Free and clear and I'm Liability for the insurance. I wanted to put it on her name. Well, I'd be liable for anything. Well, you're not gonna be able to do that. So she's 18. Correct, but because I have to sign the insurance, but, uh so you're going to be responsible. She's living in your home. You got to be responsible for her until she's 18. So even though the insurance will be on her name only well, she's she's not old enough to have it just in her name she's got she's not. She's hasn't reached 18 yet. So she because she can't sign a contract. According to the DMV. She can put the car on her name, as is 16 and the insurance company saying that I have to sign Have to sign to be liable for until she's 18. Basically, she can't sign a contract. You know she's not old enough to sign a contract. So she's not old enough to accept liability. And she lives at home, so you're going to be basically liable foretell. She's She's 18 so that the insurance company will put it on her name solely by what I would do until she was 18 is to have an umbrella policy. Okay. Uh, In T V, you can combine Can you know it's going to I'm not sure putting it just in her name is going to help you with any liability issues until she's 18. Right? Okay when she's 18 just Yeah. Trying to get some advice on that. You know, I'm getting different. You know, different signals from, you know, from the insurance company from the you know. Some say I won't be liable and some say yes. You're going to be liable. So, yeah, my My thought is you're gonna be liable till she's 18 and no insurance company is going to deal with a minor because she can't sign a contract. Well, she's 18. Correct, correct. Correct, So my name would be on it, regardless so Yep. Okay. I appreciate it. All right. Thanks for calling. Right. Let's go to Eleanor in Tampa. Okay? Good morning. Good morning. The money. Who paid for the inspector, the you the buyer or the seller. The buyer, sir, We did. Yeah. So you had an inspection before you closed. For them to determine. Any problems with the house and they missed. They missed some major things. Yeah, they would be liable. Thank you, sir. Thank you very much. Know what you didn't know? Was this a legit business who know Whose license they were recommended to us by, Um, five star you know, checking on them and by other people that have used center Mhm. We have pictures, and we have all of that that has been also sent to them. Um and we have paperwork on that as well. All right. Well, yeah, I would tell him I would show them. Have you called him? Yes, sir. And we sent pages. Yes, And if they respond, it Yes, sir. Their head. The head guy that owns the company came out and he looked through all the pictures, and he first said to me Well, you know we're not responsible to be looking for mold, I said I said, Look, this is not my first time buying a house, sir. I said I know that I said, But you know when you've got my stairs and you look to my left in my attic, you see nothing but shredded duck work, and you can see the more clearest day all over that. And the whole you can see right outside the window, right up up in the sky and the roof. Well, I need to go and look again and that's all he would say. Yeah. All right. Well, I would keep the pressure on for them to give you a written response for sure. Oh, definitely I have been doing. I've been checking with the moment every day. Okay. "One word there. There's no payment. The lock was before death. No payment before death. That's true. Okay, well, my my insurance company that I h Hello first purchased the life. Term a term policy dirty years ago, and I get a letter from them, saying that they're going to cancel my my insurance at nine age 92. Well, um, can they do how can they do that? Been paying it all these years? Well, it was a term policy and you'd have to read the fine print in the policy. They're probably in the original contract. It had a life where it was not going to be valid after a certain age. I looked at it and it's not in there, but I got a letter from them telling me that Well, you need to probably take the attorney and the policy. You need to take the letter and the policy to an attorney to look at it. To see, uh, to see what the deal is. You know the policy itself should have a state and it might not have a date, but it might have it. It's only good for 30 years. I mean, there might be a time limit on how long the policy is, in effect. And usually an office here in Sun City Center. Yes, ma'am. I've tried to find it the other day, and I couldn't find it. While I'm right on 6 74 the main route through Sun City Centre, um, in the pant Wealth center building. There's the lake Michigan variant of the lake. The lake Michigan Credit Union depend financial. I'm in that building my p a. Y? Yeah. I have my own office in that building. Yes, ma'am, but you can call the phone number for their Let me I like to give up my 800 number when I'm giving the number on the radio, because, uh, people are listening in different area codes says, Uh, I know. Is there somebody there during the week any day? Let me give you the number. So it's 800. You have to make an appointment to see I'm they're usually on Wednesdays, 800. The same number is here. No, ma'am, This is the radio station 800. Okay. Got it. 2 to 6. 