in fear of hurt his blood was found mixed with hers in her house and he was seated night disposing with his girlfriend thirty garbage bags lawyer since has said that she wrote a five hundred page manuscript years ago and they they're calling it gone girl the chief frame she wants to frame her husband for her fake murder now what they've changed it to revenge suicide and they've said she was mentally ill and as you know used car went and this what do you think about this kind of stuff right about that because it's really shocking I mean you know the price Hogan right with the four o'clock five John two sets of twins and I have twins so yeah I have a daughter myself I I mean revenge suicide you're gonna leave your children otherwise you know to a woman who's been in their lives who has never shown any sign anything it's ridiculous but you know what I mean all of these things speak to a sort of cultural almost cultural appropriation women in this country you know even when we are credible we are to be believed to be discounted we are to be dismissed in whatever way we can and I think you know one of the reasons I think the plastic mount homicide rate has risen to twenty seventeen is a retaliatory violence against women in particular women's anger at and also I would conclude men men with young men who are allies of the women's rights and women's equality I think we are all angry about about this I think we're all angry in this moment

You know, that's the other thing that just astounds me we forget, I think in, in the history that you couldn't possibly remember on a cellular level all the stuff that. There was show much evidence against this guy. And the only thing you really have three member about that are two pieces of evidence of that are really almost impossible to explain, although the dream team defense did kind of confused people with it. But there two pieces of evidence there were his socks OJ Simpson's socks. Were in his bedroom found in his bedroom. And there were, there was DNA blood from both, Nicole Brown Simpson Enron Goldman in his bedroom. Ron Goldman never had been in his bedroom ever. And there was DNA from all three of them, OJ Simpson, Ron, Goldman, and Nicole Brown Simpson in the Bronco there's no evidence ever that Ron Goldman was in that Bronco. So there was no explanation for that. Other than what the defense said, which was somehow the LA police department. Which has has trouble writing a parking ticket sometimes was able to coordinate this massive conspiracy involving everybody and getting his blood in those places. Yeah, it was it was absurd to suggest a conspiracy. But that's all they could really hang this thing on was look it's a conspiracy against this guy. The other thing I would point I was making the other day is the cops had historically been so nice to OJ Simpson. I mean, he was really one of them whatsoever onic is that OJ Simpson, somehow became a civil rights sort of emblem symbol in this trial. This was not about his guilt or innocence. This was the trial of the Los Angeles Police Department. So here's OJ Simpson who lives in Brentwood, whose friends were at the Riviera Country Club. That's who he handgun with. He was not famous for, for appearing in the African American community of south central at all. He was a spokesperson national spokesman for Hertz and others because he transcended. Tended black and white. He was not viewed as a black person he was viewed as a race Lewis. Really? Oh, it was he was OJ Simpson beyond race. So for him to then be portrayed in the trial as this victim of a police conspiracy wasn't he'd absurd. Because if anybody was going to be a victim of police brutality or, or a conspiracy was not OJ Simpson. Certainly the Los Angeles Police Department had a lot to answer for, for their treatment of people in the community here. But it wasn't OJ and in a sense, the Los Angeles Police Department as you say they were put on trial. It was a fiendishly clever decision to do it that way. Right. You know, your client has got problems. So you're just going to put the, the guys who busted your client on trial. Right. And Johnny Cochran who was the lead attorney can was the trial attorney and was smooth as silk and. He his background was that he was. In fact, a civil attorney who prosecuted who went after cops who who who were for battalion cases in the community. He was famous. He was a civil rights guy. He was the real thing. He was a distinguished attorney that way. Yes. And so he knew this background of what the community thought of the Los Angeles Police Department from firsthand experience. He knew how to pick the jury he picked a jury that was African American. And he appealed to them all along that Los Angeles Police Department frame disguise, you know, how that works in your community. It happens all the time. And in fact, the community was where that and the and this became a trial of the Los Angeles Police Department and not J Simpson. We're talking to ABC's Jim Avila, who was reporting on the OJ Simpson trial, twenty five years ago, as you know, it's the twenty fifth anniversary and so many of the facts associated with OJ and sort of the, the mood associated with that OJ Simpson case are being reviewed and, and if you have. The thoughts or questions for Jim four one five eighty eighty eight ten four one five eighty eighty eight ten. So we just heard