"So when I did have an agent, I was asked to be a player rep and voted by my peers for two years in a row. And I talked to my agent that was my counsel at the time, and I was like, hey man, so the guys voted me to be an NFL player Rhett what do you think? It was like, nah, I think you should focus on football. Just like everybody says in the world. So annoying. But yeah, you should just focus on football. Like, what else am I going to do? That is what I'm doing. How do you think I got here, Jack? I'm going to focus a football regardless if I spend 20 minutes doing something else in my life. So in any event, I was like, you know what? Probably right. Let me just focus on football, whatever, even that means. So next year, I get voted again. Hey, you should focus on football. Then I got kind of like curious. Like, you know what? All right, whatever. Next year, I got voted again. You should focus on football. I did it. Became a player rep. And I knew immediately why he didn't want me to become a player rap because he know the type of person I am, and I was privy to too much information. He did not want a privy to that information because now I know just as much as he knows for as far as contractual slotted money goes, obviously he's well educated way more educated than me when it comes to litigation, but when it comes to football sliding money, I know what you know now, buddy and matter of fact what I also know as a player that we pay 3.5% of a rookie minimal issues may have very rookie contract. Wager, we pay our NFL player NFL NFLPA association, 3.5% already. So why am I paying my NFL PH 3.5% of a rookie card, a minimum contract? And also paying my age of 3.3% of my personal contract. That's 6.5% pretty much out there for somebody to tell me, yes means yes and no means no. No, that's too much money going out, but I can go do this on my own. So it's very simple. Everybody literally. Anybody can do their own contract. However, part of the job is to part of a salesman's job, which is an Asian to a certain degree. It's to show why they are worthy. So of course they have to hype themselves up and be a little bit of your intelligence. That's part of their job. Literally. So that all of that, you know, when it comes to saving hundreds of thousands

"In the world of sports, I'm Michael Barr. And I'm scarlet fu. Big, I'm talking big because we got a lot of legal stuff that we've been talking about. We have some legal experts on the show today to help us get a better understanding of some of this week's headlines, including one involving the NFL and Cleveland Browns, quarterback deshaun Watson. Watson was issued a 6 game suspension by a neutral arbitrator for his misconduct allegations, but the NFL once a stricter punishment. They just filed an appeal which could lead to a battle with the NFL's players union, Cleveland Browns head coach Kevin Stefanski talked about Watson. And I would mention deshaun has said it that he is working to be the best version of himself. He's committed to that. He said that publicly, he said that privately, and I believe that. That was Cleveland brown's head coach Kevin stevin. To get a handle on this situation, let's bring in Marty itel, co chair of gulston and stores sports law practice and adjunct instructor of law at Columbia law school. Marty old friend, welcome back to the show. Michael, it's always a pleasure to be with you and Scarlett. This is a big time for sports lawyers in sports. We were just talking about the Liv golf tournament and that lawsuit. Now we've got this situation with deshaun Watson, the NFL, the person handing out the punishment, gave Desean Watson 6 games for violating the league conduct code, the league itself, I've never heard of this before, they want more. They're saying they want this to be about a year. And you really see that. But in the end, Marty, am I right? That is going to come down to what NFL commissioner Roger Goodell says. It is. You've hit the nail on the head. The NFL collective bargaining agreement, unlike that of any other professional sports league, gives the power to the commissioner to be the prosecutor as well as the judge. And I assume commissioner del will assume all those roles here. One comment, this is not the first time the NFL has challenged the ruling of its neutral or its arbitrator. If you go back to the ray rice case, ray rice was initially suspended, I think it was for two games and the NFL challenged it claiming it found new evidence, which were the tapes of what happened in the elevator between ray rice and his then fiance. And the commissioner imposed a harsher sentence, which was later vacated. So there is some precedent for the commissioner jumping back into the mix and trying to decide this, frankly, in light of the public outrage. Okay, so let's say Goodell moves ahead and hands down a penalty that is far tougher than the 6 game suspension. And quell some of the outreach out there, do we just assume automatically that the NFL Players Association is going to sue and this is going to go to court and this gets drawn out even longer? I think that's a fair assumption. The NFL Players Association represent the players. It agreed to the 6 game suspension and was not going to challenge