I think that some people have lost their resolve for wearing masks and social distancing. And so you know, we really need to double down and try to Keep our social distance and where our masks and watch your hands and do our best to slow this down. Would you agree that about? Well, we are starting to fill up our hospital, and I think that When we have more and more people being infected, more import people. Yeah, let's let's get to the good news, though. Here Pfizer eyes asking the FDA Food and Drug Administration for emergency authorization of a vaccine. The two goes vaccine as far you understand how so obviously it comes in two phases. How would that work? Well, five is going to ask them soon. They haven't asked yet because they have to get A little bit more safety data, um, that the FDA requires But in a few weeks they will have a sufficient amount of information, and they will go to the FDA to ask for an emergency use once they get that. There is an ability to distribute that vaccine, but they have to manufacture it has to be given in two doses. And they are not gonna have that many produced right away. So it's going to take awhile to ramp up production and to be able to get millions and millions of doses available for the public. That's a thing right is maybe finding the vaccine for Cove it But there's a lot of questions between here and there right in the fact that was developed in about six months, right? I talked to you. I talked to other infectious disease professionals, and they said, Usually these things take about two years. Maybe you can get it down 18 months or less. But to be Highland like that have something in six months and Here we go. It's six months. Are you surprised at how quickly this was developed? Well, I think we put all of our effort into it. It's kind of like a Manhattan project project to put a person on the moon. And you know, when you put all the resources you put all the best scientists together. And you create the trials right away and you get them enrolled quickly. I think you can. Demonstrate that we can move science along faster and it can still be safe. So I think the issue is really making sure we find enough vaccines that works. So risers one. But there are, you know, at least 4 to 8 other center being tested worldwide. That we should hopefully have results from in the next couple of months, a swell and it'll be good if we have just more more than one vaccine so that we can get production going in multiple facilities. Yeah, I was reading. There's something like 11 vaccines and light states trials right now for here in the U. S. And obviously there's worldwide. But you were you think about Madonna. I think that's the other one that uses similar technology. And I guess we're expecting their results out in a month or so. I think their results will be a little sooner than that. But I expect to see a preliminary look and we'll see Diddy. Do you know something? Do you have a stake in modern idea area on the board of directors? You know, sometimes you think I'm a terrible poker player Actor. I don't know in it. I'm just hopeful that we see one vaccine. It would be great to see the second one with the same kind of results because science is about reproducing results. If you could do something over and over again, then it's probably true. If it happens one time, then who knows? So it's really, really important that next study come out. And that we see something kind of similar and also we have to wait until this gets out a few months because very preliminary data 90% early on, But that's only with a 2 to 3. Months of Observation of patients who have been fully vaccinated with five certain and I think we'd all like to be happier and see more data like six months. To see if the effect is lasting. And if the benefit is still there after six months time. I think that will be the proof that we're all really looking for. That's the thing is, we're not going to know how many boosters if you will, you're going to need because there's a lot of questions. They're right and it depends how fast the strain mutates. Like. For example, the common cold att mutate so fast that we That's why we can't vaccinate for the coal because it just continued to mutate way ahead of any any drug. We may give. It were worried if that is a trait case, but it doesn't look like it's that way with Corona virus doesn't Well, we don't know yet. I think it's too soon to say. I think that you know whether it mutates or not. I think what we're really looking for is there's still persistent immunity. At that six months time, period and or are there more cases they're just going to eventually accumulate? I think that's what we need to know beyond the preliminary data. So it's great that we're seeing this. I'm very Happy and excited about it. I think it is encouraging news during a pandemic when we haven't had that much encouraging news, so it's good to hear something positive. And I look forward to the next study in the further analyses and also for five to present their data more publicly. It will impact seven of our county's it will impact all seven of the red counties in the state of Ohio on that is the order is that will be necessary for individuals who are out in public. To wear a mask. Primarily this will be when they're in a public place inside a restaurant bar, jewelry store, some other some other place in in public. This will stay on a CZ long disorder will stay on as long as that county. Is it a red level or purple level? We certainly hope that these counties will drop out of that level. Ah, And if they do our current order says that then the mandate of the mask in public will go off S O. This is aimed specifically. Ah, at the seven counties. Where were the most concerned does not mean that people should not were a mask? We wouldn't ask him to wear a mask in public and every other county we really do. We think it's a good way for us for your county not to get into that red category. Um But it is only going to be required in those seven counties. Let me just highlight a little bit of this. bridal shop owner ten year Tanya Hartman believes it the constitutional rights in the state of Ohio have been had been violated and she she's