"In the world of sports, I'm Michael Barr. And I'm scarlet fu. Big, I'm talking big because we got a lot of legal stuff that we've been talking about. We have some legal experts on the show today to help us get a better understanding of some of this week's headlines, including one involving the NFL and Cleveland Browns, quarterback deshaun Watson. Watson was issued a 6 game suspension by a neutral arbitrator for his misconduct allegations, but the NFL once a stricter punishment. They just filed an appeal which could lead to a battle with the NFL's players union, Cleveland Browns head coach Kevin Stefanski talked about Watson. And I would mention deshaun has said it that he is working to be the best version of himself. He's committed to that. He said that publicly, he said that privately, and I believe that. That was Cleveland brown's head coach Kevin stevin. To get a handle on this situation, let's bring in Marty itel, co chair of gulston and stores sports law practice and adjunct instructor of law at Columbia law school. Marty old friend, welcome back to the show. Michael, it's always a pleasure to be with you and Scarlett. This is a big time for sports lawyers in sports. We were just talking about the Liv golf tournament and that lawsuit. Now we've got this situation with deshaun Watson, the NFL, the person handing out the punishment, gave Desean Watson 6 games for violating the league conduct code, the league itself, I've never heard of this before, they want more. They're saying they want this to be about a year. And you really see that. But in the end, Marty, am I right? That is going to come down to what NFL commissioner Roger Goodell says. It is. You've hit the nail on the head. The NFL collective bargaining agreement, unlike that of any other professional sports league, gives the power to the commissioner to be the prosecutor as well as the judge. And I assume commissioner del will assume all those roles here. One comment, this is not the first time the NFL has challenged the ruling of its neutral or its arbitrator. If you go back to the ray rice case, ray rice was initially suspended, I think it was for two games and the NFL challenged it claiming it found new evidence, which were the tapes of what happened in the elevator between ray rice and his then fiance. And the commissioner imposed a harsher sentence, which was later vacated. So there is some precedent for the commissioner jumping back into the mix and trying to decide this, frankly, in light of the public outrage. Okay, so let's say Goodell moves ahead and hands down a penalty that is far tougher than the 6 game suspension. And quell some of the outreach out there, do we just assume automatically that the NFL Players Association is going to sue and this is going to go to court and this gets drawn out even longer? I think that's a fair assumption. The NFL Players Association represent the players. It agreed to the 6 game suspension and was not going to challenge it. But if the commissioner decides to impose a harsher sentence, then I think the Players Association, it's incumbent upon the player association as a representative of the players to make sure that the process doesn't tends to be fair. Rather than just a response to public opinion. So I think it will challenge in federal court. Any harsher sentence that is imposed by the commissioner. Silas read, he sent out its week, and it goes to where critics are saying about how these punishments are all over the board right now for deshaun Watson. We're looking at 6 games. Silas Reed, who was trying to get on to the Washington football team. It's been changed now in the name. But he got a whole year from the NFL for a suspension for smoking weed, but then he says, well, you just get 6 games for sexual misconduct, make it make sense. So I'm asking you, Marty, held this make it make sense. So the answer Michael is it does not make a lot of sense. Once you find a time, players could get thrown out of sports for betting on sports. You have the example of the black Sox, you have the example of Pete Rose. Players were not punished for other activities, which many, of course, no sense because there are far more heinous crimes than bedding. And then came the collective bargaining relationship and the players and the owner set forth what's in the best interest of the game and tried to put some guardrails around the types of activities that would result in a suspension. Take basketball. You run out if a player runs out onto the court from the bench. It's an automatic suspension. That's the worst thing in the world. Maybe not. But it gives a lot of discretion here in particular in the case of the NFL where all the powers have been seated to the commissioner by the Players Association. So as I said before, the commissioner is the prosecutor, the commissioner is the judge and the commissioner is the appellate judge as well. And it's important therefore that the commissioner adhere to at least fundamental due process rights in this case, they're just showing Watson because otherwise it will be all over the place and in the courts and in the media. So probably will be in the way. Right. I think it's safe to say. Roger Goodell is commissioner of the NFL. He represents the interests of the owners of the football teams, not the fans. What do the owners want him to do? What's in their best interest? Now, the owners want their players to be able to play. But they also have a public interest duty. You can't have somebody who's a sexual predator being able to play with getting just a slight slap on the wrist. And I think the owners would want to quell the public outrage by showing that there would be a harsh sentence. Of course, the owner could suspend Watson because he has a contract with the team as well. Separately away from Goodell's action and whatever the arbiter came up with. Correct. But that's unlikely to occur once the NFL has stepped in and said, I mean, we'll handle it. But that goes back to your initial point, Scarlett, the commissioner is representing the owners. This is, I can't record a podcast and not talk about this topic, so Cleveland brown's quarterback deshaun Watson has been suspended or it would appear he's been suspended for 6 games. Former federal judge Sue L Robinson reviewed everything and made that decision, she stated that he violated the NFL's personal conduct policy, she ruled that he deserved a 6 game suspension, but there wasn't enough evidence for an indefinite suspension. And so honestly, I'm still kind of just waiting to see what happens. There's like a three day period where the NFL can decide to go with the 6 game suspension or do something different, different from the recommendation they were given. So it's very early in this decision, but we're still kind of waiting to see what happens, but it looks like deshaun Watson has given a 6 game suspension. And I am surprised. It is fewer games than I expected. The NFLPA, Players Association, made an announcement yesterday, Sunday. Saying that whatever the federal judge will decide, they will support. Which, to me, it was like, oh man, it must be really bad. They must be getting out in front of it. It must be like a two year suspension or something crazy. I think actually they knew it was going to be kind of a slap on the wrist. And we're afraid of getting backlash. And so they're getting out in front saying we support it, whatever it is. Which, hey, their job is to their job is to support the players. I guess I don't know. What do you say about this one, right? Deshaun Watson getting a 6 game suspension. Feels like too little. I'm also not a lawyer.