it. But if the commissioner decides to impose a harsher sentence, then I think the Players Association, it's incumbent upon the player association as a representative of the players to make sure that the process doesn't tends to be fair. Rather than just a response to public opinion. So I think it will challenge in federal court. Any harsher sentence that is imposed by the commissioner. Silas read, he sent out its week, and it goes to where critics are saying about how these punishments are all over the board right now for deshaun Watson. We're looking at 6 games. Silas Reed, who was trying to get on to the Washington football team. It's been changed now in the name. But he got a whole year from the NFL for a suspension for smoking weed, but then he says, well, you just get 6 games for sexual misconduct, make it make sense. So I'm asking you, Marty, held this make it make sense. So the answer Michael is it does not make a lot of sense. Once you find a time, players could get thrown out of sports for betting on sports. You have the example of the black Sox, you have the example of Pete Rose. Players were not punished for other activities, which many, of course, no sense because there are far more heinous crimes than bedding. And then came the collective bargaining relationship and the players and the owner set forth what's in the best interest of the game and tried to put some guardrails around the types of activities that would result in a suspension. Take basketball. You run out if a player runs out onto the court from the bench. It's an automatic suspension. That's the worst thing in the world. Maybe not. But it gives a lot of discretion here in particular in the case of the NFL where all the powers have been seated to the commissioner by the Players Association. So as I said before, the commissioner is the prosecutor, the commissioner is the judge and the commissioner is the appellate judge as well. And it's important therefore that the commissioner adhere to at least fundamental due process rights in this case, they're just showing Watson because otherwise it will be all over the place and in the courts and in the media. So probably will be in the way. Right. I think it's safe to say. Roger Goodell is commissioner of the NFL. He represents the interests of the owners of the football teams, not the fans. What do the owners want him to do? What's in their best interest? Now, the owners want their players to be able to play. But they also have a public interest duty. You can't have somebody who's a sexual predator being able to play with getting just a slight slap on the wrist. And I think the owners would want to quell the public outrage by showing that there would be a harsh sentence. Of course, the owner could suspend Watson because he has a contract with the team as well. Separately away from Goodell's action and whatever the arbiter came up with. Correct. But that's unlikely to occur once the NFL has stepped in and said, I mean, we'll handle it. But that goes back to your initial point, Scarlett, the commissioner is representing the owners. But he's also representing what's in the best interests of the sport. Marty, we're probably burn your phone line. Thank you, Sarah for joining us. Thank you, Marty. Thank you. It's always a pleasure to be with you. Up next on the Bloomberg business of sports show, former NBA star and champion menace and deford our test. "Okay, three, two, one. Oh my goodness. Good morning, good afternoon. Whatever it is for you, I hope you're having a fantastic day. My name is Zach Schumer. This is strong opinion sports episode 400 and 94. We have to start with this today. This is, I can't record a podcast and not talk about this topic, so Cleveland brown's quarterback deshaun Watson has been suspended or it would appear he's been suspended for 6 games. Former federal judge Sue L Robinson reviewed everything and made that decision, she stated that he violated the NFL's personal conduct policy, she ruled that he deserved a 6 game suspension, but there wasn't enough evidence for an indefinite suspension. And so honestly, I'm still kind of just waiting to see what happens. There's like a three day period where the NFL can decide to go with the 6 game suspension or do something different, different from the recommendation they were given. So it's very early in this decision, but we're still kind of waiting to see what happens, but it looks like deshaun Watson has given a 6 game suspension. And I am surprised. It is fewer games than I expected. The NFLPA, Players Association, made an announcement yesterday, Sunday. Saying that whatever the federal judge will decide, they will support. Which, to me, it was like, oh man, it must be really bad. They must be getting out in front of it. It must be like a two year suspension or something crazy. I think actually they knew it was going to be kind of a slap on the wrist. And we're afraid of getting backlash. And so they're getting out in front saying we support it, whatever it is. Which, hey, their job is to their job is to support the players. I guess I don't know. What do you say about this one, right? Deshaun Watson getting a 6 game suspension. Feels like too little. I'm also not a lawyer.