filed a lawsuit I tell you you know I read the story the Columbus dispatch and in one of the one of the lines in in a lawsuit and I'm quoting from dispatches at this quote the suit notes that the Ohio department health department considered that some essential businesses included shops that sell liquor marijuana dry cleaner services in the state lottery and yet here right all season tires we had toward June it's coming from no matter what and people are still needing to get married or what so other plans and in some cases I've read stories or people are getting married in in front of no one except for the person who's marrying them the show goes on and this bridal shop owner in in Columbus I read does her business by appointment only so there's no you know thirty people crowding into our shop there in Columbus it's again it's it's a small amount of people coming in one by one or just a couple people at a time and by appointment only and so I want to talk to the organization that is representing the bridal shop owner in the brunt of the bridal stores called guild gilded social and the organization that is representing her it is called eighteen fifty one center for constitutional law which the dispatches the bills itself as dedicated to protecting the constitutional rights of Ohioans in eighteen fifty one is when the Ohio constitution was implemented and I'm no one better to talk about the suits and about potential suing the state whether it's state or federal court local jurisdiction however it might be very small group of attorneys that do this kind of work so I you know but with all the businesses affected I I thought something would have been filed and frankly I thought this is an issue where given the quickness with which it came it would there would be litigation prior to ours I was surprised when there wasn't so many people rolled over act tell you when when nothing happened we look at the issues and we saw a few soft spots in the underbelly of these lawyers and their quietly looking for new clients and that was difficult none of this rotten Tonya Harding finally came to us and that was a week or two of sitting on our hands kind of quietly looking for somebody who had the courage to step up and fight the state knowing that you know this is a very radioactive issue yeah and they're gonna be folks that are supportive but there can be a lot of folks that that shot you down and say that you you you were seeking to do something dangerous there are a lot of folks are hyperbolic the terrified of the virus and believe everything that their government will tell them hook line and sinker so she had the courage to do it and she was the first and most credible person that we can make an arrangement with and we decided to take the case filed Thursday well I I thought I'd you know by may cleaners can be open but a bridal store cannot and to me I think you got a legitimate argument there well in the in the classic sense of equal protection there is an equal protection problem because there's arbitrary treatment an arbitrary discrimination based on the identity of the business so that's step one our claim is not a pure equal protection claim because frankly those are almost impossible to win in court you more once it's about minority rights or either gender or something else but that is the point of departure in the point of problem problematic behavior by the state here is regulating on the basis of the identity of the business of regulating for safety you know if you have a wide clear safety standards across the board frankly it does not matter what you're selling one way or the other to classify a whole swath of society is nonessential yeah eight it's quite sad to be walking to work more out about and see the signs everywhere we are essential it said that you have to say that to the government that you've to clarify declared nonessential even though we have customers and clients and we were making a small profit which proves in the free market system and in fact you are essential not to say a museum and and you know bars and restaurants and all these things are necessary for survival but the majority of the exempted essential businesses are not necessary for survival either you listed some of those things it is a serious problem but now we're going with that ultimately is a very humble claim the procedural due process and I should be clear we don't litigate cases for money we don't take money from our client I haven't taken a dime from a client in twelve years and we don't litigate to get money for our clients in court for this writer does this to enjoin the law all of our clients it is to stop the law to make the logical way draw a line through it and the best way to do that in a case like this we decided the procedural due process claim all were arguing business Ratner and all the all the other all Ireland to hold their not ascential has the right to a hearing where they should be able to object to force the state to justify why they are not essential and why they are too unsafe the open even if they use security measures and safety measures of the type of the statement says so for the same thing and on and on but the state has no hearing process you have a I dictator light implemented these orders unilaterally now here beforehand no legislative testimonial or deliberation or other process so all you've got is due process under the Fourteenth Amendment which says you get a right to a hearing when the government shuts down your business you get it immediately even if the shutdown is temporary lodging very clear well we're in federal court in doing the law until those hearings are provided now if the state doesn't provide those hearing laws in joint but the state does provide those hearings we think we can run a great number of businesses that are declared nonessential through those hearings have been opened up because they can prove their safety they can prove their essential if given a hearing talk with Marie's Thompson executive director of the Columbus based eighteen fifty one center for constitutional law and that focusing specifically on the Ohio constitution is is it is generally as a as a constitutional a lawyer do you look around