22635 to 9. 35 to 9. Yes, ma'am. Okay, I know where it is. And I'll make that call. Do they come down here Any time during the week? I'm usually the in that office on Wednesdays. Yes. All right. All right. Thank making a pump for Wednesday. All right, Thank you. All right, let's go to read and Largo. Good morning. Good morning. Joe. I got a little situation here. It's not in the realm of what you describe this morning, but, uh, I'm sure you have the expertise to know. The answer to it. I have a neighbor. Behind me that has trees that hang over my pool area. And it's starting to all the leaves and all that father. I've had grass in that area for over a year now because of his trees. At one time. It was a situation where I had called him. He seemed to be a decent guy, and he came over and took care of it himself in the You know, trim the bush and whatever they were over there that were hanging over towards my pool. It's happened again. These are large trees now. And I didn't do anything about it until a few weeks ago, and then finally I called him and And said, Hey, by the way, just take a peek over the fence. It's my fence. And you'll see what's going on there. So he did, and I spoke with him later to win the day and he said, Yeah, really, should I see that's happening and I'll take care of it. I said great. So then he left his out of town now. And so he said, Well, can't do anything until you're back, which will be after Labor Day property but anyway to make a long story short, um he called and talked to him this week, he saying Well, You know you have the right to do that, because it's hanging over your property and you have the right just to go straight up from your property and cut yourself. I said, I understand that. But I said you committed to pay for it. Which I thought was great. You've been a good neighbor. You've did it before, and I appreciate you doing again. Well now, he said, No, no, I'm not going to do that. I guess he talked to his wife or something. Anyway, Things changed. And it was entirely different conversation that we had prior to. So now he's saying No, no, I'm not going to do that. Deputy bop I'm going to have to pay for it, Joe, and you know, trimming trees no cheap job these days. Unfortunately, we hurricane it ran through here. What storm that we had. The tropical last week did not fell a lot of trees. So, therefore they are these guys that are available. I have a gentleman who will do it. But the idea is this. It appears to me that inasmuch as it's a tree And I cut the branches back, which is going to cross me a couple of $1000 to get this thing done, but I have to do it because it's ruining my property in between that time. If those trees continue to grow every year or two years, I'm going to have to have that same expense. Am I allowable to do that all the time, or do I have recourse against him? No, I think he He was probably pretty correct. Some he probably went to an attorney gave him advice. You have the right to treat to trim the tree up your property line. Yes, sir. And you you have. You can do that without any liability of changing the shape of the tree or anything like that. As long as you don't kill the tree, you're fine. But you can't make him trim that tree over your problem. So therefore it could be a perpetual down the road for eating the whenever how quickly it grows again. I'm going to have to go through the same expense. Is that what you're stuck with me? Yes, sir. Obviously. Okay. I thought it was a way that I could have some kind of Extend a liability on his part for being able to trim those trees himself and protect my property. But from what you're telling me, it's up to me. Yeah, You can ask him if you have permission to trim certain limbs right at the, uh, right at the base part of the tree. So you know the the limbs won't Keep growing out on these are pretty tall Joe. They're probably 30 FT. High. So what kind of trees are they? You know, I don't know whether they're oak trees or not. They possibly are oak trees that City of Largo likes oak trees for some reason, which are destructive trees, but Is probably I don't know There's four or five of them against the fence right up there playing the right against the fence. So naturally, when this side those branches are going to be on my side. But my problem is, you know, perpetual lead down the road. Am I going to have to do this every two years and spend a couple $1000 get these trees trip? Well, you can. He doesn't. He doesn't have to. And you have the right to trim up your tree line. Just like like he said. I understand. Okay. I understand. All right. Thank you so much. And I appreciate your service. This is a great community service for what you're doing..