You know, again, not that I'm defending the material anything else. I'm just saying that, you know, these were private emails that he obviously thought he was joking. So, you know, like, okay, you know, yeah, everyone has said inappropriate shed at some point. That's the other thing. Everyone thinks they're so above reproach. Right. And it's like, you know, everybody has got some shit back there that can be taken out of context, and now your life is ruined. And this is just the world we live in. It's like everyone's sitting on a ticking time bomb of their past. You know, I feel like the Internet, we just flush it and just start over. Do you think he's? I think he should have resigned and he did resign. So, you know, that's what should have happened. You know? Because he lost the faith of his players. There's no way those guys want to play for him anymore. You know? I mean, you're talking, yeah. For what do you say? He said, we shouldn't be a female. What are you talking to you say? Well, someone a pussy, which I guess is the end of the world. He called well he called the commissioner of the league Roger Goodell. An F bomb, the gay F bomb. Yeah. And then which is a word that, you know, we used to use all the time. By the way, it doesn't like you said it to a gay guy. Like this. But he was saying it and you know, saying that he was anti football and a pussy. And then Maurice, whatever the guy the head of the NFLPA, he made talking about his big lips, you know, saying that they were the size of Michelin tires. That's what he said. And yeah. And it's like, the problem you have there is, you know, I mean, you know, you got a 53 man roster, 51 of them are gonna take that very personally. So, you know, and then the other one is the game player, the one two of his wife. Players once the gay guy. So I mean, he's pretty much, you know, when you alienate your team, you can't leave them anymore. They're not gonna play hard for you. I think he knew that. I think, you know, the riding was on the wall in that regard. And so he did the right thing to resign. But I mean, you know, it's just. I mean, that's something everything we've ever done now comes under review, the second you get fame as it was like, well, these are jokes, maybe that I made to somebody personally. I didn't say them. You know, I didn't go out there and you know, so who knows? It's tough, man. It's time. I'm not justifying what he said. But this is the world we live in. And I don't think that's the thing. I don't think anybody who's accusing me of anything. If they come into the microscope the same way, would survive it either. No single person. Every single person has something back there that you probably forgot about it. You think you're so, you know, above reproach. Oh yeah, someone's got something. I've been sunny. Nobody gives a shit about you yet. The funniest is like when you're watching a baby. Which is my problem. Yes, you've tried real hard maccorkle. Real hard to get canceled. And they just, nobody gives them. No one cares. I do have a question for you guys and I'll be serious. Maybe you could explain it to me. "That in his community donations and that dude gives a lot of money to people and really he uses his money to help other people. And I think that's something it's totally lost when we talk about Jared Goff. And it's one thing that really deserves some about him is that he doesn't need to give away money. He doesn't need to give people food. He doesn't need to do all that. A lot of people don't. Most people that have as much money as Jared Goff have never do anything philanthropic. And Jared Goff does a very, very good job, helping other humans. And that, to me, really deserves recognition. It's one of the most positive. Again, say whatever you want about Jared Goff on the field off the field, the dude's outstanding. And I really, I find that inspiring. I would love to have an impact and help people that way financially. I'm still taking care of myself, but I someday if I get there, I would love to do something like Jared Goff desk because Jared Goff does such a good job. Helping other people. And that to me deserves praise and recognition. And he's getting it. He got the NFLPA community MVP, but I almost didn't talk about it on the show. I'm like, you know what? I should mention that because that's really, really cool with Jared Goff is doing over there in Detroit. Now from one from the lion's quarterback Jared Goff to the former Lions quarterback, Matthew Stafford, let's talk about that. On Thursday Night Football, the LA rams beat the Seattle Seahawks 26 to 17, it was not a great game. I do have a bunch of notes, though, note number one is this. Is Matthew Stafford hurt worse than we're being told or we're being led to believe? It's no secret Matthew Stafford, the rams quarterback heard his hand in August. He got a minor surgery to fix that problem. He actually hit his he hit his finger on a helmet, throwing the football, and it kind