"He called the allegation from Daniel's a con job. And then she sued him for defamation, saying that he was falsely accusing her of lying about being threatened on. So she sued and she lost Now if I recall correctly What the court said. Basically was. The con job was an opinion that it wasn't really a factual statement that could be defamatory, and therefore the therefore she could not have been defamed by this statement. Exactly So to be defamatory. It has to be a false statement. A provable fact. And what the judge said. And this is a former long suffering Judge Taro in Los Angeles. Was that the whole context? It's trump. He's a blowhard on Twitter and elsewhere. The tweet is done in You know, you evocative terms and not in sober terms. It's it's meant to be an opinion. What is a con job anyway? It's commenting on a piece of news that none of that shows a provably false statement of fact, and therefore it's protected speech and therefore Trump won his anti slap motion against The suit and later gotten order entitling him to more than $300,000 in attorney's fees. The ninth Circuit Court of Appeals affirmed that decision and now The Supreme Court has refused to review it, Josh. That decision is Maura important on a somewhat obscure issue than it is on the lead issue of whether or not trump the famed stormy Daniels. The Supreme Court was never going to review on the question of whether that tweet was defamatory or not. That's too mundane an issue and not controversial enough, However, what is controversial in legal circles is whether anti slap statutes which are state statutes apply in federal court. On when they do and just to remind everyone in an anti slap statute. This is a state law that basically the purposes. We don't want people using defamation claims in the courts in order to stop other people from saying things they find inconvenience. So if you sue someone for defamation over a statement that was not defamatory on was commentary on a matter of public concern. You not only lose, but you end up having to pay their legal fees. And so it's designed. You know, we've seen we've seen a number of these sort of performative lawsuits where it's like, I don't like what this person is saying about me, so I'm going to sue them. It's designed to discourage that, and in this instance it was Donald Trump, making a statement on a matter of public concern of his opinion that was not defamatory on what the court said was. Not only did he not the fame stormy Daniels, but this was an effort to suppress the former president's speech, and therefore she should have to pay his legal fees exactly an anti slap statute of the state statute that sort of a special procedural vehicle. To attack a meritless defamation claim, and it's been somewhat in controversy. Whether or not it could be used in federal court on the Supreme Court refused Tol ache the bait to resolve that issue here. And so what? When? When you say that? There's a split among the circuit courts about whether these state statutes could be applied in federal court. Isn't the Supreme Court usually supposed to take up cases where there's a split like that? Why would they have passed on this one? Well, they may have decided that they're too many issues in the case, um, that are not well suited to do it. They may have just not want to do it in a trump case. Uh, they made think that the split isn't clear pronounced enough yet There's really no way to tell, but they were just not looking to resolve it at this time. And so, presumably the fact that that Daniel's appeal this ruling twice to the appellate court's none of the Supreme Court that just racks up more legal fees that she's going to end up having to pay if the president's Exactly what happens now is that Trump is able to file a supplemental motion in the trial court asking for more fees for the fees that happened on appeal. And since he's got very expensive lawyers, um that's going to be AH, lot more money. Not at the Supreme Court level because that was mostly passive, just waiting for the court to say no, We don't want to hear this. But on the litigation in the ninth Circuit that's going to cost stormy Daniels, another Couple 100 grand. I would guess. A nice full circle development. Stormy Daniels appeared on Michael Cohen's podcast, which Michael Cohen is doing of Michael Cohen is still in the custody of the Bureau of Prisons, but he is not in prison. He is an under supervision at home, and he's doing this podcast. He had stormy Daniels on and they talked about how they both now hate Michael have a natty Daniels, among other things, accused of anatomy of stealing part of her book advance. That's You Know, This is a well known accusation. He is currently under federal indictment for having allegedly done that. She also said she never felt comfortable being alone with him. She said that he weaseled his way into her Vogue photo shoot so that he appeared in the magazine with her. On after the podcast Cavanaugh decent Cohen a letter accusing him of defamation and demanding a retraction of various statements s are we gonna get to see a defamation suit between Michael have a naughty and Michael Cohen I don't know if God loves us that much, Josh, but I suppose it's a possibility. Although I do feel that there could be a bright line rule that you can't be defamed if you are currently under more than two federal indictments. It just seems to be sensible, You know, but we'll see. I think it's more mostly puffery. Aziz you would expect from either Cohen or of a naughty It's It's sort of like You know to bro's and backwards baseball caps, chest bumping in a bar s, so I kind of doubt that it ever actually ripen into litigation. 