If I can help you in any way in our remaining moments, I would be glad to. Hey, I had a speaking engagement this past Wednesday, an Indian Rocks Baptist Church and only mentioned that it was an overflow crowd. Actually. At a great time. I love doing speaking engagements at different places. It could be a Qantas of rotary AARP, a seniors group Coffee club meeting is your H O a meeting. It could be whatever I love going out. There's no charge for that. You need a speaker for your group. Just call our toll free office number 1 800. 22635 to 9. That's 1 802 2635 to 9. I do have some handouts and things like that. I give out. I don't solicit at these meetings. Of course, somebody's going to probably asked me my phone number and how to make an appointment. That's okay. I would answer the question, but I'm not there to solicit. So if you need a speaker for your group, something that I really like to do you have a toll free office number to call to set that up. 1 802 26. 35 to 9. Let's go to Jim in ST Petersburg. Okay, sir. Thanks for taking my call. Great Show I had looked as often as possible. Um, question I have is jumping back to what the gentleman had earlier concerning having a loved one in the nursing home and them owning a home that is home started. Um I don't know if the laws have changed. But I know that the family had to contact elder attorney because I get these two confused Medicaid or Medicare. But since the person was getting, I'd say at least well over $70,000 a year from the government. To be in the nursing home. I mean, having that expense paid for them. You mean I'm sorry sitting and they were getting the benefit of having their many their nursing home expense paid or they were receiving. Receiving 70,000 somehow otherwise is a pension or they were having the Portion of and the major portion of the nursing home expense, which was quite expensive was coming from like I said, I can Medicaid or Medicare. Medicaid, which would be the Medicaid with Medicare, taxpayers money paying for her to be in the home, and so they had to reach out to elder attorney and I guess So, in other words, you you do have your home, possibly in jeopardy when you're in that situation, so you don't actually in Florida. Your homestead is a non countable asset in Florida. And it will descend to your blood heirs free from the claims of creditors, even on large medical bill or nursing home nursing home Bill. Okay, so it has to be blood heirs. That's one of this can't be a friend or charity. I see. But it can go to they can go to your Children, for example. Okay, free from the claims of creditors because his homestead No, it's not. A government thing is the Florida rule that home status of protected asset Okay back in December in other states, possibly or, uh, if year old hundreds of thousands of dollars that the taxpayers paid for not all other places where Not all states have homestead protection laws like Florida, Florida Great station in that regards. I see Okay? All right. Well, that clarifies it because I know that a lot of money was spent two elder attorneys to be able to get this deal and I guess they did it before. 2012 or 2013. And supposedly, the law was changing back then. Not in Florida. Homesteads protected s and has been ever since I've been practicing for you know, 40 years, the homes has always been a protected asset. Okay. All right. Well, thank you for the clarification. All right? No problem. Thank you for calling. There are some other things that people do in Medicaid, like a personal service contract. There's um A variety of things. Medicaid attorney We have one on staff John Fraser, who was on the six o'clock show this morning, actually given Medicaid tips of the week ways to protect assets and move them around and make them protected and maximize your government benefit. I mean, you you pay into the many care social Security system. Your whole working career. And that is just another benefit. And you you have to apply for the benefit based on what you have in your state. And things can be moved around inside of your state. So you know they you could have excessive income. You can create a qualified income trust. All of these things are allowed under Florida statutes. All of these things are present it to The application for Medicaid benefits. Um And they're all under Florida statutes, the what you can and can't do so. You're listening to ask an attorney all about Florida law we have about seven minutes or so left in the show. If you have a legal question. Phone lines are open had 800 969 9352 that's 800. 969 9352. If you have a legal question, love to help you and their remaining moments How does Medicaid uh so you go in a nursing home for 567 years? You have a homestead? That's uh, say your family is carrying on the expenses. The real estate tax and everything. When you die. They don't. They can't put a lien on the homestead to pay them a nursing home or medical bills. So the home would then be passed to your heirs, so there's going to be passed from a will or from a trust. It's passed from a will. It goes through probate. So you do a petition to determine Homestead. As part of the probate petition, and then it passes on free from the claims of creditors because his homestead If it's a living trust, and it can just pass pretty much automatically from the trust by the successor trustee, the person you chose to handle your state to the heirs. Without having to be concerned about the medical bill again because it's homestead. There's just special ways you do all all of these all of these things. Again. The phone lines are open. You have a toll free number. 809 699352. Let's go to Ray calling. From Tampa Bay Ray Good morning. Morning. Good morning. Yes, I have a question. Uh, Had hunt and I was I was taking care of. It's been six years ago. She is she demise. And He had things happen to her when she was in a nursing home, So we got attorney that was out of county. Down south and they sell the case last year, but the attorney won't send me in that kind of atomized. Paperwork stating what they suffer for some of the case for Well, are you Were you the one that hired the attorney? Yes, sir. Send him a certified letter demanding it. Sort of I love. Yeah, I just received one from them this week. What did that say That In reference to the property that she had We use talking with the gentleman while ago about the homestead property. And, uh, he made me get appropriate attorney which there was no reason for that, because no one Contestant. The will, and last testament that testimony Well, who is the settlement check going to be made payable to To myself. You sure it's not the estate?.