of I think it was a moment where head coach for the rams Sean mcvay went, oh no, that's such a weird thing to have happened that could totally derail our season. And I think actually, someone could fact check me on this. It's very, I don't know if this is what happened. I'll tell you what I would have done if I were to go to Sean mcvay. I would say everybody on the defensive line and offensive line, you got to wear those like padded things on top of your helmet because I would hate to have my season entirely ruined because my quarterback hit his head on a helmet or a hand on a helmet throwing the football. I think the rams might have even done that. Looking back, if my memory serves correct, Sean mcvay said, oh, that's a problem. We should make sure that can never happen again. Now, against Seattle on Thursday night, Matthew Stafford had to wear a wrap on his index finger. And I look, I've seen Matthew Stafford miss a bunch of throws throughout this year. Where he's been straight up inaccurate. You're like, he had to throw it on the goal line, was it, I think it was two weeks ago. I can't remember which rams. I've watched every rams game this year..

And now, you know, through my life showing that actually they do well together. Yeah, they can't. They can't be mutually they're no longer mutually exclusive. Exactly. Yeah. I mean, it's so funny. I got a text. I got a text today. From someone and it's the NFL, it says NFL NFLPA offers $1 million in grants for pain management research, including cannabis and CBD. So this is the world we live in today. Yeah..

"Listen, if you have a minute can you can kind of ease into it because the coach is going to know all right. We don't start for a couple of months. But when you get to camp, and if there's no mini camp, the urgency is far more pressing because the season starts in five weeks, so the willingness to let you ease into it and that loaf but go at 50, or 60 per spent 50, or 60% of its probably Tougher for a coach to take on that mindset with the season around the corner. Yes, I also don't like establishing a precedent where the first time the players flex the head coach flinches. That's a big part of I don't know if this was just you know these specific players. This was kind of this was coming down from the N F l P A. You know what the NFL play every team's abiding by this route? True? This is true, but the NFLPA is encouraging it. Right there, basically telling Ah, lot of these teams that don't show up, and they're trying to pressure the rookies from the story a couple weeks ago. That kind of pressure the rookies, you know to not show up to these off season workouts, and Patrick Sartain who we talked about yesterday, then I'm a working man. I got a lot to learn, can't afford not to be here, and I think it's So it's I think it's a league wide thing from the veterans. The veterans don't want to go to these off season workouts because it can it can on Lee hurt them right. They know they know everything already, At least in theory, they know a lot because they've played before. If the coaching staff hasn't changed over the scheme is gonna be somewhat similar. It's it's in their head like the only thing that could happen to them there in this on field work competitive on field work is that they get hurt. Then they get replaced. Whereas the young players they need they need it. All right. They need to be able to, you know, learn in real time with coaches on the field and see veterans do it so This is really a rock and a hard place situation for the league and its players because I understand both sides of it, and I and I could see both sides of it. I just don't know if there's an easy answer other than doing what the Colts and the Eagles have now decided to do. All right, we could leave it there. Um, coming up next year. Take listen. You know, I've seen a lot of baseball and the last 10 years takes been dialed into the sport like he Like you never has been since we started Working takes baseball document is as just exponentially just risen. I mean from somebody who admittedly didn't love the sport didn't watch it to somebody knows the sport. We've seen a lot of baseball. I mean, I've seen somebody hit a home run, and they get rung up because it was too much pine tar on the bat with George Brett back at 83. Of course that was later rescinded, blah, blah, blah, But we've seen wacky things players. In succession tagged at home plate because one ran through a stop sign, literally, Boom, boom, wacky fit A ball hit back to the pitcher he catches. It can't get the ball out of his myth. So we flings the MIT to the first baseman. Multiple times. I've seen that. I don't know if I've ever seen nor to win over. Never heard. Ah, manager berate one of his players for hit the home run. Yeah, we'll get into that Tony LaRussa. Some cracks in the White Sox armor. That story is next act is right now he is rich. See me? Yes. Sports flag at least all was OK today with the White Sox more on.

