Thank you all right before we get started we should note that the wall street journal's publisher dow jones has a commercial agreement to supply news apple services. Okay so tim can. You remind us how we got to the trial that starts today. There's actually quite a dramatic backstory. Here right now. This is a clash of the titans. If you will it goes back to last august and the creator of fortnight epic games surprised a lot of people with an update to the fort game on the apple app store that aim to create a payment system. That would get around apple's payment system. They'll allow users to go into an epic games created pay system and that was a huge violation of apple's rules and it resulted in fortnight being booted from the app store and what followed was a pretty big legal battle that we now are seeing take place in a courtroom in oakland california and so as the court case. Kicks off today like you said in oakland. What's really the central question of this case. What is this all about. There's a few things going on here. Epic feels that apple is using. Its power anti competitive way specifically. They argue that apple has this delivery device or distribution device for apps on iphones and that it's one hundred percent controlled by them and that that is a monopoly in a bad sense and that they're misusing that power so what this case comes down to a large way is the definition of what a market is in the digital

So this is this is a very you know very interesting year in the history of of of that league at the time But there's an interesting sort of dynamic that i didn't really know about until i dug into the story and that is and maybe you can get into this a little bit. The oakland clippers and sixty eight had the second best points total and by extension record in the entire league but did not make the playoffs. They lost they were they were. They were one point behind the san diego toro's in their division. They just had the they had the unluck. I guess of being in the same division and not making the playoffs despite being one of the best teams in the league. Well huge huge your disappointments and well referee call offside improperly or not or so-called winning goal against san diego and so there was a game near the end of the season with san diego that determined winter interesting. Yes and We had our winning goal. called back. For offside and we've been recapture after that the sin and And here go call. Sign a and again. I i if to our listeners. If you if you look up the actual standings in nineteen sixty eight. You'll notice that the san diego toro's got one hundred eighty six points and this is sort of using this. I guess now known as the newman system is six points for a win. Three points for a tie and get any points for a loss and you got one point for each goal scored up to three each game right into the nsl adopted in years afterwards but again you look at the statistics and the clippers had the second best point total. That is one point below the toro's which had the best in the league and the second best point total in the league. The clippers did night in that year was better than every single other playoff team in the league and they still didn't make it and so that's that's gotta be maddening to a team. That's coming off a championship season. When i get all the year prior the double if you will not having a chance to repeat and deservedly probably soda and they should have had the opportunity in summary ship perform the that must've been beyond maddening was beyond so i mean i i okay. So how does your owners i mean. So where do they get this. We're in it for the long haul. That because i i would imagine if i were owning this franchise and seeing now a second league that i'm part of no longer viable all of a sudden and and having the you know having the the the added you know kick in the butt of not making the playoffs when arguably should have Why were they interested in sticking around with this thing given all those things e money losing. I'm sure to. I truly believe mr ilias ron. Neil were That they love the game. And they they love the work that we had done in this franchise again and they had the money to keep the team together even more d- salaries and all that and we're willing to wait it out and and see if the would get organized again on a national basis within a reasonable time and it may well have been that if our bencher with the international game which came later if those games had been more successful in terms of Income that they were stuck it out but there were a two factors number one. The united states soccer federation denying us permission to continue that program and number two all of a all the bureaucracy involved. They ended up saying this isn't any fun anymore or out and So that's sort of how it all ended all right so so let's talk about that. Nineteen sixty nine season and against for those you know. Soccer aficionados The nsl truncated dramatically to just five franchises. That season that next season. And without the oakland clippers right which. I'm sure Phil wisdom and and the league would have loved to have had is the sixth franchise but You recognize that. What oakland been. The furthest distanced team in that That beck group of six Travel would have been probably very cost prohibitive and you were not sort of not certain of the. Nfl was perhaps going to survive. So you saw international games yet again as the way to kind of at least hold on until perhaps they got their act together right so i also some more irony though because the nfl maybe to its credit right. They split their their their league that year into a not only a an internal five team tournament amongst their own players but then also had an international component where they imported five teams from just like the isocell and just like the usa full teams from abroad again and to me. With very minimal language, very minimal educational experience, no schooling, So we try to find ways to actually make sure that we're also holding them in a way that they're actually have the support that they need to be able to be successful. His school has always had students who needed help getting food or enough food, but things got worse when the pandemic hit. Families had to figure out how we're going to supplement this food that used that we usedto get at the school. It's it's kinda is difficult, exactly. Ah, fathom to think that we take something simple things like like lunch and meals and breakfast for granted, because it's it's expected. It's there. And once we've removed and you give him something else, different avenues, Actually, Tina lt's thinks it's kind of difficult and target our job. I think to find ways to toe mend that and connect families to these three services. This summer, Vaca worked at a food distribution center at another school in the area. But families from his school couldn't make it usually because they lacked transportation or were quarantined. So he got creative and what I would do is I would go check in the morning at that school and make sure that everything was going well and what I would do that would bring food back because I knew that there's families would be Needing this food and I would have. How's it at my my sights and parents know that they could come and pick it up or I would drop off on my way back to my school? Still, that wasn't enough. And he says I didn't face the same type of resistance that Robinson did. But he also tells the story of him and his family in Baltimore is struggling to find a place to live because there were people there who didn't want African American neighbors didn't want them living in their buildings. And so his path wasn't the save is Jackie Robinson. But it's sure as heck wasn't easy. And he broke a different barrier, and he had no choice, but to be tough or he wouldn't have survived and character and leadership that toughness. That all kept him going. But also.