"When I read this is from an upcoming book. But before we get to that, an email coming in tips at the news junkie dot com and we were talking the other day about petting ups like people were getting PETN umps, just like they would get a prenuptial agreement. They would get one for their animals. And, of course, a pet nuptial agreement. Yes, and this person said about shared custody of a dog. Jimmy D said Hi, Sean. My wife and I divorced in 1999. And shared custody of our black lab, Brianna. A few years later, we had to put her down due to cancer, and the event was so devastating to us that we actually ended up bonding over the loss and started spending more time together. Next year will be 30 years and many four legged kids later since we are married and happily living in Knoxville, Tennessee, although we never actually married again, fool me once, he says. I love the show You all have a great and safe weekend. Jimmy D. Thank you. You too, sir. And ma'am, There's a lot of stuff that happens like that with people in their pets and the bonding over it, And it's interesting that it got you two back together. Sometimes it gets people to just get into an argument about things. I mean, I heard a story one time about a couple that broke up and the woman ended up getting custody of the dog. And the the husband was, like, really, really fighting for the custody of the dog. And then the woman put the dog to sleep. And you're like, Oh, my God. Yeah, cold hearted human beings, man. It's like, cut it in have and then you guys split it right down the middle. How could you do this to each other? It's awful. I In a weird sense. I feel like we won't see this in the future because cloning of animals will be a lot more common. Still not the same. You don't get the same animal. Ask Barbara. I swear to God I would clone lady I would call my dog lady. If something happened, where God forbid, Knock, knock on wood. Nothing's going to happen to her. But if something did happen to her, I got I got another one. It just it will be similar. Although when we had her, you know, Sister dog Amy over here for a week. It was like a close is pretty close. But you can just tell the difference. There's personality differences. You say you can tell the difference, but you confused him a couple times. Yeah, I did. But, you know, eventually, when you didn't know which one you're stepping on, Lady I like a lot more because most cavalier King Charles spaniel of the Spaniards don't have like the Got like a sad face on her, which always gets me, man. When I walk by Mike is everything okay? And I always noticed that and appreciate it. She gets a lot of comments on her photos. Would Courtney Post the photos of our online? I mean, ladies, nowhere near Alpha each other. He's getting up there. Well, this is the story I was telling you about. This is a bombshell, and nobody's talking about it. Dr. Anthony Fauci. So here's what they said. Last summer, National Institute of Allergy and Infectious Diseases chief Anthony Fauci triggered was reportedly sent a mail a piece of mail containing white powder. Right, so normally, here's what happens. So these he's elected officials, people in the White House people as prominent as Dr Fauci. Normally they actually get somebody to sort their mail so that in case someone tried to send them ricin or an explosive through the mail, and if you don't think that's possible, Look up York and check out the fan that was going to send her an explosive, then blew himself up on video. Don't watch that video, though. It'll haunt you a little bit. But this happens and a lot of people. Even celebrities will have somebody else that opens up their mail. But I guess Fauci was opening up his own male and one of the pieces of mail had white powder, and it literally blew up in his face. Oh, my God! And no one knew about this. Nobody knew about this Until now. This is according to.

"Hey, Ryan. Hey. All right. You know, I've had My last five callers. Last four cars have been Rick, Rita. Robert and Ryan all starts with ours about that. Hmm. And from Riverview, there's another one. What can I do for you? Um, so I was driving my Kia Optima picked it up from mechanic. Um, something some kind of, uh, sensor was out. Of striving home on Monday, and, uh, on the Howard Franklin actually, and the car caught fire and completely burned to the ground. Ironically enough, I had just put the bare bones insurance on it. So my insurance company is not interested in in, uh, covering it all. The mechanics, insurance companies, you know, they said, if they could prove it somehow the mechanics that fault that you know they would cover it, but they're not really interested in proven that really. Right now. It's sitting at a And, uh, you know, tow company racking up fees. And here, you know, they didn't want to move it or do anything with it either, But they have a class action lawsuit. I guess. Kids, cats of the catching fire. Recently. So they want me to be part of this class action lawsuit, But it doesn't mention anything about, uh You know all the damages. They just said they would cover the cars. I'm not really sure what what I should be doing. Oh, and and the bridge. The Howard Franklin was a damaged in the process. I'm not sure if they're going to come after me for that, as well. So what year is your car? 2013 And you bought it new or bought it used bought it used I say okay? So all of the warrant TSR expired on the car. Right? So, um, the class action suit where you contacted by a law firm that does class action lawsuits. No, uh, actually followed a clean with Kia and they They sent me a link to the class action suit. Oh, I see..