Pa damore smith and the president jc threader and Issued a letter to players encouraging them not the voluntary workout because of the ongoing pandemic. And the nfl pa's leadership has been operating under the whole that the nfl would be open to having another virtual season in fact shredder reportedly told players earlier this month. It is the recommendation of the nfl. We urge that all players consider their own health and safety make a personal decision about attending voluntary workouts and take into consideration the unanimous recommendation of the nfl. Hey things are opening up everybody's getting taxed but the fact of the matter is is that we still do have a pandemic and It's not just the players. It's the players families people come into contact with. I get it and listen. This isn't camp. it's not as you know. Did we have a result joke of football season with a virtual off-season. Now we didn't. We still had exciting games in the end. Tom brady is still one anyway. So what is. I have no problem with it. There's no fans at minicamps. Not as i get to go. Actually i don't must. I wanted to go to santa. Clara for the raiders moved so it doesn't affect me anyway. I just as i said you might have. People saying this is just the players once again. Just being selfish. Like if I hadn't said that one thing on my podcast like this guy wouldn't have had to uproot his whole life. No, I mean again, like I feel like It was the National Hockey League at this point that was standing in his way. Now, Whatever you think about the initial prank or John being demoted. This is the moment, Greg says. When the crowd mood totally shifted complete outrage, thistles trash like complete outrage. This is garbage. I'm not going to go about on a rant about democracy. Why don't you put pressure on your favorite reporter to stick up for John Scott? I can only imagine how John feels right now. War pissed off. Sorry for yourself. Then you feel you get sad. Do I even want to play hockey? What I want to do like I do. I just quit talking. Go work like you think about all these things, But now that you're in the minor leagues are you allowed to play for the All Star game? That's the thing No one knew. He says right after he was demoted to the minor leagues. People started to, you know, read through. The bylaws read through the books, trying to figure out like 10, a minor league player play in the professional NHL All Star game, and it turns out there was no rule that even remotely addressed the situation like it was totally unprecedented. And so the pressure stayed on the NHL knew That if John Scott wasn't in the All Star game, there's probably visions from the NHL of protest signs along the glass of bands out the outside the arena holding a rally because John Scott was snubbed and, according to Greg, Hockey fans are notorious for throwing jerseys onto the ice and protest causing scenes and eventually The National Hockey League had to acquiesce. They put out a statement. They made a statement saying, Hey, if John wants to go, you can go. But John says at this point I told everybody I'm not going like the NFLPA. I told all my friends. Teammates. I'm like I'm done like this is a bogus like I don't want to do this, he says between the fans making fun of them and the league demoting him. NFL unveils Oakley Mouth Shield to combat virus
"Here's a report on the new Oakley mouth shield. Some players are slow to change their equipment if it looks or feels different. Even if it's making them safer in theory.