the country look L. obviously look around the state of Ohio but you also look around the country and I think you alluded to it there that the government do you do you just see legal a potential legal action everywhere you look right now when you when you look at all these government in a lot of people say government over reach in there there's a lot of things are being done on the fly in in and understandably so in some cases but do I'm good I mean do you think that there's gonna be a lot more of these kinds of things going on across the country I don't really the government strikes quickly and out of nowhere intensely catch folks in my business card I am part of the network of folks who do this work in other states the only one or two of us in each state if even and I could tell you that I was on a conference call Wednesday nobody has taken any action that we are the first amongst our group to take any action here in Ohio or anywhere else for that matter so with this is the first credible case that I'm aware of nationwide other than some of the one offer which is liberty cases right away could the case only they'll they're gonna call abortion cases but in terms of applaud attack on the regulatory scheme you know these things take a lot of time to plan when you when you're suing government they have so many adults they have so many tricks then the procedural hoops they can they can pull on you frankly it takes a lot of time to carefully examine the law and troubleshoot all the ways that you can lose the case if you're not exceptionally careful so it takes a long time to turn the ship around about one of these cases and frankly because folks are gonna have a hard time with money damages these people are gonna be for injunctive relief organization a lot down what if any criminal defense cases when somebody's being prosecuted and one of the problems there is a lot of bad constitutional laws made when you're a small business owner gets the bankruptcy lawyer down the street who making constitutional claims for him and all the sudden you got a bad precedent yeah so I I think there's gonna be a less litigation folks think this is a very all up hill battle and if they're not usually one yeah I've seen some of the comments with respect markes say I'm surprised it took so long I'm sure this is the first of many cases I wanted to tell you that you couldn't find a client filed the case there are hundreds of people that want to sue the state really you are claiming the facial claims so we we win for everybody if we win our case but by the today a very difficult business we filed three to four cases a year okay to give you an idea and we threw more government than anybody and we're doing critical cases here so while that's across the state includes mostly local governments state governments so I don't think you can view our location I think there are cases going to be the case upon which this this thing rises or falls right now but I can tell you that we think this is a multi year battle coming out of this there might be forced healthcare mandate more regulations on business on your body higher taxes down the road to come up for the the lost taxes now yeah well we're we're standing up for what's going to be two to three years of often on litigation on this at least at least it really that's interesting thank you know down the road and yeah no doubt when you're talking about life after corona virus and what's gonna happen then but one of the one at great stuff and one of the when asked "And now we're getting word from the the emergency management association so let's go to the neckline code issue that's in front of us all one of the biggest things that we are currently working on is managing the information for all of our partners obviously there's a lot of information coming out from the state from the different departments within the county and from our local jurisdictions and all that's coming into our emergency operations center which has been activated for over a week now and bring that in between that together so actually one of the difficulties that we face is the fact that this information is constantly changing I passed out to all of you our latest said Rep which we just issued right around noon that's already out of date because we got our second confirmed case so we're trying to get at least one situation poured out daily and we share those with all of our local fire chiefs of police chiefs all the local elected officials mayors the township administrators just so that everyone has sort of what we call that common operating picture and constant communication so that we can work to anticipate any needs that our communities might have as of today we currently have eight of the four nine jurisdictions that have declared states of emergency and clean the seats Cincinnati Anderson township Colerain township Norwood Woodlawn Lachlan deer park and spring Dale in addition to the county's declaration the state and the federal decorations that we received one of the other things that our office is currently working on regularly to this was the coordination of PP amongst our first response partners PP protective personal protective equipment for first responders and for the hospital so things like the gloves N. ninety five masks the surgical mask and one of our big efforts is really coordinating the sharing of information between the local fire departments and hospitals as far as the regional cash that Greg talked about making sure that everyone is aware of what the limitations are how to appropriately ration the use of PPE and if they do need to request that from the region cash making sure everyone's using that same process so that we can constantly monitor our resources and anticipate any potential shortfalls which right now we don't cash is going up also communicating with the state of Ohio EMA in Ohio department health so that if we do need to request state level resources to supplement what we have in the region a we're prepared to do that and that's not something we have to figure out when that time comes so my questions thank you thank you for the update I any questions or comments for right no question thank you all right and again.
