"That I mean I I think to some extent it sounds different from the Obama department justice because this is the way it's supposed to operate so when the president of present a bomb appears to withhold information from the incoming administration that's inappropriate it's improper it's unprecedented it's a scandal but it's not worthy of a criminal investigation you know I I've I I've obviously been in the department of justice for twenty five percent of my professional career I can't think of a statute that was violated them in that you know again that act it was inconsistent with tradition and practice but at the same time I don't see that that the violation of law from a technical standpoint it but however what if your and I don't it's it's interesting because you were able to see quite a bit you were able to learn quite a bit but it was also because the Muller investigation was by definition independent of much of what was going on the just department you didn't yet have direct odd or do you tell me how much direct contact you have with Mr Muller and with his team or what kind of oversight were you able to have yeah so I determined early on that I would you know make sure that we conducted the investigation above board and above criticism and so I brought in a U. S. attorney but I'd serve with in the bush administration who is he came back to be in the the trump administration to be U. S. trainees from extra California born in the Washington DC to be in you know sort of be my person that supervised and paid attention to what was going on and he he was receiving daily briefing keep me updated but that frees me up to do all the rest of the job I just did I knew that I could not be overcome with only the Muller investigation there was so much more and I need to tell me that I could cross the can interface with them on a daily basis and make sure that you know that everything was going smoothly again that we're following regular order and to that end Mr wood agrees I think that's a very important point that a lot of people are missing through all of this that you know you had a department from the department of justice by the way that should not have been paralyzed by this this ongoing Russian collusion hoax that we were so consumed with but but that was an exclusive the justice department the title again is above the law the inside story of how the just department tried to subvert president trump whether they were moving to impeach him whether they were moving to get him to resign whether they were moving to bring criminal charges against him either way it could have also just been a strategy to paralyze his ability to get anything done by having this cloud hanging over him to talk about how widespread that wise in the trump administration it was hard to attract people to work for it was hard to work with this and get people confirmed it's frankly a miracle that so much they get done with all of this going on all this unnecessary investigation no and continued to get done that you know is the conclusion of the book I talk about how I could write an entire book of all the successes that we accomplished during my time at the department of justice and unfortunately with all overshadowed by the Muller investigation in the you know the really the attempts by you bad actors to undo the twenty sixteen election results and you know as I look at a look back at my time and I'm very proud of what we accomplished you know and I'm and I just think of all the great men and women that I worked with that every day you know showed up and did their job without trying to you know frustrate the president's agenda and at the same time there were several you know that that that we're trying to frustrate the president's agenda and you know many of them of the F. B. "Do has been developments here while we've been on the air in just the last thirty minutes acting director of national intelligence Richard Grinnell has declassified that memo from Susan rice to herself talking about how president Obama that in January fifth meeting in the oval office with James Comey and Joe Biden Sally Yates and James clapper an odd ends if ms rice herself and he emphasized that this investigation into incoming president trump must be done by the book that was important part of it and make sure everything's done by the book what what book was that exactly and what now have we learned about this very odd transition process between the Obama administration and the new trump administration was any of it illegal we've got a pretty good guess to discuss all those things is name is Matthew Whitaker you know him as the former acting Attorney General of the United States and author of a brand new book above the law the inside story of how the justice department tried to subvert president trump missed would occur thank you for joining us Sir well to be with you today thank you that's quite if I wanna get in the book for a moment let's react to this news here what we what's now being revealed it appears as though the president was advising James Comey and John Brennan the whole intelligence community hierarchy there to withhold classified information and sensitive information from the incoming trump administration as it relates to Russia are you surprised at that I am surprised there is no authority that a you know incoming administration can be prevented from saying sort of everything they need to know to run the country and I I had to laugh at the the Susan rice memo because obviously the by the book was four days after the trump administration came and Jim called me was in that meeting broke the rules and didn't do a by the book and sent over to agents to interview general Flynn with no predication so I have to you know I wonder if that's really what happened in that meeting or that you know email was purposely written for you know thirty six what well that's the thing is are you you were at a United States Attorney for five years during the bush administration your chief chief of staff to Attorney General sessions you were acting Attorney General you know what that book is so insistent right says by the book all right it's it's not it's not the book of law is it did they break the law here well that's you know that's fundamentally what John during the U. S. attorney in Connecticut is looking into that general bar after I'm looking to you know I I wrote this new book above the law to talk about this sort of returning the department of justice to regular order you know when when investigations of the into the national security investigation that was going on the chemicals that fusion was going on was supposed to be closed the day before the meeting on January fifth that she is recording in that email but then we look at the various steps that were made regarding general Flynn and ultimate led to a criminal investigation of president trump and I just think there isn't there was nothing that was done by the book and in fact is as we look back on this as it covers most storable account and as repairs I record in this book there every step of the way rules were bent and laws may have been violated I've you know I think ultimately that the jury is still out on that effect and Mister Whitaker you do make a very important point in your book and I think it refutes one of the key difference is that the Obama team and James Comey and John Brennan James clapper have tried to make here and again Matthew what occurs book is above the law