a little bit. You're there staked out side, his mansion. You're kind of just staked out waiting for something to happen. And something does happen. Ultimately, they make a deal. The cops due to have OJ surrender. Right. He's the and then he doesn't show up at take several days. I mean, it didn't happen that as I was talking about in that piece, there's a lot of evidence and a lot of investigating in fact, J Simpson goes to criminal court spill, I'll to the Parker center, and his interviewed by the police department with Howard Weitzman his first attorney there in there. So they do that. And then they decide yes they go to the district attorney, and they decide we're going to charge him. His attorney at that point is Robert Shapiro. Shapiro is, of course, the king dealmaker in all of Los Angeles. When it comes to comes to lawyers, he never really tried anything. He his real expertise was making a deal with the cops and make a deal. The district attorney he made a deal. The district attorney that OJ would not have to be arrested at his house, or anyone else at OJ Simpson would come into the Parker center on his own go upstairs and, and be taken away in process. So they're all waiting, and I'm waiting along with the cops at the Parker center in a big room where a news conference is going to be held when he is when he's going to when he shows up, we're waiting and waiting and waiting one deadline passes another deadline passes meantime, OJ Simpson. If you've seen any of the movies about him after the documentaries, he's at Robert Shapiro. Robert Kardashians house, in Glendale up in the hills, and he's pacing back and forth and nervous and doesn't wanna come in. And in fact, doesn't come in and he gets in the car with a c Cowlings has his buddy and they had down the freeway, and that's the white Bronco chase. And I'm standing in the with the cops, and in the Parker center, and they come out and they are livid. I mean you never hear a police spokesman speak like that. He says OJ Simpson is a fugitive of Justice. You know, he told us he was gonna come in. He's missed three deadlines, and his arraignment, we're after him and we're going to bring him in and during that chase the bizarre. I mean it was bizarre on top of bizarre. But the cops try to kind of talk him down. He's sort of representing that he's going to kill himself, right? He wants to talk to Tom Lang, who is the one of the two lead detectives, and you may have seen him use the ball guy. So there's the big tall Irish looking guy van adder, who's the. And then the Lang though the two lead detectives Lang gets on the phone with OJ Simpson. Who's in the back of his white Bronco with a C driving and crying. And. Telling Tom Lang that he is sad and that he misses Nicole wants to go to grave, and that does everything but confess gets right to the line at confessing about, you know about what happened. And they talk him in. They goes into the Brentwood. He has a gun and he has a gun post supposedly, to his head, but he has a gun in the car and you can hear them we can hear them on the scanner. You can hear the whole thing. And he's he finally convinces him to throw the gun way. And they've taken into custody there at his Rockingham mansion. Jim Avila from ABC news. Didn't he also have a disguise with them or something back? I had a bag that had to disguise yet overnight bag. He had and and which is what you want to take when you're going to your life. Right. Was he going to his supposedly does X Y spray, but it but he was going in the direction the four zero five south to Mexico. That's the direction they were going. And that was the concern. That that's what he was going to do or commit suicide, so. So as the we were talking before, you know, Brett, and I were talking about the fact that the trial has changed the trial has changed the way so many things were covered. It was I mean to call it a gaggle of media people to understand it in the extreme, it was extraordinarily. I mean, there were there were trucks and microwave vans and reporters from all over the world who descended on that trial. And you had a very media friendly judge who said. Yeah, let's fire it up. We'll do it on camera. Yeah. He he was a little star struck. Marcia Clark tells the story the prosecutor in the case that she got called into chambers one day, and she thought, oh, what's going on? We're going to have some kind of big meeting on some piece of evidence. And instead, it was, I believe, Chuck Norris, or somebody like that who was in the land Saito's chambers. And Lance had promised judgy to at promise that he would be able to meet he would introduce them to. Marsha clark. And she was like, just astonished that this was this was what was going on. I mean he Lance Ito was named with everything now. I little bit disagree with I heard you guys yesterday. And I've heard you guys talk about that, that the publicity changed the verdict. I don't think that's the case. I think that the change the verdict was Johnny Cochran astute realization that the police department had a lot of things to answer for in this was the way to do it. I think that what for me what changed about why you cover courtrooms. Is I'm looking at the evidence the entire time and I'm thinking guilty. He's going to be guilty. There's this. There's just no. I mean, I think there was a pool in the newsroom, I said in less than a day.