11 quote from the response letter from Cohen's lawyers to have a naughty was This demand, which is both frivolous and made in bad faith will only lead to you garnering more negative press, which, in my legal opinion, you do not need given the many years in prison you are facing in multiple federal cases and in multiple jurisdictions, including for your conduct involving Miss Daniels and your other former clients, unquote. Is it usual to offer your quote legal opinion unquote to the opposing party and in a case no, and generally one tends to disregard the legal opinion of one's opposing counsel. But I mean, what they're talking about there, of course, is the strikes and effect. The notion that when you call out someone for alleged defamation and threatened to sue them, you tend to draw far more attention to the alleged Defamatory content, which can be bad for your reputation. He never wants to miss a show so i've tied him up and put them in a closet so he can't be here today because the guy needs a week off and we're gonna take some of the best moments from the year. Twenty twenty starting with the story of and this was a bad one clearview and their face recognition technology. So last week we talked about the clearview a i company who were doing the facial recognition and bragging the web for three billion face sprints and made them available to six hundred police department so they could identify people within seconds since then clearview has increased their collection of cease and desist. Letters are just not exactly what they are hoping to be collecting from major. Us social media players. The first one they they received was from twitter a couple of weeks ago when twitter told clearview to stop collecting its data and to delete whatever it had. In addition facebook has similarly demanded the clearview stop scraping photos because the that action violates facebook's policies and now google and youtube are also both telling clearview to stop violating their policies against data scraping. Clearview take on. This is defiance. The ceo hone thanh fat was interviewed last wednesday morning this morning. News show He's told to trust him. He said the technology is only to be used by law enforcement and only to identify potential criminals. Tom fat claims that the results which which is not encouraging our ninety nine point six percent accurate. I guess though you wouldn't wanna miss. I want a false positive. Miss identify you as a bad guy. So i guess accuracy is is a better thing and he also claimed that it's his right to collect public photos to feed into his facial recognition archive. He said. there's also a first amendment right to public information so the way we have built our system is to only take publicly available information and index it that way and we by the way there was a recent supreme court decision having to do or was it supreme court but maybe ninth circuit court having to do with scraping of linked in which they ruled. Yup you can't stop scraping if it's public information. Y'all can't stop it. In fact i have that i mentioned that here So we know from last week when we talked about this the that in illinois at least with their bitta. The biometric information privacy act You know it's illegal there And youtube statement read quote. Youtube terms of service explicitly forbid collecting data. That can be used to identify a person. Clearview has publicly admitted to doing exactly that and in response we sent them a cease and desist letter as facebook Facebook said last tuesday that it has demanded that clearview stop scraping photos because the action violates its policies. Facebook said we have serious concerns that clear views practices which is a with sorry serious concerns with clear views practices which is why we've requested information as part of our ongoing review. How they respond. We'll determine the next steps. We take which i'm sure. Facebook attended sort of sound ominous And taunt that defended clearview as being a google like search engine. He said google can pull information from all different websites. If it's public and it can be inside sorry. Excuse me if it's public and it could be inside. Google search engine. It can be an hours as well. Google disagreed saying that clearview isn't at all like their search engine. Google said there's a big difference between what we do and the way your shanghai ing everyone's face images without their consent. "7 23 of his Alabama's Morning news. I'm J T and joining us now from Paris, Riley and fit Hurry. Fares is here to talk about some some legal craziness going on a Kirby. Good morning. Welcome back in the morning. J. J hope you're doing well. I am, sir. Thank you and your family as well. This is interesting here. California's ninth Circuit Court, which is traditionally ah, leaning left on a lot of issues, has had a ruling now on large capacity gun clips. Let's start at the beginning of this and find out what their latest thoughts were on this It's fascinating union. That cord is based in San Francisco J T in California passed alone. Own gun clips, and this law said that it would outlaw