And then Maurice, whatever the guy the head of the NFLPA, he made talking about his big lips, you know, saying that they were the size of Michelin tires. That's what he said. And yeah. And it's like, the problem you have there is, you know, I mean, you know, you got a 53 man roster, 51 of them are gonna take that very personally. So, you know, and then the other one is the game player, the one two of his wife. Players once the gay guy. So I mean, he's pretty much, you know, when you alienate your team, you can't leave them anymore. They're not gonna play hard for you. I think he knew that. I think, you know, the riding was on the wall in that regard. And so he did the right thing to resign. But I mean, you know, it's just. I mean, that's something everything we've ever done now comes under review, the second you get fame as it was like, well, these are jokes, maybe that I made to somebody personally. I didn't say them. You know, I didn't go out there and you know, so who knows? It's tough, man. It's time. I'm not justifying what he said. But this is the world we live in. And I don't think that's the thing. I don't think anybody who's accusing me of anything. If they come into the microscope the same way, would survive it either. No single person. Every single person has something back there that you probably forgot about it. You think you're so, you know, above reproach. Oh yeah, someone's got something. I've been sunny. Nobody gives a shit about you yet. The funniest is like when you're watching a baby. Which is my problem. Yes, you've tried real hard maccorkle. Real hard to get canceled. "That in his community donations and that dude gives a lot of money to people and really he uses his money to help other people. And I think that's something it's totally lost when we talk about Jared Goff. And it's one thing that really deserves some about him is that he doesn't need to give away money. He doesn't need to give people food. He doesn't need to do all that. A lot of people don't. Most people that have as much money as Jared Goff have never do anything philanthropic. And Jared Goff does a very, very good job, helping other humans. And that, to me, really deserves recognition. It's one of the most positive. Again, say whatever you want about Jared Goff on the field off the field, the dude's outstanding. And I really, I find that inspiring. I would love to have an impact and help people that way financially. I'm still taking care of myself, but I someday if I get there, I would love to do something like Jared Goff desk because Jared Goff does such a good job. Helping other people. And that to me deserves praise and recognition. And he's getting it. He got the NFLPA community MVP, but I almost didn't talk about it on the show. I'm like, you know what? I should mention that because that's really, really cool with Jared Goff is doing over there in Detroit. Now from one from the lion's quarterback Jared Goff to the former Lions quarterback, Matthew Stafford, let's talk about that. On Thursday Night Football, the LA rams beat the Seattle Seahawks 26 to 17, it was not a great game. I do have a bunch of notes, though, note number one is this. Is Matthew Stafford hurt worse than we're being told or we're being led to believe? It's no secret Matthew Stafford, the rams quarterback heard his hand in August. He got a minor surgery to fix that problem. He actually hit his he hit his finger on a helmet, throwing the football, and it kind of I think it was a moment where head coach for the rams Sean mcvay went, oh no, that's such a weird thing to have happened that could totally derail our season. And I think actually, someone could fact check me on this. It's very, I don't know if this is what happened. I'll tell you what I would have done if I were to go to Sean mcvay. I would say everybody on the defensive line and offensive line, you got to wear those like padded things on top of your helmet because I would hate to have my season entirely ruined because my quarterback hit his head on a helmet or a hand on a helmet throwing the football. I think the rams might have even done that. Looking back, if my memory serves correct, Sean mcvay said, oh, that's a problem. We should make sure that can never happen again. Now, against Seattle on Thursday night, Matthew Stafford had to wear a wrap on his index finger. And I look, I've seen Matthew Stafford miss a bunch of throws throughout this year. Where he's been straight up inaccurate. You're like, he had to throw it on the goal line, was it, I think it was two weeks ago. I can't remember which rams. I've watched every rams game this year..

"Figure out what is the right way for players to get ready to play in the NFL. Without undue risk, and the undue risk this offseason is exposure to the thing that for a long time shutdown all sports in this country, the Corona virus in the cove in 19 pandemic, So we've seen quarterbacks quarterback specifically right. I'm sure it's happening everywhere. Let's have more places and yet, but we've seen two very visible situations.