the inside story of how the justice department tried to subvert president trump and their argument is this listed in hindsight it's easy to say that there was nothing there but we had all of this evidence we had smoke we assume there was fire we had to investigate it otherwise we wouldn't be doing our duty but you make a very important point here if that was the case why did they not alert the campaign and the candidate of this potential us a version of our laws within the campaign itself I mean that you would think that they would pick up the phone and said Hey this bad thing is happening you guys should be aware of it right I am what what it appears is is that they were just watching it watching it develop in you know you see the you make one point that I just it's it's the right there was they thought they saw smoke they never had fired they never had any evidence of any crime Vinnie relationship in fact what they had was quite the opposite everybody they talk to everyone I interviewed everyone they wire tap everything they tried to do an investigation advancement turned no new evidence up and so you know really by the time the trump administration came in this counterintelligence investigation should have been over and we should never ended up with what ultimately became the Muller investigation and you know to me since there was no collusion there never was struck and page even communicated that their techs they're famous text messages but you know it it appears to me that Bob more structured the whole pro and the team structured it as an obstruction of justice trap for the president with the goal was always creating a case for impeachment and removal of the president I just you know in my book I I've been pretty emphatic this can never happen again to a president a candidate or even an American citizen if you would occur is the author of the book above the law the inside story of how the justice department tried to subvert president trump and I find the title intriguing and a couple of ways first you specifically say the justice department obviously is acting Attorney General you got a first hand look at what was going on in that department all right talk to me about how extensive it was how widespread it was and how much needs to be done to fix the problem over there yeah well so if you look at the cover you know I have sort of the three the bad actors call me McCabe and Strzok on the cover and you know I mention others throughout the book and you know obviously I could have expanded the book but it would've been a much thicker home if I'd gone to the intelligence community and everything else and so you know I try to keep it to what I knew about what I had the most experience with and tell the story from my vantage point as the at the top of the department of justice in looking back with what we know and again we continue to have these developments both in the general when case yeah and in the you know with his unmasking and his dismissal and all these things but but they're they're pieces of a puzzle that as we see it clearer and clearer it is it is it is becoming more obvious to me that this entire you know the national nightmare that for two plus years and thirty million dollars we went through that ultimately yielded no evidence of the fundamental theory of the case and it but we use every day every week for that period of time as a cudgel to you know smash the president over the head with it so you know I don't deny it obviously I was in the cabinet I'm a big fan of the president and know him well and again I just I am amazed to weather the storm a stronger on the back end and you know he continues to fight every day to you know for the American people so it is a proud to serve them it's a great but I I'm all I'm only about I would say a little more than halfway through sixty percent of the way through it and I know the story very well I've been reporting on it from day one literally on this program and I've learned things already in this book it's a good one above the law the inside story of how the just rubbing try to subvert president trump that missed what occurred at the in the import the other part of the title that I find very important is that it's it's it's a bird president trump you focus on what happened after he was sworn into office so you know a lot of times of the day well you know he was the candidate of the was a campaign that was a doctor with the election and we were worried about you know protecting our democracy you talk about the stuff that happened after he became the head of the executive branch of government I mean talk about subverting the presidency and by in terms of burning the will of the American voter yeah and if you think about really the the crux of the investigation of president trump it happened right after the firing of of Jim Comey at the FBI director Andrew McCabe who is the acting director of the FBI decided to open up a criminal investigation the president I'd states that because in you know for a moment of panic the deputy Attorney General Rosenstein to appoint a special counsel and then you know that really it just never seemed like it was going to end I mean even the time that I spent acting trade girl I don't know if you got to the this part of the book but I sat every day waiting to get the report yeah and I was told it was eminent and you know ultimately six weeks after I left it was delivered to bill Barr four hundred plus pages with part two that was all about attempted obstruction of justice which is you know I was told was you know sort of not even a legitimate theory that they were considering so I mean clearly you know and and and after that report came out that was when you know I decided that on behalf of the you know the good men and women of the department justice and there are so many both that you know DOJ and FBI and everything that the part of the DOJ that I would write this to tell you know my story and recorded for you know history so that everyone could read it out my vantage point from that perspective yeah Attorney General William Barr who succeeded you as Attorney General I he he seems to be one of those Washington DC characters where he is getting criticized from both sides of the equation certainly more so from the left and the critics of the president but there are supporters of the president were also criticizing him specifically about his remarks yesterday saying the present but he doesn't expect the president Obama and vice president Biden to be investigated or criminally investigated because of their involvement in whatever may have happened here I'd love for you to comment on that is is that was it appropriate for the twenty general make that statement now or do you think that the law supports that judgment well it you know to some extent I mean this is the way it's supposed to be the the regular order the department justice demands that we don't open up investigations and once we have evidence of crimes and what he was saying was we do we have no evidence that president Obama or Joe Biden at this point in time committed crimes that we that we can tell based on the investigation we do have evidence of other people commit crimes and so you know to some extent this is what regular order at the department of justice look you don't open up investigations trying to develop evidence that would support your theory like we saw in the general one case like we saw on Russian collusion case and