large capacity gun clips, but it did find a large past again clips, his gun clips holding more than 10 rounds. Which blocks bread, as many guns are designed to hold more than 10 rounds just in a normal manufacturing process. I have a block 17 that holds 15 rounds, so those guns would would not be available in California at all. Well, I thought that they rolled the other way in. Rule against that law and change their mind. That's not the case. There's still no standing firm within now that when what happened, California passed that law. Also, it was taken up to the Net started Court of Appeals. And the argument was this. This law violates the Second Amendment of Coast. And the California they're not certain Court of Appeals actually agreed, and said that that long does by late of the Second Amendment and a judge chemically is whether, after the opinion And he said that to limit capacity against 10 rounds could burden people, especially people that live in rural areas and preventing him from protecting their home and property. So that law now it is allowed. You can have more than 10 rounds in your magazines. You can't but it was very surprising to see as you know, as you mentioned the not circuit. Ruled. Wait did and I think that's a very sound. I agree with, you know, I was just going to get your opinion on that as well. Had you been on that court? Would you have agreed with them as well? It sounds like you would and you know when you talk about limiting people's ammunition in their possession of weapons. The Second Amendment is there for a reason, and I know people will it's you know up against, you know the government so we don't know. But the Second Amendment allows for us to own firearms and toe limit people on that in any way now. I don't think we all have bazookas sitting in our house. But You know what I'm saying? Because criminals don't pay attention to. Ah, what rulings are by the courts, period end of story. They have magazines, 30 rounds, 40 rounds. You know these long clips and magazines So you know for for law abiding citizens to be handcuffed if you will, her hands tied to not be ableto armed themselves, protect themselves with whatever they feel necessary, like you said, in rural areas. Is wrong, and I'm glad this court, you know, once again leaning left a lot of times in a liberal court there in San Francisco to go along with allowing the clips toe isn't an unlimited situation. Whatever the ruling was, I think it's a good one because Only law abiding citizens who have been affected negatively by this thing, That's a great point it and you know, I'm on the second minute on a number of myself, and I wouldn't stand here and say. There should be no limits. I don't believe that. But I do believe that the second Amendment, their reason and then we we are allowed in this country to bear arms. And I just think an element of reasonable this needs to be part of our decision. Just like you said. I don't I don't need a bazooka under my bed. I don't need for that to be late. But I do like my Glock 17 with a 15 mile clip. I'm not pro bazooka. But I'll tell you what a grenade launcher you nice. I hate Kirby. Good stuff from California this morning. Surprisingly good stuff. Sorry. Thank you, sir. Appreciate you see you soon. You're dying to tell you Tirade. 7 27 Alabama's morning news, traffic and weather coming up here in just about three minutes. "President signed an executive order stripping big tech of its immunity I'm gonna explain this to you as best that I can and I can explain it I just want to do this is to singly as possible basically boils down to this big media companies like Facebook Twitter I would soon you too Google some of these they have immunity from the lawsuit and you say well how can this be an embarrassing we have it is me well the reason is is because they're supposed be acting as a platform but if you act as a publisher like a newspaper or a radio station near talk show or television whatever if you do Vance then you're not immune from lawsuits because what you're doing now is actively participating the content and you're responsible for the content when you do that so if your platform and you say okay we have a platform and anybody can go in post whatever they want to we can't possibly police all of this stuff well that's what Congress said years ago we're going to carve out an exemption for you because you can't possibly police all the stuff we want a free flow of ideas and we're not gonna have a free flow of ideas if a platform turns into a publisher in other words of a platform is an editor of content there we're not gonna have a free flow of ideas so it was initially intended to protect you and have your freedom of speech protected but what it's turned into is been a shield for these big companies like Twitter and Facebook to be able to do exactly what they want supposed to do which is edit your content and get away with it so the president just stripped him of that today and it's sort of complicated because it sort of goes to the FCC but it's got the justice department element in there too and this is about civil lawsuits so let's just say I put up something about Johnny beat today and I say the Johnny B. as a whatever I mean I mean the same thing goes into the van Gogh listed was that you're trying to be was I did that one time a boy just coming in reverberated around of people came back you said so I said I