"Good in the state of Florida. In this particular client had a will in a trust. So the answer is wealth was done by an attorney, You know, especially the state plane, an attorney in your previous state. Your document. Most likely would be accepted in Florida, however. Can't just answer a question like that, without reviewing the document. On. We don't charge anything for reviews of documents, but most likely Herb Your own talking. It would be fine. So stop pointing out some of the common problem sometimes with out of state documents that very first sentence of the will, for example, says you're arrested then of the other state. Also decoration that you make in the document itself. "Didn't actually work out? Not really. But SNL the whole rape. Fantastic. Yeah. Dana Carvey. Good impersonation, the current impersonation. Of President Trump I could do without with Alec Baldwin. But anyway, let's move on to the real miss of the past. Move on there. Is that the real nous of this with taxes and the fact that we do have a new administration in power? So What should we be looking out for tax wise? Because just like we heard every president has a different approach. Christian higher taxes. I mean, we know it. Our clients know it. Our listeners know it. It's higher taxes. I mean, it's this this idea, telegraphing your punches. I mean, they've told us what's going to happen. Repealing all of the corporate Not all I don't know. We'll see. But you know the trump corporate tax cuts, which were huge when it came to certainly what's been going on with markets. It's a very, very two very different administrations. So President Trump was very, very pro business. Pro economy. You know, the idea was let's grow the economy. Let's have corporations hire individuals. Let's have been paying higher salaries. Seven. Given health care. Let's do this. Let's do that. Let's have people sort of worked their way into benefits and encourage corporations to do that, and now we're making a transition or a shift, too. Well, let's raise corporate taxes. Let's make it harder for them to potentially higher people or keep them employed and let's get more people on some sort of government assistance. I mean, it's no matter what side of the aisle you're on. You're either for that, or against it, but Christian again, we do the math. It is what it is. And every time I talk to or sit down with anybody, whether it's an existing client or somebody was coming in, it always boils down to the same thing, which is, Let's take a look at your current situation. Let's take a look at the current situation when it comes to certainly government taxes in the stock market, and let's forecast was likely to happen. Moving forward. It starts with the analysis of your current investments and where they're likely to do moves on to Financial plan. All these things are extremely important person. What we know is it's it changes. I mean, we're dealing with a huge shift and change right now. People are very, very concerned with how it's gonna affect them. Personally, and I mean, I get it next two years or probably pretty tough. We're looking at the next election cycle when it comes to the House and Senate, But our primary client isn't 90 years old. Right. That's not our average client age. Somebody was only looking at the next say five years. Our clients her, you know, in their mid to late fifties, maybe early sixties. We're looking at 30 plus years of retirement. They've got a fund their life in retirement. Yeah, over that period of time, so as concerned as we are, and we are concerned about what's going on with changes in government changed is an administration changes in taxes changes in policy. We're concerned about all of that. But you know, we gotta focus on short term next couple of years. Long term next 10 2030 years and all this is gonna be really, really important. So you know anybody who says Hey, listen, I'm going to go ahead and put together a financial plan for you today. That's gonna work for your entire life. I mean that, Kristen. That's just It's not accurate, right? Right. You know that sounds too good to be true. So we are telling people that What we're doing is we're focusing on the now and we're focusing on the change and we're telling individuals that Hey, listen, we're fiduciaries or fee based advisers. We do well when you do well, we're going to focus on what's going on right now. And we're gonna help you get a sufficient as you can in your current portfolio and your financial plan, But we're going to continue to update that plan and work with you moving forward. Because when you do well, we do well and that's what if produce your relationship looks like so I know it's stressful right now. I know the next 100 days in this new administration. Is potentially I don't know, kind of blow some people's minds right eye, but Let's sit down come up with a plan. And then let's stay focused on active management of that plan, and all I could say is, if you want that kind of a relationship, and you don't have it right now, you're welcome to come in. Get a second opinion from us. See if you like what we're doing, but at least have a plan. I mean, that's all there is to it, understand what's likely They have been moving forward.