NFLPA tells agents to inform players of virus risks
"The NFL Players Association has instructed their player agents to talkto all of their clients about the Ricks risk factors that could make them more susceptible to severe illness as the result of the Corona virus and Among the things they talk about Mike in this letter players who may suffer from chronic kidney disease or COPD, chronic obstructive pulmonary disease, right immune compromised state weakened immune system from solid organ transplant. Serious heart condition. Sickle cell disease type two diabetes. And then there's this one Mike, which is the first place I went when I saw this list. Ah, B m I r a body mass index. Of 30 or higher and let me be clear, according to the BM. If you have a body mass index of 30 hire your clinic are technically obese. Now. A lot of people would have some disputes with that, and I can understand why. But if you're talking about a B m E of 30 you have just described literally. Every single offensive lineman currently signed to a roster probably even go lesson that toe linebacker and or tight and I'll get to the heights and weights in a minute and understand when they had say all these things. It's not only the players, but remember, the NFL is not going to be in a bubble, so players are going to be going to practice. Flying two trips and then coming home to family. So again, you're going to be involved in, you know, are you single that may have have Ah say on if you're going to play You're married. You have young kids, You know that You're coming home to every day from practice or from runaway trip. So And what if some one of those kids you know if they have a weakened immune system, Do you want to take that chance? So this is not just the player himself, but also the family as well. But as Faras, the bm is now there are tons of charts author. I just kind of picked a chart that basically be, am I, you know Everybody understand. You know the height and your body weight your body Mass. So it gives you how how tall you are and the wait for your B and I, And there's a lot of discrepancy about there is soul. Listen, As I said, I picked up a chart. I'm sure people will tweeted ecological lingo, different charts. If you can't great because I'd like to see some different ones because some of them you look at our like, Wait a minute like the one I'm looking at right now. Says last I checked a six foot tall is 72 inches, Correct? Yes. Yeah, Okay. Just wanted to make sure that your question is good If you're six foot tall and you weigh £221 You are right at 30 bmo. You're right at the obese, which is ridiculous. If you're and then just keep going up because you start look at tight ends. Linebackers. Obviously, offensive lineman. They're usually that you know, anywhere from six to toe got 68 Let's go to like 65 Okay, six foot five. Or 64 76 inches, 64 If you weigh £246. That's beyond my 30. According to this chart, you are considered a
NFLPA's Smith: Workouts go against player safety
"Figure out what is the right way for players to get ready to play in the NFL. Without undue risk, and the undue risk this offseason is exposure to the thing that for a long time shutdown all sports in this country, the Corona virus in the cove in 19 pandemic, So we've seen quarterbacks quarterback specifically right. I'm sure it's happening everywhere. Let's have more places and yet, but we've seen two very visible situations. Tom Brady, trying to get with his new team, the Patriots, the Tampa Bay Buccaneers and get them going. Russell Wilson also working out with teams in Seattle, sort of in a very public way, trying to get the chemistry and get it going because we haven't had a TA is in many camps in all this off season, and we're a month away from starting training camps will divorce Smith, the head of the Players Association, the NFLPA, the executive director, said. Look, guys, don't do this. The the NFLPA doctor has come out, said Don't work out with each other. And tomorrow. Smith tried to reinforce that over the weekend by saying, Look, guys, what you're doing is in Congress with the message we're trying to send, which is stay healthy. Stay safe so we can get to training camp. And start the regular season. And then you have Tom Brady holding these very public workouts, and Russell Wilson, I'm sure more free for doing it. But those are the eyes and those of the people that we see well, and quite honestly, I see both sides of it. I I see what the more Smith again when you're ahead of the union. It's the majority that you're you're trying to protect You correct one of the reasons that the last Ciba past because it benefitted more of the majority. On this one. And that's what that's what the head of the union has to look out for. And remember the last debate. When players wanted a different type of OT, a system they wanted less two a days padded practices in two days, it was all about player safety. And now you're going into a season where there's going to be a whole lot of player safety and covert testing and such and dear saying, guys, if you want me to talk to the league and about player safety in the league is just going to look at me and say How much your players really care about safety. Look at all the quarterbacks out there with 89 other teammates, disregarding not helping the what you're supposed to be doing when covert around so I understand more society that and I understand the player's side of quite honestly, I understand player if I were still a player now I was in a position to D line where you're not getting together with everybody and having workouts. But if I was a quarterback or a receiver or in this case is at the centre goes there, too. And my quarterback was like, especially if it's a new quarterback, even if it's not. Hey, let's get together. Work like hell. Yeah, let's go. I mean, right in this, I would be doing the exact same thing. So a lot of them are Jeff