that was used as examples of Joe so I'm I'm whatever I say about Johnny bean ends up not being true now if I put that on Twitter leading sue not only me being sued Twitter for allowing it up there because they have crossed the line from being a platform to being an editor slash publisher that was their own choice to make and what cross the line for trump is when they started doing to him another man during the rest of us were and that's why I said you know this guy gets hacked off now with that being the him we should have done this a long time ago but he's done it and I'm sure it's going to be challenged in the courts but I don't see how Facebook or Twitter or E. or you to renew the I don't I don't see how they win I also believe it goes this record another win on you know they get the ninth circuit court of appeals or some you know some of these folks is that these courts are packed with liberals who knows what they'll get from them but if you if you talk about common sense is pretty straight forward the law says that if your platform that you have immunity from from lawsuits but if you're not a platform if you become a publisher or an editor and I think by anybody's definition when you flag something and say this isn't true as they did with trump on Twitter you're becoming an editor I mean that's the clearest definition of it you're in a court of law and say well what do you think this is and they'll go well I. D. we just it was a flag no it's in you made an edit on this platform when you delete somebody and say you can't you can't tweet that that said that it when you when you go on Facebook and you say and I try to put a move which have not us we posted that the video from epic times about the Wuhan lab you know this is early on in this thing and they said you before you click on the thing this is been proven to be not true of course now it's proven to be true but at the time they were telling us it wasn't true and you sure you want to watch this video is the way it was set up and then you go to click it well that's editing that's editing when they inject themselves into the process if they put themselves in between the poster and the user then they are an editor that's a textbook definition they are becoming an editor and so they go to any court and I even the liberal courts are going to say you of course you're an editor and if you're an editor you no longer immune that's what the statute says that's what the law says if you become an editor or publisher you're not immune from lawsuits so you can be now wide open being sued which is going to happen people have been trying to sue Facebook and Twitter for years over content and they've been protected within no longer protected and it's of their own design and it couldn't happen to a nicer bunch of folks I'm just telling you so what happens from here that I don't know I don't know what what is going to happen from here but it could very well be that Twitter and Facebook shape up and they say okay all right let's say all right if we if we if we don't do this anymore where you give us back our immunity and I'm sure trump will say yes I would that's all he wants is you to stop **** with people stop injecting your political a bias by the way let me play because I play this early but this I mean knowing what you know right knowing what Facebook does knowing that they have I mean they have a long history of doing this this is what Zuckerberg I'm here again just the case of the epoch times video that I put up there and that other people but of the year and then they they graded out and said are you sure you want to watch is because and you need to click here because this is not true of course it ends up not being true but they were telling us it wasn't true that's them editorializing right that being arbiters of truth here's what mark Zuckerberg said on CNBC I don't think that Facebook or or internet platforms in general should be arbiters of truth I think that's a kind of a dangerous line to get down to in terms of deciding what is what what is true and what isn't well you've already done it you are the arbiters of truth just because we don't want to be determining what is true and false it doesn't mean that that politicians or anyone else can just say whatever they want I want to listen to that one again that means listen to what he says just because we don't want to be determining what is true and false it doesn't mean that that politicians or anyone else can just say whatever they want just because we're going to be arbiters of this doesn't mean the politics you can say whatever they want of course they can say whatever they want it's called free speech what are you talking about of course they see they don't the they've got some gray area and the gray area is not on social media the gray area in their head is on constitution what is allowed and what is not they think that they don't understand the freedom of speech so when they say the arbiters of truth it's their truth so they're saying what are the arbiters of truth I mean this is a known true like global warming for one thing of course we got to get rid of these deniers because that's a lie and we can't allow lies on our platform that's where they this this is how they justified in their mind they think okay well we can't we can't allow false information I mean you're not so you're certainly not saying that we can all fall out false