millions on social media and live TV a jury sided with Johnny Depp and his defamation lawsuit against his ex-wife Amber Heard awarding him $10 million in compensatory damages and 5 million in punitive damages and vindicating his allegations that heard lied about dep abusing her in a December 2018 op-ed piece The jury also awarded her $2 million finding she was defamed by one of Depp's lawyers who accused her of creating a detailed hoax for the police Joining me is nima Romani President and cofounder of West Coast trial lawyers How did you see the verdict Was there a clear winner Yeah Johnny Depp won and it wasn't close I would describe it as a complete and total victory especially after the humiliating defeat We suffered 22 the sun in the UK What about the fact that the jury awarded her Was it $2 million based on some statements that were made by his lawyer The jury did surprisely award Amber Heard $2 million on only one of our counter claims But as you mentioned it wasn't a statement made by death It was made by dep former divorce lawyer Adam waldman and then related to the 2016 incident where LAPD were called to their downtown Los Angeles apartment And specifically waldman said that it was a setup and it was a hoax that LAPD recalled and it turned out that Amber Heard didn't make that phone call I went from New York did and Amber Heard didn't cooperate with LAPD when they arrived So I think based on those two important facts the jurors found that Walmart did the same hurt Importantly because waldman was acting as death agent not ancient in the term of an acting agent but the legal term because there was a principle agent relationship that is responsible for waldman's defamatory statement as a matter of law And therefore that $2 million offset the $10.35 million that is otherwise owned the total judgment will be 8.35 million in Johnny Depp's favor What did it come down to what do you attribute this success in this trial as opposed to the UK trial Two factors likeability and credibility There's no question that Johnny Depp was the more likeable witness Both inside the courtroom and in the courtroom of public opinion the public support was overwhelmingly in favor I would say probably 90% or more but importantly credibility is the reason Amber Heard law She lied about facts that really had nothing to do with the abuse such as her donating $7 million in divorce proceedings to charity when she didn't do so The jury didn't buy that she pledged it not donated it And even when it came to TMZ and the video that she took on her phone that made its way to TMZ it was leaked Obviously by her or someone working in her direction Similarly when she filed for the TRO the temporary restraining order in 2016 and p.m. stop it had to have come from Amber Heard So when she lied about these facts the jurors were free to disregard her testimony entirely and they chose to do so Also she exaggerated the extent of her injury She told the jurors that she thought Johnny Depp was going to kill her That death hit her so many times that she lost count a picture of the videos even though they did support intrigue They didn't show an attempt in murder or felony assault For those reasons the jury decided with death and it chose to punish her What she says in her statement and what her lawyers have said is that Johnny Depp had advantages of wealth power and fame She said the mountain of evidence still was not enough to stand up to the disproportionate power influence and sway of my ex-husband Do they have a point in any of that There's no question that the public support was overwhelmingly in downy depth favor And some of it was because of last year's outside of her control but some of it was because of her own doing is self inflicted wounds or unforced errors that I like to call them.