information and so we got to get rid of wrinkles while false information to them as anything they disagree with that's what they've got in their heads they don't understand that I have a right to my opinion about global warming and they can say well this is untrue or whatever but I can say it's true all day long we can argue about it but they think that if they think I'm wrong that that I'm wrong and therefore they have a right not to let me be heard they have a fundamental misunderstanding of the first amendment they don't understand what it means at all it doesn't mean that it doesn't mean you get this you get to shout me down or quiet me if what you hear me saying you don't think is true it doesn't matter what you think I have the right to be heard now that's on a platform I have a right to be heard if you have a news thing or you have an editorial policy whatever then you're an editorial of the entity you're no longer platform but if your platform then everybody should be able to voice their own opinion and you should not have anything to say about it all you're doing is allowing them eight platform I mean that's what that means our platform is a place where people can go and voice their opinions and so if your platform use leave all that alone that's what it was intended to be and as we said over the last few years what the social media folks have turned into its arbiters of truth exactly what Zuckerberg said that they want but that's exactly what they are but the truth is in their own hands and so they can see that's the thing and I will tell you this about anything I don't have any problem with somebody going on Twitter in saying the earth is flat I think it's a line and I can probably demonstrated but what's the harm of having somebody go on and say the earth is flat and have people debate them about it well there's no harm whatsoever but you put something up about this plan that make thing out there and say that something quite right in that the the other thing may have come from a lab in Wuhan and blah blah blah and they go out of their way they got to shut it down it makes you wonder what

Supreme Court declines to hear Facebook facial recognition case

"Court has declined to hear a facebook face recognition case Illinois one Yeah Annoy it's facing Patel face the hinges on the question of whether Facebook facebook violated Illinois Law when implemented a photo tagging feature that recognized users faces. I'm reading from the hill and suggested their names without getting adequate consent consent from the user. So this high court rejected a facebook bid to review the case so facebook will now be facing a multibillion dollar class action lawsuit in Illinois the other words the Supreme Court by declining to review it did let let it go forward so that's bad for facebook. I guess they'll either have to settle for right. There's the state I chase. It's an Attorney General Attorney General Right the Ninth Circuit Court ruled last year. FACEBOOK had to face the lawsuit facebook book appealed and the Supreme Court said No. We're not going to overturn that. But this is a state law yeah. I'm not sure I'm not seeing where. Why what reasons? The Supreme Court passed on this facebook said the class action case should not be allowed to proceed because the group of users have have not proven. The alleged privacy violation resulted in real world arm. There's a doctor in there has to be some harm or you can't sue the kids who just because you don't like it there has to be some harm The court the Supreme Court rejected that argument. But well no harm harm is gonNA it's like the the UK harms reported. It's GONNA become Feelings nothing more than feeling it is. A is a privacy intrusion. "Nineteen the year in review a little different twist from your perspective the things that made the biggest impact on you in the year two thousand nineteen and we're just a few days away from being in two thousand twenty up let's get your calls let's go to our Christian in west Palm Beach Christian you've been very patient how you doing Christian hello Rick I thank the project while fall I'd like to be your best call by making reference to about two or three in the previous call if I'm careful I needs in the sample hi like you say that concerning socialism in nineteen seventy seven I went to mark and visit my friend and once for land army and I took a trip to use for land and eight years shroom Michelle on the motion in the ocean or storage more empty mass muscle mass in the next subject concerning the ninth circuit court of appeals they were the most over check mail most of return on court why is there no checks and balances when women judges overturn repeatedly why isn't he this qualified as a judge because there's no there's no political will to do so okay next Sunday concerning the shootings in the schools we had one down here in Broward county I'm in west Palm Beach county if you wanna know how terrible the the liberal you know you've talked about the liberal cities and everything and how bad things are well the schools are we just as bad because of the liberal policies everyone needs to read a book called the wind Mando died by and group Pollock Y. middle died by and go power NATO was killed in Marjory Stoneman Douglas high school in Broward county and Andrew Polikarpov there and a couple of the others what a tremendous book exposing what yeah liberal policies in Broward county yeah just to create that situation now the reason I called next final subject I I called because I wanted to explain where the left right political paragon comes from everyone no one understands this but in Matthew twenty five thirty three Matthew twenty five thirty three Jesus put the sheep on the right and the goats on the left and I'm suggesting to you that the reason the last in this country is so violent and and intolerance and nasty is because they are they are though they are the Antichrist beast of revelation really and that's because Jesus separated the sheep from the goats well I what am I believe in god believe in Jesus Christ believe in the Holy Spirit no man no the hour no man no the date or time if nobody know the you know the beast as it were I think that it's it's much simpler than that I don't know that god has a lot of time to mess with that the first place I think any time liberalism is left unchecked gone unchecked not accounted for it always devours itself you know basically liberals don't want rules regulations parameters guidelines well human beings have to have those things or they simply the vols and that's what we've done I lance why we've got kids graduating reading at a sixth grade level but they don't know what the constitution as when asked if we ought to get rid of the bill of rights because and Anna quite all yeah let's do that they don't realize it's the for the first ten minutes I mean you can't miss what you didn't know you had any time the government gets involved with anything it automatically in less than a blink of an eye becomes extraordinarily expensive and extraordinarily less sufficient and that includes educating kids that's why I've been an avid get forever I don't care if you gotta get to jobs sell the boat do whatever you have to do get your kids out of public school improvement charter schools remain private schools Pullman parochial schools and while Rick you hate teachers didn't say that I'm talking about the curriculum if the teachers are drawing up the curriculum that's a different story but I can guarantee you they're not any time the governments involved it's a giant screw up and that's exactly what we're saying these liberal cities are being run by liberals they get the votes because they say what people want to hear I'm not going to hold you accountable there are no guidelines no parameters all loosen laws yeah he's for me except he runs the city the same way so it becomes rat infested drug infested gang infested it no longer is a viable place for people to live so they leave town and the only thing left or the shambles it's like a wide shot from the old movie escape from New York nobody wants to live there that's what liberal leadership or liberal lack there of leadership will give you inner will give it to you every single time all right sorry didn't mean to go off on a rant I am prone to do that from time to time it's the year in review two thousand nineteen a little different in the sense that it's from your perspective you know a lot of year in review is a you know a lot of recordings by people that and we've got some recordings some very good Westwood One news correspondents worked very hard on some of this but I'm more interested in your opinion what impact did you what what what hit home to you that you're still struggling with still trying to deal with you know we talked about North Korea lawn order the world we're gonna get to thanks for the memories here in just a little bit of the Ukraine in sports and brexit in Syria entertainment the year in review it makes a lot of sense to look back and say okay man let's not do that again learn or to look back and say Hey that worked maybe we ought to support that a little more alright here's the number.

"On the ninth circuit court of appeals. He may have already knew and said, okay, or I'm going north anyway. And we're just going to go ahead and round them up. It's five fifteen. Time for WCBS traffic it with I sounds like Chuck at the, the opening bell of the golden corral, which is very soon. As a matter of. Yes, it is. It's coming up, what forty five minutes or so. Yes breakfast time. All right. Doing what's. This morning. We had the rain again, of course overnight some of the roadways a little bit damp. We actually see some light showers in and around the area. So factor that in nothing major locally, but now to water main breaks in Baltimore County, the new at BelAir road at Taylor avenue on the northeast side. So that means we may have to move some traffic over to Harford road. They're still working at York road at Ashland road for the traffic in hunt valley, and that will still be a problem as well. Stand by one second. Much as it happens either through poems. Right, that you want to do that. Redirect carbon floor. Everybody's earphones out, you know, the state police just cleared an accident they was there about an hour ago. Southbound ninety five at cherry hill road, right before the capitol. Beltway at one point, we had two lanes blocked. They have just cleared that in the last ten minutes. So good to go there. There is an active fire call in the city on ever all avenue off BelAir road up on the northeast side. Chuck Whitaker with traffic and the first. We'll talk radio six eighty WCBS WCBS Weather Channel forecast. Yes, we told you yesterday be a stormy week showers. Some thunder storms possible.

"To a ninth circuit court ruling in two thousand sixteen thanks to that ruling if we arrest you we have to take your kids away from you because we can't hold your kids in jail with you now there's a question as to how long we can hold the kids in jail with us we have to immediately remove them or is just that we have to remove them within twenty days but bottom line is you will be separated from your kids if you are arrested the trump administration has changed policy in the sense that they are now treating everyone who crosses the border illegally as a criminal but that was always the loss they're basically just enforcing the law strictly now i am a fan of enforcing the law strictly the reason is not because i always think the laws a great idea it's because i don't like the idea of executive discretion and executive discretion is a way of making bad laws palatable and making good laws unpalatable if you actually want a law enforced the way that it is on the books we're gonna learn pretty fast whether that law is worthwhile or whether that law is not the obama administration's sort of picked in shows how exactly they wanted to enforce immigration law and it's important to note that these sorts of controversies over separation families at the border this sort of stuff going on two thousand fourteen two thousand fifteen when there was that vast influx illegal immigrants swamping the southern border this is from the new york times july twenty fifth two thousand fifteen so a guy named barack obama was president then a federal judge in california has ruled that the obama administration's detention of children and their mothers were crop causing the border illegally is a serious violation of a long standing court settlement and that the families should be released as quickly as possible so the obama administration was arresting mothers and they were keeping them with their children and the court found that that was a problem in decision late friday roundly rejecting the administration's arguments for holding the families judge dali m g of the federal district court for the central district of california found the two detention centers in texas that the administration opened last fall failed to meet minimum legal requirements of the nineteen ninetyseven settlement for facilities housing children judge also found that migrant children had been held in widespread deplorable conditions in border troll stations this is two thousand fifteen on obrock obama migrant children had been held in widespread deplorable conditions in border patrol stations after they were first caught she said the authorities had holy failed to provide the safe and sanitary conditions required for children even temporary cells and so the kids were in cells right we're hearing the same sort of stuff now but let's not pretend this is unique because it's not the opinion was significant legal blows tension policies ordered by homeland security secretary jay johnson.

"You are sas whether there is a constitutional problem but this case is not the end of the many people at and the other thing is that this case was limited to the ninth circuit court of appeals other circuits have similar rules but they're not all implicated here that the lower court may well decide on a constitutional basis that the same outcome is required and then the supreme court will have to decide whether they agree or not but this decision is not the end of the road on this issue so until this case goes back down to the appeals court to now begin to decide on the constitutionality of holding people without an opportunity for for a bond hearing about put this in context of policy and politics at the trump administration is trying to have vastly expanded to thirty to deport people the courts are separate from the white house in the executive of course but this is all going on at once it is all going on at once and the trump administration shen has of course sought to significantly expand the number of people who is seeking to deport it is proposed significant expansion in the use of detention rather than alternatives to detention forms of supervised release and so on and the combination of those two facts means that it's quite likely that deportation proceedings will take longer so were likely to see a growing number of people subjected to detention for longer periods of time really without regard to whether they need to be detained and think about thinking about this from the government's perspective it doesn't really make a whole lot of sense for the government to spend thousands and thousands of dollars to detain somebody who is not a flight risk or a danger to public safety it's quite striking that lots of people who are covered by the rodriguez case that the supreme court justice cited were given bond hearings an an independent.
